सा० का०नि ० 750( अ) केन्द्रीय सरकार , कांवला वान भविष्य सिधि तथा प्रकीर्ण उपबंध अधिनियम, 1945 ( 1948 का 46 ) की धाग 6 और धारा 7 के माय पठिन धाग 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , कोयला ब्रान कुटुम्ब पेंशन स्कीम, 1971 का और मणांधन करने के लिए निम्नलिखित रहींग बनाती है, अर्थान ---
1. ( 1 ) श्ग स्कीम का क्षिष्ण नाम कायला खान कुटुम्ब पेंशन (संशोधन) स्कीम, 1982 है ।
( 2 ) यह 1 अप्रैल, 1982 में प्रवृत्त हुई ममझी जाएगी ।
2. कोयना खान फुटुम्ब पशन स्कीम, 1971 में,--
(1 ) पैरा 3 में , उपपैग ( ख ) के नीचे के दूसरे परन्तुक में, अंक " 58" के स्थान पर मंत्र " 59 " रखे जाने
(2) पैरा 12 में,
(क) उपपैरा ( 1 ) में, " दो वर्ष मे श्रन्यून" गब्दों के .स्थान पर "एक वर्ष मे अन्यून" शब्द रखे जाएंगे ;

(1) ( ब) उपवेश ( 1 ) के नीचे की सारणी में 40 रु ० " शब्द और प्रकों के स्थान पर 60 रु० " शब्द और अफः रखे
( 3) पैरा 12 के पश्चात् निम्नलिखित पैरा अन्तःस्थापित किया जाएगा,
" 124 -पेनगरों को प्रनुपुरक राहत खान कुम्ब रंगत ( यजांधत) प्रवृत्त होने की मार्गय हा श्री पेशन प्राप्त करने वाले पेंशनरों का परिवर्धन प्रनुदन्त कर महेगा ।" 1982 क केन्द्रीय सरकार, कोयला क्रीम,
( 4) पैरा 15 के उपपैरा ( 1 ) में "श्रा वर्षों शाब्दों के स्थान पर " ए वर्ष" शब्द खो जाएंगे;
( 5 ) पैरा 16 के उपदेश ( 1 ) में, जहाँ कही "दो वर्ष से अन्यून' तथा " 1000 रु० " शब्द और भंक आाते हैं उनके स्थान पर क्रमशः "एक वर्ष में अस्यूत" तथा " 2000 ८०" शब्द ओ अंक रखे जाएगे ,
(6) पैरा 17 के उपौरा ( 1 ) मे, 'बां ने अन्य शब्दों के. स्था पर, एषः वर्ष में अनशन,
(7) पैन 18 में
(क) उपपैरा ( 1 ) के परनुफ में "दो वर्ष " शब्दों से स्थान पर " गुत्रः वर्ष" शब्द रखे जाएगे;

(ख) उपपैग ( 2 ) मे, "दो वर्ष " राब्दों के स्थान पर " एना वर्ष" राम्द रखे जाएगे ,
(8) पैरा 19 में,--
(क) " 40 कर " ग्रहों और शब्द के स्थान पर 60 रुपए" अंक और शब्द रखे जाएंगे;
(ख) उपवेश ( 1 ) के पश्चात्, निम्ननिस्विन परन्तुक पन्न- स्थागित किया जाएगा , अर्थात्--
"परन्तु यह कि न्यूनतम कुटुम्ब पेशन, किश्ती भी दणा में, 60 रुपए से कम नहीं हानी । "
टिप्पण: ( i ) मूल स्कीम, भारत के राजपत्र, श्रमावारण, भाग-2 , खड 3 ( 1) में सा०ता० नि० सं ० 299 , तारीख 1 मार्च, 1971 द्वारा प्रकाशित की गई थी ।
(ii) पैरा 19फ, सा ० फा ० नि ० म० द्वारा अन्तःस्थापित किया गया । 423 तारीख 30 अप्रैल, 1973
( iii) पैरा 21 का मा ० का० ति ० स ० 1042, तारीख 22 सितम्बर , 1973 द्वारा संशोधन किया गया ।
(iv) पैरा 8 मा० का ० ति ० सं ० 1223, मारीख 10 नवम्बर , 1973 द्वाग प्रतिस्थापित किया गया ।
(v) सा ० का ० नि ० स ० 529 तारीख 19 जनवरी , 1974 द्वारा पैरा 3, 12, 15, 16, 17,18,19, 20 और 32 तथा अनुसूची- I का सशोधन किया गया और नए पैरा 14व और अतःस्थापित किए गए । 19 ग
