का० आ० 286 (अ):-केन्द्रीय सरकार, आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए, कागज ( उत्पादन का विनियमन) आदेश , 1978 का और संशो धन करने के लिए निम्नलिखित आदेश करती है, अर्थात्:-
1. ( 1 ) इस आदेश का संक्षिप्त नाम कागज ( उत्पावन का बिनियमम) संशोधन मावेश, 1983 है ।
( 2) मह तुरन्त प्रभावी होगा ।
2. कागज ( उत्पादन का विनियमन) आदेश , 1978 (जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) के खंड 2 में,
(i ) उपखंड ( क) , ( ख) , ( ग) , ( च) और ( ज) का लोप किया जाएगा;
( ii) उपखंड ( ठ) के पश्चात् निम्नलिखित उपखंड अंतःस्थापित किया जाएगा, अर्थात्
(४) "लेखन और छपाई कागज" से बह सामग्री अभिप्रेत है जो सामान्यतः लेखन भऔर छपाई कागज के रूप में जानी जाती है और जिसमें कागज की वे सभी किस्में हैं, जो

मुख्य रूप से छपाई और/ या लेखन के लिए विनिर्मित की जाती है किन्तु इस के अन्तर्गत अवआरी कागज महीं है; '
अर्थात् 3. उक्त आवेश के खंड 3 और 4 के लिए निम्नलिखित रखे जाएंगे,
" 3. कागज के उत्पादन का विनियमन ( 1 ) प्रत्येक विनिर्माता कागज (उत्पादन का विनियमम ) संशोधन आदेश , 1983 के प्रारंभ की तारीख की और से प्रारंभ होने वाली प्रत्येक तिमाही में नीचे सारणी में विनिविष्ठ के भनुसार उसके उत्पादन के परिमाण के आधार पर सफेव लेखत कागज का विनिर्माण करेगा, अर्थात्:-

कागज और कागज के गत्ते के कुस उत्पादन के प्रति निर्देश से सफेव छपाई कागज के उत्पादन की प्रति- शतता निम्नलिखित होगी:-
जहां कागज और कागज के गत्ते का विनिर्माण करने की कुल क्षमता के प्रतिमिर्वेश से लेखन और छपाई कागज का विनिर्माण करने की क्षमता की प्रतिशतता निम्मलिखित है-
20प्रतिशत
50 प्रतिशत से अधिक मही
25प्रतिशत
50 प्रतिशत से अधिक

(2) उपखंड ( 1 ) में किसी बात के होते हुए भी, कागज ( उत्पावन का विनियमन ) संशोधन आदेश , 1983 के प्रारंभ को और से ऐसा विमिर्माता है, जिसकी प्रतिष्ठापित क्षमता (नई यूनिट या यूनिट के सारवान विस्तार के रूप में )-
(1) 1-1-1978 को या उसके पश्चात् चालू की गई है किन्तु ऐसे चालू करने की तारीख से 5 वर्ष पूरे नहीं हुए हैं, या
( ii ) कागज ( उत्पादन का विनियमन ) संशोधन आदेश, 1983 के प्रारम्भ की तारीख को या उसके पश्चात् चालू की जानी है,
अपेक्षा की जाएगी कि यह उपखंड ( 1 ) की सारणी के स्तम्भ ( 1 ) में विनिविष्ट लेखन और छपाई कागज के उत्पावन की प्रतिशतता के अधीन रहते हुए स्तम्भ ( 2 ) में विभिर्विष्ट कागज और कागज के गले के फूल उत्पादन के प्रतिनिर्देश से पहले वर्ष में 5 प्रतिशत , दूसरे वर्ष में 10 प्रतिशत , तीसरे वर्ष में 15 प्रतिशत , चौथे वर्ष में 20 प्रतिशत और पांचवें वर्ष या पश्चात्वतीं वर्षों में 25 प्रतिशत के परिमाप तक सफेद छपाई कागज का उत्पादन करे ।
4. विनिर्माण की क्षमता के अवधारण की रीति:
७४ 3 के उपखंड ( 1 ) में निविष्ट लेखन और छपाई कागज के विनिर्माण की क्षमता और कागज और कागज के गत्ते के विनिर्माण की क्षमता का अवधारण , इस आदेश और ऐसी अन्य जानकारी , यदि कोई हो, जिसकी विनिर्माता से इस निमित्त देने की अपेक्षा की जाए, विनिर्माता द्वारा वी गई जानकारी के आधार पर किया जाएगा ।
4. उक्त आवेश के सांड 10 में,-
(i) उपखंड ( क) में , "प्रनित्रने 10,000 टन से कन है" णश्च और अंकों के स्थान पर " प्रतिवर्ष 16,500 टन से अधिक नहीं है" शब्द और अंक रखे जाएंगे;
( ii) उपखंड (ख) और ( ग ) का लोप किया आएगा ।

