विषय --1981-83 के लिए जापान सरकार द्वारा प्रयत्न येन 2/134 बिलियन (थेन 2,134,653,000 ) (ऋण नहायता ) की जापानी अनुदान-पहायता के अंतर्गत सार्वजनिक क्षेत्र के आयातों के मबंध मे लाइसेंस शतें।
मिसिल सं ० आई० पी० सी०/ 23 ( 1 )/83 से जारी --1981-82 के लिए जापानसरकार द्वारा प्रवत्त येन 3,1.34 विलियन (थेन 2,134,653,000 ) (ऋण महायता ) की आपानी अनुदान सहायता के अंतर्गत सार्वजनिक क्षेत्र के श्राधानो के सबंध में लाइसेंन शर्तों को लागू होने दाली जैसी शर्तों (1-10-1981 में 30-9-1982 तक) इस सार्वजनिक सूचना के परिशिष्ट में दी गई हैं वे जानकारी के लिए अधिसूचित की जाती हैं ।

आपान की सरवार द्वारा प्रदान किए गए 1981-82 के लिए 1-10-1981 से 30-9-1982 तक 2,134 विलियन ( येन 2,134,653,000 ) (ऋण सहायता) की जापानी अनुदान महागता के अंतर्गत सार्वजनिक क्षेत्र के श्रायानों के संबंध में लाइसेस शर्ने ।
खण्ड -1: सामान्य शर्ते
1 ( 1 ) जापान की भरकार द्वारा प्रदान की गई 2,134 बिलियन जापानी अनुदान महायता भारत के अलावा ओ ० ई० मी० डी० भौर विकाम- शील देशो के हक में संगठित की गई है । तवनुमार , इस ऋण के अधीन अधिप्राप्त की जाने वाली पण्म वस्तुएं और उनसे संबंधित प्रासंगिक सेवाएं जापान और अनुबन्ध -1 की सूची में उद्धत सभी देशों से आयात की जा आ सकती है । ये देश इस अनुदान के अमर्तत पात्र स्रोत वेश होंगे । इस अनुदान महायता के श्रग्रीन जो पाव मर्ने थायात की जा सकती है उनकी सूची अनुबंध 3 में दी गई है ।
1 ( 3 ) लाइसेंस पर एक र्श/र्षक 1981-82 के लिए 2,134 विलियन आपानी अनुदान महायना होगा । प्रथम और द्विर्तीथ प्रत्यथ के लिए लाइसेम संकेत " एम० जे० एनी०" होगा ये प्रस्थय मुख्य नियंत्रक, आयात-निर्यात के लिए आयात लाइसेस के अंग्रेधिन पत्त्र में भी बुहगए जाएगे ।
1 ( 3 ) बैंक स्त्रर्थ, जिनका प्रेषण गामान्य बैंक प्रणाली के माध्यम से किया जा सकता है , के अतिरिक्त विदेशी मुद्रा के किसी भी प्रेषण की अनुमति आयात लाइसेस के प्रति महीं दी जाएगी । भारतीय अभिकर्ता के कमीशन के प्रति कोई भी भुगतान अभिकर्ता को भारतीय म्पए से चुकाना चाहिए । लेकिन, ऐमे भुगतान लाइसेस मूल्य के ही भाग होगे और इमलिए लाइसेंस पर ही प्रभावित किए जाएगे ।
1 ( 4 ) श्रायात लाइमेग लागत बीमा भाड़ा के आधार पर 12 महीनो की प्रारम्भिक वैध अवधि के साथ आरी किया जाएगा ।

