विषय: 1-1-1983 से 31-12-1983 तक संयुक्त राज्य अमरीका, यूरोपीय आर्थिक समुदाय के सदस्य राज्यों, कनाडा और श्रास्ट्रिया को खुले सामान्य लाइसेस-3 के अन्तर्गत कुछ सूती कपड़ो और या उन और मनुष्य निर्मित धागों से तैयार मदों के निर्यात के लिए योजना ।
मिसिल सं० 2 ( 53) / 82-ई-1 प्रस्तुत सार्वजनिक सूचना सं ० 36 - ई ० टी० सी० पी० एन० )/82 दिनांक 18 सितम्बर, 1982 के क्रम में है और यह संयुक्त राज्य अमरीका , यूरोपीय आर्थिक समुदाय के सदस्य राज्यो ( जर्मन संघीय गणराज्य, फांस, इटली, बेनीलक्स, यू० के० , आयरलैंड गणराज्य, डेनमार्क और ग्रीस ) आस्ट्रिया और कनाडा को कुछ सूनी कपडो और या ऊन और मनुष्य निमित धागों से तैयार मदों के निर्यात से संबंधित्त है । स्वीडन को कपडों/तैयार मदों से निर्यात के संबंध में एक सार्वजनिक सूचना अनग से जारी की जाएगी ।
2. योजना के नियंत्रण के लिए अभिकारणः-जब तक अन्यथा रूप से निदेश न दिए जाए सुनी वस्त्र निर्यात संवर्धन परिषद , बम्बई ( टेक्सप्रोसिल ) उन सभी कपड़ों और तैयार मदो की निर्यात हकदारियो का नियनन करेगी जिनके लिए निर्यात्न हकदारियों का नियतन ऊन तथा ऊनी वस्त्र निर्याप संवर्धन परिषद्, ( डब्ल्यू एड डब्ल्यू ई ० पी० सी) नई दिल्ली द्वारा किया जाएगा किंतु ऊनी कपडे और तैयार, मदे इसमें शामिल नही होंगी । लेकिन, ऊनी कपडों और तैयार मदों सहित सभी कपड़ो और तैयार मदा के मामले में श्रावश्यक प्रमाणन मूती वम्त्र निर्यात संवर्धन परिषद् द्वारा किया जाएगा । इस योजना के अन्तर्गत आने वाले वस्त्र उत्पादों की श्रेणियों की सूचना सूती वस्त्र निर्यात संवर्धन परिषद् और ऊन और ऊनी सामान निर्यात सवर्धन परिषद के पास उपलब्ध है । सरकार को यह अधिकार होगा कि वह योजना के नियंत्रण के लिए अभिकरणों के संबंध में जैमा उचित समझे , परिवर्तन करेगी ।
3.. खंडों के लिए आरक्षण: -जहां कही , सूती, ऊनी और मनुष्य निर्मित धागों को लाया जाएगा । ऊनी और सिंथेटिक मदो के लिए आरक्षण विशिष्ट मावाओं के अनुपार किया जाएगा । वस्त्र आयुक्त द्वारा वास्तविक मात्रा को निर्धारण, भूतकालीन प्रतिकृति और प्रवलित प्रवृत्ति को ध्यान में रखते हुए संबद्ध परिषदो से उन की निश्चित आवश्यकताभो को

प्राप्त करने के बाद किया जाएगा । मांग की प्रवृत्ति पर निर्भर करते हुए इम तरह नियन की गई मात्राएं मगोधित की जा मकती है ।
4 धीमी गति वाली मदे ( 1 ) 1982 वर्ष के दौरान
अपनाई गई पद्धति के आधार पर भूमकालीन निर्यातों और प्रचलित पधतियों के श्राधार पर वस्त्र आयुक्त द्वारा इस प्रयोजन के लिए विशेष रूप से श्रभिज्ञान धीमी गति वाली मदो के मामले में पेणगी निक्षेप और बैंक गारंटी के संबंध मे प्रावधानों को समाप्त कर दिया जाएगा ।
( 2) ' अभिजात थोमी गति वाली मदो के लिए आवेदका को किसी भी बैंक गारंटी या नकद निक्षेप के बिना सूती वस्त्र निर्मान मंत्रर्धन परिषद् द्वारा निर्धारित प्रपन्न में केवल एक निष्पादन बाँड ही प्रस्तुत करना होगा ।