(vi) पैरा 7 और 9 का मा० का ० नि० सं० 400 , तारीख 19 अप्रैल , 1971 द्वारा संशोधन किया गया ।
(vii) पैरा 19क के उपपैरा ( 1 ) का परन्तुक मा०का ० नि ० स ० 2631 , तारीख 1 नवम्बर, 1975 द्वारा अन्न स्थापित किया गया ।
(viii ) अनुसूची II का सा० का ० नि० सं ० 465 तारीख 27 मार्च , 1576 द्वारा संशोधन किया गया ।
( ix) पैरा 13 का मा०का ० नि ० सं ० 758 , तारीख 19 जुलाई , 1980 द्वारा संशोधन किया गया ।
(x) पैरा 5 का सा० का ० नि० म ० 66 , तारीख 17 जनवरी , 1981 द्वारा सशोधन किया गया ।
स्पष्टीकरण भावन
कोयला खान कुटुम्ब पेंशन स्कीम, 1971 के अधीन विद्यमान, प्रमुवि- धाओं को और उदार बनाने का प्रश्न केन्द्रीय सरकार के विचाराधीन है, और इस प्रयोजन के लिए कुटुब पेशन निधि का बीमांकिक मूल्यांकन किया ज रहा है ।
2. बीमांफिक मूल्यांकन के पूरा होने तक यह विनिश्चय किया गया है कि , 1 अप्रैल, 1982 में स्कीम में निम्नलिखित परिवर्तन किए जाए:-
( i) विभिन्न प्रसुविधाओं का हकदार बनाने के लिए अभिदायी सदम्यता की न्यूनतम अवधि के अनुजव को घटा कर दो वर्ष से एक वर्ष करना ;
( ii) न्यूनतम फुटुम्ब पेंशन की दशा में, प्रविष्टि आयु के कारक को लागू नही किया जाएगा जिगमे कि यह सुनिश्चिय हो मझे कि न्युनतम कुटुम्ब पेंशन किती भी दशा में 60 रुपए प्रति मास से कम न हो और यह प्रसुविधा नभी पेंशनरों को उपलब्ध करवाना, इसके अंतर्गत ये पेंशनर भी हैं, जो1-4-1982 को या इसके पश्चात् मासिक कुट्म्य पेंशन प्राप्त कर रहे हैं ।
( iii ) स्कीम के पैरा 16 के अधीन देय जीवन बीमा असुविधा 1000 रुपए से बढ़ाकर 2000 रुपए करना ;
( iv) केन्द्रीय सत्कार का, मामित्रा कुटुम्ब पेशन प्राप्त करने वाले वेणनगे का समय- समय पर अनुपूरक गहन अनुदन्न करने में ममर्थ बताने के निए स्कीम के एक समर्थकारी उपबंध नियमित करना ।
3 कायला खान भविव्य निधि तथा प्रकोर्ण उपबंध अधिनियम, 1948 ( 1948 का 46 ) की धाग 6 अनुबंध करती है कि इस अधिनियम के अधीन बनाई गई स्कीम में यह उपबंध किया जा सकता है कि उनके कोई उपबंध ऐमी तारीख में जो स्क्रीम में इस निमित्त विनिर्दिष्ट की आए, भविष्यनर्थ। रूप से वा भृतलक्षी रूप से प्रयुप्त होगे ।
4. यह भी पुष्टि की आती है कि इनसे किसी भी व्यक्ति के हिलो पर प्रति कूल प्रभाव नहीं पड़ेगा ।

NOTIFICATJON
New Delhi, the 10th December , 1982
G.S.R. 750 (E ) . In exercise of the powers conferred by section 3E read with sections 6 and 7 of the Coal Mines Provident Fund and Miscellaneous Provisions Act , 1948 (46 of 1958) , the Central Government hereby makes the fol- lowing Scheme further to amend the Coal Mines Family Pen- sion Scheme , 1971 , namely :-
1. (1) This Scheme may be called the Coal Mines Family Pension ( Amendment ) Scheme, 19,82 .
(2) It shall be deemed to have come into force with effect from the first day of April , 1982.