लाइसेंस की वैधता में वृद्धि के लिए लाइसेंस धारी को संबद्ध लाइसेंस प्राधिकारी से संपर्क करना चाहिए जो इस मामले में आर्थिक कार्य विलग (जापान अनुमाग) से परामर्श करेगा ।
1 ( 5 ) पक्के आदेश अनुबंध । में उल्लिखित जापान या अन्य पात्र देशों में स्थित विदेशी संभरको को लागत और भाड़ा के आधार पर दिए जाने चाहिए और वे ( आयाम लाइसेंस जारी होने की तिथि से 4 महीने की प्रवधि के भीतर अवर सचिव (टीए ) आर्थिक कार्य विभाग ( जापान भनुभाग ) , मार्थ ब्लाक , नई दिल्ली को भेज दिए जाने चाहिएं । " पक्के आवेशों" का अर्थ विदेशी सभरकों को भारतीय लाइसेंसधारी द्वारा विए गए उन क्रय आदेशों का क्रय संविदाओं से है जो भारतीय लाइसेंसधारी से प्राप्त आदेश पुष्टि करने के बाद विवेशी संभरक द्वारा विधिवत समर्थित हों या भारतीय श्रायातक और विवेशी संमरेक द्वारा विधिवत हस्ताक्षरित हों । विदेशी संभरकों को भारतीय अभिकर्ताओं के आदेश और/ या भारतीय अभिकर्ताओं द्वारा पुष्टिकरण आदेश स्वीकरणीय नही है ।
1 ( 6 ) चार महीनों की श्रधि के भीतर ठेकों की इस शर्त का सब तक भ्रमुपालन किया गया नही समझा जाएगा जब तक कि ठेके के पूर्ण दस्तावेज श्रयान लाइसेंस जारी होने का तिथि से चार महीनों के भीतर वित्त मंत्रालय , मार्थिक कार्य विभाग, जापान अनुभाग को नहीं पहुंच जाते हैं । यदि उपर्युक्त पैरा 1 ( 5 ) में यथा उल्लिखित पक्के आदेश चार महीनों के भीतर वैध कारणों से नहीं दिए जा सकते हैं तो चार महीनों के भीतर आदेश क्यों नहीं दिए जा सके इन कारणों का उल्लेख करते हुए लाइसेंसधारी को आयात लाइसेंस को संबद्ध लाइसेस प्राधिकारी को प्रस्तुत कर देना चाहिए । आदेश देने की अवधि में वृद्धि के लिए ऐसे आवेदनों पर लाइसेंस प्राधिकारियों द्वारा पात्रता के आधार पर विचार किया जाएगा । वे अधिक से अधिक चार महीनों की और अबधि के लिए वृद्धि प्रश्शन कर सकते हैं । लेकिम , यदि वृद्धि इम लाइसेंस के जारी होने की तिथि से 1 महीनों से अधिक के लिए मांगी जानी है तो ऐसे प्रस्ताव निरपवाद रूप से लाइसेंस प्राधिकारियों द्वारा वित्त मंत्रालय मार्थिक कार्य विभाग ( जापान अनुभाग) नार्थ ब्याक नई दिल्ली को भेजे जाएंगे जो कि ऐसी वृद्धि के लिए प्रत्येक मामले की पात्रता के आधार पर विश्वार करेगे और अपना निर्णय लाइसेंस प्राधिकारियों को भेजेगे जिसे वे लाइसेंसधारी को प्रेषित करेंगे ।
पोन लदान के लिए आखिरी तिथि निश्चित करने में इस बात का ध्यान रखना चाहिए कि यह तिथि 31-3-1984 के बाद की न हो ।
खण्ड-2 संभरण ठेके का समझौता करते समय ध्यान में रखी जाने वालो विशेष बातें:-
2. ( क ) ठेके का लागत और भाड़ा मूल्य येन या यू ० एस० डॉलर या पौष्ठ स्टलिंग में एक येन, एक सेस्ट या एक पेमी से कम की भिन्न के बिना ही अधिव्यक्त होना चाहिए । और इसमें भारतीय श्रभिकर्ता का कमीशन यदिकोई हो तो यह शामिल नहीं होना चाहिए जो कि भारतीय रुपए में चुकाना जाहिए । भारतीय रुपए या किसी अन्य मुद्रा में ठेके का मूख्य किसी भी परिस्थिति में अभिब्यक्त नहीं होना चाहिए। जहाज पर्यन्त निःशुल्क लागत- बीमा और भाड़ा धनराशि अलग-अलग प्रशित की जा सकती है परन्तु ठेके में बात स्पष्ट कर देनी चाहिए कि भाड़े का खर्चा बास्तबिक आधार पर बेथ होगा या ठेके में निरिष्ट किए गए भाड़े का खर्च वास्तबिक खचों के अति- रिक्त वेय धनराशि होगी ।
(ख ) संविदा में नकद भ्राधार पर अर्थात् बैंक आफ इंडिया , टोकियो को जापासी संभरकों द्वारा पोसलवान दस्तावेजों को प्रस्तुत करने पर भुगतान की व्यवस्था होनी चाहिए ।
(ग) क्रय भावेण और संभरक द्वारा पुष्टिकरण आदेश केवल अंग्रेजी में होने चाहिए ।
2 ( 2 ) आयात लाइसेंस के विपरीत केवल एक संविदा की जानी चाहिए । विशेष मामलों में एक से अधिक संविदा की प्रविष्टि की अनुमति दी जा सकती है जिनके लिए वित्त मंत्रालय , आर्थिक कार्य विभाग से आयात लाइसेंस जारी होने की तिथि के तत्काल बाद पूर्व अनुभोदन ले लेना चाहिए ।
2( 3) संभरक को पालता
संभरक पात्र होत देणों का राष्ट्रिक होगा या पाक्त स्रोत देशों में पंजीकृत और समाविष्ट न्यायिक व्यक्ति होगा ।
खण्ड-3 मं भरक निम्नलिखित ठेको की शर्त विशेष रूप से ममाविष्ट होनी चाहिए । 3 ( 1) 1981-84 के लिए 2,134 बिलियन के अमुदाम महायता से संबद्ध इस संविदा की व्यवस्था 1 फरवरी , 1983 को भारत और जापान की सरकार के बीच हुए समझोले के अनुसार की गई है ।
3 ( 2 ) विदेशी संभरकों को भुगतान उम "भुगतान के लिए प्राधिकार-मत्र ' (ए०पी ० ) के माध्यम से किया जाएगा जो 1981-82 के लिए जापानी अनुदान सहायता के अधीन बैंक आफ इंडिया, टोकियो के नाम में सहायता एवं लेखा परीक्षा नियंत्रक वित्त मंत्रालय , आर्थिक कार्य विनाग , यू० सी० श्रो बैंक विल्डिग पार्लियामेन्ट स्ट्रीट , नई दिल्ली -110001 द्वारा जारी किया जाएगा ।
3 ( 3 ) विदेशी संभरक ऐसी सूचना और दस्तावेजों को प्रस्तुत करने के लिए सहमत होगा जो एक ओर भारत सरकार द्वारा और दूसरी और जापाम सरकार द्वार। अपेक्षित हो ।
3 (4) उस मामलें में जिसमें संभरक जापान में स्थित हो और भारतीय दूतावाम टोकियो के परामर्श से पोचलवान की व्यवस्था करने को तैयार है और उसके लिए संबंधित माल की मुपुर्दगी के कार्यक्रम की भारतीय दूतावास टोकियो को सूचना देगा और अपेक्षित पोत परिवहन के लिए कम से कम 6 सप्ताह से पहले ही भारतीय दूतावास टोकियो को अधिसूचित करवाएगा जिसमे उचित व्यवस्था की जाए । विशेष मामलों में जहा भारतीय श्रायानक यहायता हो तो अधिसूचना की अवधि कम को जा सकती हैं । आवश्यक म्यौरे देते हुए पोतलदान के बाद जापानी संमरक को आयातक को केवल सूचना भेजेने के लिए भी सहमत होना चाहिए । और उसकी एक प्रति भारतीय दूतावास टोकियो को भेजी जानी चाहिए ।
खण्ड-4: भारत सरकार द्वारा ठेके का अनुमोदन:
4 ( 1 ) जैसे ही श्रादेशों को अन्तिम रूप दे दिए जाते हैं, लाइसेंसधारी को दोनों पार्टियों द्वारा विधिवत हस्ताक्षरित ठेके की चार प्रतियां या समुद्र पाम संभकों को भारतीय श्रायातक द्वारा दिए गए क्रय आदेश के साथ समुद्र पार संभरक द्वारा लिखित रूप में पुष्टिकरण आवेश की चार, प्रतियां या उनकी सभी प्रकार से पूर्ण फोटो प्रतियों के साथ अनुबंध 3 के प्रपत्त में " ए० पी ० जारी करने के आगेवम" की 2 प्रतियों सहित संगतबध आयात लाइसैंस की वो फोटो प्रतियां अवर सचिव ( टी० ए ० ) माथिक कार्य विभाग वित्त मंत्रालय, मार्थ ब्लाक, नई दिल्ली को भेजनी चाहिए । उपर्युक्त प्रक्रिया संविदा की विषयवस्तु या उसकी कीमत के आवश्यक आशोधनों से उत्पन्न सभी संविवा संशोधनों के लिए भी लागू होंगों ।
4 ( 2 ) यदि ठेके के दस्तावेज " ए/ पी" जारी करने के लिए 'आबेदन पक्ष' और अन्य संबंधित दस्तावेज सही पाए जाएंगे तो बिटन मंत्रालय ( आर्थिक कार्य विभाग) जापान अनुभाग ठेके का अनुमोदन करेगा और उपर्य क्त ( 1) में उल्लिखित वस्तावेज के एक सेट को सहायता लेखा एंव लेखा परीक्षा नियंत्रक और भारत के राजदूतावास टोकियो और भारत में जापान के राजदूतावास को भेजने की व्यवस्था करेगा ।

