G.S.R. 751(E). In exercise of the p w^ cufow 1 b/ Section 12 of th; Goveriraent Siviigs Ccrtifi;>.t;s Act, 195) (46 of 1959), the Central Govemnieit hereby m^kc? the follo- wing rules to p.meni the National Swings Certificates (VI Issue) rules 1981, namely:—

1. Short title and commencement.—(1) Thes-; rubs may bo

called the Nation.il Swings Certificates (VI Issue) Amendment

Rules, 1982.

(2) They shall corns into force on th; 1st day of January,

1983.

"6. Procedure for purchase of certificate.—Anv person desi- ring to purchase ;i certificate, shall present at a p)gt office, an npplication—

(i) in Form 1, or

(ii) if such application is made by any person referred to in the proviso to this rule or rule 8, in Form 1 A, (obtainable free of cost at all post offices) either in person or through an authorised agent of tho Snail Savings Schemes:

provided that where the applicant is an individual not bein,j citizen of India or not being a person of Indian origin, \vh"> is a non-resident or, as the casemay be, who is not resident if* India, p-iorappr3VJl of the Reserve B \nk of.India fur the pur- chase of the certificate stnll be necoisary.

Explanation:—For the purposes of this rule, a person shall be deemed to be of inlian origin if hi, or cither of his parents or any of his griind-parcnts.w as b jr iin in livido t Ini. ;

Explanation:—Fur the purposes of this rule, a person "hal* bo deemed to be of In Inn origin if In, or either of his parent* or;my ofhisgrand-pirentswisbrmiiimlivlded India,","

(4) in rule 9, to sub-rule (2), the following provisos ah ill

''Provided that where the payment for parcbisc of certifi- cate or certificates is mndc by means of .i cheque, pay-nrdcr or dem nd draft expressed in a foreign currency and the proceeds thereof arc not equivalent to the face value of the certificate of the certificites applied for, a certificate or certificates shall be issueo for the mwmum nggrcg to face value possible within the said proceeds but in any c .se not exceeding the aggregate facevv.lue of the certificate or the cortiflc .tes applied for ami any bal-incc i mount of the said proceeds shill be refunded to tho applicant or to any person authorised by him to receive such amount or credited to the s-vings -.CLOunt, if any, of the appli- cant in the post office savings kuik:

Provided further th .t where the payment is made in tue manner specified in clau&eGO of the proviso to rulo K, the certifi- cate shall be issued only after the post office receive an intiivn- tion from the drawee bank branch that the cheque lru been p iid by debit to the appljct'ul's Non-Resident (External) Acjount with the said drawee bank branch.";

(5) in rule 10, the following proviso shall be inserted at the

end, namely;—

"Provided that the facility of issue of a certificate H lieu of an old certificate specified in this rule shall not be available to a person who is a non resident or, as the cise may be, who i8 oot

residentin India.'";

(6) in sub-rule (1) of rule 18, for the w >rj .\nJ figure "Fo,m I", the words, figures and letter "Form 1 or, ;j.s the case nny be. Form IA" shall be substituted;

(7) to rule 28, the following proviso shall be added, namely:

"Provided that such interest shall not, in the case of certi-

ficates purchased under rule 6 or rule 7 by or on behilf of a

person who Is a non-resident, be liable to tax subject to the fulfll- ment of the conditions specified in this behalf in the said Act."

(8) after rule 28, the following ruL-s shall b: inserted, iv.mely.

"28A. Wcalth-tix.—Subject to the conditions specified ii this behalf in thj Wealth-tax Act, 1957, (27 of 1957), wealth- tax shall not be payable in respect of certificates pur^h v".d uTi 'er rule 6 or rule 7 by or on bch If of a person who is n.t r^ident in Iidia.

