मिर्यात व्यापार नियन्त्रण
का० प्रा० 318 ( भ) /सं० ई ( सी) श्रो, 1977/ए एम- (258) :--आयात एवं निर्यात ( नियंत्रण ) अधिनियम, 1947 ( 1947 का 18 ) के भाग-3 में प्रदत्त अधिकारों का प्रयोग करते हुए , केन्द्रीय सरकार निर्यात ( नियंत्रण ) आदेश, 1977 में संशोधन करने के लिए आगे निम्नलिखित आदेण का निर्माण करती है, अर्थात:--
1. इग आदेश को निर्यात ( नियंत्रण ) पांचवा संशोधन आदेश, 1983 की संज्ञा दी जाए ।
2. निर्यात ( नियंत्रण ) आदेश , 1977 में , --
( 1) अनुसूची-1, भाग-ख में , -
6. ( क) संबंधित क्रम संख्याओं के सामने आने वाली निम्नलिखित प्रविष्टियों को नीचे उल्लिखित ढंग से प्रतिस्थापित किया जाएगा-
2. जीवित मादा भैंसे ( केवल निकृष्ट) और नर भैंसे जिनका उपयोग प्रजनन

और बोझा ढोने के लिए न किया

(ग) क्रम सं० 35 और 36 के सामने आने वाली वर्तमान प्रविष्टियों को क्रम सं ० 35 ( 1) और 66( 1 ) के रूप में पुनः संख्यांकित किया जाएगा और निम्नलिखित 'मदों को क्रमा- नुसार क्रम मं ० 35 ( 2 ) और 66 ( 2 ) के
म्हप में जोड़ा जाएगा :-
" 35 ( 2 )-खण्डसारी सीरा
166 ( 2 )-शाडी/वूलन/समी-वास्टिड यार्ने । "
(घ) क्रम सं० 64 ( 6) के सामने आने वाली वर्तमान प्रविष्टि हटा दी जाएगी ।

( 3 ) खुले सामान्य लाइसेंम-3 की अनुसूची 3 में ,--
(क) नीचे उल्लिखितानुसार निम्नलिखित मदें जोड़ी जाएंगी:-- 3 1 2 4 '16-क जी ख-20 क केवल 100 % पक्के अपरिवर्तनीय साख-पत्न के मद्दे ।
22-क अरण्डी का तेल ख-31 ( 3 ) केवल सामान्य मुद्रा क्षेत्र से निर्यात अनुमेय होगा ।
22-ख मूंगफली का मक्खन ख -32 ( 2)
22-ग गन्ना ख-33 ( 2) 100% पक्के अपरि- वर्तनीय साखपत्त्र के मददे निर्यात अनुमेय होगा ।

तमिलनाडु पश्चिम बंगाल जैसा भी मामला हो से प्राप्त प्रमाणपत्त्र के मद्दे निर्यात की अनुमति दी जाएगी ।
(ख) क्रम सं ० 68 के सामने कालम-4 में आने वाली वर्तमान प्रविष्टि को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-
( 1) नकली जरी से भिन्न उत्पादों के निर्यात की अनुमति इस शर्त के अधीन दी जाएगी कि उत्पाद का जहाज पर्यन्त निशुल्क मूल्य निर्यात किए जाने वाले उत्पाद में चांदी की मात्रा का भारतीय या अन्तर्राष्ट्रीय मूल्य, निर्यात की तिथि को जो भी अधिक हो, से कम से कम 33-1/3% (तैंतीस और एक तिहाई प्रतिशत) अधिक होना चाहिए । इस प्रयोजन के लिए चांदी के अन्तर्राष्ट्रीय मूल्य का निर्धारण सीमाशुल्क प्राधिकारियों द्वारा निर्यात की तिथि को लंदन या न्यूयार्क में प्रचलित चांदी के मुख्य से इसमें से जो भी अधिक हो, को ध्यान रखकर लगाया जाएगा ।
( 2) बनावटी जरी के निर्यात की अनुमति इस शर्त पर दी जाएगी कि उत्पाद में चांदी की मात्ना वजन में 5 % से अधिक न हो ।
( 3 ) प्रेषण के आधार पर निर्यात की अनु- मति नहीं दी जाएगी ।
(ग) कालम-3 मे क्रम सं ० 68 ( 2 ) ( 20) के बाद निम्नलिखित मद जोड़ी जाएगी :- " 21--कलात्मक हस्तशिल्प किया हुआ लकडी का फर्नीचर और चांदी की चदर से आवरित सजावटी उपसाधित । " (घ) क्रम सं ० 79 के सामने के कालम 4 की वर्तमान प्रविष्टिनिम्नलिखित द्वारा प्रतिस्था- पित की जाएगी :-
"मरम्मत के उद्देश्य के लिए देश में एयर लाइन्स/परिचालकों द्वारा इस शर्त के अधीन कि जिन पुर्जों और उप-साथित्त्रों (अनुमोदित या अन्यथा ) की मरम्मत सुविधाएं देश में उपलब्ध नहीं है, उनके लिए वे एयर लाइन्स प्रत्येक 6 महीने में संबद्ध निरीक्षण कार्यालय के कार्य प्रभारी अधिकारी से निकासी प्राप्त करेंगे । "
(ङ) क्रम सं० 15 के सामने के कालम 4 की वर्तमान प्रविष्टि हटा दी जाएगी ।
(घ) क्रम सं ० 1 सामने के कालम 4 की शर्त-1 में न्यूनतम निर्यात मूल्य 6/-रु० पढ़ा जाएगा ।
(छ) क्रमसं० 3 के सामने के कालम-4 में न्यूनतम निर्यात मूल्य 10/- रु० पढ़ा जाएगा ।
(ज) क्रम सं० 4( 2) ( 7) और 39के सामने के कालम-2 की वर्तमान प्रविष्टियां निम्नलिखित द्वारा प्रतिस्थापित की जाएगी:- "4 ( 2) ( 7) वे गेंढक जो निर्यात के लिए उन यूनिटों में संसाधित किए जाते हैं जो कि निर्यात के लिए आवश्यक रूप से समुद्री उत्पाद के संसाधन में लगी हुई है ।
39. आयात एवं निर्यात नीति ( जिल्द-2 ) में यथा परिभाषित संसाधित लकड़ी । "
(झ) कालम-2 में क्रम सं० 43 ( 4) के बाद निम्न- लिखित मव जोड़ी जाएगी :- "43( 5)-नायल/नायल ड्रापिंग्स"
(ज) कालम-2 की क्रम सं ० 44( 1) में आने वाली वर्तमान प्रविष्टि निम्नलिखित द्वारा प्रति- स्थापित की जाएगी:- " 600 डेनियर या इससे अधिक का रेयन टायर यार्न"
( 4) खुले सामान्य लाइसेंस सं० 4 में
(क) कालम -2 की क्रम सं ० 4-क में आने वाली वर्तमान प्रविष्टि निम्नलिखित द्वारा प्रति- स्थापित की जाएगी:-
"अरण्डी का तेल , जबकि उसका निर्यात रुपया भुगतान क्षेत्र को किया गया हो । "
(ख) कालम 2 की क्रम सं ० 10 में आने वाली वर्तमान प्रविष्टि निम्नलिखित द्वारा प्रतिस्थापित की जाएगी "मैंगनीज अयस्क (रसायनिक रूप से संसाधित मैंगनीज डाई -ऑक्साइ को छोड़कर) 4