मूल आवेश अधिसुधमा स० का ०आ ० 169 ( अ) तारीख 18 मार्च, 1978 को प्रकाशित किया गया था ।
तत्पश्वात् निम्नलिखित द्वारा संशोधित किया गया: -
( 1) अधिसूचना सं ० सा ०का ० 583 ( अ ) तारीख 16 अक्तूबर , 1979 ।
(2) अधिसूचना सं ० का ० आ ० 787 ( अ ) तारीख 9 नवम्बर, 1982 1
MINISTRY OF INDUSTRY (Department of Industrial Development) ORDERS NewDelhi , the 11th April , 1983
S.O. 286(E) . In exercise of the powers conferred by sectio n 3of the Essential Commoditles Act , 1955 (10 of 1955 ) , the Cen- tral Government hereby makes the following Order further to amend the Paper (Regulation of Production) Order , 1978 , namely:-
1. (1) This Order may be called the Paper (Regulation of Production) Amendment Order , 1983 .
(2) It shall come into force at once.
2. In the Paper (Regulation of Production) Order , 1978 (hereinafter referred to as the said Order) , in clause 2,-
(1) sub-clauses (a), (b), (c) , (f) and (h) shall be omitted;
(ii) after sub-clause ( 1 ) , the following sub -clause shall be inserted, namely :-

(m) " writing and printing paper " means , the material commonly known as writing and printing paper and includes all varieties of papers which aro primarily manufactured for printing and /or writing , but does not include newsprint . "
3. For clauses 3 and 4 of the said Order , the following clause shall be substituted , namely :-
" 3. Regulation of Production of Paper . ( 1) Every manufacturer shall manufacture in respect of every quarter commencing on and from the date of commencement of the Paper ( Regulation of Production) Amendment Order , 1983 , white printing paper on the basis of the extent of production thereof as specified in the Table below, namely :--

Percentage of production of white printing paper with reference to the total pro- duction of proer and paper boards shall be- Where percentage of capacity to manufacture writing and printing paper with reference to the total capacity to manu- facture paper and paper boards is-

(2) Notwithstanding anything contained in sub - clause (1) on and from the commencement o tue Paper (Regulation of Production) Amendment Order , 1983 , a manufacturer whose installe, capacity ( by vay of new unit or substantlal expansion)-
(1) has been commissinol on or after 1-1-1976, but has not completed 5 years from the date of such commissioning, or
(ii) is to be commissioned on or after the date of commencement of the Proer ( Regulation of Pro- duction) Amendment Order, 1983 ,
shall be required to produce white printing paper to the extent of5 per cent in the first year, 10 pat co 11 the second year, 15 per cent in the third year , 20 per cent in the fourth year and 25 per cent in the fifth or subsequent years with reference to the total production of paper and paper boards specified in column (2) subject to the percentage of pro- duction of writing and printing paper as specified in column (1) of the Table to sub-clause (1 ) .
4. Manner of determining the capacity to manufacture: The capacity to manufacture writing and printing paper and capacity to manufacture paper and paper boards referred to in sub-clause (1) of clause 3 shall be determined on the basis of information furnished by the manufacturer under this Order and such other information, if any, as the manu- facturer may be required to furnish in this behalf." .
4. In clause 10 of the said Order,
(i) in sub-clause (a) , for the words and figures " is less than 10,000 tonnes per annum " , the words and figure "is not more than 16,500 tonnes per annum" shall be substituted;

