सा० का ० नि० 338 ( घ) केन्द्रीय सरकार , भारतीय पत्तन अधिनियम, 1908 ( 1908 का 15 ) की धारा 35 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और मुम्बई पत्तन मार्गदर्शन और अन्य कार्य (फीस ) आदेश, 1975 को अधिक्रान्त करते हुए उन बातों के सिवाय जिन्हें ऐसे अधिक्रमण के पूर्व किया गया है या करने का लोप किया गया है, मुम्बई पत्तन में मार्ग- दर्शन और अन्य कार्यों के लिए फीस के उद्ग्रह्ण को विनियमित करने के लिए निम्नलिखित आदेश करती है, अर्थात्: -
आवेश
1983है । 1. संक्षिप्त नाम और प्रारम्भ ( 1 )-इस आदेश का संक्षिप्त नाम मुम्बई पत्तन मार्गदर्शन और अन्य कार्य ( फीम ) आदेश,
(2) यह तुरन्त प्रवृत्त होगा ।
2. परिभाषाएं इस आदेण में,
(क ) तटवर्ती जलयान से ऐसा जलयान अभिप्रेत है जो भारत के किसी पत्तन या स्थान से भारत के किसी अन्य पत्तन या स्थान को समुद्रमार्ग से यात्रियों का माल के लाने ले जाने का कार्य करता है । किन्तु यदि कोई जलयान या नाव या बजरा अथवा देणी नाथ जिसमें चौकोर बड़े-बड़े पाल न लेने हों ( मुम्बई पत्तन को सीमा के भीतर किसी विदेश- गामी जलयान को या मे यात्रियों और/या माल के लाने से जाने में स्वयं को लगाती है तो उक्त जलयान या नाव *सा० का० नि० 375 (अ) दिनांक 1-7-75

