अधिसूचनाएं
निम्नलिखित शर्तों के अधीन रहते हुए , छूट देती है , अर्थात्ः-
सं ० 267/83-सीमा- शुल्क दई दिल्ली, 20 सितम्बर, 1983
( क) ऐसी आयातित एलुमिनियम की पत्नी का , उक्त ऐसी एलुमिनियम की पन्नी में उपयोग किया जाता है जो पालिथिलीन फिल्म से पटलित है और जिसकी मोटाई 0.02 मिमी ० से 0.04 मिमी के बीच है और उसमें 97 प्रतिशत से अधिक एलुमिनियम है ;
सा ० का ० ति० 733 (अ) केन्द्रीय सरकार , सीमा शुल्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 25 कीं उपधारा ( 1 ) द्वारा प्रदस शक्तियों का प्रयोग करते हुए, अपना यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है , मीमाशुल्क टैरिफ अधिनियम, 1975 (1975 का 51) की पहली अनुसूची के अध्याय 76 के अन्तर्गत आने वाली ऐसी एलुमिनियम की पन्नी को जो पालिथिलीन फिल्म में पटलित है , जब उसका भारत में आयात किया जाए:--
( ख ) आयातकर्ता तकनीकी विकास महा निदेशक या भारत सरकार के विकास आयुक्त (लघु उद्योग ) द्वारा जारी किया गया इस आशय का प्रमाण- पत्त्र प्रस्तुत करता है कि-
(i) उक्त पहली अनुसूची के अधीन उस पर उग्रहणीय सीमाशुल्क के उतने भाग से जितना मूल्य के 60 प्रतिशत की दर पर संगणित रकम से अधिक
(i) आयातकर्ता के पास औषधियों और औषधियों के विनिर्माण के लिए एक अनुमोदित कार्यक्रम है ; और

( ii) ऐसे आयातित एलुमिनियम की पत्नी जो पालि- थिलीन फिल्म से पटलित है , आयातकर्ता द्वारा औषधियों और औषधियों की स्ट्रिप पैकिंग के प्रयोजन के लिए अपेक्षित होगी ।
( ग) आयातकर्ता , यथास्थिति, तकनीकी विकास महानि- देशक या भारत सरकार के विकास आयुक्त ( लयु उद्योग) से उस आशय का प्रमाणपत्र प्रस्तुत करता है कि ऐसी एलुमिनियम की पत्नी का जो आयातित पालिथिलीन फिल्म से पटलित है उपरोक्त प्रयोजन के लिए उपयोग प्रयोग किया गया है;
(घ ) आयातकर्ता सीभाशुल्क सहायक कलक्टर द्वारा विनिर्दिष्ट प्ररूप में और राशि के लिए बन्धपत्न निष्पादित करके , स्वयं को इस बात के लिए आबद्ध करता है कि यह उक्त एलुमिनियम पन्नी की जो पालिथीलीन फिल्म से पटलित है , ऐसी मात्रा की बाबत जिसके बारे में , यथास्थिति, तकनीकी विकास महानिदेशक या भारत सरकार के विकास आयुक्त ( लयु उष्ण्योग ) द्वारा यह प्रमाणित नहीं किया जाता कि उसका पूर्वोक्त प्रयोजन के लिए उपयोग किया गया है, मांग किए जाने पर उतनी रकम का संदाय करेगा जो इस अधिसूचना में अन्तर्विष्ट छूट के न दिए जाने की दशा में , ऐसी मात्रा पर उग्रहणीय शुल्क और आयात किए जाने के समय पहले ही संदत्त शुल्क के बीच के अन्तर के बराबर हो ।
2. यह अधिसूचना 31 दिसम्बर , 1983 तक , जिसमें यह तारीख भी सम्मिलित है , प्रवृत्त रहेगी ।

MINISTRY OF FINANCE (Department of Revenue) NOTIFICATION No. 267/ 83 - COSTOMS New Delhi , the 20th September, 1983
G.S.R. 733 (E) . In exercise of the powers con- ferred by sub- section ( 1) of section 25 of the Cus- toms Act, 1962 (52 of 1962) , the Central Govern- ment, being satisfied that it is necessary in the pub- lic interest so to do, hereby exempts aluminium foil laminated with polythylene film and failing within Chapter 76 of the First Schedule to the Customs Tariff Act , 1975 (51 of 1975) , when imported into India, from--
(i) so much of that portion of the duty of customs leviable thereon under the said First Schedule as is in excess of the amount calculated at the rate of 60 % ad -valorem; and

(ii) the whole of the additional duty leviable thereon under section 3 of the said Customs Tariff Act, subject to the fol- lowing conditions, namely :
(a) the imported aluminium foil used in the said aluminium foil laminated with polythylene film is of a thickness bet- ween 0.02 mm to 0.04 hm and con- tains more than 97 per cent of alumi- nium;
(b) the importer produces a certificate issued by the Director General of Technical Development or the Deve- lopment Commissioner (Small Scale Industries) of the Government India, to the effect that- of
(i) the importer has an approved prog- gramme for the manufacture of drugs and medicines ; and
(ii) the imported aluminium foil lami- nated with polythylene film shall be required by the importer for the purpose of strip packing of drugs and medicines ;
(c) the importer produces a certificate from the Director General of Technical De- velopment of the Development Com- missioner (Small Scale Industries) of the Government of India, as the case may be, to the effect that the alumi- nium foil laminated with polythylene film imported has been used for the aforesaid purpose;
(d) the imported executes a bond in such form and for such sum as may be specified by the Assistant Collector of Customs, binding himself to pay, on demand, in respect of such quantity of the scaid aluminium foil laminated with polythylene film as is not certi- fied by the Director General of Techni- cal Development or the Development Commissioner (Small Scale Industries) of the Government of India, as the case may be , to have been used for the aforesaid purpose , an equal to the difference between the duty which would have been leviable on such quantity, but for the exemp- tion contained herein and that already paid at the time of importation . amount
2: This notification shall be in force upto and inclusive of the 31st day of December , 1983 .

सा० का० ति ० 734( अ) - कैन्द्रीय सरकार, वित्त अधिनियम, 1983 ( 1983 का 11) की धारा 45 की उपधारा ( 4) के साथ पठित सीमाशुल्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 25 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपना यह समाधान हो जाने पर कि लोक हित में ऐसा करना आवश्यक है, भारत भरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना में ० 126/83 सीमा शल्क तारीख 13 मई, 1983 का निम्त लिखित और संशोधन करती है, अर्थान्ः-
उक्त अधिसूचना की अनुसूची में क्रम सं० 230 और उसस संबंधित प्रविष्टि के पश्चात् निम्नलिखित क्रम सं० और प्रविष्टि अंतःस्थापित की जाएगी, अर्थातः-
" 231 सं० 267/83 सीमाशुल्क , तारीख 20 सितम्बर 1983"

In exercise of the powers con- ferred by sub- section ( 1) of section 25 of the Customs Act , 1962 (52 of 1962) , read with sub- section (4) of section 45 of the Finance Act, 1983 (11 of 1983 ) , the Central Government, being satis- fied that it is necessary in the public interest so to do, hereby makes the following further amend- ment in the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 126/ 83 -Customs , dateddated thethe 13th May, 1983 , namely :-
In the Schedule to the said notification after Serial No. 230 and the entry relating thereto, the following Serial No. and entry shall be inserted, namely :-
"231. No. 267/ 83 - Customs, dated the 20th September, 1983 " .
