सां० फा० मि० 88 ( ८ ) घावश्यक वस्तु अधिनियम , 1955 ( 1955 का 10 ) की धारा 3 रा प्रदत्त अधिकारों का प्रयोग भरते हुए , केन्द्रीय सरकार एतद्वारा मिट्टी का तेल (अधिकतम मूल्य निर्धारण ) आवेण , 1970 मे और संशोधन करने के लिए निम्नलिखित श्रादेश बनाती है, अर्थात्
1. ( i ) इस अदेश को मिट्टी का तेल (अधिकतम मूल्य निर्धारण ) संशोधन प्रादेश, 1983 कहा जायेगा ।
(ii ) यह सरकारी राजपक्ष में प्रकाशन की तिथि से लागू होगा ।
2 मिट्टी का मेल ( अधिकतम मूल्य निर्धारण ) अवेश, 1970 ( जिसे इसके पश्चात् उक्त अवेण कहा जायेगा ) से धाग 3 के पश्चत् निम्नलिखित धारा जाडी जायेगी, अर्थात्
" उक मिट्टी के तेल के रियायती सथा गैर-रिश्रायती मूल्यो के के निर्धारण के लिए विशेष प्रावधान
अब तक कि मिट्टी के सेस की बिक्री तथा वितरण के लिए किसी राम सरकार द्वारा कोई सशोधिन योजना नहीं बन ई जाती तथा

केन्द्रीय सरकार द्वारा उसका अनुमोदन नही किया जाता, मिट्टी के तेल की बिक्री तथा वितरण निम्नलिखित योजना के अनुम र किया जायेगा अर्थात्.----
कोई भी डीलर जिसके पास मिट्टी के तेल का भंडार है ऐसे मिट्टी के तेल को नही बेचेगा:
(क) एक थोक उपभोक्त को गैर-रिश्रायती मूल्य के अलावा किसी अन्य मुल्य पर;
(ख ) किसी अन्य उपभोक्ता को जिसकी घरेलू उपयोग के लिये मिट्टी के तेन को खरीदने को ह्यादी किसी ऐसे दस्तावेज पर आधारित है जिनमें धारक को उसकी समास्य दैनिकः श्राषश्यकताओं को पू०० वारने के लिए आवश्यक वस्तुओं की सप्लाई के लिए प्राधिकृत किया गया हो और जिसे किसी राज्य सरकार द्वारा अपनी अावश्यक वस्तुश्रो के वितरण की योजना के अन्तर्गत जारी विःया गयः हा, चाहे इसे र. शन कार्ड कहा जाए या किसी और नाम से पुषर ज ये,
(i) ऐसी हकवारी का मत्पर प्रतिशत रियायती मूल्य से अधिक मूल्य पर , और
( ii ) ऐसी हयादारी की शेय म.त्ता , गैर-रिक्रयाती मूरुष के अधिक मूल्य पर:

बशर्ते कि जहां ऐसे राशन कार्ड में या अन्य दस्तावेज में मिट्टी के तेल के सम्बन्ध में कोई हक्कदारी निर्दिष्ट नहीं की गई हो, मिट्टी के तेल की हमारी राजन कार्ड में या अन्य वस्तावेज में अनाज अथवा जीनी के लिए विनिर्दिष्ट यूनिटों के आधार पर राज्य सरकार द्वारा हम सम्बन्ध में सरकी राजपत्र में अधिसूचना के द्वारा दिये गये ऐसे भावेशों के अनुसार निर्धारित की जायेगी ।
इम धार। में, जब तक कि सन्दर्भ अन्यथा अपेक्षित न हो:-- व्याख्या:
(i ) " मिट्टी के तेल" में विमानन टबाईन ईंधन शामिल नहीं है
(ii ) "थोक उपभोक्ता " का अर्थ वह उपभोक्ता है जो मिट्टी के तेल की खरीद किसी परमिट, ल इसेंस या अन्य वस्ता वेज के आधार पर करता है, जो कि राशन कार्ड अथवा अन्य वस्तावेज न हो जिसका उपधारा (ख) में उल्लेख किया गया है, जो किसी राज्य सरकार द्वारा श्राषश्नः वस्तुओं के वितरण की अपनी योजना के अनुसरण में जारी किया गया हो और जिनमें उसको ऐसी खरीद के लिए प्राधिकृत किया गया हो
(iii ) "घरेलू उपयोग " का अर्थ है खाना पकाने अथवा रोशनी के प्रयोजनों के लिये उपयोग, परन्तु इसमें ऐसे प्रयोजनों के लिए किसी होटल, कैंटीन जलपान गृह और इसी प्रकार के अन्यों द्वारा उपयोग सम्मिलित नही है,
(iv) गैर-रिश्रायती मूल्य" किसी मुख्य बन्दरगाह भथवा शोधन शाला के संबंध में इसका अर्थ है वह मूल्य जो कि धारा 3 के प्रावधानों के अनुसार निकाले गये हैं और घोषित किये गये हैं, जो इस आवेश के साथ संलग्न अनुसूची के कॉलम 4 में दर्शाये गए मूल्य के आधार पर हैं
(v) "रिश्रायती मूल्य " का किसी मुख्य बन्दरगाह भ्रथवा शोधन- शाला के संबंध में अर्थ है वह मूल्य जो कि धारा 3 के प्रावधानों अनुसार निकाले गए हैं और घोषित किये गये हैं, जो इस आवेश के साथ संलग्न अनुसूची के कालम 3 में दर्शाये गए मूल्य के आधार पर हैं
व्याख्या II--यदि, किसी राज्य में , राशन कार्ड या किसी अन्य वस्तावेज जिस का उपधारा ( ख ) में उल्लेख किया गया है के प्राधार पर अवश्यक वस्तुओं के वितरण की कोई योजना नहीं है, घरेलू उपयोग के लिए मिट्टी के तेल के सम्बन्ध में उपभोक्ता की हकवारी का निर्धारण जब तक कि राज्य सरकार द्वारः इस संबंध में कोई अन्य योजना तैयार नहीं की जाती, उस राज्य में अावश्यक वस्तुओं के वितरण के लिए लागूयोजना के अनुरूप किया जायेगा ।
3. उपरोका प्रवेश में धारा 4 के पश्चात् निम्नलिखित घारा जोड़ी जाएगी , अर्थात्:--
" 4क रियायती तथा गैर रियायती मूल्यों पर बेचे जाने वाले मिट्टी के तेल का भंडार से प्रदर्शित करना:-धारा 3 के प्रभायी अवधि के दौरान प्रत्येक डीलर अपने विक्रय के स्थान पर या प्रवेशद्वार के निकट इस प्रयोजन के लिए रख गये विशेष बोर्ड पर संप्रदर्शित करेगाः-
(क) रिभ्रायती अथवा गैर-रियायती मूल्य पर डिलीवरी के लिए समय समय पर उसके द्वारा रखा गया भंडार;
(ख) ऐसे मिट्टी के तेल के घोषित मूल्य; तथा
( ग) ऐसे मूल्य जिन पर वह ऐसे मिट्टी के तेल को बेचना चाहता है ।"
4. उक्त श्रवेश में , संलग्न अनुसूची के स्थान पर निम्नलिखित अनुसूची प्रतिस्थापित की जायेगी , अर्थात्

