(परिवहन पक्ष) अधिसूचना मई ,वल्ली, 12 नवम्बर, 1982
फा०आ० 800 ( अ):-केन्द्रीय सरकार , मोटर यात अधिनियम , 1939 (1939 का 4) की धारा 1097 की उपधारा ( 1 ) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए , पोषण निधि के प्रशासत्र और उसमें से प्रतिकार के संवाय के प्रयोजन के लिए निम्नलिखित स्कीम बनाती है:--
1 -- संक्षिप्त नाम और प्रारंभ ( 1 ) इस स्कीम का संक्षिप्त नाम तोषण
निधिस्कीम, 1983 है ।
( 2 ) यह 1 अक्तूबर , 1982 से प्रवृत्त हुई समधी जाएगी ।
2--परिभाषाएं इन नियमों में, जब सस कि संदर्भ से अन्यथा अपेक्षित हो,
(क ) "अधिनियम " से मोटर यात अधिनियम , 1939 ( 19394) अभिप्रेत है।
(ख) "प्रांधिकरण " से खण्ड 3 के अधीन गठित तोषण निधि प्रा.अहरण अभिप्रेत है ।
(ग) "वावा जांच अधिकारी" से किसी राज्य के प्रत्येक राजस्त्र जिले में उपखंड प्रधिकारी , तहसीलदार, या किसी राजस्व उपखंड या किसी तालुका काः भारसाधक कोई अन्य अधिकारी अभिप्रेत है ।
(ब) "दावा निपटान आयुक्त" से किसी रज्म में राजस्व जिले कা। जिला मजिस्ट्रेट, उप प्रायुक्त, कलक्टर या कोई अन्य भारसाधत अधिकारी अभिप्रेत है ।
(ङ) "सांड " से इस स्कीम का खंड अभिप्रेत है ।
(च) "प्ररूप" से इस स्क्रीम से उपबद्ध प्ररूप अभिप्रेत है ।
(छ) "परिवहन आयुक्त" से परिवहन आयुक्म के कर में नियुश कोई अधिकारी अभिप्रेत है भौर उसके अन्तर्गत राज्य सरकार द्वारा नियुक्त परिवहन महानिदेशक , परिवहन निदेशत या परिवहन नियंत्रक होंगे । "
(ज) उम शब्दों और पदों के, जिनका इम स्क्रीन में प्रयोग किया गया है किन्तु जिन्हें परिभाषित नहीं किया गया है, किन्तु जिन्हें अधिनियम य। उसके अधीन बनाए गए नियमों में परिभाषित किया गया है, बही अर्थ होंगे जो उनके क्रमशः उस अधिनियम और नियमों में है ।
3---तोषण निधि प्राधिकरण ( 1) तोषग निधि प्राधिकरण नामक एक प्राधिकरण होगा जो निम्ताले खत सदस्यों से मिलकार गडित होगा, ग्रंथीत---
(का) संयुक्त सचिव ( परिवहन)
मौवहन और परिवहन मंत्रालय
(ख) बोमा नियंत्रक, वित्त मंत्रालय ( ग्रीमा पक्ष) । सदस्य
---सवश्य (ग) भारतीय साधारण बीमा नियम का एक नाम निवेशिती, जो सहायक प्रधान प्रबंधक की पंक्ति से भीचे का नहीं होगा और केन्द्रीय मध्क्षार द्वारा नार्मानविष्ट किया जाएगा

(घ) तत्समय भारत में साधारण बीमा कारबार करने बाली कंपनियों में से दो नाम निर्देणिती , जो सहायक प्रधान प्रबंधक की पंक्ति से नीचे का नहीं होगा और जो केन्द्रीय सरकार द्वारा नाम निर्दिष्ट किए जाएंगा । सदस्य
सवस्य ( ङ) वो राज्यों के दो परिवहन आयुक्त जो कैम्द्रीय सरकार द्वारा नामनिदिष्ट किए जाएंगे ।।
(च) निवेशक ( वित्त खंड) मौ-परिवहन और परिवहून
मंत्रालय ।
संवस्य सचिव (छ ) प्रायुक्त, सोषण मिधि ।
( 2 ) प्राधिकरण कः मुख्यालय नई दिल्ली में होगः ।
( 3) किसी पव के श्राधार पर सवस्य के रूप में नियुक्त व्यक्ति तंव सवस्य नहीं रहेगा जब वह उस पद पर नहीं रह जाता है ।
( 4) उपसांड ( 1 ) ( घ) और ( ॐ ) के अधीन नामनिर्दिष्ट सदस्यों का
पदावधि एक वर्ष होगी ।
( 5) मायुक्त, तोषण निधि , केन्द्रीय सरकार द्वारा नियुक्त किया जाएगा और प्राधिकरण के सदस्य सचिव के रूप में कार्य करेगा ।
4--सवस्यों और मक्षिक, रियों का पारिश्रमिक ( 1) सदस्यों को प्राधि- करण द्वारा समय -समय पर भवधारित की जाने वाली वरों पर यात्रा और दैनिक भत्ते के सिवाय कोई पारिश्रमिक संवरत नहीं किया जाएगा ।