भाग 1-खंड 1 ]
4 ( 3 ) उपर्युक्त ( 2 ) मे उल्लिखित दस्तावेज की प्राप्ति के बाद महायता लेखा एवं लेखा परीक्षा नियंत्रक आर्थिक कार्य विभाग वित्त मत्रालय, पानियामेन्ट स्ट्रीट , मई बिल्ली-110001 बैंक आफ इंडिया , टोकियो के लिए अनुबंध -4 के रूप में विदेशी सभरको को भुगतान करने के लिए "भुगतान के लिए प्राधिकार पत्र ( एपी ) " जारी करेगा । एपी की प्रतियां भारत के राजदूताबास, टोकियो आयातक भारत में आयातक के बैंक और जापान अनुभाग आर्थिक कार्य विभाग बित्त मंत्रालय को पुष्ठा- कित की जाएगी ।
4 ( 4 ) भुगतान के लिए प्राधिकार पत्त्र (ए/पी ) की प्राप्ति के बाद बैंक आफ इंडिया टोकियो जापान की सरकार भारत के राजदूतावास टोकियो आयातक के भारत में बैंक सहायता लेखा एंथ लेखा परीक्षा नियंत्रक को सूचना देते हुए इम प्राप्ति की सूचना से संभरक को अवगत कराएगा ।
4 ( 5) पोतलदान प्रभावी करने के बाद विदेशी संभरक अपने बैकरो के माध्यम से ए/पी में उल्लिखित वस्तावेज बैंक आफ इंडिया, टोकियो को प्रस्तुत करेगा । यदि दस्तावेज सही पाए गए तो बैंक आफ इडिया टोकियो दस्तावेज में उल्लिखित धनराशि का विदेशी संभरक को उमने बैंकरों के माध्यम से रिहा करेगा ।
4( 6) , संभरक के लिए ए पी जारी करने के लिए और भुगतान की व्यवस्था करने के लिये बैंक आफ इडिया, टोकियो को देय बैंक खर्च, भारत में आयातक के सम्बद्ध बैंक द्वारा बैंक आफ इण्डिया टोकियो को प्रेषण द्वारा सामान्य बैंक प्रणाली से भारत सरकार के लेखे को प्रभावित किए बिना ही निर्धारित किए जाएगे ।
खण्ड-5: रुपया जमा करने का उत्तर- वायित्व:
में उपर्युक्त रुपया जमा करना चाहिए वह "के डिपोजिट्स एण्ड एडवान्सिज - 843-सिविल डिपोजिट्स -डिपोजिट्स फोर परणेजिग एमेट्टा एम्राड परचेस ग्रान्ट ऐंड फ्राम गवर्नमेंट आफ जापान फार 1981-82 ) येन 2,134 विलियम ग्रान्ट ऐड ऋण सहायता ।
5( 2 ) उल्लिखित धनराशि या तो भारतीय रिजर्व बैंक, नई दिल्ली मे या स्टेट बैंक आफ इण्डिया, नीम हजारी , दिल्ली में मरकार की साख में मकद जमा होनी चाहिए , या यदि वह सुविधाजनक न हो तो स्टेट बैंक आफ इण्डिया की किसी शाखा या इसके उपमगी किसी भी राष्ट्रीयकृत बैंक (हुण्डीकर्त्ता) से प्राप्त एक हुण्डी ( डिमाण्ड ड्राफ्ट ) के माध्यम से स्टेट बैंक आफ इण्डिया , तीस हुजारी शाखा दिल्ली-6 ( हुष्टी ग्राहक और प्रापक ) की सार्वजनिक सुचमा स ० 184-आईटीसी ( पीएन)/ 67 विनाक 30-8-68 , सं० 233-आईटीसी (पीएन)/ 68, दिनांक 24-10-68 स० 132-आईटीसी (पीएन) / 71 , विनांक 5-10-71 , सं० 74-आईटीसी ( पीएन )/ 74 विनाक 31-5-74 और सं ० 103- आईटीसी (पीएन )/ 76, दिनांक 12-10-76 मे निर्धारित सरकारी लेख में जमा भारने के लिए घन प्रेषण करना चाहिए ।
5( 3) मरकार द्वारा ऐसी माग किए जाने के बाव सात दिनो के भीतर मम्बद्ध भारतीय बैंक की ऊपर निर्धारित तरीके से वह अतिरिक्त धनराणि सेवा खर्षों के निमित भेजेगा जो भारत सरकारद्वारा मांगी जाए । जालान के विभिन्न कालमों को भरते समय आयातकों/ उनके बैंकरों को इस बात का सुनिश्चय कर लेना चाहिए कि सार्वजनिक सूचना म ० 103- आईटीसी (पीएन ) / 76 , विनांक 12-10-76 के साथ पढ़ी जाने वाली सार्व- जनकि सूचना सं ० 132-आईटीसी (पीएन ) / 71, विनाक 5-10-71 के पैरा 2 मे निर्धारित सूत्रना और सार्वजनिक सूचना सं ० 74-आईटीसी (पीएन )/7 + दिनांक 31-5-74 में भी निर्धारित सूचना चालान के कालम " धन परेषण और प्राधिकारी ( यदि कोई हो ) के पूर्ण ब्यौरे" में निरपवाव रूप मे निर्दिष्ट किए गए हैं । खजाना चालान में निम्मलिखित ब्यौरे मिरपवाद रूप में प्रस्तुत करने चाहिए.--|
(क) वित्त मन्त्रालय के भुगतान के लिए प्राधिकार पत्र सं ० और विनाक
(ख ) येन मुद्रा की वह धनराशि जिसके सम्बन्ध में अपनाई गई परि- वर्तन की दर के साथ निक्षेप किए जाने है ।
( ग ) विदेशी संभरक को भुगतान करने की तिथि ।
(घ ) चुकाए गए ब्याज की धनराशि और वह अवधि जिसके लिए यह गिना जाएगा । ।
( ङ) जमा की गई कुल धनराशि ।
5 ( 1 ) मूल विनियम पोन परिवहन दस्तावेज निरपवाद रूप से बैंया आफ इण्डिया, टोकियो द्वारा भारत में आयातक के सम्बद्ध बैंक को भेजे जाएंगे जो भारतीय स्टेट बैंक या किसी भी राष्ट्रीयकृत बैंक ( जो अनुबन्ध-3 के ओ में उल्लिखित है) की शाखा होगी उम बैंक को दस्ताबेजो केये विनियम सेट केवल इस बात का सुनिश्चय कर लेने के बाद ही सम्बद्ध आयातक को देने चाहिए कि विदेशी संभरक को चुकाई गई येन/यू० एस ० डालर/ पौण्ड स्टालिग धनराशि के बराबर रुपया उन मामला में जहा देने योग्य है ब्याज के खर्चे सहित संभरक को भुगतान कर विया है और उस धनराशि पर विदेशी संभरक को बैंक आफ इण्डिया, टोकियो द्वारा भुगता की तिथि से वास्तविक रुपया जमा करने की तिथि तक ही की अवधि पर पहले 30 विमो के लिए 9 प्रतिशत प्रतिवर्ष की वर से और शेष अवधि के लिए 15 प्रतिशत प्रतिवर्ष की दर से हिसाब लगाकर व्याज सार्वजनिक सूचना सं० 46-आईटीसी( पीएन) / 76 , दिनाक 16-6-76 के अनुभार सरकारी लेखा मे जमा कर विया गया है । ब्याज दोनो विनों, अर्थातजिस दिन विवेशी संभरक को भुगतान किया जाता है, और जिस दिन सरकारी लेने में रुपया जमा किया जाता है, के लिए वेय है । देखिए सार्बजनिक सूचना सं० 103-आईटीसी (पीएम) / 76, दिनाक 12-10-76 द्वारा संशोधित सार्बजनिक सूचना सं ० 74- आईटीसी ( पीएन ) / 74, विनाक 31-5-74 भुगतानों की येन/ यू० एस ० डालर/ पाँड धनराशि के बराबर रुपए की गणना करने के लिए अपनाई जाने वाली विनिमय दर मुख्य नियंत्रक, आयात-निर्यात की सार्वजनिक सूचना सं ० 8-आईटीसी (पीएम)/ 76, विनांक 17-1-78 मे निर्धारित मुद्रा, विनिमम की मिश्रित वर होगी या वह दर होगी जाकि मुख्य नियंत्रक, आयात-निर्यात की सार्वजनिक सूचनाओ के माध्यम से भारतीय रिजर्व बैंक के मुद्रा विनियम नियंत्रण परिपक्षों के माध्यम से सरकार द्वारा समय -समय पर अधिसूचित की जाए । इस संबंध में कोई भी परिवर्तन जब और जैसे ही आवश्यक होगा अधिसूचित कर दिया जाएगा । इस बात का सुनिश्चत करने का उत्तरदायित्व संबद्ध भारतीय बैंक का होगा कि आयात बस्ताबेज आयातकों को सौंपने से पहले ही बेय धनराशी सरकारी लेखे में सहीं रूप से जमा कर दी गई है । लाइसेंसधारी को भी यह सुनिश्चित कर देना चाहिए कि अपने बैंकरों के वस्तावेज लेने से पहले ही वेय धनराशि लेख्खे में सही रूप से जमा कर दी गई है । जिसे लेखा शीर्ष (ब्याज की गणना विदेशी संभरक को भुगतान की तिथि से मरकारी लेख मे समतुल्य रुपया जमा करने की तिथि तक की अवधि के लिए की मानी है ) ।
उसके पश्चात सी ० ए ० ए ० एण्ड ए ० द्वारा जारी किए गए भुगतान के लिए प्राधिकार पत्त्र का संदर्भ देते हुए और बीजक तथा पोत परिवहन वस्तावेजो को संलग्न करते हुए खजाना चालान रुपया जमा करने का साक्ष्य देते हुए पंजीकृत डाक द्वारा सी० ए ०ए ० एण्ड ए० को भेजा जाना चाहिए ।
टिप्पणी.- भारत में आयातक के बैंक का यह सुनिश्चय करना चाहिए कि रुपए का निक्षेप बैंक आफ इण्डिया, टोकियो से अदायगी की सूचना और अपरिवर्तमीय पोतलदान दस्तावेजो की प्राप्ति के दस दिनो के भीतर भिरपवाध रूप से किया जाना चाहिए और यह कि इसके तत्काल बाद सी ० ए ० ए ० एण्ड ए ० विस मंस्रालय ( अधिक नार्य विभाग ) नई दि को सूचित कर विया जाएगा ।
5(4) भारत में सम्बद्ध बैंक आफ इण्डिया, को लाइसेंस की मुद्रा विनियम निर्मक्षण प्रति वर रुपया निवेशों की धनराशि का पूष्ठांकन करना चाहिए और अपेक्षित "एम" प्रपत्न भारतीय रिजर्व बैंक आफ बभ्बई को भेजना चाहिए ।

