निर्यात व्यापार नियंत्रण

फा० बा० 19 (अ) /सं० ई० (सो) ओ ०, 1977/ए ०एम ( 255) --श्रायात- निर्यात ( नियंत्रण ) अधिनियम, 1947 ( 1947 का 18) के खंड-3 द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए केन्द्रीय सरकार एतद् द्वारा निर्यात (नियंत्रण ) आदेश , 1977 में श्रागे संशोधन करने के लिए निम्नलिखित प्रादेश का निर्माण कारती है, अर्थात्

का निर्यात (नियन्त्रण ) दूमरा मशोधन 1. इस आत्रेयश आवेश , 1983 की संज्ञा दी जाए ।

2 निर्यात ( नियत्क्षण ) श्रादेश , 1977 मे,

(क) घारा 3 क हटा दी जाएगी ।

(ख) भाग 'ख' घनुमूर्ची 1 में क्रम सं ० 70 के मामने वर्तमान उप- प्रविष्टियां ( 5 ) से ( 15 ) तक हटा दी जाएंगी और उनके स्थान १४ निम्नलिखिन प्रतिस्थापित की आएंगी

" 70 ( 5 ) सूरा, ऊन मोर मानव निमित्त रेशा (पटसन, रेशम और प्रवेयस को छोड़कर ) से निमित नस्त्र और सूती वरुण उत्पादो का भारत यूरोपीय श्रार्थिक समुदाय से बस्त्र समझौते के अन्तर्गम यूरोपीय भाषिक समुदान के साज्य राज्यों को मिर्धात ।

( 6 ) सूत, ऊन और निर्मित रेशो (पटसन, ग्शम और फ्लेक्स को छोड़कर) से निर्मित वस्त्रो का भारत संयुक्त राज्य वस्त्र समझौते के अन्तर्गत मयुक्त राज्य अमरीका को निर्यात ।

( 7 ) कुछ सूती वस्त्रो और बस्त्र उत्पादो का भारत और आस्ट्रिया के बीच अपसो नहमति के ज्ञापन के अन्तर्गत आस्ट्रिया को निर्यात ।

( ४ ) हटा दिया गया है ।

( १ ) भारत स्वीडन वम्क्ष करार के अन्तर्गत स्वीडन को सून, ऊन या उनके मिश्रण के कुछ वस्त्र उत्पादों का निर्यात ।

( 10) भारत श्रौर फिनलैंड के मीष हुए सहमति ज्ञापन के अन्तर्गत फिनलैंड को सूमी और मामव निर्मित रेशे के वस्त्र उत्पादों का निर्यात।

( 11) हटा दिया गया है ।

(13) कोटोन, लोम और अकरा ( भाना) को असली मद्रासी रुमाल (आरामगाव ०० ) का निर्यात ।

( 13) भाग्य और कनाडा के बीष हुए सहमति ज्ञापन के अभ्भर्गत कनाडा को सूम, ऊन और मानव निर्मित रेशे और उनके मिश्रण के बने कुछ वस्त्र उत्पादा का निर्यान ।

( 14) ऐसे देशो के मामले में जिन बेणों के साथ भारत के ऐसे समझौते है, द्विवपक्षीय के अन्तर्गत न आने बाले वेशो को निर्यात की जासे बागी सभी किस्म की पोशाक और सलाई से बनाए हुए

पहनावे और ऐसो भव जो विवपक्षीय समझौते के प्रावधनों के अधीन नहीं है ।

( 15) ऐसे देशों के मामले में जिम देशों के साथ भारत के ऐसे समझौते है ,द्विपक्षीय वस्त्र समझौते के अन्तर्गत न आने वाले देशों को निर्यात किए जाने वाले वस्त्र और तैयार वस्तुएं और ऐसे वस्त्र और तैयार वस्तुए जोद्विपक्षीय समझौते के प्रावधानों के अधीन नहीं है ।

किया जाएगा और न्यूनतम मूल्य प्रक्रिया के माध्यम से उचित वसूली करने का मुनिश्वयं करने के प्रयाग किए आए गे ।

