सा. का. नि. 779(अ) आंषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए कुछ नियमों का निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार औषधि तकनीकी सन्नाहकार बोर्ड से परामर्श करने के पश्चात् औषधि और प्रसाधन मामग्री अधिनियम , 1940 ( 1940 का 23) की धारा12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बनाना चाहती है, उवत धाराजों की अपेक्षानुसार ऐसे सभी व्यक्तियों की जान- कारी के लिए प्रकाशित किया जाता है , जिनके उससे प्रभावित होने की सम्भावना है । इसके द्वारा यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उम तारीख से जिसको उस राजपत्र की प्रति, जिसमें यह अधिसूचना प्रकाशित की जाए जनता को उप- लब्ध की जाए , नब्बे दिन की अवधि की समाप्ति वर या उसके पश्चात विचार किया जाएगा ।
ऐसे आक्षेपों या सुझावों पर जो पर्योक्त नब्बे दिन की समाप्ति में पहले उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त होंगे, केन्द्रीय सरकार विचार करेगी ।
बाक्षेप वा सुझाब , यदि कोई हों , सचिव , भारत सरकार , स्वास्थ्य और परिवार कल्याण मंत्रालय , निर्माण भवन , नई दिल्ली गो भेजे जा सकेंगे ।
प्रारूप नियम
1. इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री (संशोधन) नियम , 1983 है ।
2. औषधि और प्रसाधन सामग्री नियम , 1945 के ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) नियम 71 में , शर्त 1 में , प्रथम परंतुक के स्थान पर निम्नलिखित परन्तक रखें जाएंगे , अर्थात्
"परन्तु यह कि सूत्रयोगों के विनिर्माण के प्रयोजन के लिए ,
(क) ऐसे पूर्णकालिक कर्मचारी के लिए जिसके सक्रिय निशिन और व्यबितक पर्यवेक्षण के अधीन विनि- मर्माण किया जाता है यह आवश्यक होगा कि उसके पास खंड (क) में विनिर्दिष्ट अर्हताएं हां :
(ख) किसी ऐसे व्यक्ति को जिसके पास , खंड (ख) , खंड (ग) या खंड (घ) में विनिदिष्ट अर्हताएं हैं और जो किसी अनुज्ञप्तिधारी के किमी विनिर्माण प्रभाग में औषधि और प्रसाधन सामग्री (संशोधन) नियम , 1983 के प्रारम्भ से ठीक पहले कार्य कर रहा था , उस हैसियत में तीन वर्ष की सेवा पूरी कर लेने के पश्चात्, एक सक्षम तकनीकी कर्मचारिन्द के रूप में , मान्यता दी जा सकेंगी ।

स्पष्टीकरण-इस नियम के प्रयोजन के लिए , " सूत्र- योगों के विनिर्माण " के अन्तर्गत है मनुष्यों या जीवजन्तुओं के खाने या लगाने के लिए तैयार रूप में किसी औषधि की मात्रा की प्रक्रिया:
परन्तु यह गौर कि किसी ऐसे व्यक्ति के बारे में जो औषधि और प्रसाधन ( संशोधन) नियम , 1983 के प्रारम्भ से ठीक पहले , औषधियों के विनिर्माण सक्रिय निदेशन और वैयक्तिक पर्यवेक्षण कर रहा था , और तद्नुसार उसका नाम , प्ररूप 25 में , विशेषनीय कर्मचारिवन्द के रूप में दर्ज था , यह समझा जाएगा कि इस नियम के प्रयोजन के लिए अहित है । "
3. उक्त नियमों के नियम 76 में , शर्त ( 1) के पहले परन्त्क के स्थान पर निम्नलिखित परन्तुक रखा जाएगा , अर्थात्一
परन्तु यह कि सूत्रयोगों के विनिर्माण के प्रयोजन के लिए--
(क) ऐसे पूर्णकालिक कर्मचारी के लिए जिसके सक्रिय निदेशन और वैयक्तिक पर्यवेक्षण के अधीन विनि- र्माण किया जाता है यह आवश्यक होगा कि उसके पास खंड (क) में विनिर्दिष्ट अर्हताएं हों ;
(ख) किसी ऐसे व्यक्ति को जिसके पास , खंड(खा) , खंड (ग) या खंड (घ) में विनिदिष्ट अर्हताएं हैं और जो किसी अनुज्ञप्तिधारी के किसी विनिर्माण प्रभाग में औषधि और प्रसाधन सामग्री (संशोधन ) नियम , 1983 के प्रारम्भ से ठीक पहले कार्य कर रहा था , उस हैसियत में तीन वर्ष की सेवा पूरी कर लेने के पश्चात् एक सक्षम तकनीकी कर्मचार- वृन्द के रूप में , मान्यता दी जा सकेगी ।
स्पष्टीकरण- इस नियम के प्रयोजन के लिए , " सूत्रयोगों के विनिर्माण" के अन्तर्गत है मनुष्यों या जीव- जन्तुओं के खाने या लगाने के लिए तैयार रूप में किसी औषधि की मात्रा की प्रक्रिया :
परन्तु यह और कि किसी ऐसे व्यक्ति के बारे में औषधि और प्रसाधन (संशोधन) नियम , 1983 को प्रारम्भ से ठीक पहले , औषधयों के विनिमाण का सक्रिय निदेशक और व्यवितक पर्यवेक्षण कर रहा था . और तनुसार उसका नाम, प्ररूप 28 में अनुमोदित विशेषज्ञीय कर्मचारिवृन्द के रूप में वजे था , यह समझा जाएगा कि इस नियम के प्रयोजन के लिए अहित है ।