MINISTRY OF ENERGY (Department of Petroleum) ORDER New Delhi , the 17th February, 1983
G.S.R. 88 (E) . In exercise of the powers conferred by section 3 of the Essential Commodities Act, 1955 (10 of 1955 ) , the Central Government hereby makes the following order further to amend the Kerosene (Fixation of Ceiling Prices ) , Order, 1970, namely :-
1. (1) This order may be called the Kerosene (Fixation of Ceiling Prices) Amendment Order, 1983.
(2) It shall come into force on the date of its publication in the Official Gazette .
2. In the Kerosene ( Fixation of Celling Prices ) Order , 1970 (herein after referred to as the said Order) , after clause 3, the following clause shallbe inserted , namely :-
" 3A. Special provisions for the fixation of subsidised and non -subsidised prices of kerosene-Until a revised scheme for the sale and distribution of kerosene is made by a State Government and approved by the Central Government, sale and distribution of kerosene shall be made in accordance with the following scheme , namely :-

Na dealer having stock of kerosene shall sell such kerosene-
(anto a bulk consumer, at a price other than the non- ubsidised price;
(b) any other consumer whose entitlement to purchase Ferosene for domestic use isbased on any document authorising the supply of essential commodities for meeting the ordinary daily requirements of the holder thereof issued by a State Government in pursuance of its scheme of distribution of essential commodities , whether called as ration card or by any other name,-
(i) seventy per cent of such entitlement , at a price higher than the subsidised price; and
(ii) the balance of such entitlement , at a price higher than the non-subsidised price :
Provided that where such ration card or other document does not specify any entitlement with regard to kerosene, the entitlement for kerosene shall be determined on the basis of units specified in the ration card or other document for cereals or sugar , as the case may be, in accordance with such orders as the State Government may , by notification in the Official Gazette , make in this behalf.
Explanation I. In this clause , unless the context otherwise requires,-
(1) "kerosene" does not include aviation turbine fuel;
(ii) "bulk consumer " means a consumer who makes purchase of kerosene on the strength of any permit, licence or other document , not being a ration card or other document referred to in sub-clause (b) , issued by a State Government in pursuance of its scheme of distribution of essential com- modities , authorising such purchase by him;
(iii) "domestic use" means use for the purposes of cook- ing or illumination, but does not include any use for such purposes by a hotel , canteen , restaurant and the like;
(iv) " non-subsidised price " , in relation to a main port or refinery , means the price derived and declared in accordance with the provisions of clause 3 , on the basis of the price indicated against it in column 4 of the Schedule appended to this Order;
(v) " subsidised price " , in relation to a main port or refinery , means the price derived and declared in accordance with the provisions of clause 3, on the basis of the price indicated against it in column 3 of the Schedule appended to this Order Explanation II . If, in a State, there is no scheme for the distribution of essential commodities on the basis of ration card or other document referred to in sub -clause (b) , the entitlement of the consumer with regard to kerosene for domestic use shall be determined until any other scheme is made in this behalf by the State Government, in accordance with such scheme of dis- tribution of essential commodities as is in force in that State ."
3. In the said Order , after clause 4, the following clause shall be inserted , namely: --
"4A. Stock of kerosene to be sold at subsidised and non-subsidised prices to be displayed. During the period of operation of clause 3A, every dealer shall cause to be separately and prominently displayed on a special board to be maintained for this purpose at or near the entrance of the place of sale.-
(a) the stock of kerosene held by him from time to time for delivery at the subsidised and non-subsidised prices; (b) the declared prices of such kerosene ; and
(c) the prices at which he proposes to sell such kerosene." .
4. In the said Order , for the Schedule appended thereto, the following Schedule shall be substituted, namely :~~