(ग) बुले सामान्य लाइसेंस 3 में , क्रम सं ० 55 से 62 -खा तक के सामने को वर्तमान प्रविष्टियां हटा दो आएंगी और निम्मलिखित को प्रति- स्थापित किया जाएगा:

56 भारत -यूरोपीय प्रायिक समु बी-70 ( 5) बाय वस्त्र समझौते के अन्तर्गत सूती, ऊन और मानवनिर्मित रेशों (जिसमें पटसन , रेशम और फलैक्स शमिल नहींहैं ) से बने वस्त्रों और वस्त्र सामग्री का यूरोपीय आर्थिक समुदाय के सदस्य राज्यों को निर्यात ।

(i ) निम्नलिखित व्वारा निर्यात हकदारी के आर्यटन के मद्दे (क) बस्त्रों और तैयार वस्त्रों के लिए ( जिसमें ऊनी वस्त्रभौर तैयार बस्त्र शामिल नहीं है ) सूती बस्त्र निर्यात संवर्धन परिषद्; (ख) 'पौशाकों और बने हुए वस्त्र के लिए ( जिसमें ऊनी बुने हुए वस्त्र शामिल नहीं है) परिधान निर्यात संवर्धन परिषद;

(iii ) कुटीर उद्योग के हथकरघा वस्त्रों, हथकरघा वस्त्रों से बने हस्तनिर्मित कुटीर उद्योग उत्पाद (पोशाकों से भिन्न) भोर परम्परागत लोक हस्तशिल्प वस्त्र सामग्री ( भारत मर्वे ) मात्रिक प्रतिबन्ध के अधोन नहीं है । हथकरघा पोशाकों के निर्यात के मामले में , वस्त्र समिति से इस संबंध में प्रमाणम प्रस्तुत करना आवश्यक होगा कि वस्त्र वास्तव में हथकरघा द्वारा तैयार किया गया है । प्रतिबंधित मदों के समरूप सभी हथकरघा वस्त्रों/ तैयार वस्त्रोंके निर्यात के मामले में संयोजन प्रपत्र के भाग-2 में वस्त्र समिति द्वारा एक 'निरी- क्षण पृष्ठांकन' अपेक्षित होगा 'भारत मदों' के संबंध में, विकास श्रायुक्त ( हस्तशिल्प) अथवा वस्त्र समिति द्वारा जारी किया गया उचित प्रमाणपत्र अपेक्षित होगा ।

श्री-70 ( 1) निम्नलिखित द्वारा निर्यात एकवारी के आबंटन के महे--

56 भारत संयुक्त राज्य अमरीका वस्त्र समझौते के अधीन सूत , ऊन और मानव निर्मित रेशों से बने ( जिसमें पटसन, रेशम और फ्लैक्स शामिल नहीं है) वस्त्रों का संयुक्त राज्य अमरीका को निर्यात ।

(क) वस्त्रो और तयार बस्तों के लिए ( जिसमें ऊभी वस्त्र भोर तैयार वस्त्र शामिल नहीं है ) सूती वस्त्र निर्यात संवर्धन परिषद;

(ख) पोशाकों और सलाई से मुने हुए वस्त्रों के लिए (जिसमें सलाई से बुने हुए ऊनी वस्त्र शामिल नहीं है ) परिधान निर्यात संवर्धन परिषद्;

(ग) ऊनी वस्त्रों, तैयार वस्त्रों और सप्लाई से बुने हुए पहलायों के लिए (जिसमें ऊनी पोशाक शामिल नहीं है) ऊन भौर ऊमी वस्त्रनिर्यात संवर्धन परिषद् सभी प्रकार के कपड़ों और तैयार कपड़ों ( जिसमें कमी कपड़े और तैयार कपड़े भरे शामिल है ) के लिए पोतल- बान बिलों पर भावश्यक प्रभाणम सूती वस्त्र निर्याप्त संवर्धन परिषद् द्वार बनाए जाएंगे और सभी पौशाकों और बुने हुए वस्त्र (जिसमें उनी पौशाफ और बुमे हुए वस्त्र शामिल हैं ) के लिए ऐसे प्रमाणन परिधान निर्यात संवर्धन परिषद द्वारा बनाए जाएंगे ।