(2) शासकीय सदस्य यात्रा और वैनिक मले ऐसी वरों पर लेगे जो उन्हें उस स्रोत से अनुर्शय हों जहां से वे अपने वेतन लेते हैं ।
5-प्राधिकरण की शक्तियी और कृत्य प्राधिकरण निम्नलिखित कृत्यों का पालन करेगा, अर्थात:--
(क) शोषण निधि की मावश्यकताभों का समय-समय पर निर्धारण और केन्द्रीय सरकार को समय पर निधियों के लिए निवेदन प्रस्तुत करना;
(ख) परिवहन भायुक्तों के व्ययताधीन रश्श्री जाने वाली रकमों का समय-समय पर भाबंटम :
( ग) वार्षिक बजट तैयार करना;
( घ) सोषण निधि के ऐसे धन का , जिसकी सुरन्त श्रावश्यकता नहीं है, न्यास घन के विनिधान के लिए विधि द्वारा प्राधिकृत विनिधाम की रीतियों में से एक या अधिक में , जो प्राधिकरण उचित समझे, बिनिधान ।
(ङ) सोषण निधि के प्रशासन और उसमें से प्रतिकर के संदाय सम्बन्धी सभी मन्यविषय ।
6-- शक्तियों का प्रत्यायोजन ( 1 ) प्राधिकरण अपनी सभी शक्तियो भौर फत्तेभ्य या उनमें से कोई कामकाज के तत्परता से और प्रभित्र निपटारे के लिए अध्यक्ष को प्रत्यायोजित कर सकेगा ।
( 2) प्राधिकरण अपने कामकाज के संचालन के लिए समय - समय पर ऐसी उपविधियां विरचित भौर परिवर्तित कर सकेगा जो वह ठीक समझे ।
7--प्राधिकरण के अधिवेशन प्राधिकरण एसे समयों और ऐसे स्थानों पर अधिवेशन करेगा जो अध्यक्ष समय-समय पर इस निमित्त नियुक्त करे: -- परन्तु प्राधिकरण छह मास में कम से कम एक बार अधिवेशन करेगा ।
8-- गणपूर्ति गणपूर्ति कम से कम तीन सदस्यों से होगी.
परन्तु यदि किसी अधिवेशन में गणपूर्ति नहीं होती है तो अध्यक्ष अधि- बेशन कोऐसी तारीख तक के लिए, जो सात दिन से पूर्व की न हो, स्थगित फरते हुए उपस्थित सदस्यों को यह जानकारी वेगा और अन्य सदस्यों को यह सूचना भेजेगा कि वह स्थगित अधिवेशन में, बाहे उसमें गणपूति हो या नहो, कामकाज का निपटारा करता बाहुता है और तब वह ऐसे स्थगित अधिवेशन में कामकाज का निपटारा कर सकेगा ।

9-बहुमत द्वारा विनिश्चय प्रत्येक विषय उपस्थित तथा मनदान करने वाले मवस्यों के वहमत द्वारा अश्धारित किया आएगा । मतों की संख्या बराबर होने की दशा में अध्यक्ष का मत निर्णायक मत होगा ।
30 - अधिवेशनों की सूचना ( 1 ) प्रत्येक लवस्थ को ऐने प्रत्येक अधिवेशन के लिए नियत समय और स्थान की, ऐमे अधिवेशन के कम से कम मात विन पूर्व, सूचना दी जाएगी और प्रत्येक सरस्य को अधिवेशन में निपटाए आने वाले कामकाज की एक सूची दी जाएगीः
परन्तु जन अध्यक्ष द्वारा कोई अति-प्रावश्यक प्रधित्रेगन बुलाया जाপ্রা है तब ऐसो सूचना प्रविश्यक नही होगी ।
( 2 ) किसी ऐसे कामकाज पर, जो कामकाज सूची में नहीं है अध्यक्ष की अनुशा के बिना विचार नहीं किया जाएगा ।
11-प्रधिवेशन क कार्यवृत-प्राधिकरण के प्रत्येक अधिवेशन की कार्य बाहिया सभी सदस्यों को पारिवालित की जाऐगी और उसके पश्चात कार्यवृत्त पुस्तक में अभिलिखित की जाएंगी जो स्थायी अभिलेख के रूप में रखी जाएगी । प्रत्येक अधिवेशन की कार्यवाहियों के अधिलेख पर अध्क्ष द्वारा हस्ताक्षर किए जाएगे ।
12. आयुक्त, तोषण निधि, की नियुक्ति और उनके कर्तव्य -मायुक्त, तोषण निधि, अध्यक्ष और प्राधिकरण के साधारण नियंत्रण के अधीन प्राधि करण की सभी मा र्यपालिका शक्तियो का प्रयोग करेगा और अध्यक्ष को उसके कृत्यों के निर्वहन में सहायता करेगा । वह निम्नलिखित कर्तव्यो कः पालन करेगा, अर्थात: -- !