5. पेशगी, निक्षेप, बैंक गारंटी और उनकी जब्ती:---- एक निर्यानक जो पहले आए सो पहने पाए संविदा आरक्षग या विशेष निर्यात हकदारी अवधि में पहने श्राए सो पहले पाए तैयार माल पद्धति के अधीन या भूनकालीन निष्पादन के पूरे वर्ष के भीतर उने ग्रावंटित नियात हकदारी के 90 प्रतिशन से कम का निर्यान करता हो तो उसका पेशगी निक्षेप/बैंक गारंटी को जब्त नही किया जाएगा । एक निर्यातक का निष्पादन 75 प्रतिशत से कम नहीं है । किंतु 90 प्रतिशत से जायदा का निष्पादन नह। करता है तो अनुपातिक जुमाना अदा करना होगा । यदि निर्यात हरुदारी 75 प्रतिशत से कम का हो तो निर्यातक का पुरन के पूरे पेणगी निक्षेप/बैंक गारंटी को जब्त कर लिया जाएगा । जहा कही इस प्रकार का मामला उत्पन्न होगा तो यह अनिवार्य वाध्य शतों के अधीन होगा ।
1 2 उन मामलो पर जहा पर अर्वाध के भीतर उपयोग 75% से कम नही है तो निर्यातक का निर्यात हकदारी वर्ष के भीतर दूसरी आवंटन अधि मे वृद्धि के लिए विकल्प दिया जा मवाना है । वृद्धि के लिए आवेदन पत्र मवंद्ध निर्यात हकदारी अवधि के समाप्त होने के एक महीने के भीतर भेजे जाएंगे । ऐसे मामलो मे निर्यातका को शेष मात्ना के लिए , सार्वजनिक सूवना १० 36 ईटीसी (पीएन)/82, दिनांक 18 सितम्बर , 1982 की कंडिका 5 में दी गई दर से दुगुनी की बैंक गारंटी के साथ एक बाड निष्पादित करना होगा । पूरा निर्यात करने पर , संपूर्ण बांड बैंक गारंटी रद्द कर दी गई समशी जाएगी ।
1 3 इस नीति के अन्तर्गत, वे निर्यातक जिनको निर्यात हकदारी आबंटित की गई है , लेकिन वे उनको उपयोग मे नही जाते हैं, इस संबंद्ध में उनके विरुद्ध की जाने वाली कार्यवाही को ध्यान में रखे बिना , भविष्य में होने वाले आबंटन से उनको बंचिन किया गया समझा जाएगा ।

6. अग्रिम धनराशि निक्षेप/ बैंक गारंटी के जब्त करने के विरुद्ध अपील-आवटिन निर्यात हकदारियो का उपयोग न करने पर प्रग्रिम धनगणि निक्षेप/ बैंक गारंटियो की जब्त करने पर निर्यातको द्वारा किए गए प्रतिवेदनों पर उचिन तरीके में विचार करन के प्रयोजनार्थ, निम्नलिखित प्रक्रिया लागू होगी । मूनी वस्त्र निर्यात संवर्द्धन परिषद् द्वारा अग्रिम धन- गणि निक्षेप/बैंक गारंटी को जब्त करने पर सबंधित निर्यातक इस प्रकार जब्त किए गए के विरुद्ध वम्न आयुक्त , बबई को, जब्त करने के संबद्ध में पत्र प्राप्त होने के 15 दिनों के भीतर, अपील कर सकता है । वस्त्र आयुक्त , प्रनिवेदन प्राप्त होने पर , शीघ्र से शीघ्र निर्णय देगा । यदि निर्यातक , किसी मामले में, वस्त्र आयुक्त के निर्णय से संतुष्ट नहीं है तो वह निर्णय मे संबंधित पत्त्र प्राप्न होने के 15 दिनों के भीतर निर्णय के विरुद्ध अपील कर मकता है । दमरी अपील वस्त्र विभाग के यहा होगी और इसकी सुनवाई सरकार द्वारा गठित अपील समिति द्वारा की जाएगी ।
7 निर्यात हकदारियो के आबंटन के लिए पर्यवेक्षण:- निर्यात हकदारियो के आबटन से संबंधित मामलों पर वस्त्र आयुक्त , बम्बई , दिन प्रतिदिन पर्यवेक्षण जारी रखेगा । अध्यक्ष के रूप में वस्त्र आयुक्त और सदस्यो के रूप में संबंद्ध निर्यात संवर्धन परिषदो के प्रतिनिधियों के साथ एक समन्वय समिति ममय -समय पर नीत्ति के परिचालन की पुन- रीक्षा करेगी । उन मामलो में, जहां पर मतभेद होगा. वस्त्र आयुक्त का निर्णय अंतिम होगा ।
8. सीमा शुल्क द्वारा निकामी
( क ) नियंत्रण के अधीन उत्पादे:-इस उद्देश्य के लिए मनोनीत वस्त्र मूती निर्यात संवर्द्धन परिषद अथवा अन्य किसी उचित प्राधिकरण द्वारा जारी किए गए निर्यात ह्वादारी के प्रमाण-पत्र की मूल प्रति पर और व्यक्तिगत प्रेषण के लिए पोतलदान बिलों की अनुलिपि प्रति पर भीमा शुल्क प्रमाणन प्राधि- कारियों द्वारा लदान के पत्तनो पर के सत्यापन के बाद ही पोसलदान अनुमेय होगा ।
