सा० का० नि० 385 ( अ) केन्द्रीय सरकार औषधि और प्रसा धन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा12 और 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तथा औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् औषधि और प्रसाधन सामग्री नियम, 1945 का कतिपय और संशोधन करना चाहती है । जैसा कि उक्त धाराओं में अपेक्षित है, प्रस्तावित संशोधनों का निम्नलिखित प्रारूप उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जा रहा है, जिनके उससे प्रभावित होने की संभवना है । इसके द्वारा सूचना वी जाती है कि उक्त प्रारूप पर उस तारीख से जिसका उस राजपत्त की प्रतिया, जिस यह अधिसूचना प्रकाशित की आती है, जनता को उपलब्ध करा वी जात। है, 90 दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ।
इस प्रकार विनिविष्ट अवधि की समाप्ति से पूर्व नियमों के उक्त प्रारूप की बाबत जो भी आक्षेप या सुभाष किसी व्यक्ति से प्राप्त होंगे , केन्द्रीय सरकार उन पर विचार करेंगी ।
प्रारूप-नियन
1. इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री (संशोधन ) नियम, 1983 है ।

2. मौषधि और प्रसाधन सामग्री नियम, 1945 में (जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है) , नियम 65 के प्रारंभिक पैरा में, "प्रारूप 20 , 20 , 200, 21 , 215, 21 ख , में अनुज्ञप्तियां" शब्दों, अंकों और अक्षरों के स्थान पर नम्नलिखित रखा जाएगा, अथर्थात्:-
"प्रारूप 20, 20 फ , 20 , 20खख, 216, 21 ख, और 21 खख में अनुज्ञप्तियां " ।
3. उक्त नियमों के नियम 67छ में, शर्त ( 5 ) के पश्चात् तिम्त लिखित जोड़ा जाएगा, अर्थात्:-
"( 6) अनुज्ञप्तिधारी, किसी निरीक्षक को उसके संप्रेक्षण और उसके द्वारा पाई गई त्रुटियों को अभिलिखित करने को लिए समर्थ बनाने के लिए प्ररूप 35 में एक निरीक्षण पुस्तक बनाए रखेगा" ।
4. उक्त नियमों के नियम 74-ख में, शर्त ( 5 ) के पश्चात् निम्त लिखित जोड़ा जाएगा, अर्थात्:-
"( 6 ) अनुज्ञप्तिधारी , किसी निरीक्षक को उसके संप्रेक्षण और उसके द्वारा पाई गई त्रुटियों को अभिलिखित करने के लिए समर्थ बनाने के लिए प्ररुप 35 में एक निरीक्षण पुस्तक बनाए रखेगा" ।
5. उक्त नियमों के नियम 78 -फ में, शर्त ( 8) के पश्चात् निम्त लिखित जोड़ा जाएगा, अर्थात्:-

"( 7 ) अनुज्ञप्तिधारी किसी निरीक्षक को, उसके संप्रेक्षण और उसके द्वारा पाई गई त्रुटियों को अभिलिखित करने के लिए समर्थ बनाने के लिए प्रश्प 35 में एक निरीक्षण पुस्तक बनाए रखेगा" :
6 उक्त नियमो के नियम 96 के, उपनियम ( 1) के खड ( iv) मे,
(क) "विनिर्माता का नाम और पता" गब्दों के स्थान पर निम्न- लिखित जाएगा, अर्थात्:-
"विनिर्माता का नाम विनिर्माता के उस परिसर का पता जहा औषधि निर्मित की गई है" ;
(१) परन्तुक में, " कारबार" शब्द के स्थान पर "विनिर्माण " शब्द रखा जाएगा ।
7 उक्त नियमों के नियम 138 में,
(i) उपनियम ( 1) , ( 2) और ( 3) का परत्सुक हटा दिया जाएगा ;
(ii) उपनियम ( २) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्ः-
"( 4) उपनियम ( i ) के अधीन जारी की गई किसी अनु- ज्ञप्ति की दूसरी प्रति के लिए पचास रुपये की फीस संदत्त की जाएगी यदि मूल अनुज्ञप्ति विरुपित हो जाती है, क्षतिग्रस्त हो जाती है या खो जाती है ।
8. उक्त नियमों के नियम 139 के उपनियम ( 1 ) के खंड ( ग) और
( थ) के परन्तुक का लोप किया जाएगा ।
9. उक्त नियमों के नियम 158 में, शर्त ( ख) के पश्चात् निम्नलिखित जोड़ा जाएगा, अर्थात्
" ( ग) अनुज्ञप्तिधारी , किसी निरीक्षक को उसके संप्रेक्षण भौर उसके द्वारा पाई गई त्रुटियो को अभिलिखित करने के लिए समर्थ बनाने के लिए प्ररूप 35 में एक निरीक्षण पुस्तक बनाए रखेगा" ।
10 उक्त नियमों के नियम 158-ख में, शर्त ( ब) के पश्चात् निम्भ- लिखित जोड़ा जाएगा, अर्थात्:-
"(3) अनुज्ञप्तिधारी, किसी निरीक्षक को उसके संप्रेक्षण और उसके द्वारा पाई गईक्षुटियों को अभिलिखित करने के लिए समर्थ बनाने के लिए प्ररूप 35 में एक निरीक्षण पुस्तक बनाए रखेगा" ।
11. उक्त नियमों की अनुसूची क के प्रस्रुप 35 में , " (नियम 65 , 74, 74 , 78, 85 -ज , 142 और 142 क देखिए ) " कोष्ठकों, शब्दों, अंकों बौर अक्षरों के स्थान पर निम्मलिश्रित रखा जाएगा, अर्थात्:-
"(नियम 65, 67-8, 74, 74-फ, 74- , 78, 78-क, 85-ज, 142, 142-5, 158 और 158-क देखिए) " ।
12. उक्त नियमों की अनुसूची फ में, प्रविष्टि 2 के पश्चात् निम्न- लिखित जोडा जाएगा , अर्थात्:-
" 3. कैप्स्यूल के रूप में पेटेन्ट या सांपत्तिक औषधियों के लिए मानक:
कैप्स्यूल के रूप में किसी पेटेंन्ट या सांपत्तिक औषधि के संबंध में भारतीय औषधकोष में " कैप्स्यूल " के लिए मोमोग्राफ में विहित "विघटन परख का अनुपालन किया जाएगा" ।