(क) प्राधिकरण के सभी अभिलेखों का अभिरक्षक होगा ;
(छ) प्राधिकरण की ओर में शासकीय पक्ष-व्यवहार भारेग।;
(१ ) प्राधिकरण के अधिवेशन संयोजित करने के लिए सभी सूचनाए जारी करेगा-
(ब ) प्राधिकारण के सभी अधिवेशनों के कार्यबूत रखेगा'
( ४) प्राधिकरण की सम्पत्तियों और निधियों का प्रबन्ध करेगा ,
(च) सभी अन्य शक्तियों का प्रयोग करेगा और ऐसे कृत्यों का नि पावन करेगा जो प्राधिकरण उसे समनुदेषित करे ।
13. प्राधिकरण के अन्य अधिकारी और कर्मचारी प्राधिकरण ऐसे पर्व सृजित कर सकेगा और ऐसे अधिकारी और अन्य कर्मचारी नियुक्त कर सकेगा जो वह अपने कृत्यों के निर्देहत के लिए आवश्यक समझेः
परन्तु प्राधिकरण ऐसा कोई पव, जिसका अधिकतम वेतन प्रतिमास एक हजार छह सौ रुपए से अधिक है , केन्द्रीय सरकार के पूर्व अनुमोदन से हीसुजित कर सकेगा ।
14. प्राधिकरण के अधिकारियों और कर्मचारियों की सेवा की शहें-- प्राधिकरण के अधिकारी और कर्मचारी केंन्द्रीय सरकार के कर्मचारी होंगे और सभी विषयों में वे केन्द्रीय सरकार द्वारा अपने कर्मचारियों के लिए बनाए मुस गत नियमों भौर प्रादेशों द्वारा शासित होंगे ।
15. निधि का निक्षेप प्राधिकरण द्वारा सोरण निधि के लिए प्राप्त सभी धन प्राधिकरण के उस लेबे में जमा किए जाएंगे जो सिंडीकेट बैंगा ऑफ इण्डिया या उनके किसी समनुषंगी बैंक या केन्द्रीय सरकार द्वारा इस निमित्त अनुमोदित किमी अन्य राष्ट्रीयकृत बैंक में खोना जाएगा ।
16 निधि से रकर्म का निकाला जाना ( 1 ) भारवार मांगते की दुर्घटना के परिणामस्वरूप किसी व्यक्ति को मृत्य या चोर क्षति के लिए प्रतिकर के रूप में संदेय रकम की प्रतिभूति के प्रयोजन के मिवाय तोषण निधि से कोई रकम नहीं निकाली जाएगी ।
(2)प्राधिकरण के सेवाओं से वन का निकाला जाना ऐसी रीति से विनियमित किया जाएगा जो प्राधिकरण द्वारा समय- समय पर अवधारित की जाए ।

17. दावा निपटान आयुक्तों को गिधियों का आवंटन ( 1 ) प्राधि- करण निधियों की ऐसी मात्रा अवधारित करेगा जो प्रत्येक राज्य को आवंटित की जाएगी और राज्य के परिवहन आयुक्म के व्ययनाधीन ऐसी रकम रखेगा जो समय-समय पर अवश्यक हो ।
(2) परिवहन आयुक्त अपने व्ययनाधीन रखी गई निधियों में से वावा निपटान आयुक्तो को ऐसी रकम आश्रटिन करेगा जिसकी दाबा निपटान आयुक्तों को समय समय पर आवश्यकता हो ।
18 वाया निपटान आयुक्त प्रत्येक दावा निपटान अायुक्त अपने जिले में भारकर मागने की मोटर दुर्घटनाओ से उत्पन्न होने वाले दावों के निपटान के लिए उत्तरदायी होगा । दावा निपटान श्रायुक्त के निम्म लिखित कर्तव्य होंग, अर्थात्: --
(i) परिवहन आयुक्त द्वारा उनके व्ययनाधीन रखे गए धन को पृथक लेखा में रखना;
(ii ) तोषण निधि में में प्रतिकर के अनुदान के लिए भावेवतो पर दावा जांच अधिकारी से रिपोर्ट मंगाना;
( iii) प्रतिकर के मंत्राय के लिए आवेदनों पर आदेश पारित करना , और
( iv) प्रतिकर के संदाय के लिए उसके व्ययनाधीन रखे गए धन में में किए गए व्यय का प्रत्येक माम परिवहन आयुक्त को लेस्त्रा भेजना ।