खण्ड-6 : विविध शर्ते:
6(1). आयात लाइसेंस के उपयोग की रिपोर्ट:
भुगतान के लिए प्राधिकार पत्र जारी होने के बाद आयातक को पोत लवानों और उनके अधीन किए गए भुगतानों के सम्बन्ध में और जो पोतल- दान होने बाकी हैं उनके विषय में एक मासिक रिपोर्ट सी ० ए ० ए ० एण्ड ए ० आर्थिक कार्य विभाग , वित्त मंत्रालय , यू० मी ० ओ ० बैंक बिल्डिंग, संमद भार्ग , नई दिल्ली को भेजसी चाहिए ।
6 ( 2 ) . संभरकों को जिरोत्र शर्ते अधिसूचित करमाः
लाइसेंस धारी को चाहिए कि वे आयात लाइसेंस की उन विशेष शतौ से संभरक को अवगत करायें जो समझौते का पालन करने में संभरकों पर प्रभाव डाल सकती है ।
6(3). विवाद:
यह समक्ष लेना चाहिए कि लाइसेंन धारी और संभरकों के बीच यदि कोई विवाद उठेगा तो उसके लिए भारत सरकार कोई उत्तर दायित्व नहीं लेगी । बैंक आफ इण्डिया , टोकियो द्वारा भुगतानों से पूर्व संभरक द्वारा पूरी की जाने वाली शर्त साफ-साफ " भुगतान के नियम " के अधीन अमुबन्ध-1 में वर्शाई जानी चाहिए । विवादों से निपटने की शर्तें ठेके की शतों में शामिल होनी चाहिए ।
6( 4) . भविष्य अनुदेश:
आयात लाइसेंस या उसके संबंध में उठ खड़े होने वाले किसी मामले या सभी मामलों से सम्बन्धित जापान से 1981-82 के लिए अनुदान सहायता के अधीन सभी आभारों को पूर्ण करने के लिए भारत सरकार द्वारा समय -समय पर जारी किए गए निवेशों या अनुदेशों या आदेशों का लाइसेंसधारी को तुरन्त पालन करना होगा ।
6 ( 5 ) . अतिक्रमण या उल्लंघम:
उपर्युक्त खण्डों में स्थिर की गई शर्तों के अतिक्रमण या उल्लंघन करने पर आयात-निर्यात ( नियंत्रण) अधिनियम के अधीन उचित कार्रवाई की जाएगी ।

