का.आ. 632 (अ). केन्द्रीय सरकार की यह राय है कि अधिकतम संभव सीमा तक सभी मजबूरियों को दूर करके उत्पादन को बढ़ाने के लिए अर्थव्यवस्था के और निश्चयात्मक उत्पादन पूर्धा- भिमूखीकरण के लिए दिशा प्रदान की जानी है ;
अतः , अब , केन्द्रीय सरकार , उद्योग (विकास और विनियमन) अधिनियम , 1951 (1951 का 65) की धारा 29ख की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , ऐसे सभी औद्योगिक उपक्रमों को , जो उक्त अधिनियम के अधीन रजिस्ट्रीकृत हैं या जिनकी बाबत उक्त अधिनियम के अधीन अनुज्ञप्ति या अनुज्ञा दी गई है , उक्त अधिनियम की धारा 13 की उपधारा (1) के खंड (घ) के , और उसके अधीन बनाए गए नियमों के प्रवर्तन से , निम्नलिखित शतों के अधीन रहते हुए , छट देती है , अर्थात-
(1) विनिर्माण की वस्तु वह वस्तु नहीं होगी जो भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास

विभाग) की अधिसूचना सं. का. आ . 98(म) / उ.वि.वि.अ./29 / 73-1, तारीख16 फरवरी , 1973 की अनुसूची 1 या अनुसूची 4 या अनुसूची 5 में विनिर्दिष्ट है ;
(2) विनिर्माण की वस्तु नाशकजीवमार सूत्रयोगों से संबंधित वस्तू नहीं होगी ;
(3) औद्योगिक उपक्रम , छूट के लिए तभी पात्र होगा जब कि वह विस्तार ऐसे माल के किसी वर्णन की बाबत है जिसके लिए औद्योगिक उपक्रम , एका- धिकार तथा अवरोधक व्यापारिक व्यवहार अधि- नियम, 1969 (1969 का 54) के अर्थान्तर्गत प्रधान उपक्रम नहीं है ;
(4) औद्योगिक उपक्रम ने 1 अप्रैल , 1983 के पूर्ववर्ती पांच वित्तीय वर्ष में से किसी वर्ष में अपनी अनुज्ञप्त क्षमता का कम से कम 94 प्रतिशत प्राप्त कर लिया है ;
(5) जहां क्षमता का , भारत के राजपत्र , असाधारण , भाग 2 , खंड 3 , उपखंड (2) , तारीख 26 जलाई , 1982 में प्रकाशित अधिसूचना का.मा . 529 (अ) , तारीख 26 जुलाई , 1982 के अनुसार पनः पष्ठांकन किया गया है वहां तारीख 31-3-83 को गमाप्त होने 2

बाले वर्ष के दौरान उत्पादन इस प्रकार पुनः पृष्ठां कित क्षमता से अधिक होगा ;
(6) अनुप्ति/रजिस्ट्रीकरण प्रमाणपत्र पर पुनः पृष्ठां कित की जाने वाली क्षमता:
(क) उपरोक्त खंड ( 4) के अंतर्गत आने बाले औद्यो- गिक उपक्रमों की दशा में , 1 अप्रैल , 1983 के पूर्ववर्ती पांच वर्ष में से किसी वर्ष के दौरान प्राप्त उच्चतम उत्पादन धन उसके 33-1/2 प्रतिशत तक सीमित रहेगी , या
(ख) उपरोक्त उपखंड (5) के अंतर्गत आने बाले औद्यो- गिक उपक्रमों की दशा में , 1982-83 को समाप्त होने वाले वर्ष के दौरान उत्पादन धन उसके 33-1/3 प्रतिशत तक सीमित रहेगी ।
(7) औद्योगिक उपक्रम , संतुलन उपस्करों के सिवाय , देशी या आयातित कोई भी अतिरवत मशीनरी संस्थापित नहीं करेगा , किन्तु शर्त यह है कि ऐसे उपस्कर के संस्थापन के परिणामस्वरूप क्षमता में 25 प्रतिशत से अधिक की वृद्धि नहीं होती है :

4. 20 मेगावाट से 60 मेगावाट तक की गैस/जल/ वाष्प टरबाइन
4. विद्युत उपस्कर
1. बिजली के पारेषण और वितरण के लिए उपस्कर जिसके अंतर्गत विद्युत और वितरण ट्रांसफारमर , विद्युत रिले , एच. टी . स्विच गियर , तुल्यकालिक संधारित्र हैं ।
2. विद्युत मोटरें
3. विद्युत भट्टियां जिनके अंतर्गत औद्योगिक भट्टियां हैं ।
4. एक्सरे उपस्कर
5. इलेक्ट्रानिक घटक और उपस्कर ।
6. अंतर्वाही तारों के विनिर्माण के लिए घटक तार
7. 20 मेगावाट से 60 मेगावाट तक के जल/बाष्प/ गैस जनित्र ।
5. परिवहन
परन्तु एकाधिकार तथा अवरोधक व्यापारिक व्यवहार अधिनियम , 1909 (1969 का 54) के क्षेत्रांत- र्गत या विदेशी मुद्रा विनियमन अधिनियम , 1973 (1973 का 45) के क्षेत्रान्तर्गत आने वाले किसी औद्योगिक उपक्रम के संबंध में , विनिर्माण की वस्तु इस अधिसूचना से उपाबद्ध अनुसूची में सम्मिलित किमी उद्योग से संबंधित होगी ।
2. यह अधिसूचना , सिवाय इस बात के कि वर्तमान अधि- सूचना में छूट का उपबंध भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास विभाग) की अधिसूचना सं. 98 (अ)/ उ.वि.वि.अ./29 /73-1 , तारीख 16 फरवरी , 1973 की मद 3 के दूसरे परन्तुक में विनिर्दिष्ट अवस्थानिक मजबूरियों के होते हुए भी उपलब्ध हो सके , उक्त अधिसूचना के अतिरिक्त होगी न कि उसके अल्पीकरण में ।