19. दावों की मंजूरी ( 1 ) वात्रा जांच अधिकारी की रिपोर्ट माप्त होने पर दावा निपटान आयुक्त उक्त रिपोर्ट के श्राधार पर दावा मंजूर करेगा । जहां दावा निपटान आयुक्त को दावा जाच अधिकारी द्वारा प्रस्तुत की गई रिपोट की बाबत कोई संदेह हो वहां वह दावा जांच अधिकारी को अतिरिका जांच के लिए रिपोर्ट लौटा देगा और उसमें थे विनिर्दिष्ट बाते उपवणिन करेगा जिनके मन्जस्ध में जांच की जानी है ।
( 2) दाया जांच अधिकारी से रिपोर्ट प्राप्त होने के पश्चात् श्रावा निपटान अधिकारी दाया मंजूर करेगा और उम प्रभाव का प्रादेश प्ररूप 'ग' में पारित करेगा । वह मंजूरी आदेश की एक -एक प्रति निम्नलिखित को भेजेगा, अर्थात्
( क) दावा जात्र अधिकारी ,
(ख) राज्य का परिवहन आयुक्त,
( ग) सम्पूक्त जिले का मोटर यान दुर्घटना दात्रा प्रधिकरण का अध्यक्ष । या यिविन कोर्ट ट्रिब्यूनल गठित नहीं हुए हैं ।
(3) छाया निपटास आयुक्त दावा मंजूर करने वाला मजूगे पावेश पौर उसके साथ प्रतिकर की रकम, यथास्थिति , बैंक या बजाना वाउचर के रूप में दाया जांच अधिकारी को भेजेगा ।
(4) मृत्यु मे उत्पन्न होने वाले दावे की दशा में सवाय भूतक के विधिक प्रतिनिधियो को किया जाएगा । भोर उपद्भुत से उत्पन्न होने वाले दावों की दशा में संवाय क्षतिग्रस्त व्यक्ति को या जहां ऐसा व्यक्ति स्वयं हाजिर होने की स्थिति में नही है यहा संवाय क्षतिग्रस्त व्यक्ति द्वारा सम्यक रूप मे प्राधिकृत किसी अभिकर्ता को किया जाएगा ।
( 5 ) दावा जांच अधिकारी सवाय करते समय उस व्यक्ति में स्टाम्प लगी रसीद ( रसीदें ) प्राप्त कोगः ।
29. दाया जाच अधिकारी- दावा जाच भधिकारी अपने उपखण्ड या तालुका में भास्कर मांगने की मोटर दुर्घटनाओं से उत्पन्न होने वाले बावों पर विचार करेगा । वाया जांच अधिकारी के निम्मलिखित कर्तव्य होंगे, पर्थात्
(1) दावेदार में प्रका 'कः' में आवेदन प्राप्न करना ,

( ii) भारकर मांगते की मोटर दुर्घटनामों से उत्पन्न होने वाले दाव की बाबत जांच करना;
( iii ) दुर्घटनाओं की बाबत पुलिस और चिकित्सा प्राधिकारी से रिपोर्ट मंगाना;
(iv ) जहां एक से अधिक दावेदार हों वहां यह विनिश्चय करना कि अधिकारवान दावेदार कौन हैं।
(v) दावा निपटान आयुक्त को प्ररूप "ख " मे रिपोर्ट सौर उसके साथ मंजूरी श्रादेशों के लिए अपनी सिफारिणे प्रस्तुत करना;
(vi) दावा निपटान आयुक्त से मंजुरी आदेश प्राप्त होने पर दावे- दार या दावेदारों को प्रतिकर की रकम संवितरित करना ।
21. दावे का आवेवन करने के लिए प्रक्रिया ( 1 ) दावेवार, जो तोषण निधि से प्रतिकार का दावा करता है , दुर्घटना की तारीख से एक मास के भीतर प्ररूप ' क' में मावेदन करेगा
( 2 ) दावेदार से आवेदन काटने के लिए किसी फीस का संदाय करने की अपेक्षा नहीं की जाएगी ।
( 3 ) प्राश्वन उभ उपखंड तालुका के दावा जांच अधिकारी को किया जाएगा जिसमें दुर्घटना हुई है ।
22. वाया जांच अधिकारी द्वारा अनुसरण की जाने वाली प्रक्रिया-- ( 1 ) दावे का आवेदन प्राप्त होने पर वाया जांच अधिकारी पुलिस प्राधिकारी से प्रथम इनला रिपोर्ट , मृत्यु समीक्षा रिपोर्ट और उस चिकित्सा अधिकारी या डाक्टर से, जिमने क्षतिग्रस्त व्यक्ति की वेखभाल की है, ययास्थिति, शय परीक्षा रिपोर्ट या क्षति के प्रमाणपत्र की प्रति तुरन्त प्राप्त करेगा ।