( ii ) निर्यात हकदारी के झाबंटम के मामले में , निर्यात संबर्धन परिषदों मंत्रालय द्वारा जारी किए गए मार्ग दर्शनों का पालम

(ग) ऊनी वस्त्रो तैयार वस्त्रों और सलाई से बुने हुए ऊनी वस्त्रों के लिए (लेकिन जिसमें ऊनी पोशाक शामिल नहीं है) ऊन और ऊभी बस्न निर्यात संवर्धन परिषद् ।

सामग्री का आस्ट्रिया को नियति ।

बिलों पर प्रमाणन करने पर:--

(क) वस्त्रों और तैयार वस्त्रों के लिए सूनो वस्त्र निर्यात संवत परिष और

(ख) पोशाक प्रौर सनाई से युने हुए वस्त्रों के लिए परिधान निर्यात सवर्धन परिषद्:

लेकिन ऊनी वस्त्रों और तैयार वस्त्रों के लिए पोतनत्रशन बिलों पर आय- श्यक प्रमाणन सूती वस्त्र निर्यात संवर्धन परिषद द्वारा किया जाएगा मौर सलाई से बुने हुए ऊनी वस्त्रों के मामरों में इस प्रकार का प्रमाणन परिधान निर्यात संवर्धन परिषद् व्वारा किया जाएगा ।

(II ) निर्यात हकदारी भो आवंटन के मामा सें में निर्यात संवर्धन परिषदें वाणिज्य मंत्रालय द्वारा जारी किए गए मार्गदर्शन का पालन करेंगी और न्यूनतम कीमत प्रक्रिया के माध्यम से उचित वसूली सुनिश्चत करने के लिए प्रयाम करेंगी ।

( II ) कुटीर उद्योग के हथकरघा वस्त्र ऐसे हथ- करधा वस्त्रों से बने हस्त- निर्मित सूती वस्त्र उत्पाद और परम्परागत लोक हस्त शिल्प वस्त्र उलाद " ( भारत मदों) " के रहर में जाने जाने वाले ) माक्षिक प्रति- बंधों के अधोन नहीं है । सूतो ह्यकरवा उत्पादों के लिए कम्बोनेशन प्रपत्र के भाग-2 में बस्त्र समिति द्वारा "निरीक्षण पृष्ठकित " ग्राब- श्यक होगा । " भारत मदों के मामले में विकास मायुक्त ( हस्तशिल्प ) के कार्यालय या वस्त्र समिति द्वारा जारी किया गया उचित प्रमाण -पत्र अपेक्षित होगा ।

( 1 ) निम्नलिखित द्वारा निर्यात हरुदारों के प्रावंटा के मद्दे--

58 भारतीय स्वी उम वस्त्र ख-70 ( 9 ) समझौते के अधोन सूतो ऊनी मानवनिर्मित रेशे यः उनके मिश्रण के कुछ वत्त्वत्र उत्पादों का स्वोडन को निर्यात ।

(क ) तैयार (ऊनी वस्त्र/ ऊनो वत्त्रों को छोड़कर ) बच्त्रों के निए सूतो बच्वा निर्यात संवर्धन परिषद ।

(ख) पौशक्षकों और सजाई से चुने हुए वस्त्रे (सजाई से बुने हुए ऊनी वस्त्रों को छोड़कर) के लिए परिधान निर्यात संत्रर्बत परिपत्ः और