G.S.R. 779 (E) . The following draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 which the Central Government pro- poses to make after consultation with the Drugs Technical Advisory Board, in exercise of the powers conferred by sections 12 and 33 of the
[ PART II-SEC . 3 (i ) ]
Drugs and Cosmetics Act , 1940 (23 of 1940) , is hereby published, as required by the said sections for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules will be taken into consideration on or after the expiry of a period of ninety days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public .
Any objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period of ninety days will be taken into consideration by the Central Government .
Objections or suggestions , if any, maybe sent to the Secretary to the Government of India , Ministry of Health and Family Welfare , Nirman Bhavan, New Delhi . DRAFT RULES 1. These rules may be called the Drugs and Cosmetics (Amendment) Rules , 1983 .
2. In the Drugs and Cosmetics Rules , 1945 (hereinafter referred to as the said rules) , in rule 71 , in condition 1 , for the first proviso , the fol- lowing provisos shall be , substituted , namely :
"provided that for the purpose of manufacture of formulations ,-
(a) it shall be necessary for the whole- time employee under whose active direction and personal supervision the manufac- ture is conducted to have the qualifica- tions specified in clause (a) ;
or (b) any person, holding the qualifications specified in clause ( b) , clause (c) clause (d) and who was working in a manufacturing division of a licensee im- mediately before the commencement of the Drugs and Cosmetics (Amendment) Rules , 1983 , may after the completion of three years service in that capacity be recognised as a competent technical staff :
Explanation. For the purpose of this rule, "manufacture of formulations " includes the processing of a drug into a dosage form ready for internal or external ad- ministration to human beings or animals:
Provided further that any person who was im- mediately before the commencement of the Drugs and Cosmetics ( Amendment) Rules , 1983 , actively directing and personally supervising the manufac- ture of drugs and whose name was accordingly entered in Form 25 as expert staff shall be deemed to be qualified for the purpose of this rule " 3

3. In rule 76 of the said rules , in condition 1 , for the first proviso, the following provisos shall be substituted, namely :----
"Provided that for the purpose of manufac- ture of formulations ,-
(a) it shall be necessary for the whole- time employee under whose active direction and personal supervision the manufac- ture is conducted to have the qualifica- tions specified in clause (a) ;

(b) any person holding the qualifications spe- cified in clause (b), clause (c) or clause (d) and who was working in a manufac- turing division of a licensee immediately before the commencement of the Drugs and Cosmetics (Amendment) Rules , 1983.
may after the completion of three years service in that capacity be recognised as a competent tech- nical staff :
Explanation.-For the purpose of this rule , "manufacture of formulations " includes the processing of a drug into a dosage form ready for internal or external administra- tion to human beings or animals :
Provided further that any person who was im- mediately before the commencement of the Drugs and Cosmetics (Amendment) Rules , 1983 , actively directing and personally supervising the manufac- ture of drugs and whose name was accordinglyen- tered in Form 28 as approved expert staff shall be deemed to be qualified for the purpose of this rule." .