या बजरा अथवा देशी नाथ ( जिसमें चौकोर बड़े बड़े पाल त तने हों ) को इस आदेश के अधीन दरों के मापमान के प्रयोजनों के लिए तब तक विदेणगामी जलयान ममआ जाएगा जब तक कि उससे यात्रियों या माल के उतारने का काम पूरा नहीं हो जाता है ,
(ख ) विदेशगामी जलयान से ऐसा जलयान अभिप्रेत है जो भारत के किसी पत्तन या स्थान और किसी अन्य पत्तन या स्थान अथवा भारन के बाहर पत्तनों का स्थानों के बीच व्यापार में लगा हुआ है ,
(ग) पत्तन में मुम्बई पत्तन अभिप्रेत है,
(घ) पाल जलयान से किसी भी वर्णन का ऐसा जलयान अभिप्रेत है, जिसके लिए केवल पाल लगाकर नौपरिवहन के लिए पर्याप्त माल-क्षेत्र का प्रबन्ध किया गया है , चाहे वह नोदन के यांत्रिक साधनों से युक्त है या नही और उसमें पतवार- नौका या डोगी सम्मिलित है, किन्तु उसमें मनोरंजन या बिहार यान सम्मिलित नहीं है ,
(ङङ) " अनुसूची" से इस आदेश की अनुसूची अभिप्रेत है ।
3. मार्गदर्शन (पाइलटेज) आदि के लिए फीसः-( 1 ) स्टीमरों या पालजलयानों, जिनमें सरकारी जलयान और किराए पर लिए गए परिवहन के साधन भी सम्मिलित है, किन्तु भारतीय और विदेशी युद्ध जलयान सम्मिलित नहीं है, के सक्ल रजिस्ट्री कुल टनभार पर जलयानों के मार्गदर्शन और परिवहन के लिए फीस वह होगी जो प्रथम अनुसूची में विनिर्दिष्ट है ।
( 2 ) भारतीय और विदेशी युद्ध जलयानों के मार्गदर्शन, ( पाइलटेज ) और परिवहन के लिए फीम वह होगी. जो द्वितीय अनुसूची में विनिर्दिष्ट है ।
4. मास्टर पाइलटों और पाइलटेज के लिए उपस्थिति फीस और रोके रखने की फीसः ( 1 ) तटवर्ती जलयान की दशा में 140 रुपये की और विदेशगामी जलयान की दशा में 220 रु ० की उपस्थिति फीस उस स्थिति में प्रभारित की आएगी , जिसमें कौहें पाइलट जलदान पर आता है और उसे सूचित किया जाता है कि उसकी सेवाएं अपेक्षित नहीं है , या हर छह घंटे की उपस्थिति या प्रथम छह घंटे के अतिरिक्त उसके भाग के लिए निम्नलिखित दशाओं में ( पाल जलयानों को छोड़कर ) उक्त फीम प्रभारित की जाएगी, अर्थात्: -
( i) जब कोई भास्टर पाइलट या पाइलट बन्दरगाह में जलयान के परिवहन के लिए नियुक्त किया जाता है और जलयान के परिवहन बन्दरगाह में लाये जाने या बन्दरगाह से ले जाये जाने के लिए तैयार है या जब कोई पायलट नियुक्त किया जाता है और जलयान समुद्र में जाने के लिए तैयार नहीं है या जब मास्टर पाइलट या पाइलट मे जलयान में पुनः लंगर डालने की मांग की जाती है,
( ii ) जब कोई जलयान डॉक से बाहर लाये जाने के पश्चात् अभिभारित होने के कारण रोक लिया गया है ।
( 2 ) जब अपरिहार्य परिस्थितियों में , मास्टर पाइलट या पाइलट से पोत पर काम के लिए उपस्थिति होने की अपेक्षा की जाए, तो प्रत्येक छः घंटे के लिए या प्रथम छः घंटे के अतिरिक्त उसके भाग के लिए जिसके दौरान वह पत्तन की सीमाओं से बाहर है और जब तक वह मुम्बई वापस नहीं आ जाता है , निम्नलिखित फीस ली जाएगी । अर्थात्: -
(क) 70 रुपये तटवर्ती जलयान पर,
(ख) 110 रुपये विषेशगामी जलयान पर ।
5. जलयान मोचने की फीस मुगल या रिट्शी शुष्क डाक में शुष्क डांक करने वाले सभी जलयानों से निम्नलिखित दरों पर खींचने की फीस ली जाएगी. यदि उसके पहले हेड कास्ट यान के लिए लंगर डाला जाता है और उसके पश्चात् उन्हें शुष्क डॉक में खींचा जाता है , अर्थात्:--
(क) 177 रुपये, तटवर्ती जलयान पर,
(ख) 279 रुपये विवेणगामी जलयान पर ।
परन्तु उम स्थिति में कोई फीस नहीं ली जाएगी, जब जलयान सीधे मुगल या रिट्शी शुष्क डॉक को जाता है ।
6. बन्दरगाह मास्टर की उपस्थिति फीसः-जहां उप संरक्षक यह समझता है कि बन्दरगाह मास्टर की उपस्थिति आवश्यक है और वह ऐसी उपस्थिति की व्यवस्था करता है, वहां तटवर्ती जलयान के संबंध में 207 रुपये और विदेशगामी जलयान के संबंध में 326 रुपये की वर से फीस इस आदेश के अधीन प्रभार्य परिवहन या मार्गदर्शन (पाइलटेज ) फीस के अतिरिक्त निम्नलिखित कार्यों के लिए उद्गुहीत की जाएगी:-
(क ) लंगरों की परीक्षा करने या उन्हें उठाने या डालने या पुनः डालने या लंगरों या जंजीर को ढूंढने के लिए , 3

(ख) प्रपुंज तेल जलयान को तेल बर्थ तक या वहां से ले जाने के लिए,
( ग) किसी जलयान को ब्रेक अप भूमि पर रखने के लिए,
(घ) ऐसे जनयान में काम पर उपस्थिति होने के लिए, जिसमें आग लग गई हो या जो किसी अन्य विशेष परिस्थिति मेंहो ।