( 2) जहा दावा निपटान मायुक्त ने कोई रिपोर्ट खंड 19 के उप खंड ( 1 ) के अधीन अतिरिक्त जांच के लिए दावा जांच अधिकारी को लौटाई है वहां वावा जांच अधिकारी ऐसी अतिरिक्त जांच करेगा जो आवश्यक हो और साठ दिन के भीतर बावा निपटान आयुक्त को उसके प्रक्तिम भादेशों के लिए रिपोर्ट पुनः प्रस्तुत करेगा ।
(3) दावा निपटान मायुक्त से मंजूरी अवेश प्राप्त होने के पश्वात् दाया जांच अधिकारी मृत व्यक्ति/ क्षतिग्रस्त व्यक्ति के विधिक प्रतिनिधि मे या उसके सम्यक् रूप में प्राधिकृत अभिकर्ता से, प्रतिकर का उसे संवाय करने के पूर्व वचनबंध प्राप्त करेगा
23. कालिक विबरणी का प्रस्तुत किया जाना दावा निपटान आयुक्त राज्य के परिवहन आयुक्त को प्रतिमाम प्ररूप "ड ० " में विवरण प्रस्तुत करेगा । परिषहुन प्रायुक्त प्राधिकरण द्वारा उसके व्ययनाक्षीन रखे गए बन में से किए गए व्यय का समेकित विवरण प्रत्येक तीन मास के पश्चात् प्राधिकरण को भेजेगा
24. वार्षिक रिपोर्ट-मायुक्त , तोषण निधि, प्राधिकरण के कार्य करण पर वार्षिक रिपोर्ट तैयार करेगा और उसे प्राधिकरण के समक्ष उमके अनुमोदन के लिए रखेगा । प्राधिकरण का अध्यक्ष उस बार्षिक रिपोर्ट को नौवहन और परिवहन मंत्तालय की वार्षिक रिपोर्ट में सम्मिलित किए जाने के लिए केन्द्रीय सरकार को प्रस्तुत करवाएगा ।

पुत्र । की पुत्री/विधवा हूं और (स्थान) का निवासी हूं , मोटर थान दुर्घटना में धोर रूप से क्षतिग्रस्त हो गया हूं और मुझे हुई घोर क्षतियों के लिए प्रतिकर के अनुदान के लिए आवेदन करता हूं । जो क्षतियां मुझे हुई हैं उनकी बाबत आवश्यक विशिष्टियां नीचे श्री गई हैं: -

(स्थान) का/की निवासी हूं । की पुत्री/विधवा हूं और श्री/श्रीमती/ कुमारी को ओ का पुत्र/ की विधवा/ पुती थी , जिसकी जिसको तारीख स्थान पर मृत्यु हुई थी । /क्षतियां हुई थी/ मृत्यु/ क्षतियों के लिए प्रतिकर के अनुदान के लिए विधिक प्रतिनिधि/ प्रभिकर्ता के रूप में आवेदन करता हूं । दुर्घटना की बाबत विशिष्टियां भौर अभ्य जानकारी नीचे दी गई हैं
1. क्षतिग्रस्त व्यक्ति का नाम और उसके पिता का नाम (विवाहित स्त्री या विधवा की दशा में उस उसके पति का नाम) :
2. कतिव्रस्त/ भूत व्यक्ति का पता
3. प्रायु जन्म की तारीच
4. क्षतिग्रस्त मृत व्यक्ति पुरुष है या स्त्री:
5. पुर्वतना का स्थान , तारीख और समय:
6. क्षतिग्रस्त मृत व्यक्ति की उपजीविका
7. क्षतियों की प्रकृति:
8. जिस पुलिस थाने की अधि- कारिता में दुर्घटना हुई थी था जिसमें दुर्घटना रजिस्टर कराई गई थी उसका नाम और पता:
9. जिस चिकित्सा अधिकारी/चि- कित्सा व्यवसायी ने क्षतिग्रस्त/ मृत व्यक्ति की देखभाल की थी उसका नाम भौर पता:
10. वावेवार या वावदारों के माम और पते:
11. मृत व्यक्ति के साथ भातेवारी:
12. कोई भस्य जानकारी जो बाबे के निपटान के लिए आवश्यक था सहायक समझी जाए ।

NOTIFICATION
New Delhi , the 12th November , 1982
SiO. 800(E). In exercis of the powers conferred by sub- section ( 1) of section 109C of the Motor Vehicles Act , 1939 (4 of 1939) , the Central Government hereby makes the following scheme for the purpose of the administration of

the Solatium Fund and payment of compensation there- from.-
1. Short title and commencement.( 1 ) This scheme may be called the Solatium Fund Scheme , 1982 .