टोकियो के लिए भुगतान के लिए प्राधिकार पत्र जारी करने के लिए हम आपको निम्नलिखित ब्यौरे प्रस्तुत षवारते हैं:--
(क) भारतीय आयातक का नाम और पता ।
(ख) आयात लाइनेंस की स ० , विनाक और मूल्य और वह तारीख जिस एक वैध है ।
(ग) प्राप्ति के तरीके- क्या यह सीधे कथ या औपचारिक म्बुले अंतर्राष्ट्रीय निविदा पर आधारित है । इसके मामले में यदि कोई कारण हो तो कारण सहित यह संतित होनाचाहिए कि क्या संविदा का निर्णय उपयुक्न न्यूनतम तकनीकी प्रस्ताव के आधार पर किया गया है ।
(घ) माल का सक्षिप्त विवरण ।
(ङ ) माल का उद्गम देण ।
(च) मंविदा का कुल लागत भाड़ा मूल्य ( येन में) ।
(छ) यांदे कोई हो तो भारतीय रुपए में भुगतान की जाने वाली भारतीय एजेंट के कर्मशन की धनराशि ।
(ज) वह कुल लागत तथा भाड़ा मूल्य (येन में ) जिसके लिए भुगतान के लिए प्राधिकार पत्र की आवश्यकता है ।

प्रिय महोदय ,
1. आपके बैंक के साथ 13-3-79 को किए गए समझौते की शर्तों के अनुसार आपको एतद्वारा यथा संलग्न ब्यौरे ( जो परिशिष्ट में दर्शाए गए हैं ) के अनुसार सर्व श्री
के नाम में कियाजाता है । --येन धनराशि के भुगतान के लिए प्राधिकृत

