मि. सं. 13/ 24/80- ईपीसी वाणिज्य मंत्रालय की मार्वजनिक सूचना सं. 10 - आईटीसी ( पीएन) /82 , दिनांक 5 अप्रैल , 1982 के अन्तर्गत प्रकाशित अप्रैल , 1982-मार्च , 1983 की आयात- निर्यात नीति ( जिल्द -1) की ओर ध्यान दिलाय। जाता है ।

उक्त नीति के रिशिष्ट 20 में उप - पैरा 9 (3 ) 1977-78 के दौरान या इससे पहल किए गए पजीकृत ठेको से संबधित है । यह निश्चय किया गया है कि इस पैरा में उल्लिखित अन्तिम तिथि अर्थात 31 दिसम्बर , 1982 " को सशोधित करक " 30 जून , 1983 " पढ़ा जाएगा । अन्तिम तिथि में यह वृद्धि उन्ही शर्तों के अधीन होगी जो उक्न उप -पैरा 9 (3 ) में पहले ही दी गई है । वृद्धि उन निरन ठेको के लिए लागू होगी जो 16 दिसम्बर , 1981 से पहले कुछ अंश तक निष्पादित किए गए थे और वर्ष 1982 के दौरान आगे निष्पादित किए जाते रहे हैं । यह वृद्धि आगे इस शर्त क भी अधीन होगी कि यह कंवल उन्ही निर्यात ठेको के लिए लागू होगी जिनके लिए विदेशी क्रेता ने भारतीय निर्यातक के पक्ष में 1 जनवरी , 1983 से पहले अपरिवर्तनीय मास्खपत्र खोल दिया हो । जिन मामलों में विवेशी क्रेता न 1 जनवरी , 1983 में पहले अपरिवर्तनीय साखपत्र न खोला हो , परन्तु भारतीय निर्यातक दस्तावेजी माध्य के अधार पर यह सिद्ध कर सकें कि ठेका पर्याप्त अवधि से जारी रहा है , तो ऐसे पंजीकृत ठेको के लिए उपलब्ध संरक्षण लाभों पर विचार किए जाने से पहले मुख्य नियंत्रक , आयात - निर्यात , नई दिल्ली से निकासी प्राप्त करना आवश्यक होगा । 30 जून , 1983 से बाद में ऐसे ठेको के अनुसरण में किए गए निर्यात पंजीकृत ठेको के लिए उपलब्ध संरक्षण के लिए पात्रता प्रदान नहीं करेगे ।

PUBLIC NOTICE NO . 8 - ITC (PN) / 83
Subject . Import & Export Policy for 1982-83
F. No 13 / 24 / 80 - EPC .- Attention is invited to Import & Export Policy ( Volume 1 ) for the period April 1982-March , 1983 , published under the Ministry of Commerce Public Notice No. 16-ITC ( PN ) 82 , dated the 5th April , 1982.
2. In Appendix 20 of the said policy , sub - para 9 ( 3 ) pertains to registered ontracts entered into during 1977-78 or earlier .It has been decided that the lerminal date viz . " 31st December , 1982 " referred to thesein shall be amended to read as '30th June , 1983 " . This extension in the terminal date shall be subject to the same conditions as are already stipulated in the said sub - para 9 ( 3 ) . The extension shall apply to those export contracts which were partly executed prior 3

to 16th December , 1981 and have continued to be executed further during the year 1982. This extension shall also be subject to the further condition that it will apply only to those export contracts for which an irrevocable letter of credit has been opened before 1st January , 1983 by the foreign buyer in favour of the Indian exporter . In cases where no irrevocable letter of credit has been established by the foreign buyer before 1st January , 1983 , but the Indian ex- porter can establish , on the basis of documentary evidence , that there has been a subsisting contract over the period , a prior clearance from the Chief Con- troller of Imports & Fxports , New Delhi shall be necessary before the pro- tection benefits available to such registered contracts could be considered. Exports made in pursuance of such contracts after 30th June , 1983 shall cease to qualify for protection available to registered contracts .