(2) It shall be deemed to have come into force from the first day of October , 1982.
2. Definitions . In these rules , unless the context other- wise requires ,-
( a ) "Act" means the Motor Vehicles Act, 1939 ( 1 of 1939);

5. Powers and functions of the Authority. The Authority shall perform the following functions:
(b) " Authority " means the Solatium Fund Autherity constituted under clause 3;
(a) assessment from time to time of the requiremen's of the Solatium Fund and timely submission of re- quests lor Funds to the Central Government ;
(c) "Claims Enquiry Oflicet " means Sub Divional Offi- cer. Tehsildar , or any other cfficer in charge of a revenue sub - division or a Taluka in each icvenuc district of a State;
(b) Allotment , from ume time of amounts to be kept at the disposal of the Transport Commissioners ;
(c) preparation of annual budget .
(d) 'Claims Settlement Commissioner." means the Dis- trict Magistrate, the Deputy Commissioner , the Collector or any other officer in charge of a revenue district in a State;
( e ) " Clause " means clause of this scheme .
( f) ' Form" means form annexed to this Scheme,
(d) investment of monies of the Solatium Fund , not immediately required , in any one or mere of the modes of the irvestment for the time being autho- rised by law for the investment of the trust monies as the Authority may think proper,
(c) all other matters jelating to the administration of the Solatium Fund and payment of compensation therefrom.
of (g ) Transport Commissioner " means an officer appointed as the Transpot Commissioner and shall inclued the Director General of Transport, Director Transport or the Controller of Transport , appointed by the State Government;
6. Delegation of Powers . ( 1 ) The Authority may dele- gate all or any of its powers and functions to the Chairman for prompt and expeditious disposal of business .
(h) words and expressions used but not defined in this Scheme but defined in the Act or the rules made thereunder shall have the meanings respectively assisned to them in that Act and rules,
(2) The Authority may frame , and vary , from time to time as it think fit byelaws for the conduct of its business .
3. Authority of the Solatium Fund . There shall be an Authority to be called the Solatium Fund Authority consist- ing of the following members , namely -
7. Meetings of the Authon.y . The Authouty shall meet at such times and at such places as the Chairman may from time to time , appoint in this behalt .

8. Quorum .-- Not los than three members shall forr. quorum;

(c) One nomince of the General Insurance Corporation of India, not below the rank of the Assistant General Manager, to be nominuted by the Central Government.