2. कृपया भुगतान के लिए प्राधिकृत पत्र ( एपी ) की पावती के बारे में संभरका को सूचना दें और इसकी प्रत्येक सूचना पत्न की एक प्रति जापान सरकार आयातक बैंक , भारत के राजदुतावास, टोकियो और इस मंत्रालय को पृष्ठांकित की जाए ।
3. भुगतान के लिए प्राधिकार पश्न की शर्तों के अनुमार भुगतान परिशिष्ट में यथा सकेनित लवान दस्तावेजों के आधार पर किया जाएगा ।
4. आयातक द्वारा आपको दस्तावेज को भेजने आवि के लिए भाड़ों सहित अदा किए जाने वाले बैंकिग भाडे टोकियो में भारतीय दूतावाम/ आयातक के बैंक द्वारा निर्धारित किए जाएंगे ।
5. जैसे ही संभरक द्वारा प्रस्तुत किए गए लदान दस्तावेज के आधार पर आपके द्वारा कोई भी भुगतान किया जाता है तो इसकी सूचना निर्धा- रित प्रपत्त में मंत्रालय और आयातक को बैंक को भेजी जानी चाहिए ।
6. इम मन्त्रालय की विशेष अनुमति के बिना भुगतान के लिए प्राधि कार पम्न के लिए कोई भी सशोधन जारी नहीं किया जा सकता है ।
7. यह भुगतान के लिए प्राधिकार पत्त्रतक वैध रहेगा ।
प्रति निम्नलिखित को प्रेषित--
1. आयातक दिनांक- को उनके पन सं ० -के संदर्भ में ।
2. आयातक का बैंक उनसे निवेदन किया जाता है कि भारतीय बैंक आफ इंडिया, टोकियो , ब्रोच से दस्तावेज प्राप्त करने पर विदेशी संभरकों को येन यू एस डालर/ पौंड के बराबर रुपया जमा करने की व्यवस्था करें । विवेशी संभरकों को चुकाई गई धनराणि के बरा- बर रुपए की गणना सार्वजनिक सूचना सं 8 -आई टी सी ( पी एन ) 176 दिनांक 17-1-76 या अम्य ऐसी सार्वजनिक सूचना को समय -समय पर जारी की जाए, के अनुमार विदेशी मंभरकों को भुगतान करने की तिथि को यथा प्रचलित परिवर्तन की मिश्रित दर पर की जाएगी । विदेशी संभरक को भुगतान करने की तिथि में सरकार के लेखे में सुन्य रुपया जमा करने की तिथि तक की अवधि के लिए मार्वजनिक सूचना सं ० 46-आई टी सी ( पी एन )/ 76 वि० 16-6-76 के अनुसार पहले 30 दिमों के लिए 9 प्रतिशत वार्षिक वर पर और इसमे अधिक की गणना की गई अवधि के लिए 15 प्रतिशत की दर से ब्याज भी सरकारी लेखे में जमा कराना होगा । ब्याज दोनों दिनो के लिए विया जाएगा अर्थात् वह तिथि जिसको बिदेशी संभरक को भुगतान किया जाता है और वह तिथि भी जिमको मरकारी लेखे में रुपया निक्षेप किया जाता है । ( इस दर में यदि कोई परिवर्तन किया गया तो तुरन्त उनकी सूचना दी जाएगी ) । यह सुनिश्चित कर लेना चाहिए कि आयातक को सीमा शुल्क निकामी के लिए आयान वस्तावेजों का मूल सेट दिए जाने से पूर्व यह धनराशि अमा की जानी है ।
ये धनराशियां या तो रिजर्व बैंक आफ इंडिया, नई दिल्ली या स्टेट बैंक आफ इंडिया तीम हजारी, दिल्ली में जमा करमी चाहिए या स्टेट बैंक आफ इंडिया की किसी शाखा या इसकी अनुषंगी संस्थाओं या किसी भी राष्ट्रीयकृत बैंक से उनके द्वारा प्राप्त की गई स्टेट बैंक आफ इंडिया, तीस हजारी शाखा, विल्ली-6 ( आदेशित और आदाता ) के नाम में और उमको देय दर्शनी हुण्डी के माध्यम से करनी चाहिए । इस संबंध में आपका ध्यान सार्वजनिक सूचना सं 23-आई टी सी (पी एन )/ 68 दिनांक 24-10-68, सं ० 132-आई टी सी ( पी एन )/ 71 दिनांक 5-10-71 , सं० 74-आई टी सी (पी एन )/ 74, दिनांक 31-5-74 और स ० 103- आई टी सी ( पी एन )/ 76 दिनांक 12-10-76 की शर्तों की आर दिलाया जाता है । लेखा शीर्ष जिसमें धनराशि जमा की जाएगी वह "के डिपाजिट्स एंड एडयांसिज-843 सिविल डिपोजिट्म-डिपोजिटस फार परचेजिस एटसेक्ट्रा एप्राड-परचेजिम ग्रांड पेंड फाम दि गवर्नमेंट आफ जापान फार 1981-82 ( येन 2.134 बिलियन ग्राट एंड डेविट रिलीफ) " ।

I ( ii ) The licence will bear the superscription " Yen 2.134 billion Japanese Grant Aid for 1981-82 " . The licence code for the first and second suffix will be " S / JN " . These will also be repeated in the letter from the CCI & E forwarding the import licence.

I ( iii ) No remittance of foreign exchange will be permitted against the import licence , except bank charges which may be remitted through norntal banking channels . Any payment towards Indian Agent's com- mission should be made in Indian rupees to the agents in India. Such payments , however , will form part of the licence value and will , therefore , be charged to the licence .

I (v) Firm order must be placed on C&F basis on the overseas suppliers located in Japan and in other eligible countries mentioned in Annexure- I and sent to the Under Secretary ( TA ) , Department of Economic Affairs (Japan Section ) , Ministry of Finance, North Block, New Delhi ( within 4 months from the date of issue of the import licence ) . " Firm Orders " means purchase orders placed by the Indian licensee on the Overseas supplier duly supported by order confirmation by the latter or purchase contract duly signed by both the Indian importer and the overseas supplier. Orders on Indian Agents of Overseas suppliers and or order confirmation of such Indian Agents are not acceptable.

Licensing conditions in respect of Public Sector Imports under the Japanese grant aid of Yen 2.134 Billion (Y 2,134,653,000 ) ( Debt Relief) for 1981-82 ex- tended by the Government of Japan ( from 1.10.81 to 30.9.82).
Section I-General Conditions :
I ( i) The Japanese Grant Aid of Yen 2.134 billion extended by the Government of Japan is untied in
I ( vi ) This condition of the placement of contracts within 4 months period will be treated as not having been complied with unless complete contract documents reach the Ministry of Finance , Department of Economic Affairs, Japan Section, within four months from the date of issue of the import licence. If firm orders as explained in para 1 (v)(v) above cannot be placed within 4 months for valid reasons the licensee should submit the import licence to the concerned licensing authorities giving reasons why ordering could not be completed within 4 months . Such requests for extension in the ordering period will be considered on merit by the licen- sing authorities who may grant extension upto a further maximum period of 4 months . If however , extension is sought beyond 4 months from the date of issue of this Import licence, such proposals will invariably be refer- red by the licensing authorities to the Department of Economic Affairs ( Japan Section ) , Ministry of Finance , North Block , New Delhi who will consider such exten- sion on the merits of each case and communicate their decision to the licensing authorities for communication to the licensee .