S.O. 318 (E ) / No . E ( C ) O , 1977/ AM ( 258 ) . In exercise of the powers conferred by Section 3 of the Imports and Exports (Control) Act, 1947, ( 18 of 1947 ) , the Central Government hercby makes the following Order further to amend the Exports (Control ) Order , 1977 , namely : --
1. This Order may be called the Exports (Control) Fifth Amendment Order , 1983 .
2. In the Exports ( Control) Order , 1977-

(b) The existing condition appearing in col . 4 against S. No. 68 shall be substituted by the following :-
(i) Export of products , other than imitation zari , will be allowed subject to the condition that the f.o.b. value of the product should be at least 33-1 / 3% ( Thirty three and one third per cent ) more than either Indian price or international price of silver content in the products to be exported , which- ever is higher on the date of export . The inter- national value of the silver for this purpose will be ascertained by the customs Authorities having regard to the prevailing price of silver in London or New York whichever is higher, on the date of export.
(ii ) Export of imitation zari will be allowed provided the silver content does not excced 5 % by weight inthe product .
(iii) Export on consignment basis will not be allowed .
(c) In col . 2, the following item shall be added alter S. No. 68(II) (20) :-
"21 Artistic handcrafted wooden furniture and de- corative accessories covered with silver sheet " .

(d) The existing condition appering in cl . 4 , against S. No. 79 shall be substituted by the following :-
"by the Air lines/Operators in the country for the pur- pose of repairs subject to the condition that they would get clearance from the Officer - in - charge of the concerned Regional Inspection Office every six months for the spares and accessories for which repair facilities ( approved or otherwise) are not available within the country" .
(c) The existing condition appearing in col . 4 , against S. No. 15 , shall be deleted .
(1) In col . 4, in condition No. ( i ) against S. No. 1 , the mini- mum export price shall be read as Rs . 6/ - .
(g) In col . 4, against S. No. 3 , them inimum export price shall be read as Rs . 10/- .
(h) In col . 2, the existing entries appearing against S. No 4( ii) (7) and 39 rerpectively shall be substituted by the following:-
"4( ii ) (7) -Frogs which are processed for export in units which are engaged essentially for pro- cessing marine precis for the purpose of export.
39. Processed Timber as defined in the Import and Export Policy (Volume 11)" .
(i) In col. 2, the following item shall be added after S. No. 43 ( iv) : -- "43 (v) -Noil / Noil Droppings" .
(j ) In col. 2, the existing entry appearing against S. No. 44( i) shallbe substitued by the following:-
"Rayon Tyro Yarn of 600 deniers and above" . (iv) In OGL-4-
(a) In col , 2. the existing entry appearing against S. No. 4A shall be substituted by the follow- ing:- "Castor Oil when exported to Rupee Payment Areas".
