सा.का. नि. 252(अ) केन्द्रीय सरकार , भारतीय पत्तन अधिनियम , 1908 (1908 का 15) की धारा 7 की उपधारा (1) और धारा 36 की उपधारा ( 1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , नव शिव पत्तन न्यासी बोर्ड की उक्त पत्तन के संरक्षक के रूप में और उक्त अधिनियम द्वारा या उसके अधीन पत्तन पर 'लिए जाने के लिए प्राधिकृत सभी शोध्यों फीसों और अन्य प्रभारों को प्राप्त करने तथा अधिनियम द्वारा प्राधिकृत किन्हीं उद्देश्यों पर उन प्राप्तियों को व्यय करने के लिए नियुक्त करती है ।

New Delhi , the 26th August, 1982
G.SR. 252 (E) . In exercise of the powers conferred by sub- section 1 of Section 7 and sub- section ( 1) of section 36 of the Indian Ports Act , 1908 ( 15 of 1908 ) , the Central Government hereby appoints the Board of Trustees of the

Port of Nhava - Sheva to the Conservator of the said port and 10 receive all dues , fees or other charges authorised to be taken at the port by or under the said Act and , subject to the control of the Central Government , to expend the receipts on any of the objects authorised by the said Act .

सा.का. मि. 253(अ) केन्द्रीय सरकार , महापत्तन न्यास अधिनियम , 1963 (1963 का 38) की धारा 17 की उपधारा (2) और धारा 123 के खंड ( क) के साथ पठित धारा 126 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित विनियम बनाती है, अर्थात्:-
1. मंक्षिप्त नाम और प्रारम्भ (1) इन विनियमों का मंक्षिप्त नाम न्हावा शेवा , पत्तन न्यास समिति के अधिवेशनों की प्रक्रिया विनियम , 1982 है ।
(2) ये तुरन्त प्रवृत्त होंगे ।
2. परिभाषाएं-(1) इन विनियमों में , जब तक कि संदर्भ में अन्यथा अपेक्षित न हो ।
(क) अधिनियम , से महापत्तन न्यास अधिनियम , 1963 (1963का 38) अभिप्रेत है ।

जाएगी या ऐभी तारीख के बारे में सभी सदस्यों को ऐसी तारीख से कम से कम तीन दिन पूर्व संसूचित किया जाएगा ।
(ख) " ममिति" से , अधिनियम की धारा 17 का उपधारा (1) के अधीन गठित समिति अभिप्रेत है ।
3. समिति के अधिवेशन- समिति क अधिवेशन मुम्बई/दिल्ली म और ऐसी तारीखो पर होगे जो समिति के अध्यक्ष द्वारा ममय - समय पर अवधारित की जाए ।
13 विशेष अधिवेशनो का बुलाया जाना- बोर्ड का अध्यक्ष समिति का विशेष अधिवशन , स्वप्रेरणा से बुला सकेगा और समिति के कम से कम दो सदस्य द्वारा किए गए लिखित अनुरोध पर. तुलायंगा ।