28B. Gift-tax,- Subject to the conditions specifiei in this behalf in the Gift-fix Act, 1953 (18 of 19 58), gift-t.'.x shall not bs charged in rc8p;ct of gifts made by p. person ^vho h not resident in Inrtin. to any relative of such person in India in the form of certificates purchased by such person under rule 6 or on his behalf under rule 7.";

(9) in rule 29, -

(i) in sub-rule(l), after c-Ujses iiv) and bjfore Bxplanition (1), the following proviso shall be inserted, namely: — "Provided that no fee shall be charge ible in respect of such transactions in the case of a certificate pur^h iscd by a person who is a non-resident or, ^s the case miy be, who is not resident in Indiii,";

(ii) in sub-rule (2), after the proviso, the following provioi

shall bz inserted, namely: —

"Provided further th it n 5 fee shill bo clnrga 1 in the c ise of a certificate purchased by a person who is a non- resident or, as the case rn^v be, whi is mt resident ii) India.";

(10) in Form 1, in the heading ''Forn of Apphcati-in for the purchase of NUionil Savings Certificates (VI Issue)", for the words "Form of Application", the words "Gcner;¹! Farm of Application" shall be substituted";

(11) after Form 1, the following Form shall bo inserted,

G.SR. 752(E).—In cxecise of the powers confened by Soc'ion lz of the Government Savings Certificates Act, 1959 (46 of 1959), tho Central Government horeby makes the following rules to atn;nd the National Savings Cei tificates (Vll Iisuo) Rules 1981, nrmcl> :—

1. Short title and commencement.—(lj These rules may be called the National Savings Certificates (Vll Issue) Amendment

Rules, 1982.

(1) They shall come into force on the 1st day of 'anuary,

1983.

2. In the National Savings Certificates (Vll Issue) Rules,

1981

(1) in rule 2—

(i) after clause (i), the following clause shall be inserted,

namely ;—

*0") "cash" mtans cash in Indian cunency;*

(li) after clause (viii), the following clause shall be ineeitod,

namely :—

'(viila) "non-resident" has tho meaning assigned to it in clause(30) of section 2 of tho Income-tax Act, 1961 (43ofl961);';

(iii) after clause(x), the following clause shall be inserted,

namely :—

'(xi) "resident in India" has the meaning assigned to it

in tho Tna me-it * Act, ISO C3 cf 1?61);'

(2) for rule 6, tho following rule ahall bo substituted

namely :—

"Procedure for purchase of certificate:—

Any person desiring to purchase a certificate, shall piesont

at a post office, an application—

(i) in Form 1, or

(il) if such application is made by any pe son iofcJ red to in the pi oviso to (his rule or rule 8, in Form 1 A, (obtainable free of cost at all post offices; either in pet son or through an authorised agent of the Small Savings Schemes:

Pioyided that wheie the applicant is an individual not being a citizen of India or not being a per son of Indion origin, who is a nr>n resident or, as tho case may bo, who is noti esidfint in Imiia, prior approval of the Reserve Bank of India for the purchase of tho certificate shall be nccessaiy.

Explanation :—For the purposes of this mlc, a poison shall be deemed to be of Indain origin if he, or cither of his parents or any of his giand-parcnts, was born in undivided India.";

(3) in rule 8,—

(i) for clause (ii), the following clause shall be substituted,

the-postmaster;"

(il) the following proviso and Explanation shall be added

at the end, namely :—

Piovidod that where the applicant h an individual, being a citizen of Indian or a peison of India oiigin who is a non- residont or, as the case may be, who is not resident in India, he shall, if he desires to avail of the benefits under clause (4B) of section 10 of the Income-tax Act, 1961 (43 of 1961), oi clause (xvic)of sub-section (1) of section 5 of the Wealth-tax Act, 1957 (27 of 1957) or clause (iid) of sub-section (1) of section 5 of the Oift-tax Act, 1958 (18 of 1958), ai the case may be, make such payment Only in any of the ft Ho win? me des, ns nicly :—

(a) a cheque in favour of the postmaster d a wn by the applicant onhis Non-Resident (External) Account with a bank bianch in India;

(b) a domind diaft or pay order in favour of tho postmaster issued by a bank branch in India by debit to the appli- cant's Non-Resident (External) Account or by with drawn.1 fioui his Foreign Currency (Non-Resident) Account together with a ceitificato from the said bank branch stating that the said demand diaft or pay oidor has been Issued by debit to or withdrawal fiom the said account;

(c) a demand draft drawn in tavour of tho postmastei by

a bank in a country outside India on its bi anch or corres- pondent bank in India;

(d)cnsh, together with foieign inward remittance certificate or bank certificate indicating conversion of foreign exchange in rupees or bank certificate issued in favour of the applicant stating that tho funds have emantated from tho applicant's Non-Resident (External) Acccunt or Foreign Currency (Non-Resident) Account.

