फा० भा० 355 (प्र ) -केन्द्रीय सरकार , एकाधिकार तथा अबरोधक व्यापारिक व्यवहार अधिनियम , 1969 ( 1969 का 54) की धारा 22 क की उपधारा ( 1 ) द्वारा प्रदन्न शक्तियों का प्रयोग करते हुए और इसमें इसके पश्चात् विनि- दिष्ट शर्तों के अधीन रहते हुए यह निदेश देती है कि उक्त अधिनियम की धारा 21 और 22 के उपबन्ध इस अधिसूचना की अनुसूची में विनिर्दिष्ट किसी उद्योग या सेवा के संबंध मे किसी प्रस्थापना को लागू नहीं होंगे ।
शर्ते
प्रस्थापना करने वाला उपक्रम व्यक्ति या प्राधिकारी :
( i) केन्द्रीय सरकार के कंपनी कार्य विभाग को अभिलेख के प्रयोजन के लिए उद्योग ( विकास और विनियमन ) अधिनियम , 1951 (1951 का 65 ) के अधीन दिए गए आवेदन पत्न की प्रति के साथ एक ज्ञापन प्रस्तुत करेगा जिसमें प्रस्थापना के ब्यौरे होंगे ;
( ii) मप्रवर्तकों का अभिदाय परियोजना लागत के कम से कम 20 प्रतिशत तक की मीमा तक लाने के लिए भार अपने उपर लेगा और
( iii ) ऋण साम्या अनुपात 2: 1 से अधिक नहीं रखेगा ।
2. यह अधिसूचना राजपत्र मे प्रकाशन की तारीख से पाच वर्ष की अवधि के लिए प्रभावी होगी ।
अनुसूची
1. कच्चा लोहा ( 3 लाख मीटरी टन से अधिक की क्षमता) ।
2. सौर फोटो वोल्टीय संघटकों, पैनलों और पद्धतियों से भिन्न अनुकल्पी ऊर्जा पद्धतियां ।
3. नीचे सूचीबद्ध इलैक्ट्रोनिक संघटक और उपस्करः-
( i ) इलैक्ट्रोनिक संघटक , जो इलैक्ट्रोनिक उद्योग के लिए अपेक्षित है ( सभी प्रकार के एकीकृत सर्किटों से भिन्न अर्थात् वी ० एल ० एस ०

आई ० , एल ० एस ० आई ० , एस ० एस ० आई० , अर्ध चालक फोटो बोल्टीय संघटक आदि) ।
( ii) कम्प्यूटर पैरिफेरल ।
( iii ) कम्प्यूटर सोफ्टवेयर ।
(iv) कम्प्यूटरों और वीडियो उपस्कर में उपभोग के लिए चुम्वकीय टेप , कम्प्यूटरों के लिए हार्ड डिस्के, फ्लोपी डिस्कें और डिस्कैट्स ।
(v) परीक्षण और मापन उपकरण ।
टिप्पण: उपरोक्त इलैक्ट्रानिक संघटकों और उपस्करों के संबंध में छूट तभी उपलब्ध होगी जब एका- धिकार तथा अवरोधक व्यापारिक व्यवहार गृह उर्ध्वरूप से एकीकृत मूल उत्पादन मुविधाएं प्रवान करता है ; उपरोक्त छूट प्राप्त मदों के संबंध में आयातित किटों से केवल समंजन कार्य करने के लिए अनुजा नहीं दी जाएगी ।
4. औद्योगिक मशीनरी जो नीचे सूचीवद्ध हैं:-
(i) प्रदुषण नियंत्रण उपस्कर ।
( ii) अपशिष्टो के पुनः चक्रण के उपयोजन के लिए प्रसंस्करण उपस्कर ।
(iii ) मुद्रण मशीनरी जो नीचे सूचीवद्ध हैं :-
(क) रीलचढ़ी उच्च गति लैटर प्रैस रोटरी और आफसैंट रोटरी मुद्रण मशीनें जिनका प्रति घंटा उत्पादन 30,000 या अधिक छाप है , अर्थात् सिलिडंर गति 30,000 प्रति घंटा है ।
(ख ) फोटो/ कम्पोजिग/टाइप सैटिंग मशीनें और आनुषंगिक की बोर्ड सम्पादन टमिनल्स और फिल्म/कागज प्रसंकरणक ।
(ग) चार रंग/दो रंग आफ मैट मशीनें ।
(vi) देरी उद्योग उपस्कर:
समांगिन
(v) रसायन उद्योग के लिए मशीनरी जो नीचे सूची- बद्ध हैं:-
(क) विभेदन डिस्कें।
(ख) विशेष वातीय अंशमापक ।
(ग) कारबेट पम्प ।
(घ) अपकेन्द्री गैम संपीडक ।
5. मशीन औजार जो नीचे सूचीबद्ध हैं.-
( i) फ्रैंकशफ्ट और फ्रैंकशैफ्ट वर्तन खराद ।
( ii) जिग बेधन मशीन ।

