का०प्रा० 699 (अ) / 18 कक/आई० डी० आर ० ए०/ 83:- यतः , भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग ) के आदेश संख्या 293( अ) / 18 कक/ आई ० डी० आर ० ए० / 78 दिनांक 1 मई, 1978 ( जिसे इसमें इसके पश्चात उक्त आदेश कहा गया है) द्वारा एल्यूमीनियम कारपोरेशन आफ इंडिया लि० , कलकत्ता के आसनसोल के समीप जे ० के ० नगर में स्थित औद्योगिक उपक्रम का प्रबन्ध उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65) की धारा 18कक की उपधारा ( 1) के अधीन 30 अप्रैल, 1979 तक ( जिसमें यह दिन भी शामिल है ) एक वर्ष की अवधि के लिए ग्रहण किया गया था तथा भारत एल्यूमी- नियम कंपनी लि० को उ५० औद्योगिक उपक्रम का प्रबंध करने के लिए प्राधिकृत किया गया था ।

और , यतः , भारत सरकार के उद्योग मंत्रालय (औद्यो- गिक विकास विभाग ) के आदेशों दिनांक 25 अप्रैल, 1979 के का०आ० संख्या 224 ( ई ) , विनांक 29 अप्रैल , 1980 का का ०आ० 286 ( ई ) , दिनांक 31 अक्तूबर , 1980 का का०आ० 869 ( ई)/ 18कक/ आई ० डी ० आर० ए० / ४० , दिनांक 30 अप्रैल , 1981 का का०आ० 325( ई) / 18कक/ आई ०डी० आर ० ए ० / 81 , दिनांक 30 अप्रैल, 1982 क का०आ ० 290 ( ई ) , दिनांक 31 जुलाई , 1982 का का ० आ ० 539( ई) तथा दिनांक 28 मार्च , 1983 का का ० आ ० 235 ( ई) / 18कक/ आई ० डी० आर ० ए०/ 83 , द्वारा उक्त आदेश की अवधि समय -समय पर 30 सितम्बर , 1983 तक बढ़ा दी गई थी ।
और, यतः , केन्द्र सरकार की राय में लोक हित में यह समीचीन है कि उक्त औद्योगिक उपक्रम को 31 मार्च , 1984 तक 6 महीने की और अवधि के लिए भारत एल्यूमीनियम कंपनी लि० के प्रबन्ध में बना रहने दिया जाना चाहिए ।
अतः, अब , केन्द्रीय सरकार औद्योगिक ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65 ) की धारा

18कक की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निदेश देती है कि उक्त आदेश 31 मार्च , 1984 तक , जिसमें यह दिन भी शामिल है, 6 महीने की आगामी अवधि के लिए प्रभावी बना रहेगा ।

S.O. 699 ( E ) 18AA IDRA 83. Whereas by the order of the Government of India in the Ministry of Industry ( Department of Industrial Develop- ment ) No. 293 (E ) 18AA IDRA 78 , dated the 1st May , 1978 (hereinafter referred to as the said order ) , the management of the industrial under- taking located at Jaykaynagar near Asansol be- longing to the Aluminium Corporation of India Limited, Calcutta, was taken over under sub- section ( 1 ) of section 18AA of the Indus- trics (Development and Regulation ) Act, 1951 (65 of 1951 ) , for a period of one year upto and inclusive of the 30th April , 1979 , and the Bharat Aluminium Company Limited was authorised to take over the management of the said industrial undertaking;
And, whereas , by the Orders of the Government of India in the Ministry of Industry ( Department of Industrial Development ) No. S.O. 224 (E) , dated the 25th April , 1979 , No. S.O. 286( E ) , dated the 29th April , 1980, No. S.O. 869 ( E ) 18AA IDRA 80, dated the 31st October , 1980 , No. S.O. 325 ( E )| 18AA IDRA 81 , dated the 30th April , 1981 , S.O. 290 ( E) , dated the 30th April , 1982, S.O. 539 ( E) , dated the 31st July , 1982 and S.O. 235 (E ) 18AA IDRA 83 , dated the 28th March , 1983 , the duration of the said Order was extended from time to time for a further period upto the 30th September , 1983 ;
And, whereas , the Central Government is of opinion that it is expedient in the public interest that the said industrial undertaking should conti- nue under the management of the Bharat Alumi- nium Company Limited for a further period of six months upto the 31st March , 1984;
Now, therefore , in exercise of the powers con- ferred by sub-section ( 2 ) of section 18AA of the Industries (Development and Regulation) Act , 1951 ( 65 of 1951 ) , the Central Government here- by directs that the said Order shall continue to have effect for a further period of six months upto and inclusive of the 31st March , 1984.