( III ) कुटीर उद्योग के हथकरथा ऐसे बस्त्रों से बने हस्तनिमित्त 'कुटीर उद्योग वस्त्र (पोशाकों से भिन्न) और कुटीर उद्योग के परम्परागत लोक हस्त- शिल्प वस्त्रों की सामग्री ("भारत मर्दे" ) माक्षिक प्रतिबन्धों के अधीन नहीं हैं । हथकरबा पौश कों के निर्यात के मामले में वस्त्र समिति बारा यह प्रमाणन भी अपेक्षित होगा कि वस्त्र मूल रूप से हृयकरवा द्वारा तैयार किए गए हैं । जहां तक प्रतिबंधित मदों के समका सभी हथकरषा वल्त्रों/ तैवार वस्त्रों के निर्यात का संबंध है इस संबंध में संयोजन मपन के भाग-2 में वत्व समिति द्वारा एक " निरीक्षण पृष्ठांकन" अपेक्षित होगा । "भारत मदों" के संबंध में विकास प्रायुक्त (हस्त शिल्प) अथवा वस्त्र समिति द्वारा जारी किया गया उचित प्रमाणपक्ष अपेक्षित होगा।

67 भारत और श्रास्ट्रिया के मो-70 ( 7 ) बीच सहमति ज्ञापन के अधीन

(ग) तैयार ऊनी वस्त और सलाई से बुने हुए ऊनो वस्त्रों से लिए उन और ऊतो वस्त्र नियति संवर्धन परिषद । लेकिन पोत परिवहन बिलों पर प्रावश्यक प्रमाणन सभो तैयार वस्त्रों (वैकर ऊगो बस्त्रों सहित) के लिए

( 1 ) मिम्नलिखित व्वारा निर्यात हकदारी के प्राबंटन के मह वे पोस परिवहन

( 1 ) निम्नलिखित व्व। २ निर्यात हङ्कवारी के आबंटन के मद्देः-- T

61 भारत और कनाडा के बीच बो-70 ( 13 ) सह‌मति ज्ञापन के अधीन सूती, ऊनी और मानव निर्मित रेशों या उनके मिश्रण के कुछ वस्त्र उत्पादों का कनाड। को निर्यात ।

(क ) वस्त्रो औ तैयार बस्त्रो के लिए (जिसमें ऊनी वस्त्र और तैयार वत्त्र शामिल नही हैं) मूती वस्त्र निर्यात संत्रर्धन परिषद :

मूती वस्त्र निर्मात संवर्धन परिषद द्वाग और सभी पौणाकों और सलाई से बने हुए वस्त्रों (ऊनी पोशाकों और सलाई से बुने हुए वस्त्रों सहित ) के लिए परिधान निर्यात संवर्धन परिषद द्वारा किया जाएगा । ( 2) प्रतिबंध के अधीन उथकरघा के तैयार वस्त्रो और पौशाकों के निर्या के लिए वस्त्र समिति से इस संबंध में प्रमाणन आय- प्रयक होगा कि ये वन्त्र मूल रूप से हथकरघा के हैं ।

39 भारत और फिनड के बीच ख ( 70 ) समझौता ज्ञापन के अधीत सूती और तैयार रेशों के वस्त्र उत्पादों क। निर्यात । फिनलैंस को

( 10 ) ( 1 ) निम्नलिखित द्वारा निर्यात हकदारी श्रार्बटन के मद्दे:-- (क ) पोशाकों और सलाई से बुने हुए वस्त्रों के लिए परिधान निर्यात संवर्धन परिषद ।

(ख) ऊनी जुराबो के लिए ऊन और ऊनी वस्त्र निर्यात संवर्धन परिषद लेकिन पोत परिवहन बिलों पर अावश्यक प्रमाणन सभी पोशाकों और मलाई से बुने हुए उत्लादों के लिए परि धान निर्यात सवर्धन पर्पा रषद द्वारा किया जाएगा ।

( ब) पौशाकों और मलाई से बुने हुए वस्त्रों ( जिसमें मन्दाई से बने हुए ऊनी वन्त्र शामिल नहीं हैं ) , के लिए परिधान निर्यात संवर्धन परिषद , और (ग) ऊनी वस्त्रों और तैगर वों और मला ई से बुने हुए ऊतो वस्त्रों ( लेकिन जिननें ऊनी पोशाक शामिल नहीं है ) के लिए ऊम और ऊनी वस्त्र निर्यात संवर्धन परिषद । लेकिन पोत परिवहन बिलो पर श्रावश्यक प्रमाणन सभी वस्त्रों मौर तैयार बस्तों ( जिसमें ऊनी वस्त्र और तैयार यत्व शामिल है ) के लिए सूतों वस्त्र निर्यात संवर्धन परिषद द्वारा किया जाएगा और पोशाकों एवं सलाई से बुने हुए वस्त्रों के मामले में ऐसा प्रमाणन परिधान निर्यात संवर्धन परिपत्र द्वारा किया जाएगा।