(ख ) हथकरघा उत्पाद जहां तक नियत्रण से तदनुरूपी मदों सभी हथकरघा वस्त्रों/तैयार पोशाकों के निर्यात से संबंधित्त है, समन्वय प्रपत्त के भाग-2 में वस्त्र ममिति द्वारा " निरीक्षण पृष्ठांकन " के आधार पर सीमा शुल्क प्राधिकारियों द्वारा पोतलदान अमुमेय होगा ।
(ग ) भारतीय मदों के अन्तर्गत आने वाली तैयार पोशाके: - " भारतीय मदो" के संबंध में जो कि भारत की परंपरागत लोकजीवन से संबंधित हस्तशिल्प वस्त्र उत्पाद है उन्हें यूरोपीय आर्थिक समुदाय , राष्ट्र अमरीका, फिनलैंड , आस्ट्रिया और कनाडा को निर्यात के लिए सीमाशुल्क सवनों द्वारा पोसलवान [भाग 1 -खंद्र 11
की अनुमति विकास ग्रायुक्त ( हस्तशिल्प) ग्रथत्रा वस्त्र समिति द्वारा जारी किए गए उचिव प्रमाण पत्रों के आधार पर ही होगी ।
9. (क ) निर्यात प्रभाणपत्र, उद्गन प्रमाण पत्र और बोना संबंधिन द्विपक्षीय वस्त्र गमझौते के अधीन निम्न- लिखित अपेक्षित प्रमाणन सूमी वम्व निर्यात मत्र- र्धन परिषद अथवा इस संबंध मे एनद्वारा प्राधि कुन किसी अन्य निकाय ने जारी किए जाएंगे:
1. अमरीका
( क ) सभी मिल निर्मित वस्त्रो और तैया अस्त्रों के लिए वीमा जिनका परेषण भ्रमरीकी डालर 250 से अधिक है ।
(ख) अमरीकी डालर 250 तक अथवा इमसे कम मूल्य के परेषण के लिए छूट प्रमाण-पल ।
(2) यरोपीय आर्थिक समुदाय के सदस्य राज्य
(क ) शक्ति चालित कग्धे/मिन्न निर्मित/ मूल रूप से सलाई से बनाई हुई सभो नियंत्रण मदो के लिए उद्गम के लिए निर्यान प्रमाण पब और उद्गम प्रमाणपत्र ।
( ख ) शक्ति चालित करघे/मिन निर्मित/सलाई मे बनाई हुई मूल के अनियनित मदों के लिए उद्गम प्रमाण पत्र ।
( 3 ) कनाडा: शक्ति चालिन करघे/मिल निर्मित या सलाई से बनाए हुए मल के वस्त्र औ तैयार वस्तुएं जो 500 वानडा डालर तक के मूल्य के परेषणों को छोडकर नियत्रण शर्त के अधीन है के लिए निर्यात प्रमाणपत्र ।
(4) आस्ट्रिया शक्ति चालित करघे/ निर्मित मूल के वस्त्र/तैयार वस्तुएं जो नियंत्रण या निग- रानी के अधीन है , के लिए प्रमाण पत्र ।
9 ( ख ) हथकरघा फ्रूट प्रमाण पत्र
कनाडा को तदनुरूपी मदो के नियंत्रण के सभी हथकरघा वस्त्रों/तैयार वस्तुएं आस्ट्रिया को सूती हथकरघा से बनी हुए वस्त्र/तैयार वस्तुओं, यूरोपीय आर्थिक समुदाय के सदस्य राज्यो और यू० एस ० ए ० को मभी हथकरघा वस्त्रों और तैयार वस्तुओ के मामले में वस्त्र समिति ऐसे उत्पादों के लिए द्विपक्षीय समझौते में निर्धारित किए गए अनुसार प्रमाण पत्र जारी करेगी ।
10 सरकार को यह अधिकार होगा कि वे पूर्व सूचना दिए बिना ही उपर्युक्त किसी भी प्रावधान मे संशोधन कर सकती ह ।

Subject : Scheme for exports under OGL- 3 of certain fabrics and/or made - ups items made from cotton , wool and man - made fibres to U.S.A. , E.E.C. member states , Canada and Austria、 from 1-1-83 to 31-12-1983 .
F. No. 2( 53 ) /82-EI.-1 . The Scheme : This Public Notice is in continuation of Public Notice No. 36 ETC ( PN )/82 dated 18th September , 1982 and relates to the export of certain fabrics and, or madce - ups items of cotton , wool and man - made fibres to U.S.A. , E.E.C. member states ( Federal Republic of Germany , France, Italy, Benelux, U.K. , Republic of Ireland, Denmark and Grecce ) , Austria and Canada . A separate Public Notice will be issued in respect of export of fabrics/ made- ups to Sweden.