New Delht, the 23rd December, 1982 4. कार्यसूची के कागज पत्रों का परिचालन समिति के विशष अधिवेशन से भिन्न किसी अधिवेशन के लिए कार्यसूची से संबंधित कागज- पत्र अधिवेशन की तारीख से कम से कम तीन दिन पूर्व सदस्यों में परिचालित किए जाएगे और विशेष अधिवेशन की दशा म सदभ्यो में , अधिवेशन की तारीख से कम से कम तीन दिन पूर्व परिचालित किए जाएगे , तथा विशेष अधिवेशन की तारीख से कम से कम एक दिन पूर्व परिचालित किए जाएगं ।
G.S.R. 253 (E) . In exercise of the powers confened by section 126. read with sub - section ( 2 ) of section 17 and clause ( a) of section 123 of the Maior Port Truest Act , 1963 38 of 1963 ) , the Central Government hereby makes the first regulations , namely :
5. समिति द्वारा कामकाज के संव्यवहार के लिए गणपूर्ति- समिति का अधिवेशन गठित करने के लिए गणपूर्ति, ममिति के सदस्यों की कुल संख्या का दो - तिहाई भाग होगी ।
it 1. Short title and commencement .-- ( 1 ) These regulations may be called the Nhava Sheva Port Trust ( Procedure Committee Mectings ) Regulations , 1982 .
6. समिति का सभापति समिति के किसी सदस्य को बोर्ड द्वारा समिति के सभापति के रूप में नियुक्त किया जाएगा ।
(2) They shall come into force with immediate eflect
2. Definitions . ( 1 ) In these regulations , anless the context otherwise requires ,
7. अधिवेशनों का सभापतित्व समिति का सभापति , समिति के अधिवेशनों का सभापतित्व करेगा और उसकी अनुपस्थिति में , उपस्थित सदस्य उन अधिवेशनों का सभापतित्व करने के लिए अपने में से अध्यक्ष चन सकते हैं ।
( a) "Act " means the Major Port Trusts Act, 1963 ( 38) οι 1963 ) ;
( b ) "Committee " means a Commaltec constituted under sub-section ( 1 ) of section 17 of the Act .
3 Meetings of a Committee . The meetings of a Committee shall be held in Bombay/Delhi and on such dates as may from time to time be determined by the President of that Committee
8. कार्यसूची में मम्मिलित न की गई मदो पर विचार विमर्श समिति के अधिवेशन में (जिसके अन्तर्गत विशेष अधि- वेशन है) ऐसी किसी मद को , जो पहले से कार्यसूची में सम्मिलित नहीं है विषार- विमर्श के लिए मम्मिलित कर सकता है , यदि उसकी राय में वह इतनी महत्वपूर्ण या अत्यावश्यक है कि उसे ममिति के किसी पश्चात्त्वती अधिवेशन में विचार के लिए रोक कर नहीं रखा जा सकता ।
4. Circulation of Agents Papers , The Papers connected with agenda for any meeting of a Committce . other than a special mecting thereof, shall be circulated to the members at least three days before the date of the meeting, and m the case of a special meeting Papers shall be circulated , at least one day before date of meeting.
5 Quorum for transaction of business by a Commutee.- To constitute meeting of a Committe , the quorum shall be two-third of the total number of members of the Committee 9. समिति के अधिवेशन म विनिश्चय समिति के अधिवेशन में सभी विनिश्चय उपस्थित और मत देने वाले मदस्यों के बहुमत से किए जाएंगे और ऐमी प्रस्थापना के जिसके संबंध में मतदान किया जाता है ,है, पक्ष और विपक्ष में बराबर मत होने की दशा में अधिवेशन में सभापतित्व करने वाले व्यक्ति का द्वितीय या निर्णायक मत होगा ।
6. President of a Committee . The President of a Com- mittce shall be a member of the Committee appointed as such by the Board .
7 Presiding at moeungs . The president of the Committee shall preside over the meetings of the Committee , and in his absence the members present may choose one from among themselves to preside a such meetings .
10. मतदान-यदि समिति क किमी सदस्य द्वारा मत- दान की मांग की जाती है तो अधिवेशन में सभातित्व करने वाले व्यक्ति द्वारा , मत देने वाले व्यक्तियो के नाम और उनके मतों की प्रकृति अभिलिखित की जाएगी ।
11. अधिवेशन की कार्यवाहियों के कार्यवृत-
(1) समिति के प्रत्येक अधिवेशन के कार्यवृत , अधिवेशन समाप्त होने पर , अधिवेशन का सभापतित्व करने वाला व्यक्ति अभिलिखित करेगा ।
8. Discussion on items not included in the agenda. The person presiding at a meeting of a Committee may, at his discretion , includo for discussion at the meeting ( including a special meeting) any item not already included in the agenda , if in his opinion it is of such importance and urgency that it cannot be withheld for consideration at any subsequent meeting of the Committee .
(2) ऐसे प्रत्येक अधिवेशन में उपस्थित सदस्यों के नाम कार्यवृत में अभिलिखित किए जाएंगे ।
9. Decisions at a meeting of a Committee meeting .-All decisions at a meeting of a Committee shall be taken by a majority of the votes of the members present and voting and; in case of an equal number of votes for and against the proposal voted upon , the person presiding at the meeting shall have a second or casting vote .
(3 ) ऐसे प्रत्येक अधिवेशन के कार्यवृत , अगले अधिवेशन में बोर्ड के समक्ष रखे जाएंगे ।
10. Poll .-11 a poll is demanded by any member of a Committee , the names of the members voting and the nature of their votes shall be recorded by the person presiding at the mecting.
12 अध्यियन का स्थगन समिति के अधिवेशन में सभा- पत्तित्व करने वाला व्यक्ति अधिवेशन में उपस्थित सदस्यों की महमति से उसे किमी पश्चात्वती तारीख के लिए ग्वगित कर मकेगा , ऐसी तारीख की घोषणा या तो उभी अधिवेशन में की
11. Minutes of the proceedings of a meeting. ( 1 ) The minutes of each meeting of a Committee shall be recorded 3

and shall be signed as soon as may be after the close of the meeting , by the person presiding at the mecting .
(2) The names of the members present at each such meeting shall be recorded in the minutes .
( 3 ) The minutes of every such meeting shall be placed before the Board at its next meeting .
12. Adjournment of meeting . The person presiding at a meeting of a Committee may , with the consent of the mem- hers present in the meeting, adjourn it to a later date , which date shall either be announced at the meeting , in which case intimation shall be sent to the members absent at the meetings immediately , or communicated to all the members at least three days before such date .
13. Calling of special meetings . The Charman of the Board may, on his own motion and shall , upon a written request made by not less than two members of a Committee , call a special meeting of Committee .
