और केन्द्रीय सरकार ने भारत सरकार के उद्याग मत्रालय (औद्योगिक विकास विभाग) के यादेश सं . का. आ. 665(अ)/ 18 पक/18 कक/ आई.डी. आर . ए ./ 82 , तारीख 14 सितम्बर ,। 1982 तथा का .आ . 174(अ) /18चक/18कक/आई.डी. आर.ए. / 83 तारीख 14 मार्च , 1983 द्वारा प्राधिकृत व्यक्ति को उक्त औद्योगिक उपक्रमों का छह मास की अतिरिक्त अवधि के लिए प्रबंध रहने के लिए प्राधिकृत किया था ,
और केन्द्रीय सरकार ने , यह राय होने पर कि सर्व साधारण के हित में यह समीचीन था कि प्राधिकृत व्यक्ति उक्त औद्यो गिक उपक्रमों का प्रबंध करना जारी रखें , उद्योग (विकास और विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 18 - चक की उप -धारा ( 2) के परन्तुक के अधीन एक आवेदन कलकत्ता उच्च न्यायालय को किया था जिसमें यह प्रार्थना की गई श्री कि ऐसा प्रबंध छह मास की और अधि के लिए जारी रखा जाए ।
का. आ. 660(अ)/18चक/18कक/आई.डी. आर.ए./83:- केन्द्रीय सरकार ने , भारत सरकार के उद्योग मंत्रालय , औद्योगिक विकास विभाग के आदेश में. का. आ. 613 (अ) / 18 चक/18 कक/ आई.डी. आर.ए./76 दिनांक 15 सितम्बर , 1976 द्वारा इण्ड- स्ट्रीयल रिकन्सट्रक्शन कारपोरेशन आफ इंडिया लिमिटेड , कलकत्ता (जिसे इसमें इसके पश्चात् प्राधिकृत व्यक्ति कहा गया है) मैसर्स बंगाल पाटरीज लिमिटेड कलकत्ता के स्वामित्व वाले 45 , टंगरा रोड , कलकत्ता और 3 , पगलाढ़ग रोड , कलकरता स्थित औद्योगिक उपक्रमों के सम्पूर्ण प्रबंध को 15 सितम्बर , 1976 से पांच साल की अवधि के लिए ग्रहण करने के लिए प्राधिकृत किया था ,
और उक्त उम्ब न्यायालय ने अपने , तारीस 12 सितम्बर , 1983 के आदेशानुसार प्राधिकृत व्यक्ति को उक्त दो औद्योगिक उपक्रमों का प्रबंध छह भास की और अवधि तक जारी रखने के लिए अनुज्ञात कर दिया था ।
अतः केन्द्रीय सरकार उक्त अधिनियम की धारा 18 कक के साथ पठित धारा 18 -चक की उप- धारा (2 ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , प्राधिकृत व्यक्ति को और केन्द्रीय सरकार ने भारत सरकार को उद्योग मंत्रालय (औद्योगिक विकास विभाग) के आदेश सं . का. आ. 657(अ)/ 18चक/18 कक/माई . डी. आर . ए./ 18 तारीख 14 सितम्बर , 1981 द्वारा प्राधिकृत व्यक्ति को उक्त औद्योगिक उपक्रमों का एक वर्ष की अतिरिक्त अवधि के लिए प्रबंध करते रहने के लिए प्राधिकृत किया था ,

निर्देश देती है , कि वह 15 सितम्बर , 1983 से आरम्भ होने वाली छह मास की और अवधि के लिए उक्त औद्योगिक उप- क्रमों का प्रबंध करना जारी रखें ।

ORDER
New Delhi , the 14th September , 1983
5.0. 660 (E) 18FA 18AA IDRA 83. Whereas by the order of the Government of India in the Ministry of Industry (Department of Industrial De- velopment ) No. S.O. 613 ( E) 18FA 18AA IDRA 76, dated the 15th September , 1976 the Central Government had authorised the Industrial Recon- struction Corporation of India Limited Calcutta (hereinafter referred to as the authorised person) to take over the management of the whole of the two industrial undertakings at 45, Tangra Road , Calcutta , and at 3 , Pagladanga Road , Calcutta, owned by Messrs Bengal Potteries Limited, Cal- cutta, for a period of five years from the 15th Sep- tember , 1976;
And, whereas , by the order of Government of India in the Ministry of Industry (Department of Industrial Development ) Nos . S.O. 665 ( E ) 18FA| 18AA IDRA 83 dated 14 September , 1982 and the Central Government authorised the authorised person to continue to manage the said two indus- trial undertakings for a further period of one year .
And whereas, by the orders of Government of India in the Ministry of Industry ( Department of Industrial Development ) Nos . S.O. 665 ( E ) | 18FA 18AA IDRA/ 82 dated 14th September , 1982 and S.O. 174(E) 18FA 18AA IDRA 83 dated the 14th March , 1983 the Central Government authorised the authorised person to continue to manage the said two industrial undertakings for a further pe- riod upto 14th September , 1983 .
And, whereas , the Central Government being of opinion that it was expedient in the interests of the general public that the authoristd person should continue to manage the said Industrial undertak- ings , made an application under the proviso to sub -section ( 2) of section 18FA of the Industries (Development and Regulation) Act, 1951 (65 of 1951 ) , to the Calcutta High Court praying for the continuance of such management for a further period of six months ;
And, whereas , the said High Court by its order dated the 12th September, 1983 permitted the authorised person to continue to manage the said two industrial undertakings for a further pe- riod of six months .