वस्त्र (2 ) कुटीर उद्योग के हथकरघा वस्त्रों, हस्त- निर्मित फुटीर उद्योगद्वारा बताए गए ऐसे ही हथकरघा वस्त्र ( ब्लाउज और कमीजों मे भिन्न ) और परम्परागत लोक हस्तशिल्प ("भारत मद्दे" ) मात्तिक प्रतिबन्धा के अधीम नहीं है। हथकरथा ब्लाउज भौर कमीजों के मामले में वस्त समिति द्वारा इस संबंध में जारी किया ग । प्रमाण- पत्त्र भी भावश्यक होगा कि वस्त्र मूल रूप से हथकरषा द्वाग तैयार किए गए है "भारत मद्दो" के प्रन्तर्गत यस्त उत्पादों के मामले में बस्त समिति या वस्त्र आयुक्त ( हस्तशिल्प ) से एक प्रमाण-पत्त प्रावश्यक

(2 ) कुटीर उद्योग के दथकरघा के वस्त्र, ऐसे हथकरघा वस्त्रों में निमित्त हस्त निर्मित कपड़ा और वस्त्र उत्पाद और पर- स्पर। गत लोक प्रचलित हस्तशिल्प वस्त्र उत्पाद (जो भारत मदों के नाम से जाने जाते हैं ) मात्रिक प्रतिबन्धों के प्रधीन नहीं है । सभी हथकरघा वस्त्रो , तैयार वस्सो और प्रतियन्धित मदो के ममस्त तैयार पौणाका * के मिति के मामसें में कम्योंनेशन प्रपक्ष के भाग 2 में वस्त्र समिति द्वारा "निरोक्षण पृष्ठांकन "

सर्वो" के संबंध में बिकास आयुक्त (हस्तशिल्प ) के कार्यालय या वस्त्र समिति द्वारा जारी किया गया उचित प्रमाणपत्त्र श्रावश्यक होगा ।

ख -70 ( 14 ) निर्यात की अनुमति परिधान नियति संवर्धन परिषद वारा पोत परिवहन बिलों पर पृष्ठांकन करने के बाद सभी गंतम्य स्थानों के लिए छो जाएगी ।

के अन्तर्गत न आने वाले 62 (क ) द्विपक्षीय त्रस्त नमझौते देशो को मिर्यासित सभी किस्म की पौशको और मलाई से बने हुए पहनावो और जिन देशो के साथ भारत के ऐसे समझीते है उनके मामसे में वे महें जो द्विपक्षीय समझौतों की शर्तों के अधीन नहीं है ।

-70 ( 15 ) सूती वस्त्र निर्यात संवर्धन परिषद द्वारा पोतपरि- वहन बिलों पर प्रमाणन करके ममो ग्रनुज्ञेय गन्तब्य स्थानो को निर्यात अनमेथ होगा।

62 (ख ) द्विपक्षीय वम्त सम झौते के अन्तर्गत न आने वाले वेशों को निर्यातित वस्त्रो और तैयार वस्त्रों औरजिन देशो के साथ भारत के ऐसे समझौते है उनके मामरों मे वे वस्त्र और तैयार वस्त्र जी द्विपक्षीय समझौतो की शर्तों के अधीन नहीं है ।

S.O. 19 ( E) No . E ( C) O , 1977/AM(255 ) :-In exercise of the powers conferred by section 3 of the Imports and Exports (Control ) Act , 1947 ( 18 of 1947) , the Central Government hereby makes the following order further to amend the Exports (Control) Order, 1977, namely :-

1. This Order may be called the Exports ( Control ) Second Amendment Order , 1983 .

2. In the Exports (Control ) Order , 1977,

(4) Clause 3 A shall be deleted .