In fixing the terminal date or shipment it should be noted that this date should not be beyond 31-3-1984.
Section II .--Special points to be kept in view while Negotiating a supply contract ,
Il ( i ) ( a) The C& F value of the contract should be expressed in Yen or US Dollar or Pound Sterling without fraction less than one Yen, one Cent or one Penny and should exclude Indian Agent's commission , if any, which should be paid in Indian rupees . In no circumstances the contract value should be expressed in Indian rupee or in any other currency . The FOB cost and freight amount may be shown separately but it should be clarified in the contract whether the freight charges will be payable on actual basis or whether the freight charges indicated in the contract would be the amount payable irrespective of the actual charges .
(b) The contract should provide for payment on cash basis i.e. on presentation of shipping documents by the Japanese Suppliers to the Bank of India , Tokyo.
(c) The purchase order and the suppier's order con- firmation should be in English only .
II ( ii ) Only one contract should be entered into against the import licence . In exceptional cases , more than one contract may be permitted to be entered into, for which prior approval of the Department of Econo- mic Affairs , Ministry of Finance, should be obtained soon after the date of issue of the import licence .
II ( iii ) Eligibility of Supplier
The supplier shall be a national of the eligible source countries , or a uridical person registered and incorpo- rated in the eligible source countries .
Section III
The following provision should be specifically incor- porated in the supply contract :-
III ( i ) The contract is arranged in accordance with the Agreement date the 1st February , 1983 between the Governments of India and Japan concerning the Grant Aid of Yen 2.134 billion for 1981-82 " and will be subject to the approval of Government of India" .
III ( ii ) Payments to the overseas suppliers shall be made through an 'Authorisation to Pay' ( AP) which will be issued by the Controller of Aid Accounts and Audit, Ministry of Finance , Department of Economic Affairs , UCO Bank Building, Parliament Street , New Delhi- 110001 in favour of the Bank of India , Tokyo under the Japanese Grant Aid for 1981-82.
III ( iii ) The overseas suppliers agree to furnish such Information and documents as may be required by the Government of India on the one hand and the Govern- ment of Japan on the other.
III ( iv) Where suppliers are located in Japan, they agree to make shipping arrangements in consultation with the Embassy of India , Tokyo and that for this purpose they would keep the Embassy of India , Tokyo

informed of the delivery schedule of the goods involved and notify the Embassy of India, atleast six weeks in advance of the shipping required so that suitable arrangements should be made . In exceptional cases , where the importer require this period of notice may be reduced. The Japanese supplier should also agree to send a cable advice to the importer after each shipment giving the necessary details and a copy thereof should be sent to the Embassy of India , Tokyo.
Section IV. Contract Approval by Govt . of India .
IV ( i ) As soon as the orders are finalised , the licencee should forward to the Under Secretary ( TA ) , Department of Economic Affairs , Ministry of Finance , North Block , New Delhi 4 copies of the contract duly signed by both parties or purchase orders by the Indian Importer placed on the overseas supplier supported by order confirmation in writing by the overseas supplier or their photo copies complete in all respects together with two photo copics of the relevant valid import licence as also two copies of the " Request for issue of AP" in the form at Annex III . The above procedure will also apply to all contract amendments causing essential modifications to the contents of contracts or in its price .
IV ( ii) If the contract documents "Request for issue of AlP" and other connected documents are found to be in order the Ministry of Finance ( Deartment of Economic Affairs ) Jaan Section will approve the con- tract and will arrange to send one set of the documents mentioned in (i )(i) above each to the CAA&A , the Em- bassy of India, Tokyo and the Embassy of Japan in India.
IV ( iii ) On receipt of the documents mentioned at (ii) above the Controller of Aid Accounts & Audit, Department of Economic Affairs , Ministry of Finance , UCO Bank Building, Parliament Street . New Delhi - 110001 will issue an 'Authorisation to Pay' ( AP) to the Bank of India , Tokyo in the form at Annexure IV for making payment to the overseas supplier . Copies of the AlP will be endorsed to the Embassy of India. Tokyo, the importer, the importer's Bank in India and Japan Section , Department of Economic Affairs , Minis- try of Finance.
IV ( iv) On receipt of the Authorisation to Pay (AIP) the Bank of India , Tokyo will intimate the fact of this receipt to the supplier under intimation to the Government of Japan , Embassy of India , Tokyo , the importer's Bank in India and the CAA& A .
IV ( v) The foreign supplier shall , after affccting shipment present through his bankers the documents specified in the AP to the Bank of India . Tokyo , If the documents are found to be in order, the Bank of India, Tokyo will release the amount specified in the documents to the Supplier through his bankers .
IV (vi ) Banking charges pavable to the Bank of India , Tokyo for advising the Alp and for arranging payment to the overscas supplier shall be settled by the concerned importer's Bank in India by remittances to the Bank of India. Tokyo through normal banking channel without affecting the Government of India's account.

