विषय: विदेशी ऋण/ क्रेडिट/अनुदान के मद्दे सीधे ही भुगतान' करने की क्रियाविधि के अन्तर्गत किए गए आयातों के संबंध में आयातको से ब्याज की वम्ली ब्याज की वर में संशोधन ।
मिसिल सं . आई . पी. सी./ 23/ 9/83:-विदेशी ऋण/ क्रेडिट/ अनुदान के अन्तर्गत जारी किए गए आयात लाइसेसों के लिए लागू लाइसेस शतों में इस बारे में एक ठिशिष्ट धारा यह भी है कि ऐसे मामलों में जहां सीधे भुगतान/ वचन बद्धता की क्रियाविधि का अनुपालन किया जाता है और आयातित माल और सेवाओं की कीमत विदेशी ऋण/क्रेडिट/अनुदान में से सीधे ही अदा कर दी जाती है तो वहां लेन - देन की तारीख को लागू विनिमय की मिश्रित दर पर परिकलिप्त आयातित माल का मूल्य ग्पये में आयातकों के बैंकरो द्वारा दस्तावेजो के पराक्रम सेंट की पावती की तारीख से 10 दिन के भीतर भारत सरकार के लेखे में जमा कराना चाहिए ।
किया जाता है तो 9 प्रतिशत की दर से वाषिक ब्याज वसूल किया जाना है और यदि निक्षेप विवेशी सम्भरक को भूगतान की तिथि से 30 दिन के बाद; अदा किया जाता है तो पहले 30 दिन के लिए ब्याज की दर 9 % होगी और बाकी 30 दिन से अधिक की जो अवधि है उसके लिए ब्याज की दर 15% होगी । ये दरे 15 जून ,1976 से लागू होती है (देखें सार्वजनिक सूचना सं . 40-आई . टी. सी. (पी एन)/76 , दिनांक16 जून , 1976) 1
2 यह देखने मेले आया है कि बहुत सारे मामलों में लाइ- संस शो में निर्धारित समय के भीतर भारत सरकार के लेख मे रुपया निक्षेप नहीं किया जा रहा है और बहुसंख्यक मामलों में देरी की अवधि बहुत लम्बी हो गई है । यह अनिवार्य है कि आयातको और उनके बैंकरों को लाइसेस शतों में निहित अनुदेशों का सख्ती से पालन करना चाहिए । सरकार आयाठको द्वारा रुपया विक्षेप करने में ऐसी देरी से चिन्तित है ।
4. आवश्यकता के अनुसार इस बात के अनुपालन का सुनि- श्चय करने के लिए कि रुपया निक्षेप निर्धारित अवधि के भीतर किया जाना चाहिए , यह निश्चय किया गया है कि विदेशी सम्भरकों को भुगतान की तिथि से सरकारी लेखो में रुपया निक्षेप करने की तिथि तक (दोनों विन शामिल करके ) का ब्याज' 1 सितम्बर , 1983 को या उसके बाद किए जाने वाले

सभी निक्षेपों के सम्बन्ध में नीचे संकेतित अनुसार दर पर वसूल किया जाना चाहिए:-

1. ऐसे मामले जहां निक्षेप विदेशी सम्भरकों को भगतान की तिथि से 30 दिन के भीतर किया जाता है ।
2. ऐसे गामले जहां निक्षेप विदेशी सम्भरक को भुगतान की तिथि से 30 दिन के बाद किया जाता है ।
(क) पहले 30 दिन के लिएः- 12 प्रतिशत वार्षिक loans credits grants , contain a specific clause to the effect that the rupee value of the goods imported, calculated at the composite rate of exchange appli- cable to the date of transaction should be deposited to the account of the Government of India within 10 days from the date of receipt of the negotiable set up documents by the importer's bankers , in cases where direct payment commitment procedure is followed and the cost of goods imported and ser- vices are paid for directly out of the foreign loans credits grants .

(ख) 30 दिन से अधिक अवधि के लिए: -
ब्याज की उपयुक्त दर इस प्रकार लागू होगी:-
(क) यदि आयातित माल और की गई सेवा की लागत 1 गितम्बर , 1983 को या उसके बाद ऋण/क्रेडिट/ अनदान में से सीधे ही अदा की जाती है ।
(ए) यदि आयातित माल या की गई सेवाओं के लिए भुगतान , 1 सितम्बर , 1983 से पहले ऋण/क्रेडिट/ अनुदान में से अदा किया गया था , किन्तु 1 सित- म्बर , 1983 से पहले रुपया निक्षेप आंशिक रूप में किया गया था और बाकी 1 सितम्बर , 1983 को था उसके बाद निक्षेप किया जाता है ।
(ग) यदि आयातित माल या दी गई सेवाओं के लिए भुगतान 1 सितम्बर , 1983 से पहले ऋण/क्रेडिट/ अनुदान में से किया गया था किन्तु रुपया निक्षेप 1 सितम्बर , 1983 से पहले आंशिक रूप में किया गया और नाकी 1 सितम्बर , 1983 को या उसके बाद निक्षेप किया जाता है ।
5. वर्तमान लाइसेंस शतों में इस सम्बन्ध में दिए गए प्रावधान इस सीमा तक आशोधित किए गए समझे जाएं । आयातकों को इम सार्वजनिक सूचना के जारी होने की तारीख से एक महीने के भीतर वर्तमान बैंक गारन्टी के साथ अभी- अभी गधिसूचित ब्याज की परिशोधित दरों से सम्बन्धित प्रावधानों के लिए संशोधन भेजने की व्यवस्था भी करनी चाहिए ।

Subject : Recovery of interest from Importers in respect of imports made under the direct payment procedure against foreign loans credits grants revision of rate of interest .

The Licensing conditions also provide that interest at the rate of 9 per cent p.a. are recoverable where deposits are made within 30 days from the date of payment to the foreign suppliers and where the rupee deposits are made more than 30 days after the date of payment to the foreign supplier the interest will be 9 per cent for the first 30 days and 15 per cent for period in excess of 30 days . These rates are effective from 15th June , 1976 (vide public notice No. 46- ITC ( PN) 76 dated 16th June , 1976) .
3. It has come to notice that in very many cases rupee deposits are not being made to the account of the Government of India within the time stipu- lated in the licensing conditions and the delay in a number of cases is for long periods . It is impera- tive that importers and their bankers should strictly adhere to the instructions contained in the licensing conditions . Government are concerned at such delays in making rupee deposits by the importers .
4. As a measure to ensure compliance with the requirement that rupee deposits should be made within the prescribed period, it has been decided that interest should be recovered for the period from the date of payment to foreign suppliers to the date of rupee deposit to the Government account (both days inclusive) at the rates indicated below in respect of all deposits to be made on or after 1st September , 1983 .

The above rates of interests will be applicable :
credits grants prior to 1st September , 1983 but rupee deposits were made prior to 1st September , 1983 in part and the balance is deposited on or after 1st September , 1983 .
(a) Where cost of goods imported and service rendered are paid for directly out of foreign loans credits grants on or after 1st September , 1983 .
5. The provisions in this regard in the existing licensing conditions may be deemed to have been modified to this extent . Importers should also arrange to furnish amendments to existing Bank guarantees including the provisions relating to re- vised rates of interest now notified , within a month from the date of issue of the Public Notice .
(b) Where payment, for goods imported or services rendered , was made out of loans credits grants prior to 1st September, 1983 , rupee deposits were made perior to 1st September, 1983 , in part and the balance is deposited on or after 1st September , 1983 .
(c) Where payment , for goods imported or services rendered, was made out of loans