1. जलयान के टनभार की गणना करते समय 0.05 और इससे अधिक के अंकों को एक टन माना जायगा तथा 0.50 से कम के अंकों को गणना में नहीं लिया जायेगा ।
2. पैरा 4 और 5 में अन्यथा उपबन्धित के सिवाय उपरोक्त दरों पर फीस के अन्तर्गत , किसी पाइलट की जलयान पर आने के समय से 6 घटे की अवधि तक पत्तन में प्रवेश करने वाले या पत्तन से बाहर जाने वाले किसी जलयान के संचलन , लंगरगाही ( एंकरेज ) या लंगर डालने से संबद्ध सभी प्रकार के कर्तव्यों के लिये पाइलट की सेवाएं आती हैं किन्तु यदि 6 घंटे ने अधिक के लिये उसकी सेवा अपेक्षित हो, तो यथास्थिति, अतिरिक्त परिवहन या उपस्थिति फीस प्रभारित की जायेगी ।
5. ऐसे स्टीमरों में जो तटवर्ती स्टीमर की परिभाषा के भीतर आते है और जिनके लिये मुम्बई पत्तन के न्यासा बोर्ड द्वारा डाक हारजर बाल में नियमित बर्थों की व्यवस्था की गई है उस समय मार्गदर्शन फीस प्रभारित नहीं की जायेगी जब ऐसे स्टीमरों का उनके अनुबन्ध मास्टरों द्वारा अपने बर्थ मे मीधे खुले समुद्र तक और खुले समुद्र से सीधे अपनी बर्थ तक मार्गदर्शन किया जाना है । जन्य सभी मामलों में ऐसे स्टीमरों पर सामान्य मार्गदर्शन फीस प्रभारित की जायेगी ।
4. किसी जलयान को या बन्दरगाह अथवा डाक में नौकर प्वाइंट पर ले जाने के बूचर द्वीप, होग द्वीप या नौकर प्वाइंट से सीधे समुद्र में या किसी अन्य स्थान पर ले जाने के लिये लंगर डालने के लिये या सीधे समुद्र से या किसी अन्य स्थान से उसे बूचर द्वीप, होग द्वीप या लिये और परीक्षण यात्रा पर जा रहे जलथानों के लिये यथास्थिति धारा या डाक तक एक ही बार 6

भार्गदर्शन फीस प्रभारित की जायेंगी किन्तु जब कोई ऐसा जलयान जो बूचर द्वीप, होग द्वीप या नौकर प्वाइंट से समुद्र की ओर जा रहा है , अपने मास्टर की इच्छानुसार वन्दरगाह में लंगर डालता है, तो धारा से मार्गदर्शन फीस का डेढ गुणा प्रभारित किया जायेगा ।
5. किसी जलयान को सीधे पीर पाओ से समुद्र में लाने या समुद्र में सीधे पीर पाओ को ले जाने के लिये मार्गदर्शन फीस और नमुद्र से डाक तक की दर की आधी फीस प्रभारित की जायेगी और किसी जलयान को पीर पाओ से किसी बर्थ तक या डाक तक ले जाने के लिये था लंगर डालने के लिये या इसके विपर्ययेन के लिये समुद्र से डाक तक की दर पर एकल मार्गदर्शन फीस प्रभारित की जायेगी ।
6. जब कोई जलयान टंकी की गैस मुक्त करने के प्रयोजन से पत्तन की सीमा से बाहर जाता है और किसी जलयुक्त या शुष्क डाक में प्रवेश करने हेतु पनन में वापस आ लौटता है तो उससे आधी बहिर्गमन और आधी अन्तर्गमन मार्गदर्शन फीस उद्गृहीन की जायगो ।
7. ( i) जब किसी पाइलट को जलयाग समुद्र में ले जाने का आदेश दिया जाता है और वह यह पाता है कि जलयान के समुद्र में प्रस्थान करने से पूर्व कम्पास को व्यवस्थित करना या परीक्षण यात्रा करना आवश्यक है तो , यथास्थिति धारा , या डाक से अतिरिक्त मार्गदर्शन फीस की आधी यदि जलयान पाइलट स्टेशन की सीमाओं से बाहर नही जाता, प्रभारित की जायेगी ।
7. ( ji ) यदि जलयान पाइलट स्टेशन से बाहर प्रस्थान कर जाता है और पुनः बन्दरगाह में वापस जाता है तो अन्ततः जलयान को समुद्र में ले जाने के लिये सामान्य मार्गदर्शन फीस के अतिरिक्त धाग से या डाक से अतिरिक्त पूर्ण मार्गदर्शन फीस की प्रभारित की जायेगी ।
( iii) यदि किसी पाइलट से कंवल कम्पासों को व्यवस्थित करने की अपेक्षा की जाती है , चाहे पाइलट स्टेशन में या उसके बाहर जो यथास्थिति धाराया ठाक से आधी मार्गदर्शन ( पाइलटेज ) फीस प्रभारित की जायेगी ।
( iv ) पाइलट उपर्युक्त सेवाओं के लिये जलयान के मास्टर से एक प्रभाणपत्र प्रस्तुत करेगा ।
8. जलयान के अभिकर्ता या स्वामी के अनुरोध पर पाइलट स्टेशन के बाहर जलयान को रोकने के लिये निम्नलिखित प्रभार लिया जायेगा:-
172 रुपये
(क ) तटवर्ती जलयान
272रुपये
(ख ) विदेशगामी जलधान
9. ऐसे जलयान में जिसे पाइलट स्टेशन छोड़ने के पश्चात् मौसम की खराबी के कारण था कोई नुकसान होने के परिणामस्वरूप पत्तन मे पुनः प्रवेश करना पडता है पूर्ण मार्गदर्शन ( पाइलटेज ) फीस प्रभारित की जायेगी ।
10. दि पाइलट को पाइलट स्टेशन पर छोड़ जाने से पूर्व किमी बर्बाह्रगामी जलयान को मौसम की खराबी के कारण या कोई है तो पूर्ण अन्तर्गमन मार्गदर्शन ( पाइलटेज ) फीम और पूर्ण बहिर्गमन मार्गदर्शन पाइलट फीम जब वह समुद्र में पुन जाये, प्रभारित की जायेगी ।