2. In the Coal Mines Family Pension Scheme, 1971 ,-
(1 ) in paragraph 3 , in the second proviso under sub - para- graph ( b ) , for the figures " 58 " , the figures " 59 " shall be subs- tituted;
(2) in paragraph 12,-
( a) in sub -paragraph ( 1 ) for the words " not less than two years" , the words "not less than one year" shall be substituted;
(b) in the Table below sub -paragraph ( 1 ) , for the words . and figures " Rs . 40 " , the words and figures "Rs . 60 " shall be substituted;
(3 ) after patagraph 12 , the following paragraph shall be inserted, namely :---
" 12A. Supplementary relief to pensioners . On and from the date of coming into force of the Coal Mines Family Pension ( Amendment ) Scheme , 1982, the Central Government may grant to the pensioners in receipt of the monthly family pension , supplemen- tary additions at such rates and in such manner as may be notified from time to time" ;
(4) in paragraph 15 , in sub - paragraph ( 1 ) , for the words " two years" , the words " one year " shall be substituted;
(5) in paragraph 16 , in sub -paragraph ( 1) , for the words and figures "not less than two years " and "Rs . 1,000/- " wherever they occur , the words and figures "not less than one year" and " Rs . 2,000/- " shall , respectively, be substitu- ted;
(6) in paragraph 17 , in sub - paragraph ( 1 ) , for the words, "not less than two years" , the words " not less than year" shall shall be substituted; one
(7 ) in paragraph 18 ,-
(a) in the proviso to sub -paragraph ( 1 ) , for the words and figures " 2. years " the words "one year" shall be substituted:

(b) in sub -paragraph ( 2 ) , for the wards " before the completion of two years " , the words " before the completion of one year's " shall be substitured;
( 8 ) in sub- paragraph 19 ,--
( a ) in sub - paragraph ( 1 ) , for the words and figures "Rs . 40" , the words and figures " Rs . 60 " shall be substituted;
(b) after sub -paragraph ( 1 ) , the following proviso shall be inserted, namely : --
"Provided that the minimum family pension shall not, in any case , be less than Rs . 60" .
Note : ( i ) Principal published in the Gazette of India, Extra- ordinary, Part II , section 3 ( 1 ) vide GSR NO . 299 , dated the 1st March , 1971 .
(ii ) Paragraph 19A was inserted vide GSR NO . 423 , dated the 31st April, 1973 .
( iii) Paragraph 21 was amended vide GSR NO . 1042 , dated the 22nd September , 1973 .
( iv) Paragraph 8 was substituted vide GSR NO . 1223 , dated the 10th November , 1973 .
( v) Paragraph 3 , 12, 15 , 16 , 17 , 18, 19 , 20 and 32 and Schedule I were amended and new paragraphs 19B and 19C were inserted vide GSR NO. 52, dated 19th January, 1974 .
(vi ) Paragraph 7 and 9 were amended vide GSR NO . 400 , dated the 19th April , 1974 .
(vii) Proviso to sub-paragraph ( 1 ) of paragraph 19A inser- ted vide GSR No. 2631 , dated the 1st November, 1975 .
( viii ) Schedule II was amended vide GSR NO . 465 , dated the 27th March , 1976 .
( ix) Paragraph 13 was amended vide GSR NO . 758 , dated the 19th July, 1980.
(x) Paragraph 5 was amended vide GSR NO . 66 , dated the 17th January, 1981 .
EXPI ANATORY MEMORANDUM
The question of liberalisation of the existing benefits under the Coal Mines Family Pension Scheme , 1971 is under con- sideration of the Central Government, and for this purpose , an acturial valuation of the Family Pension Fund is in prog- ге63 .
2. Pending completion of the acturial valuation , it has been decided to make the following changes in the Scheme , with effect from the 1st April , 1981 :---
( i ) To reduce the stipulation of the uninimum period of contributory membership , for entitlement to the various benefits , from two years to one year;
( ii) To dispense with the application of the entry age factor in the case of minimum family pension , so as to ensure that the minimum family pension i5 not In any case less than R. 60 /- per month, and to make this benefit available to all pensioness , in- cluding those in receipt of the monthly family ren- sion on or after 1-4-1982;
(i ) To enhance the Life Insurance Benefit from Rs . 1,000/- to Rs . 2,000 payable under paragraph 16 of the Scheme .
( iv) To incorporate an enabling provision in the Scheme to empower the Central Government to grant to the pensioners , in receipt of the monthly famliy pensión, supplementary relief from time to time .
3. Section 6 of the Coal Mines Provident Fund and Mis- cellaneous Provisions Act, 1948 (45 of 1948 ) , stipulates that a scheme framed under this Act may provide that any of is provisions shall come into force either prospectively or ret- rospectively with effect from such date as may be specified in thisbehalf in the Scheme .
4. It is also confirmed that nobody's interests will be ad- versely affected .