Explanation.—For the puiposos of this rule, P. peison shall be deemed to be of Indian origin if he, or either of his pajonti or any of his grand-parents was bom in undivided Jndia.";

(4) in rule 9, to sub-rule (2), the following piovisios shall be

added, namely :—

'Provided that who-o the payment for pu chase of certificate

certificates is made by means of a cheque, pay ordor or demand

draft expressed in a foreign cunency and tho proceeds thereof ai e not equivalent to the face value of the certificate or tho coitl- ficatos applied for, a certificate or certificates shall bo issued for tha maximum aggregate" face value possible within tho said proceeds but in any case not exceeding the aggicgate free value of the certificate of tho cci tiflcaios applied for and any balance amount of the said proceeds shall be refunded to the applicant or to any poison authorised by him to receive such amount or credited to tho savings account, if any, of tho applicant in tho post office savings bank :

Provided fuithcr that whee tlic payment is mado in the manner specified in clause(a) of the p.oviso to rule 8 the certi- ficate shall be issued only after the post office rocehes an intimc- tion from the drawee bank bi snch that the cheque has been paid by debit to the applicant's Non-Resident (External) Account withthesaiddraweobankbranch."; (5)innilel0 the following proviso shall be inseitcd at the end namely :—

"Piovided that the facility of issue of a ceitificate inl;eu of en old certificate, specified in this iule shall not be available to a peison who is a non-iesident or as the case may be who is not resident in India.";

(6) in sub-rule (1) of rule 18 for the word and figu c "Foini 1" the wOids figuics and letter "Form 1 or as tho case may be Form 1A" shall be substituted;

(7) to rule 8, the following proviso shall be added, namely :—

"Piovided that such intoiest shall not, in the ca-e of certificates puichascd under lulc 6 or rulr 7 by or on behalf of a person" who is a nonresident, be liable to tax subject to the fulfilment of tho conditions specif cd in thi behalf .in tho said Act.";

(8) aftor rule 28, tho following IUICS shall be inserted,

namely :— "28.A. Wealth-tax,—Subject to the conditions specified in this behalf in tho Wealth-tax Act, 1957, (27 of 1957), wealth-tax shall not be payable in lesrect of ceilificctos purchased under rule 6 or rulo 7 by or on behalf of a person who is not itsident in India.

28B. Gift-tax,- Subjectto the conditions specified in this behalf in the Gift-tax Act, 1958 (18 of 1958), gift-tax shall not bocharged in respect of gifts made by a person who is not i csident in Indip to any relative of such person in India in the form of co> tificato purchased by such person under rule 6 or on his behalf under rule 7.";

(9) in 01^29,—

(i) in sub-rule (1), aflei c l a ws (iv) and before Fxpfeina-

tion (1), the following proviso shall be inserted, namely :—

"Pi ovidod that no fee shall bo chargeable in respect of such tiansactlons in the case of a ceitificate purchased by a person who is a non-resident or, a? the case may be, who is notiesidont in India."; (ii) in sub-rule (2), aftei the proviso, the following

poviso shall be inwted, namely ;— "Piovided further that no foe shall be charged in the case of a certificate purchased by a poi son who is a non-i esidont or, as the case may bo, who is not losidrnt ;n India.";

(10) In Form I, in the heading "Form of Application for the pii'chase of National Savings Ceitific^tes (VH Issue)", for the words "Form of Application", the words "Genoal Foim of Application" shall be substituted;

(11) after Foim 1, tho following Foim shall be inserted,