NOTIFICATION
New Delhi , the 16th April , 1983
G.S.R.338 (E) . In exercise of the powers conferred by sub - section ( 1 ) of section 35 of the Indian Port Act 1908 ( 15 of 1908 ) and in supersession of the port of Bombay Pilotage and other services (fees ) order, 1975 , (* ) except as respects thing done or omitted to be done before such supersession , the Central Government hereby makes the following order , for regulating the levy of fees for pilotage and other services in the Port of Bombay, namely :-
ORDER
1. Short title and commencement . ( 1 ) This order may be called the port of Bombay Pilotage and other ser- vices ( fecs ) Order 1983. (2) It shall come into force at once .
2. Definitions . In this Order-
( a) " Coasting vessel " means a vessel engaged in the carriage by sea of passengers or goods from any port or place in India to any other port or place in India . However , if any vessel or boat or barge or country craft (not square rigged) employces itself in the carriage of passengers and/ or goods to or from a foreign going vessel within the limits of the port of Bombay, then the said vessel or boat or barge or country craft (not square rigged ) shall be treated as a foreign going vessel for the purposes of the scale of rates under this order until disembarkations of passengers or discharge of goods therefrom is completed .
(b) " Foreign going vessel " means a vessel employed in trading between any port or place in India and any other port or place or between ports or places outside India .
(c) " port" means the port of Bombay .
(d) " Sailing vessel " means any description of vessel provided with sufficient sail area for navigation under sails alone, whether or not fitted with mechanical means or propulsion and includes a rowing boat or canoe , butdoes not include a pleasure craft .
(e) " Schedule" means a Schedule to this Order .
3. Fees for pilotage, etc. ( 1 ) Fees for pilotage and transporting of vessels on the gross registered tonnage of steamers or sailing vessels including Government vessels and hired transports out excluding Indian and foreign vessels - of- war shall be as specified in the First Schedule .
(2) Fees for pilotage and transporting Indian and foreign vessels of war shall be as specified in the Second Schedule .
4. Attendance and detention fees for Master Pilots and Pilots .-(1 ) An attendance fee of Rs . 140 and Rs . 220 in the case of a coasting vessel and foreign-going vessel , respectively, shall be charged, where a pilot boards a vessel and is informed that his services are not required , or for each six hours attendance or part thereof in excess of the first six hours , in the following cases ( except sailing vessels) , namely :-
( i ) When a Master Pilot or a Pilot is appointed to transport a vessel in the harbour and the vessel is not ready to move or to dock or undock or when a Pilot is appointed and the vessel is not ready to proceed to sea or when a Master Pilot or Pilot is requisitioned to re - moor a vessel ;
( ii ) When a vessel after being brought out of a dock is detained on account of being overladen .
(2) When in circumstances of unavoidable necessity a Master Pilot or Pilot is required to attend a ship , the following fees shall be charged for every six hours or part thercof in excess of the first six hours during which he is beyond the limits of the port and until he returns to Bombay , namely :-
(a) Rs . 70, in respect of a coasting vessel;
(b) Rs . 110, in respect of a foreign -going vessel .
5. Warping Fees . All vessels dry docking in Mogul or Ritchie dry Dock shall be charged warping fees at the following rates if first moored to the Head Fast Bucy and thereafter warped into Dry Dock , namely :-
(a) Rs . 177 , in respect of a coasting vessel;