(iii) धागा कृमि मिलीयन और घर्षण मशीनें ।
( iv) घागा आवर्तन और धागा रोलिंग मशीनें ।
(v ) गियर धर्षण, प्रवण गियर कर्तक फल का तेज करना और प्रकाशीय अनुप्रस्थ काट के धर्षण की घर्षण मशीनें ।
6. उद्योग ( विकास और विनियमन) अधिनियम, 1951 की पहली अनुसूची में " 18-उर्वरक " के अधीन अकर्बनिक उर्वरक जिनके अन्तर्गत वह उर्वरक उद्योग नहीं है जो सिंगल सुपर फास्फेट का कारबार करता है ।
7. औषधियां/औषधि मध्यक:
आधारी -स्तर से उच्च प्रोद्योगिकी प्रपुंज औषधियां और उन पर आधारित सूत्र योग तथा ( अपने विनिर्माताओं से) प्रपुंज औषधि उपभोग का और सभी स्रोतों मे सूत्त्रयोग के बीच समग्र अनुपात 1 : 5 है जो नीचे सूचीबद्ध है:-

NOTIFICATION
New Delhi , the 6th May, 1983
S.O. 355 (E ) . In exercise of the powers conferred by sub- section ( 1) of section 22A of the Monopolies and Restrictive Trade Practices Act, 1969 ( 54 of 1969) and subject to the conditions hereinafter specified, the Central Government hereby directs that the provisions of section 21 and section 22 of the said Act shall not apply to any proposal in respect of an industry or service specified in the Schedule to this notification.
CONDITIONS
The undertaking ; person or the authority making the proposal shall :
(i) submit to the Department of Company Affairs in the Central Government, for the purpose of record, a memorandum containing the details of the pro- 3

posal alognwith a copy of their application made under the Industries (Development and Regulation) Act, 1951 (65 of 1951 ) ;
( ii ) undertake to bring in promoters ' contribution to the extent of not less than 20 percent of the project cost ; and
(iii) maintain the debt-cquity ratio of not more than 2: 1.
2. This notification shall have effect for a period of five years from the date of its publication in the Official Gazette.
SCHEDULE
1. Pig Iron (capacity of not more than 3 lakh tonnes) .
2. Alternate Energy Systems other than Solar Photovoltaic Components , Panels and Systems .
3. Electronic Components and Equipments listed below :-
(i) Electronic Components required for the electronic industry (other than all types of Integrated Circuits viz. , VLSI , LSI, MSI , SSI Semi- conductors , Photo- Voltaic Components etc.)
(ii) Computer Peripherals
( iii) Computer Software
(iv) Magnetic Tapes for use in Computers and Video Equipment, Hard Discs , Floppy Discs and Diskettes for Computers
(v) Test and Measuring Instruments.
(Noto : Exemption in respect of the above electronic components and equipments shall be available only if the MRTP House establishes in depth produc- tion facilities vertically integrated; it shall not be allowed to do mere assembly work from the impor- ted kits in regard to the above exempted items) .
4. Industrial Machinery as listed below :

(c) Four colour/two colour off- set machines .
( iv) Dairy Industry Equipment : Homogenisers
(v) Machinery for Chemical Industry as listed below :
(a) Rupture Discs "
(b) Special Pneumatic Calibrators
(c) Karbate pumps
(d) Centrifugal Gas Compressors .
5. Machine Tools as listed below :-
(i) Crankshaft and Crankshaft turning lathes
( ii) Jig boring machines
( iii) Thread/ worm milling and grinding machines
(v) Gear grinding, Bevel Gear Cutter blade sharepening and grinding and optical profile grinding machines .
6. Inorganic fertilizers under '18 -Fertilizers' in the First Schedule to the I ( D &R) Act, 1951 , excluding fertilizer in- dustry dealing with Single Super Phosphate .
7. Drugs/drug intermediates :
High technology bulk drugs from basic stages and for- mulations based thereon with an overall ratio of bulk drugs consumption (from own manufacturers ) to formulation from all sources of 1 : 5 as listed below :-