कॉ० श्रा ० 700 (अ) / 18 वख/आई ० डी० आर ० ए ० / 83.- यनः भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग ) के दिनांक 2 मई, 1978 के का ० आ० संख्या 302(अ) / 18 एफ ० बी० आई ०डी ० आर ० ए ०/ 78 ( जिसे इसमें इसके पश्चात उक्त आदेश कहा गया है ) द्वारा केन्द्रीय सरकार ने उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 -चख की 'उपधारा ( 1 ) के खंड (ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा की थी कि उक्त आदेश के जारी होने की तारीख से ठीक पूर्व प्रदत्त ऐसी संविदाओं, सम्पत्ति के हस्तान्तरण , पत्त्रों, करारों, ममझोतों, पंचाटों, स्थायी आदशों या अन्य लिखतों, जिनका एल्यूमिनियम कारपोरेशन आफ इंडिया लि. कलकत्ता के आमनमोल के समीप जे ० के ० नगर स्थित औद्योगिक उपक्रम एक पक्षकार है, या जो उक्त औद्योगिक उपक्रम पर लागू हो सकते हों, का प्रवर्तन एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख के पूर्व उनके अधीन प्रोद्भूत या उद्भूत होने वाले सभी अधिकार, विशेषाधिकार , बाध्यताएं और दायित्व एक वर्ष की अवधि के लिए निलम्बित रहेंगे ।
30 और, यतः , भारत सरकार के उद्योग मंत्रालय , औद्योगिक विकास विभाग के दिनांक 25 अप्रैल , 1979 के का ० आ० संख्या 225 ( अ) /18 चख/आई० डी० आर० ए ०/ 79 , दिनांक 29 अप्रैल, 1980 का का ० आ० संख्या 287/18चख/ आई ०डी० आर ०००/ 80 दिनांक 31 अक्तूबर , 1980 का ० आ० संख्या 870 ( अ) / 18चख/आई० डी० आर ० ए० /80 , दिनांक अप्रैल , 1981 का का ०आ ० संख्या 326 ( ई)/ ४ चख/आई ० डी०आर ० ए ० / 81 दिनांक 30 अप्रैल , 1982 का का ०आ० संख्या 291 (अ ) , 31 जुलाई, 1982 का का ० आ ० संख्या 540(अ ) , दिनांक 28 मार्च , 1983 का का ० आ ० संख्या 236 (अ) / 18चख/आई ० डी० आर ० ए ०/ 83 और 28 मई, 1983 का का ०आ० संख्या 380 (अ ) द्वारा उक्त आदेश की अवधि समय -समय पर 30 सितम्बर, 1983 तक की आगामी अवधि के लिए और बढ़ा दी गई थी ।
और, यतः , केन्द्रीय सरकार संतुष्ट है कि उक्न आदेश की अवधि और 6 महीने यानी 31 मार्च , 1984 तक , जिसमें यह दिन भी शामिल है , बढ़ा देनी चाहिए ।
अब , अतः , केन्द्रीय सरकार उद्योग ( विकास और विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 18 चख की उपधारा ( 2 ) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त णक्तियों का प्रयोग करते हुए उक्त आदेश की अवधि 31 मार्च, 1984 तक , जिसमें यह दिन भी शामिल है , बढ़ाती है ।

the 2nd May , 1978 , (hereinafter referred to as the said Order ) , the Central Government , in exercise of the powers conferred by clause (b ) of sub- sec- tion ( 1) of section 18FB of the Industries ( Deve- Jopment and Regulation) Act, 1951 ( 65 of 1951 ) , had declared that the operation of all contracts , assurances of property agreements , settlements , awards , standing orders or other instruments in force immediately before the date of issue of the said Order to which the industrial undertaking located at Jaykaynagar near Asansol and belong- ing to the Aluminium Corporation of India Limit- ed, Calcutta, is a party or which may be appli- cable to the said Industrial undertaking , shall re- main suspended for a period of one year and that all rights , privileges , obligations and liabilities ac- cruing or arising thereunder before the said date shall remain suspended for a period of one year ;
And, whereas by the Orders of the Government of Iudia in the Ministry of Industry (Department of Industrial Development ) No. S.O. 225 ( E) | 18FB IDRA 79 , dated 25th April, 1979 , No. S.O. 287 (E ) 18FB IDRA 80 dated the 29th April , 1980 , S.O. 870 / 18FB/ JDRA 80 dated the 31st October , 1980, No. S.O. 326 ( E) 18FB IDRA 81 , dated 30th April , 1981 , No. S.O. 291 ( E ) , dated 30th April , 1982 , S.O. 540 (E) , dated the 31st July, 1982, S.O. 236 (E) 18FB IDRA 83 dated the 28th March , 1983 and S.O. 380 (E) dated the 28th May , 1983 the duration of the said Order was further extended from time to time for a fur- the period upto the 30th September , 1983 ;
And , whereas , the Central Government is satis- fed that the duration of the said Order should be extended for a further period of six months upto and inclusive of the 31st March , 1984 ;
Now, therefore , in exercise of the powers con- ferred by sub- section ( 1 ) read with sub- section ( 2) of section 18FB of the Industries ( Develop- ment and Regulation ) Act , 1951 (65 of 1951 ) , the Central Government hereby extends the dura- tion of the said Order upto and inclusive of the 31stMarch , 1984 .
