का ०ग्रा० 235 ( अ) 18एए/ श्राई ० डी० आर ० ए ० / 83.- यतः भारत सरकार, उद्याग मन्त्रालय ( औद्योगिक विकास विभाग) के आदेश मंग्या २१०आ ० 293 ( ) / 1800, आईडीआगए 78 दिनांक 1 मई, 1978 ( जिसे यहा आगे स कथित आदेश कहा गया है ) , आग एल्यूमिनियम कारपोरेशन आफ इंडिया लि० कलकत्ता के आमनमाल के निकट स्थिन जे के नगर औद्योगिक ( विकास और विनियमन ) अधिनियम 1951 (-1951 का 65 ) की धारा 18 गए की उपधारा ( 1) के अन्तर्गत एक वर्ष की अवधि के लिए 30 अप्रैल , 1979 तक ( जिसमे पह नारीख भी गामिल है ) बढ़ाया गया था तथा भारत एल्यूमिनियम कम्पनी लि० को उक्त औद्योगिक उपक्रम मभालने के लिए प्राधिकृत किया गया था;
और यतः, भारत मरसार, उद्योग मंत्रालय ( औद्योगिक विकास विभाग) आदश संख्या का ०आ ० 224( ई) 1519 GL/32

दिनांक दिनांक 25 अप्रैल 1979 संख्या का ० आ ० 286( ई) 29 अप्रैल 1980 संख्या का० आ ० 869 ( ई) / 18एए/ आई डीआर ए/ 80 दिनांक 31 अक्तूबर 1980 , संख्या का ०आ ० 325 ( ई) / 180ए/ आईडीआरए/ 81 दिर्नाक 30 अप्रैल 1981 , सख्या का ०आ ० 290 ( ई ) दिनांक 30 अप्रैल, 1982 तथा संख्या का ०आ ० 539 (ई ) , दिनांक 31 जुलाई 1982 द्वारा कथिन आदेश की अवधि को समय- समय पर बढ़ाते हुए आगे 31 मार्च, 1983 तक बढ़ाया गया था;
और यतः केन्द्र मरकार का यह अभिमत है कि लोक- हिल में ऐमा करना समीचीन है कि उक्त औद्योगिक उपक्रम को 6 महीने की आगामी अवधि के लिए अर्थात् 30 सितम्बर , 1983 तक भारत एल्यूमिनियम कम्पनी लि० के प्रबंध में बना रहना चाहिए;
अतः अब उद्योग ( विकास और विनियमन) अधिनियम , 1951 (1951 का 65) की धारा 18एए को उपधारा ( 2 ) द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए केन्द्र सरकार, एतद्वारा , निदेश देती है कि कथित आदेश 30

सितम्बर , 1983 तक, जिसमें उक्त दिन भी शामिल है , 6 महीन को आगामी अवधि तक प्रभावी रहेगा ।

New Delhi , the 28th March, 1983
8.Ο. 235 (E )/ 18AA/ IDRA/83 . Whereas by the order of the Government of India in the Ministry of Industry (De- partment of Industrial Development ) No. S.O. 293 ( Ε) / 18ΛΑ/ IDRA/78 , dated the 1st May , 1978 ( hereinafter referred to as the said Order ) , the management of the industrial under- taking located at Jaykaynagar near Asansol belonging to the Aluminium Corporation of India Limited, Calcutta , was taken over under sub - section ( 1 ) of section 18AA of the Industries (Development and Regulation ) Act, 1951 ( 65 of 1951 ) , for a period of one year upto and inclusive of the 30th April , 1979 , and the Bharat Aluminium Company Limited was authorised to take over the management of the said industrial undertaking ;
And , whereas , by the Order of the Government of India in the Ministry of Industry ( Department of Industrial Deve- Lopment No. S.O. 224( F ), dated the 25th April, 1979 , No. S.O. 286( E ) , dated the 29th April , 1980 , No. S.O. 869 ( E ) / J8AA / IDRA/ 80, dated the 31st October , 1980 , No. S.O. 325 ( E )/ 18A , 1/ IDRA/ 81 , dated 30th April , 1981 , S.O. 290 (E) , dated 30th April , 1982 and S.O. 539 ( E ) , dated the 31st uly, 1982 itre duration of the said Order was extended from time to time for a further period upto the 31st March , 1983
And , whereas , the Central Government is of opinion that t is expedient in the public interest that the said industrial undertaking should continue under the management of the Bharat Muminium Company Limited for a further period of six months upto the 30th September, 1983 ;
Now, therefore , in exercise of the powers conferred by sub- section (2 ) of section 18AA of the Industries (Develop- nent and Regulation ) Act, 1951 (65 of 1951 ) , the Central Kloveinz en hereby directs that the said Order shall continue to have effect for a further period of six months upto and inclusive of the 30th September , 1983 .