(2) स्वचालित दो पहिए और तीन पहिए वाले यान । दो पहिए वाले यानों के संबंध में केवल विद्यमान यूनिटों का , अतिरिक्त क्षमता पर 25 प्रतिशत की निर्यात बाध्यता के अधीन विस्तार ।
(3) विशिष्ट स्वचालित घटक , जैसे पिस्टन और पिस्टन रिंग , ईंधन इंजेक्शन उपस्कर , आटो- इलेक्ट्रीकल्स , जैसे स्टार्टर मोटरें , जनित्र , स्पार्क प्लग , रियर एक्सल असेम्बली , ब्रेक और क्लच असेम्बली , टायर/ ट्यूब वाल्य , आटोमोबाइलों के लिए पहिए और द्विधात् बीयरिग्स ।
6. औद्योगिक मशीनरी
औद्योगिक मशीनरी जिसके अंतर्गत विशिष्ट उपस्कर हैं:
1. उच्च-निष्पादन और उत्तम तदरूपता औद्योगिक वाल्व जो उद्योग मंत्रालय द्वारा विनिर्दिष्ट किए जाए ।
2. केन्द्रीकृत स्नेहन (लुब्रिकेशन) प्रणालियां
3. गियर , गियर बाक्स और कपलिंग

जो उद्योग ( विकास और विनियमन) अर्धािनयम , 1951 की पहली अनुसूची में " 18 - उर्वरक " के अधीन " ( 1) अकार्बनिक उर्वरक के अंतर्गत आते हैं ।
13. रसायन (उर्वरकों से भिन्न)
(ख) बुनियादी प्रक्रम से उच्च प्रौद्योगिकी बाली प्रपूंज ओषधियां और उन पर आधारित मुत्रयोग जिनमे प्रपूंज ओषधि उपयोग का ( निजी विनिर्माण से) सभी स्रोतों से सूत्रयोगों के साथ समग्र अनुपात 1: 5 होगा ।
1. भारी कार्बनिक रसायन जिसके अतर्गत पेट्रो-रसायन हैं ।

विदेशी मुद्रा विनियमन अधिनियम के अंतर्गत न आने वाले एकाधिकार तथा अवरोधक व्यापारिक व्यवहार कम्पनियों के लिए :

सभी प्रपूंज ओषधिया और सूत्रयोग जिनमें प्रपुंज ओषधि के उत्पाद और सूत्रयोग मूल्य के बीच समग्र अनुपात 1:10 होगा ।

7. औद्योगिक विस्फोटक

Now , therefore , in exercise of powers conferred by sub - section ( 1 ) of section 29B of the Indus- tries (Development & Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government hereby exempts all industrial undertakings registered under the said Act or in respect of which a licence or per- mission has been issued under the said Act , from the operation of clause (d) of sub -section ( 1 ) of section 13 of the said Act and the rules made there- under , subject to the following conditions , name- ly:-

( i) the article of manufacture shall not be an article specified in Schedule I or Schedule IV or Schedule V to the noti- fication of the Government of India in the Ministry of Industry ( Department of Industrial Development ) No. S.O. 98 (E ) / IDRA/ 29B/ 73 -I , dated the 16th February , 1973 ;
(ii ) the article of manufacture shall not be an article relating to pesticide formulations ;

( iii ) the industrial undertaking shall be eligible for exemption only if the expansion is in respect of any description of goods for which the industrial undertaking is not a dominant undertaking within the meaning of the Monopolies and Restric- tive Trade Practices Act , 1969 ( 54 of 1969);

(v) where capacities have been re - endorsed in terms of notification S.O. 529 (E ) dated 26th July, 1982 published in Part II--Section 3-Sub-section ( ii ) of the Gazette of India Extraordinary dated 26th July , 1982 , the production during the year ending 31st March , 1983 should be higher than the capacity so re - endorsed ;

(vi) the capacity to be re - endorsed on the licence/registration certificate shall be limited to :

(a) the highest production achieved during any of the five years preceding 1st April, 1983 plus thirty - three and one- third per cent thereof in the case of industrial undertakings covered by clause ( iv ) above ; or

(b) production during the year ending 1982-83 plus thirty- three and one- third per cent thereof in the case of industrial undertakings covered by clause (v ) above .
(vii ) the industrial undertakings shall not instal additional machinery , indigenous or imported , except balancing equip- ments subject to the condition that in- stallation of such equipment does not result in increase in capacity by more than 25 per cent .
Provided that in relation to an industrial undertaking falling within the purview of the Monopolies and Restrictive Trade Practices Act, 1969 ( 54 of 1969) or within the purview of the Foregin Exchange Regulation Act, 1973 (46 of 1973) , the article of manufacture shall pertain to an industry included in the Schedule annexed to this notification .
2. This notification is in addition to and not in derogation of the notification of the Govern- ment of India in the Ministry of Industrial De- velopment (Department of Industrial Develop- ment ) No. 98 ( E) / IDRA/ 29B/ 73 - I dated the 16th February, 1973 , except that the exemption provision in the present notification may be available notwithstanding the locational cons- traints specified in the second proviso to item 3 of the saidsaid notification.