NOTIFICATION
New Delhi , the 12th May, 1983 .
G.S.R.385(E) . The following draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 which the Central Government propose to make , after consultation with the Drugs Technical Advisory Board. in exercise of the pewers conferred by sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940), is hereby published as required by the said sections for the information of all persons likoly to be affected thereby and notice is hereby given that the sald draft rules will be taken into consideration after the expiry of a period of 90 days from the date on which the copies of the Official Gazette in which the notifi- cation is published are made available to the public .
Any objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be taken into considera- tion by the Central Government.
DRAFT RULES
1. These rules may be called the Drugs and Cosmetics (Amendment) Rules. 1983 .
2. In the Drugs and Cosmetics Rules , 1945 (hereinafter referred to as the said rules) , in Rule 65 in the opening paragraph, for the words , numbers and letters " Licences in Forms -20 , 20A, 208 , 21 , 21A and21 -B " the following shall be substituted, namely: "Licences in Forms 20 , 20A , 20B, 20BB, 21 , 21 -A, 21 -B and 21 -BB " .
3. In rule 67-G of the said rules after condition ( 5) , the following shall be added, namely:-
"(6) The licensee shall maintain an Inspection Book in Form 35 to enable Inspector to record his im- pressions and the defects noticed" .
4. In rule 74-B of the said rules , after condition (5) the following shall be added, namely:-
"(6) The licensee shall maintain an Inspection Book in Form 35 to enable an Inspector to record his im- pressions and the defects noticed".
5. In rule 78 -A of the said rules , after condition ( 6) the following shallbe added , namely:-
"(7) The licensee shall maintain an Inspection Book in Form 35 to enable an Inspector to record his Im- pressions and the defects noticed" .
6. In rule 96 of the said rules , in sub -rule ( 1) in clause (iv) :
(a) for the words "The name and address of the manu- facturer" the following shall be substituted, namely:-
"The name of the manufacturer and the address of the premises of the manufacturer where the drug has been manufactured" ,
(b) in the proviso, for the word "business" the word "manufacture" shall be substituted,
7. In rule 138 of the sald rules ,
(1) the proviso sub - rules ( 1) , (2) and (3 ) shall be deleted;
(ii) for sub- rule (4) the following shall be substituted, namely :-
"(4) A fee of rupees fifty shall be paid for duplicate copy of a licence issued under sub -rule ( 1) if the original is defaced , dan aged or lost" .
8. In rule 139 of the said rules in sub-rule ( 1) , the proviso to clause (c) and clause (d) shall be omitted.

9. In rule 158 of the said rules , after condition (b) , the following shall be added , namely:-
"(c) The licensee shall maintain an Inspection Book in Form 35 to enable an Inspector to record his impres- sions and the defects noticed" .
10. In rule 158 -A. of the said rules , after condition ( d ) , the following shall be added, namely
"(e) The licensee shall maintain an Inspection Book in Form 35 to enable an Inspector to record his im- pressions and the defects noticed".
11. In Schedule A , to the said rules , in Form , for the brackets , words numbers and letters
"(See rules 65, 74, 74-A , 78 , 85 -H, 142 and 142 -A" the following shall be substituted , namely :
"(Sce rules 65, 67-G , 74, 74-A, 74-B , 78 , 78 -A, 85 -H, 142, 142-A, 158 and 158 -A) ".
12. In Schedule V, to the said rule after entry 2, the following shallbe added, namely:--
"3. Standards for patent or proprietary medicines in Capsule form:-
APatent or proprietary medicino in capsule form shall comply with the disintegration test' prescribed in the monograph for 'capsules' in the Indian Phar- macopoeia".