हों या जो उक्त औद्योगिक उपक्रम पर लागू हों, एक वर्ष तक निलंबित रहेंगे तथा उक्त तारीख से पूर्व उनमे प्रदत्न हा उत्पन्न मभो अधिकार, विशेषाधिकार दायित्त्र या देन दरियां एक वर्ष तक निलंबित रहेगी:
और यतः, भारत सरकार उद्योग मंत्रालय ( औद्योगिक विकास विभाग ) के का ०आ ० संख्या 225 ( ई) / 18 एफबी/ आईडीआरए/ 79 दिनाक 25 अप्रैल, 1979 का ० अ १० 287 (ई) / 18 एफबी/आरडीआरए/ 80 दिनांक 29 अप्रैल 1980 क।० आ ० 870/18 एफबी/आईडीआरए/ 80 दिनाक 31 अक्तूबर 1980 का ० आ ० 326 ( ई) / 18 एफबी/ आईडीआरए/ 81 दिनांक 30 अप्रैल 1981, का०आ० 291 ( ई ) दिनांक 30 अप्रैल 1982 तथा का ०आ० 540 ( ई ) दिनांक 31 मार्च , 1983 के आदेशों द्वारा कथित आदेश की अवधि समय- समत्र पर बढ़ाई जाकर आगे 31 जुलाई , 1983 नः बढ़ायी गर्द थी
और थत , केन्द्र सरकार इस बात में संतुष्ट है कि कथित आदेश की अवधि 6 महीने की अतिरिक्त अधि के लिए अर्थात् 30 सितम्बर , 1983 तक , जिसमें यह नारीख भी गामिल है, चढ़ायी जानी चाहिए :
अन.. अब उद्योग ( विकास और विनियमन ) अधिनियम, 1951 की धारा 18 एफ बो को उपधारा ( 2 ) साथ भठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करने हुए , केन्द्र सरकार एदलद्वारा उक्त आदेश की अवधि 30 मिनम्बर, 1983 तर जिपमे यह तारीख भी शामिल है, बढातो है ।

फा०ग्रा० 236 ( श्र)/ 18 वख / श्राई ० डी ० श्रार ० ए ०/ 83 .-- गतः, भारत सरकार, उद्योग मंत्रालय (औद्योगिक विकास विभाग ) के का ० आ ० संख्या 302 ( ई)/ 18एफबी/आईडीआ गए/ 78 दिनांक 2 मई , 1978 (जिसे यहा आगे कथित आदेश कहा गया है) द्वारा केन्द्र सरकार ने उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 एफ बी की उपधारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्ल शक्तियों का प्रयोग करते हुए घोषित किया था कि वे सभी ठेके, सम्पत्ति आश्वासनपत्न करार, समझौते एवार्ड , स्थायी आदेश या अन्य दस्तावेज जो कथित आदेण, जिसमें कि एल्यूमिनियम आफ इंडिया लि० कलकत्ता का तथा आगनमोल के निकट स्थित जेके नगर औद्योगिक उपक्रम एक पार्टी है, जारी किए जाने की तारीख से तत्काल पूर्व प्रभावो S.O. 236( E ) / 18FB / IDRA/ 83 . Whereas by the Order of the Government of India in the Ministry of Industry ( Depart- ment of Industrial Development ) No. S.O. 302 (E )/ 18FB / IDRA/78 , dated the 2nd May 1978, ( hereinafter referred to as the said Order ) , the Central Government , in exercise of the powers conferred by clause ( b) of Sub - section ( 1 ) of section 181 - B of the Industries ( Development and Regulation ) Act , 1951 165 of 1951 ) , had declared that the operation of all contracts , assurances of property , agreements , settlements , awards , standing orders or other instruments in force im- mediately before the date of issue of the said Order to which the industrial undertaking located at Jaykaynagar near Asansol and belonging to the Aluminium Corporation of India Limited , Calcutta , is a party or which may be applicable to the said Industrial undertaking , shall remain suspended for a period of one year and that all rights , pri- vileges , obligations and liabilities accruing or arising there- under before the said date shall remain suspended for period of one year ; a
And, whereas by the Orders of the Government of India in the Ministry of Industry ( Department of Industrial Deve- lopment) No. S.O. 225 (E ) / 18FB / IDRA/ 79 , dated 25th April , 1979 , No. S.O. 287( E ) / 18FB / IDRA/ 80 dated the 29th April 1980, S.O. 870 / 18FB / IDRA / 80 dated the 31st October 1980, No. S.O. 326( E ) / 18FB /IDRA /81 , dated 30th भारत का राजयन असाधारण

April 1981 , No. S.O. 291 (E) dated 30th April , 1982 and No. S.O. 540( E) dated the 31st March, 1983 , the duration of the said Order was further extended from time to time for a further period upto the 31st July, 1982 ;
Now , therefore , in exercise of the powers conferred by sub - section ( 1 ) read with sub -section (2) of section 18FB of the Industries (Development and Regulation) Act, 1951 (65 of 1951 ) , the Central Government hereby extends the duration of the said Order upto ond inclusive of the 30th September , 1983 .
And , whereas the Central Government is satisfied that the duration of the said Order should be extended for a further period of six months upto and inclusive of the 30th September, 1983 ;