Provided that if at any meeting there is no quorum, the Chairman may adjourn the meeting to a date not less than seven days later , mforming the member, present and sending notice to other members that he proposes to dispute of the business at the adjourned meeting, whether there is a quorum or not, and he may thereupon dispose of the business at such adiourned meeting .
9. Decision by Majority. Every matter shall be deter- mined by a majority of votes of the members present and voting. In case of equality of voter the Chan man shall have a casting vote .
(d) Two nominecs one each of insurance companies for the time being carrying on general insurance business in India, not below the rank of Assistant General Manager , to be nominated by the Central Government . Member
(e) 1wo Transport Commissioners one each of two States, to he nominated by the Central Government, Members
10 Notice of meetings .-( 1) Notice shall be given to every member of the time and place fixed for each such meeting at least seven days before such meeting and cach member shall be furnished with a list of business to be disposed of at the meeting :
Provided that when an ungent meeting is called by the Chauman , such notice shall not be necessary.

(2) No business which is not on the list of business shall be considered at a meeting without the permission of the Chairman.
(2) The Headquarters of the Authouty shall be at New Delhi .
11. Minutes of the meeting. The proceedings of each meet- ing of the Authority shall be circulated to all members and thereafter recorded in a minute book which shall be kept as permanent record . The record of the proceedings of each meeting shall be signed by the Chairman .
(3) The person appointed as member by virtue of an office shall cease to be a member when he ceases to held that office .
(4) The term of office of the members nominated under sub -clause ( 1 ) ( d ) and ( c ) , shall be for a period of one year .
12. Appointment of Commissioner , Solatium Fund and his duties. The Commissioner, Solatium Fund shall exercise all executive powers of the Authority under the general cont- rol of the Chairman and the Authority and shall assist the Chairman in the discharge of his functions . He shall po form the following Jutics.-
(5) The Commissieuer , Solatium Fund, shalı be appoin- ted by the Central Government , and shall function as the member secretary of the Authority,
(a) be the custodian of all records of the Authority .
(b) Conduct the official correspondence on behalf of the Authority;
4. Remuneration of members and officers .-( 1 ) Members shall not be paid any remuneration excepa travelling and daily allowance at the rates to be determined by the Autho- rity fromtime to time .
( e) to issue all notices for convening the mecting of the Authority;
(2) Official members will draw travelling and daily allow- ance at the rates admissible to them from the scute frem which they draw their salaries .
(d) to keep minutes of all meetings of the Authority ;

( e) to manage the properties and funds of the Authority;
(c) the Chairman , Motor Vehicles Accident Claims Tri- bunal of the concerned district or Civil Court , where the Tribunal have not been Constituted , (f) to exercise all other powers and execue such of the functions as may be assisned to him by the Autho- rity.
(3 ) The Claims Settlement Commissioner shall send the sanction order sanctioning the claun to the Claims Enquiry Officer alongwith the amount of compensation by way of cheque or treasury voucher. as the case may be .
13. Other officers and employees of the Authority . The Authority may create any posts and appoint such officers and other employees as it may consider necessary for the discharge of its functions :
Provided that the Authority shall not create any post the the maximum salary of which exceeds rupees one thousand six hundred per mensem except with the previous approval of the Central Government .
(4) In the case of a claim arising out of death , the pay- ment shall be made to the legal representatives of the de- ceased. In the case of claims arising out of grievous hurt , the payment shall be made to the person injured or where such person is not in a position to appear personally, the payment may be made to any agent duly authorised by the person injured.
(5) The Claims Enquiry Officer shall obtain stamped re- ceipt ( s) from the person while making payments 14. Conditions of service of the officers and employees of the Authority. The officers and employees of the Authority shall be the employees of the Central Government and shall be governed by the relevant rules and orders framed by the Central Government for its employees in all matters .
20. Claims Enquiry Officer. The Claims Enquiry Officer shall consider the claims arising out of hit and run motor accidents in his sub -division or taluqa . It shall be the duty
of the Claims Enquiry Officer.- (i) to receive applications in Form 'A' from the claiment ;
15. Deposit of fund . All monies received towards the Solatium Fund by the Authority shall be credited to the ac- count of the Authority to be opened in the Syndicate Bark or any of its subsidiaries or any other Nationalised Bank ap- proved in this behalf by the Central Government .
