2. In the Standards of Weights and Measures (Packaged Commodities) Rules, 1977,—

(i) in rale 2, in clause (s),—

(a) for sub-clause (i), the following shall be substituted, namely:—

"(i) Price inclusive of freight but exclu- sivo of local taxes, and where such price is mentioned on the package, there shall be printed on the package the words "Max. price local taxes extra";";

(b) after sub-clause (ii), the existing Explana- tion shall be numbered as 'Explanation I', and after Explanation I, as so numbered, the following shall be inserted, namely:—

"Explanation II—-For the purposes of sub-clause (ii), local taxes" Include—

(i) Sales tax, (ii) Octroi, and (iii) Central Sales tax.

Where leviable and actually paid by the retail dealer under any law in force in a particular area.";

(ii) in rule 6, in sub-rule (1), in Proviso (A), after clause (ii), the following shall be inserted, namely:—

"(iia) liquid milk in pouches;";

(iii) in rule 23, after sub-rule (2), the following Explanation shall be inserted, namely:—

"Explanation—For the removal of doubts, it is hereby declared that a sale, distribution or delivery by a wholesale dealer to a retail dealer or other person is a 'retail sale' within the meaning of this sub-rule.";

(iv) for the Third Schedule, the following shall be substituted, namely*--^

G.S.R. 303(E).—In exercise of the powers con- ferred by section 83 of the Standards of Weights and Measures Act, 1976 (60 of 1976), the Central Govern- ment hereby makes the following rules further to amend the Standards of Weights and Measures (Packaged Commodities) Rules, 1977, namely:—

1. (1) These rules may be called the Standards of Weights and Measures (Packaged Commodities) Amendment Rules, 1983.

(2) They shall como into force on the date oJL their publication in the Official Gazette.

(See Rule 5)

Commodities to be packed in specified

Amendment Rules, 1980, any quantity- other than the stan- dard quantity was moulded, embossed or indication on any bottle by any chemical process in suoh a way that the quantity so indicated cannot be altered without break- ing the bottle, such bottle may be used so long as it lasts; but no soft drink shall be bottled in any new bottle manufactured after such commence- ment unless such new bottle conforms to the quantities specified above.