2. Agencies for the Administration of the Scheme :
Unless otherwise directed , the Cotton Textiles Export Promotion Council , Bombay ( TEXPROCIL) will allocate export entitlements for all fabrics and made- ups except woollen fabrics and made - ups , for which Export entitlement allocation will be done by the Wool and Woollens Export Promotion Council , New Delhi ( W & WEPC ) . However , necessary certi- fication for all fabrics and made -ups including the woollen fabrics and made- ups will be done by the Cotton Textiles Export Promotion Council . Lists of categories of textile products covered under the Scheme are available with the Cotton Textiles Export Promotion Council and the Wool and Woollens Ex- port Promotion Council Government reserves the 4

right to make changes , as considered appropriate , with regard to the agencies for the administration of the Scheme.
3. Reservation for Segments :
Wherever export entitlements for cotton , Wooilen and man -madeade fibres are combined , the reservation for woollen and synthetic items will be done in terms 'of specific quantities . The actual quantities will be determined by ' the Textile Commissioner after ascer- taining the firm requirements from the respective CouncilsCouncils , keeping in view the past pattern , and pre- vailing trends . Depending upon the demand trend, the quantities so fixed may be modified .
4. Slow moving Items :
(i) In line with the practice followed during the year 1982 , the provisions regarding Earnest Moncy deposits and Bank Guarantees would be dispensed with in the case of slow- moving items , specially identified for this purpose by the Textile Commissioner on the basis of past exports and prevailing trends .
( ii ) For the identified slow- moving items , appli- cants will have to submit only the perfor- mance bond in the proforma prescribed by TEXPROČIL without any Bank Guarantee or Cash deposit .
5. Earnest Money Deposits , Bank Guarantees and Forfeitures Thereof :
5.1 An exporter who exports not less than 90 % of the export entitlement allotted to him under FCFS Contract Reservation or FCFS ready goods system in a particular export entitlement period or within the whole year under Past Performance System , will not be liable to the forfeiture of EMD/ Bank Guarantee An exporter who performs not less than 75 % but less than 90 % will have to pay proportional forfeiture . If the export entitlement utilisation is less than 75 % the exporter will be liable to forfeiture of his EMD/ Bank Guarantee in full . This will be subject to force majeure conditions , wherever these arise .