Section V. Resonsibility for rupee deposit .
V ( i ) 'The original negotiable shipping documents will lbe invariably forwarded by the Bank of India , Tokyo, to the concerned importer's bank in India which would be a branch of the State Bank of India or any of the nationalised Banks as mentioned in ( 0 ) in An- nexure- III who should release these negotiable set of documents to the importer concerned only after en- suring that the rupee equivalent of the Yen US$ Pound Sterling Payments madeents made to the supplier alongwith m terest charges thereon in cases where payable calculated at the rate of 9 per cent per annum for the first thirty days and at 15 per cent for the period in excess thereof reckoned from the date of payment by the Bank of India, Tokyo to the foreign Supplier to the date of actual rupee deposit , is deposited into Government of India account in terms of the Public Notice No. 46 - ITC ( PN ) 76 dated 16.6.76 . The interest is payable for both the days i.e. the day on which pay- ment is made to the supplier and also the day on which rupce deposits is made into Government account vide Public Notice No. 74 - ITC ( PN) | 74 dated 31-5-1974 as modified under Public Notice No. 103-1TC ( PN ) 76 dated 12.10.1976 . The exchange rate to be adopted for computing the rupee equivalent of the Yen US$ Pound Payment will be the prevailing composite rate of cx- change as laid down in CCI & E Public Notice No. 8- ITC ( PN ) 76 dated 17.1.1976 or as may be notified by Government from time to time through Public Notices of the CCI & E or through Exchange Control Circulars of the Reserve Bank of India . Any change in this regard as also in regard to the rate of interest will be notified as and when necessary. It will be the res- ponsibility of the Indian Bank concerned to ensure that the amounts duc are correctly deposited into Gov- ernment Account before the import documents are handed over to the importers . The licencee should also cusure that the amounts due are correctly deposited into Government account before taking delivery of the documents from their bankers . The Head of Account to which the above rupee deposits should be credited is ' K-Deposits and Advances - 843 -Civil Deposits- Deposits for purchases etc. , abroadpurchase Grant Aid from the Government of Japan" for 1981-82 ( Yen 2.134 billion Grant Aid-Debt- relief) .
V ( ii ) The amount referred to above should be deposited in cash to the credit of the Government either inthe Reserve Bank of India , New Delhi or State Bank of India , Tis Hazari , Delhi , or if this is not possible it should be remittedby means of a demand draft obtain- ed from any branch of the State Bank of India or its subsidiaries or any one of the Nationalised Banks (drawer) drawn on and made payable to the State Bank of India, Tis Hazari Branch, Delhi - 6 ( drawee and Payee) for credit to Government account as contem- plated in Public Notices No. 184 - ITC ( PN ) | 68 dated 30.8.1968 , No. 233 - ITC ( PN ) 68 dated 24.10.68 and No. 132 - ITC ( PN) 71 dated 5.10.1971 , 74-ITC ( PN) | 74 dated 31.5.197431.5.1 and No. 103 - ITC ( PN ) 76 dated 12.10.1976. No.
V ( iii) The concerned bank in India shall also furnish such additional deposit in the same manner stipulated above as may be requested by the Govern- ment of India on account of service charges within seven days after such a demand is made by the Govern- ment . While filling in the various columns in the challan it should be ensured by the importers , their bankers 150 GI/ 83-2
that the information prescribed in para 2 of Public Notice No. 132- ITC ( PN ) 71 dated 5.10.1971 and also in Public Notice No. 74- ITC ( PN) 174 dated 31.5.1974 read with Public Notice No. 103 -ITC ( PN ) 76 dated 12.10.1976 is invariably indicated in the column "full particulars of remittances and authority ( if any ) " of the charlan. The following particulars should invariably be furnished in the Treasury Challans :
( a) Ministry of Finance ' A'P ' ( Authorisation to Pay) No. and date .
(b) Amount of Yen Currency in respect of which deposits are to be made together with rate of conversion adopted .
(c) Date of payment to the foreign supplier .
(d ) 'The amount of interest paid and the period for which it has been calculated.
( e ) Total amount deposited .
(Intcrest is to be calculated for the period from the date of payment to the supplier upto and inclusive of the date of deposit of rupee equivalents into Government Account) .
Thereafter the Treasury Challans evidencing the rupec deposit should be sent by registered post to the CAA&A indicating reference to the AP issued by him and also enclosing copies of invoice and shipping documents .
Note . Importer's Banks in India should ensure that the rupee deposits are invariably made within 10 days of the receipt of the advice of payments and negotiable shipping docu- ments from the Bank of India , Tokyo and That the CAA & A , Ministry of Finance ( DEA ) , New Delhi is kept informed of the fact immediately thereafter .
V ( iv ) The concerned bank in India should alo endorse the amount of rupee deposits on the exchange control copy of the licence and send the requisite "S " Form to the Reserve Bank of India. Bombay.
Section VI . Miscellaneous provisions .
VI ( i ) Reports on the utilisation of the import licence .
The importer should send a monthly report , after the A/ P has been issued regarding shipments and pay- ments made thereagainst and about the balance left , to the Controller of Aid AccounAccounts & Audit , Department of Economic Affairs , Ministry of Finance , UCO Bank Building, Parliament Street , New Delhi .
VI ( ii ) Notifying Suppliers of Special Conditions . The licencee should apprise the supplier of any special provisions in the importport licence which may affect the suppliers in carrying out the transaction .
VI ( iii) Disputes .
It should be understood that the Government of India will not undertake any responsibility for dispute , if any, that may arise between the licencee and the suppliers . The conditions to be fulfilled by the supplier before payment by the Bank of India , Tokyo must he clearly spelt out by the importer in Annexure- I under 10

"Terms of payment " . Provision dealing with a settle- ment of disputes be included in the condition of contract .
VI ( iv) Future Instructions .
The Licencee shall promptly comply with directions , instructions or orders issued by the Government of India from time to time regarding any and all matters arising from or pertaining to the import licence and for mecting all obligations under the Grant Aid for 1981-82 from Japan.
VI ( v) Breach or violation .
Any breach of violation of the conditions set forth in the above clauses will result in appropriate action under the Imports and Exports ( Control Act ) .

In accordance with the terms and conditions of the agreement dated 13.3.1979 entered into with your Bank , you are hereby authorised to pay an amount not excceding Yen to Mis . (as per details given in the Appendix ) .
(c) Method of procurement-whether it is based on direct purchase or Formal open Inter- national tendering in which case it should be indicated whether the contract has been awarded on the basis of technically suitable offer with reasons , if any.
2. Please advise the Suppliers of the fact of receipt of this authorisation to Pay (AP ) and endorse a copy of this adviceto the Government of Japan, Importers ' Bank, Embassy of India , Tokyo and this Ministry.
(d) Brief description of the goods .

3. Payments to the suppliers in terms of the AP will be made on the basis of shipping documents etc. as indicated in the Appendix .

4. The banking charges including charges for handf- ing documents payable to you by the importer will be settled by the Embassy of India Tokyo Importers Bank.

5. As and when any payment is made by you on the basis of shipping documents etc. presented by the sup- plier, an advice in the prescribed form should be sent to this Ministry and the importer's bank.

6. No amendments to A/ P may be issued in the absence of a specific authority from this Ministry .
7. The AP will remain valid upto ( k ) Payment terms and probable dates on which payments under the contract will fall due .

The rupee equivalent of amount disbursed to the overseas suppliers will have to be calculated by applying the composite rate of conversion as prevailing on the date of payment to Overseas Suppliers in accor- danco with the Public Notice No. 8 - JTC ( PN ) 76 dated 17.1.1976 or such other Public Notices as may be issued from time to time . These amounts should be deposited either with the RBI , New Delhi or the S.B.I. , Tis Hazari , Delhi or remitted by means of a Demand Draft obtained by them from any Branch of the S.B.I. or its subsidiaries or any one of the Natinoalised Banks ( Drawer) drawn on and made payable to the S.B.I. , Tis Hazari , Delhi - 6 (Drawee and Payee) .