1955 ( 1955 का 10 ) की धारा द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए, कागज ( नियंत्रण ) आवेश , 1979 का और संशोधन करने के लिए निम्नलिखित आवेश करती है, अर्थात्
1. ( 1 ) इस आवेश का संक्षिप्त नाम कागज ( नियंत्रण ) संशोधन आवेश, 1983है ।
( 2) यह सुरम्त प्रवृत्त होगा ।
2. फागज ( नियंत्रण) आवेश , 1979 ( जिसे इसमें इसके पश्चात् उक्त आवेश कहा गया है ) में, खंड 2 के उपखंड (ख) का लोप किया जाएगा ।
3. उक्त आवेश के खंड 3 में, " और क्रीम लेड या बोव कागज" शब्दों का लोप किया जाएगा ।
4. उक्त आदेश के खंड 4 में, " और क्रीम लेख या बोव कागज" शब्दों का सोप किया जाएगा ।
5. उक्त आदेश के खंड 5 में , जहां दो स्थानों पर 'और क्रीम लेड या बोव कागज" शब्द आते हैं उनका लोप किया आएगा ।
6. उक्त आदेश के खंड 6 में, " 4200.0०१० ( केबल चार हजार दो सौ रुपए ) " अंकों, अक्षरों, कोष्ठकों और शब्दों के स्थान पर 5400.00 रु० (केवल पांच हजार चार सौ रुपए ) " अंक, अक्षर, कोष्ठक और शब्द रखो जाएंगे ।
7. उक्त आदेश के खंड 6क में ,-
(i) उपसखंड ( क) में , " प्रतिवर्ष 10,000 टन से कम है" शब्दों और 16500 टन से अधिक नहीं है" शब्य अंकों के स्थान पर " प्रतिवर्ष और अंक रखे जाएंगे;
( ii) उपखंड ( ख) और ( ग) का लोप किया जाएगा ।

टिप्पण
मूल आदेश, अधिसूचना स ० का ० आ ० 376 ( अ) , तारीख 30 जून , 1979 द्वारा प्रकाशित किया गया था । तत्पश्चात् निम्नलिखित द्वारा संशोधित किया गया:-

S.O. 287 (E) . In exercise of the powers conferred by Section 13 of the Essential Commodities Act, 1955 (10 of 1955) , the Cen- tral Government hereby makes the following Order further to amend the Paper (Control) Order , 1979 , namely :
1. (1 ) This Order may be called the Paper ( Control) Amendment Order , 1983 .
(2) It shall come into force at once.
2. In the Paper ( Control) , Order 1979 ( hereinafter referred to as the sald Order) , in clause 2 , sub - clause (b) shall be omitted.
3. In clause 3 of the said Order , the words " and cream laid or wove paper " shall be omitted .
4. In clause of the said Order , the words " and cream laid or wove paper or any such varieties of paper " shall be omitted,
5. In clause 5 of the said Order , the words " and cream laid or wove paper " occurring at two places shall be omitted .
6. In clause 6 of the said Order , for the letters , figures , brac- kets and words " Rs . 4200.00 (Rupees four thousand two hundred only) , the letters , figures , brackets and words "Rs . 5400.00 (Rupees five thousand four hundred only) " shall be substituted,
7. In clause 6 -A of the said Order-
(i) in sub -clause (a) , for the words and figures " is less than 10,000 tonnes per annum " , the words and figures "is not more than 16,500 tonnes per annum " shall be substituted;
(ii) sub-clauses ( b) and (c) shall be omitted .