5.2 In cases where the utilisation is not less than 75% within the validity period, the exporter may be given the option to seck extension for the next allot- ment period within the export entitlement year . Application for extension shall be filed within one month of the end of the relevant export entitlement period, In such cases , the exporter will have to execute a bond supported by Bank Guarantees at double the rates as given in para 5 of Public Notice No. 36 ETC ( PN ) / 82 dated 18th September , 1982 for the balance quantity . In the case of his failure to export fully, the bond /bank guarantce will be liable to be forfeited in full.
are 5.3 Exporters to whom export entitlements allotted in terms of this policy, but who do not utilise them would render themselves liable to disqualification from future allotment , without prejudice to any other action that may be taken in this behalf.

6. Appeal against forfeiture of EMDs / Bank Guaran- tees :
For the purpose of giving due consideration to representations made by exporters against forfeiture of EMDs, Bank Guarantees for non- utilisation of allotted export entitlements , the following procedure will apply . On forfeiture of EMDs / Bank Guarantees by the Cotton Textiles Export Promotion Council the expor- ters concerned may appeal against such forfciture to the Textile Commissioner , Bombay within fifteen days of receipt of the Communication regarding the forfeiture . The Textile Commissioner shall , upon receipt of the representation , give a ruling as early as possible . If , in any case the exporter is not satisfied with the decision of the Textile Commissioner , he may prefer an appeal against the decision within 15 days of receipt of the communication conveying the decision . The second appeal will be with the Department of Textiles and will be dealt with by an Appellate Com- mittee constituted by the Government .
7. Supervision of Allocation of Export Entitlements :
The Textile Commissioner, Bombay, will continue to exercise day to day supervision over the matters re- lating to allocation of export entitlements , A Co- ordination Committee with the Textile Commissioner as Chairman and with the representatives of the con- cerned EPCs as members will review the operation of the policy periodically . On matters where there is difference of opinion , the decision of the Textile Com- missioner will be final .
8. Clearance by Customs :
A. Products under restraint :
Shipments wll be allowed by Customs autho- ritics at the ports of shipment after verifying the certification of export entitlement on the original and duplicate of shipping bills for individual consignments issued by the Cotton Textiles Export Promotion Council or any other appropriate agency designated for this purpose .
B. Handloom Products :
In so far as exports of all handloom fabrics/ made- ups corresponding to restrained items arc concerned , shipments will be permitted by the Customs on the basis of ' Inspection Endorsement' by the Textile Committec in Part- 2 of the Combination Form .
C. Made- ups Falling Under India Items :
In respect of ' India Items ' which are traditional folklore handicraft textile products of India shipments will be permitted by the Customs for exports to EEC , U.S.A.. Finland , Austria and Canada on the basis of appropriate certificate issued by the Office of the Development Commissioner (Handi- crafts ) or the Textile Conmmittec .

9. (A) Export Certificate , Certificate of Origin and Visa :
The following certification required under the relevant Bilateral Textile Agreement will be issued by the Cotton Textiles Export Promotion Council or any other body duly authorised in this behalf :
( 1 ) U.S.A .--( a ) Visa for all Mill- made fabrics and made - ups consignments valued over US $ 250.
(b ) Exempt Certificate for consign- ments valued at US $ 250 or less .
( in) EEC.-( a) Export Certificate and Certifi- cates of origin for all restrained items of Powerloom , Mill- made Knitted origin.
(b ) Certificate of Origin for non- restrained items of Powerloom, Millmade/knitted origin .
or ( iii) Canada . Export Certificates for fabrics and made- ups of powerloom , mill - made knitted Origin which are subject to restraint except for consignments valued at less than Canadian $ 500 .
( iv) . Austria.--Export Certificates for Fabric/ Made- up of Powerloom/Mill made origin subject to restraint or surveillance .
9. ( B ) Handloom Exempt Certificate :
In the case of export of all Handloom fabrics/ Made - ups corresponding to restrained itemsto Canada ,
to Cotton Handloom Textile Fabrics, Made- ups Austria , all Handloom fabrics and made - ups to EEC and the U.S.A. , the Textile Committee will issue the Certificate as prescribed in the Bilateral Agreements for such products .
10. Government reserves the right to make amend- ment to any of the foregoing provisions without giving prior notice .