Now , therefore , in exercise of the powers con- ferred by the proviso to sub - section ( 2 ) of section 18FA read with section 18AA of the said Act , the Central Government hereby directs the authorised person to continue to manage the said two indus- trial undertakings for a further period of six months commencing from the 15th September , 1983 .

आदेश
का. आ. 661(अ)/18 चख/उ.वि.वि.अ./88 केन्द्रीय सरकार ने उद्योग (विकास और विनियमन) अधिनियम , 1951 (1951 का 65) की धारा 18 - चल की उपधारा (1) के रूण्ड (क) और (ख) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत मरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग) के आदेश मं. का. का. 39(अ)/ 18चल/ उ. वि. वि.अ./77 , तारीख 22 जनवरी , 1977 द्वारा ( जिसे इसमें इसके पश्चात उक्न आदेश कहा गया है) यह घोषणा की थी कि: -
(क) आंद्योगिक विवाद अधिनियम , 1947 (1947 का 14) , इम अनुकूलों सहित की उक्त अधिनियम की धारा 9 - क के अध्याय 5 -क और 5 - ख और धारा 33- ग का लोप किया जाएगा , मैसर्स बंगाल पाट- राीज लिमिटेड कलकत्ता के स्वामित्वाधीन दो आँयो- गिक उपक्रमों जो कि 45 , टंगरा रोड , कलकत्ता और 3 , पगलाढ़गा रोड , कलकत्ता में स्थित हैं , को लागू होगा , और
(ख) राजपत्र में उक्त आदेश के प्रकाशन की तारीख से ठीक पूर्व प्रवत्त ऐसी सभी संविदाओं संगत्ति के हस्तारण- पत्रों , करारो व्यवस्थापनों , पंबाटो स्थायी आदेशों या अन्य लिखतों का प्रवर्तन (उनसे भिन्न जिनका संबंध बैंकों और वित्तीय संस्थाओं के प्रतिभूत दायित्वों से है) जिनके उक्र ओद्योगिक उपक्रम पक्षकार है या ऐसे औद्योगिक उपक्रमों की स्वामी कम्पनी पक्षकार है , या जो यथास्थित , उन औद्योगिक उपक्रमों या कम्पनी को लागू होने हों , और उक्त तारीख के पूर्व उनके अधीन प्रोद्भूत या उद्भुत सभी या कोई अधिकारी विद्याधिकार बाध्यताएं और दायित्व विलंबित रहेगा ,
और उक्त आदेश की अवधि समय - समय पर और 14 सितम्बर , 1983 तक के लिए जिसमें यह तारीख भी सम्मिलित है , बढ़ा दी गई थी,
और केन्द्रीय सरकार का समाधान हो गया है कि उबन आदेश की अवधि 14 मार्च, 1984 तक के लिए जिसमें यह तारीख भी सम्मिलित है , बढ़ा दी जानी चाहिए ,
अतः अब , केन्द्रीय सरकार , उद्योग (विकास और विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 18 - चल की उप- धारा ( 2) के साथ पठित उपधारा ( 1) के खण्ड ( क्र) और (स) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त अवधि 14 मार्च , 1984 तक के लिए जिसमें बह तारीख भी सम्मिलित है , बढ़ाती है ।

ORDER
S.O. 661 ( E ) 18FB IDRA 83.-Whereas by the order of the Government of India in the Ministry of Industry (Department of Industrial Develop- ment ) No. S.O. 39 ( E ) 18FA IDRA 77 , dated the 22nd January, 1977 ( hereinafter referred to as the said Order ) , the Central Government in exercise of the powers conferred by clauses ( a ) & ( b ) of sub - section ( 1 ) of section 18FB of the Industrics (Development & Regulation ) Act , 1951 ( 65 of 1951) declared that :-
( a ) the Industrial Disputes Act, 1947 ( 14 of 1947) , shall apply to the two industrial undertakings at 45 Tangra Road Cal- cutta, and 3 Pagladanga Road , Calcutta owned by Ms. Bengal Potteries Limited, Calcutta with the adaptation that section 9A , Chapters , VA and VB and section 33C of the said Act shall be omitted , and
(b) the operation of all contracts , assurances of property, agreements , settlements , awards , standing orders or other instru- ments in force immediately before the dated of publication of the said Order in the Official Gazette (other than those relating to secure liabilities to banks and financial institutions ) , to which the said industrial undertakings are parties , or the company owing such industrial under- takings , is a party or which may be ap- plicable to the industrial undertakings of the company, as the case may be and all or any of the rights , privileges obli- gations and liabilities accruing or arising thercunder before the said date , shall re- main suspended;
And , whereas , the duration of the said Order was extended from time to time upto and inclusive of the 14th September, 1983 ;
And , whereas , the Central Government is satis- fied that the duration of the said order should be extended for a further period upto and inclusive of the 14th March, 1984;
Now, therefore , in exercise of the powers con- ferred by clause ( a) and (b ) of Sub-section ( 1) , read with sub-section (2) of section 18FB of the Industries (Development and Regulation) Act , 1951 ( 65 of 1951 ) , the Central Government here- by extends the duration of the said Order upto and inclusive of the 14th March , 1984.