( ii) to hold enquiries in respect of the claims arising out of his and run motor accidents ;
(iii) to call for reports from the police and medical autho- rity in respect of the accidents ;
16. Withdrawal from the Fund .-( 1 ) No amount shall be withdrawn from the Solatium Fund except for the purpose of reimbusing the amount payable as compensation for death or grievous injury to a person as a result of hit and run accident .
(iv)- where there are more than one claimant , to decide as to who are the rightful claimants ;
(2) Withdrawal of monies from the accounts of the Autho- rity shall be regulated in such manner as may be determined by the Authority from time to time .
(v) to submit report to the Claims Settlement Commis- sioner alongwith his recommendation for sanction orders in Form 'B ' ;
17. Allocanon of funds to the Claints Settlement Commis- sioners . ( 1 ) The Authority shall determine the quantum of fundsto be allotted to each State and shall place at the dis- posal of the Transport Commissioner of the State such amount as may be necessary from time to time.
(vi) to disburse the amount of compensation on receipt of the sanction order from the Claims Settlement Commissioner to the claimant or claimants .
(2 ) The Transport Commissioner shall allot to the Claims Settlement Commissioners such amount of the funds placed at his disposal , as may be required by the Claims Settlement Commissioners from time to time .
21. Procedure for making the claim application.-( 1 ) The claimant , claiming compensation from the Solatium Fund shall make an application in Form ' A' within one month from the date of the accident .
(2) The claimant shall not be required to pay any fee for making an application.
18. Claims Settlement Commissioner - Every Claims Setile- ment Commissioner shall be responsible for the settlement of claims arising out of hit and run motor accidents in his dis- trict . It shall be the duty of the Claims Settlement Commis- sioner,--
(3) The application shall be made to the Claims Enquiry Officer of the Sub - Division/Taluqa in which the accident has taken place .
( i) to keep the monies placed at his disposul by the Trans- port Commissioner in a separate account;
(ii ) to call for the reports from the Claims Enquiry Offi- cer on applications for grant of compensation from the Selatium Fund .
22. Procedure to be followed by the Claims Enquiry Offi- cer. ( 1 ) On receipt of the claim application , the Claims Enquiry Officer shall immediately obtain a copy of the F.I.R. , inquest report from the police authority and the past- morten report , or as the case may be , the certificate of in- jury form the Medical Officer or the doctor, who has atten- ded the injured person .
(iii ) to pass orders on applications for payment of com- pensation; and
( iv) to send every monin ar account of the expenditure made out of the montes , placed at his disposal for peyment of compensation , to the Transport Commis- sioner.
(2) Where the Claims Settlement Commissioner has re- turned any report to the Claims Enquiry Officer for further enquiry under sub - clause ( 1 ) chase 19, the Claims En- quiry Officer shall make such additional inquiries as may be necessary and resubmit the report to the Claims Settlement Commissioner within seven days for final orders .
(3) After receipt of the sanction order from the Claims Settlement Commissioner , the Claims Enquity Officer shall obtain an undertaking in Form 'D' from the legal represen- tatives of the deccased , injured persón or his duly authorised agent, before making payment of compensation to him.
19. Sanctioning of claims. ( 1 ) On receipt of the report of the Claims Enquiry Officer the Claims Settlement Commis- sioner shall sanction the claim on the basis of the said report . Where the Claims Settlement Commissioner has any doubt in respect of the report submitted by the Claims Enquiry Officer. he shall retain the report to the Claims Enquiry Officer for further enquiry indicating the specific points in which the enquiry is to be made .
23. Submission of periodical return . The Claims Settle- ment Commissioner shall submit every month a statement in Fodm 'F' to the Transport Commissioner of the State . The Transport Commissioner shall send a consolidated statement of the expenditure made out of the monies placed at his disposal by the Authority every three months to the Authority.
(2) After receipt of the report from the Claims Enquiry Officer, the Claim Settlement Commissioner shall sanc- tion the claim and pass an order to that effect in Form " C " . He shall send a copy of the sanction order to each of the following , namely.--
( a) the Claims Enquiry Officer;
(b) the Transport Commissioner of the State ,
24. Annual Report . The Commissioner , Solatium Fund , shall prepare an annual report on the working of the Autbo- rity, and place it before the Authority for its approval . The Chairman of the Authority shall cause the annual report THE GAZETTE OF INDIA : EXTRAORDINARY
to be submitted to the Central Government for its inclusion in the annual report of the Ministry of Shipping and Trans- port .