(b) In Part 'B ' Schedule I the existing sub -eutrios (v) to (xv) againt Sl . 70 shall be deletec and shall be substituted hy the following

" 70(v) Export to EEC Member -States of lextiles and Textilo products made from cotton , wool and man-made fibras( excluding jute , silk , and flax) under the Indo- EEC Textile Agreement .

(vi ) Export to U.S.A. of Textiles made from cotton , wool and mam de fibres (excluding jute , silk and flax) under the Indo- U.S . Textile Agreement .

(vii ) Export to Austria of certain cotton textiles and textile products under Memorandum of Understanding bet- ween India and Austria .

(VA) Doloted

(ix) Export of certum textile products of cotton wool and min -made fibres or blends thereof to Sweden under tho Indo - Swedish Textile Agreement .

(x) Export of textile products of cotton and man-made fiores to Finland under the Memorandum of Under standingbotween Iudia and Finland .

(x1) deleted .

(xii ) Export to Cotonou, Lome and Accra (Ghana ) of Real Madras Handkerchief (RMHK) .

(xui) Export of certain textile products of cotton , wool and man -made fibres and blonds thereofto Canada undor the Memorandum of Understanding between (udia and Canada .

(XIV) Garments and knitwear of all types exported to coun- tries not covered by bilateral Textile Agreements and items not subject to the provisions of the bilateral Agreements in the case of countries with which India has such agreemonts .

(xv) Fabrics and made - ups exported to countries 'not co- vered by bilateral Textile Agreements , and fabrics and made -ups not subject to the provisions of the bilateral Agreements in the case of countries with which India has such agreements ."

c ) In OGL 3 , the existing entries against Sl . Nos . 55 to 62B shall be deleted and the following shall be substituted :-

respect of " India Items" appropriate certified issued by the Office of the De- velopment Commis- sioner (Handicrafts) or the Textile Con- mittee will be re- quired.

B.70(vi ) (i ) Against allocation of export entitle- mentby :

Necessary certification on shipping bills will however, be made by the Cotton Textiles Export Promotion Council for all fabrics and made- ups (includ- ing woollen fabrics and made-ups) , and in respect of all gar- ments and knitwear (including woollen gar- monts and knitwear) such certification will be made by the Appa- rels Export Promotion Council .

56 Export to USA of Textiles made from cotton , wool and manmade fibres (excluding jute , silk and flax) under the Indo -US Textile Agreement.

(a) The Cotton Tex- tiles Export Promo- tion Council for fab- rics and made-up (excluding woollen fabrics and made- ups);

(b)The Apparels Ex- port Promotion Co- uncil for garment and knitwear (ex- cluding woollenknit- wear);

(ii) In the matter of allocation of export entitlement , the Ex- portPromotion Co- uncils will observe the guidelines issued by the Ministry of Commerce and will make efforts to onsu re reasonable reali- sation through floor price mechanism.

(c) The Wool and Woollens Export Promotion Counci for woollen fabrics madc -upsand wooll- en knitwear (but excluding woollen garments) .

Necessary certification on shipping bills will , however , be made by the Cotton Tex- tiles Export Prome tion Council for Wooj one fabrics and made- ups , and in respect of woollen knitwear , such certification will be made by the Apparels Export Promotion Council.

(ii) In the matter of allocation of export entitlement , Export Promotion Councils will observe the guidelines issued by the Ministry of Co- mmerce and wil make offorts to ensure reasonabk realisation through floor price mecha. nism .

(iii) Handloom fabrics of the cottage in- dustry, handmade cottago industry pro- ducts made of such handloom fabrics (other than garments) and traditionalfolk- love handicraft tex- tile products ( India items) are not subject to quantitative res- traints . In the case of exports of hand- loom garments , cer- tification by the Textile Committee as to the handloom origin of the goods will also be required . In the case of textile pro- ducts falling under 'India Items ' a Cer- tificate by the Textile Committee or the Office of the Deve- lopment Commissi- oner (Handicrafts) will be required.