(b) Rs . 279 , in respect of a foreign- going vessel ;

Provided that there shall be no charge if the vessel proceeds direct to Mogul or Ritchie Dry Dock .
6. Harbour Master's Attendance Fees . Where the Deputy Conservator considers that the attendance of the Harbour Master is necessary and provides such attendance , a fee at the rate of Rs . 207 in respect of a coasting vessel and Rs . 326 in respect of a foreign - going vessel shall, in addition to any transporting or Pilotage fees chargeable under this Order , be levied :-
( a ) for examining or lifting or laying or re -laying moorings or recovering anchors , or chain ;
(b) for taking a bulk oil vessel to or from an oil berth ;
(c) for putting a vessel upon the break up ground;
(d) for attending a vessel on fire or in any other special circumstances .

Notes to First Schedule
1. In reckoning tonnage of a vessel , figures 0.50 and more shall be taken as one tonue and figures below 0.50 shall be ignored .
2. Save as otherwise provided in paragraphs 4 and 5, fees at the above rates shall cover the services of a Pilot for all duties connected with the movement , anchorage or mooring of a vessel entering or leaving the port for a period of 6 hours from the time of the pilot's joing the vessel , but if his services are required for more than 6 hours , an additional Transporting or Attendance fee , as the case may be , shall be charged .
3. Steamers which come within the definition of " Coasting Steamers " and for which regular berths have been provided by the Board of Trustees of the port of Bombay at the Dock Harbour Walls shall not be charged Pilot- age fees . when such steamers are piloted direct from their berths to the open sea or vice- versa by their Licensed Masters . In all other cases , the usual Pilotage fees shall be charged on such steamers .
4. For taking a vessel from Butcher Island, Hog Island or Nocar Point to sed direct or to any pomt or moor- ing in the Harbour or Dock or vice - versa , and for vessels proceeding on a trail-trip a single Pilotage fee from stream or dock , as the case may be , shall be charged , but when a vessel proceeding to sea from Butcher Island, Hog Island or Nocar Point is . at the wish of the Master , anchored in the Harbour one and a half pilotage fee from stream shall be charged
5. For taking a vessel from Pir Pau to sea direct or vice - versa a pilotage fee and a half at the sea- to - dock rate shall be charged and for taking a vessel from Pir Pau to any berth or mooring in the harbour or to dock , or vice- versa , a single pilotage fee at the sea to dock rate shall be charged.
6. When a vessel proceeds out of Port limits for the purpose of rendering the tanks gas - free and returns to Port to enter a wet or dry dock . half outward and half inward pilotage fees only shall be levied.
7. (i) When a pilot is ordered to take a vessel to sea, and it is found that , before the vessel proceeds to sea , it is necessary to adjust compasses or make a trial - trip , an extra half pilotage fee from stream or dock , as the case may be, shall be charged, if the vessel does not proceed beyond the Pilot Station limits .
(ii) If, however , the vessel proceeds beyond the Pilot Station and returns to harbour again , an extra full pilot- age fee from stream or dock , as the case may be in addition to the ordinary pilotage fee for ultimately taking the vessel to sea , shall be charged.
(iii) If a pilot is required for adjusting compasses only, whether inside or outside the Pilot Station , half pilotage ee from stream or dock , as the case may be shall be charged .

(iv) Pilots shall produce a Certificate from the Master of the vessel for the above services .
8. For intercepting a vessel outside the pilot station at the request of the Agent or Owner of the vessels , the charge will be as under: -

9. A vessel which , having left the Pilot Station , is compelled to re - enter the portby stress of weather or in consequence of having sustained any damage , shall be charged the full Pilotage fee .
10. If before the pilot is discharged at the Pilot Station , an outward bound vessel is compelled to re- enter the Port by stress of weather or in consequence of having sustained any damage , a full inward pilotage fee and a full outward pilotage fee when she proceeds to sea again shall be charged.
11. For piloting a tug in tow of another barge or barges , fees at the above rates shall be levied on the aggre- gate gross Registered Tonnage of the tug and the barge or barges in tow .
