था. अ. 90(अ) .-निर्वाचन आयोग का , निर्वाचन प्रतीक (आरक्षण और आबंटन) आदेश ,1968 के पैरा 7 के साथ पठित पैरा 6 के उण्बन्धों के अनुमरण में , यह समाधान हो गया है किरिवोल्यूशनरी सोशलिस्ट पाटी , जनवरी , 1983 में हुए त्रिपूरा राज्य की विधान सभा के साधारण निर्वाचन में उसकी मतदान में गम्पादित स्थिति के परिणामस्वरूप , उक्त आदेश के पैरा 6 के अनुसार त्रिपुरा राज्य में एक राज्यीय दल के रूप में मान्यता प्राप्त करने के लिए हकदार है ;
और निर्वाचन आयोग ने रिवोल्यूशनरी सोशलिस्ट पार्टी को त्रिप्रा राज्य में एक 'राज्यीय दल के रूप में मान्यता देने का निर्णय किया है ;
अतः अब , निर्वाचन आयोग , उक्त प्रतीक आदेश के पैरा 17 के उप -पैरा (1 ) के खण्ड (ख) और (ग) और उप-पैरा (2 ) के अन्मरण में , भारत के राजपत्र , असाधारण , भाग-2 , खण्ड 3 (3 ) , तारीख 12 अप्रैल , 1982 में का. आ. 29 (अ) के रूप में प्रका- शित और समय -समय पर यथा संशोधित अपनी अधिसूचना नं. 56/82, तारीख 8 अप्रैल , 1982 में निम्नलिखित संशोधन करता है , अर्थात
(
1) उक्त अधिसूचना की सारणी 2 में स्तम्भ 1 के अधीन उल्लिखित त्रिप्रा राज्य के सामने , स्तम्भ 2 और 3 के अधीन विद्यमान प्रविष्टि " त्रिप्रा उपजाति जुबा समिति दो पत्तियां" के स्थान पर , निम्नलिखित प्रविष्टियां , " 1-रिवोल्यशनरी सोशलिस्ट पार्टीफावड़ा और बेलचा । 2-त्रिपुरा उपजाति जुबा समितिवो पत्तियां" रखी जाएंगी ।
(2) उक्त अधिसूचना की सारणी 4 में , स्तम्भ 1 में मद 20त्रिपरा के सामने , स्तम्भ 2 के अधीन " 11 फावड़ा और बेलवा" प्रविष्टि हटा दी जाएगी और विद्य- मान प्रविष्टियां12 और 13 को क्रमशः 11 और 12के रूप में पुनः संख्यांकित किया जाएगा ;
उपयुक्स राजनैतिक दल को प्रदत्त मान्यता निम्नलिखित शतों के अध्यधीन है :-
(1) दल बिना देरी किए निर्वाचन आयोग को अपने नाम , मुख्यालय , पदाधिकारीयों के पतों , और राजनैतिक सिद्धांतों , नीतियां, लक्ष्यों और उद्देश्यों में

2. Tripura Upajati Juba Samiti ...... Two leaves".
किसी प्रकार के परिवर्तन तथा किसी अन्य महत्व पूर्ण मामले में किसी प्रकार के परिवर्तन के बारे में संसूचित करेगा ;
2. In Table 4 of the said notification , against item 20. Tripura in column 1 the entry '11 . Spade and Stoker " under column 2 shall be deleted and the existing entries 12 and 13 shall be renumber- ed as 11 & 12, respectively;
(2) दल जब कभी दल के विधान में किसी प्रकार का संशोधन करता है तो उनकी सूचना सुसंगत दस्तावेजों जैसे संशोधनों पर विचारार्थ बैठक की सूचना , बैठक के लिए कार्यसूची , उस बैठक का कार्यवृत्त जिसमें संशोधन किए गए , आदि के साथ तत्काल निर्वाचन आयोग को सूचित करेगा ;
The recognition granted to the above- mention- ed political party is subject to the following con- ditions :-
(3) दल सभी अभिलेखों जैसे कार्यवृत्त पुस्तक , लेखा बहियों , सदस्यता रजिस्टरों , रसीद अहियां आदि का समुचित रूप से रख - रखाव करेगा ;
( i ) The Party shall communicate to the Com- mission without delay and change in its name, head office , office bearers , address and political principles , poli- cies, aims and objectives and any change in any other material matters;
(4) निर्वाचन आयोग के प्राधिकृत प्रतिनिधियों द्वारा उक्त अभिलेखों का किसी भी समय निरीक्षण किया जा सकेगा ; और
(5) निर्वाचन आयोग द्वारा दी गई मान्यता का समय -समय पर पुनर्विलोकन किया जा सके ।

(ii ) The Party shall intimate the Commission immediately whenver any amendments are issued to Party constitution along with the relevant documents like the notice for the meeting to consider amendments , agenda for the meeting, minutes of the meeting where the amendments have been carried etc .:

( iii ) The party shall maintain all the records like minutes books , accounts books , membership registers , receipt books etc. properly;
(iv) The said records shall be open for ins- pection at any time by the authorised representative(s) of the Commission; and
(v) The recognition granted shall be review- ed by the Commission from time time. to Ο.Ν. 90 ( E ) . Whereas the Election Commis- sion, in pursuance of the provisions of paragraph 6 read with paragraph 7 of the Election Symbols (Reservation and Allotment) Order, 1968 , is satisfied that as a result of its poll performance at general election to the Legislative Assembly of Tripura State held in January, 1983 , the Revo- lutionary Socialist Party is entitled for recogni- tion as a State Party in the State of Tripura in terms of para 6 of the said Order;
[No. 56/ 82- ΕΙΙ ] And whereas the Commission has decided to recognise the Revolutionary Socialist Party in Tri- pura State as a State Party;
आ. अ. 01(अ) रिवोल्यूशनरी सोशलिस्ट पार्टी केरल और पश्चिमी बंगाल राज्यों में प्रतीक " फावड़ा और बलचा" के साथ जो कि निर्वाचन प्रतीक ( आरक्षण और आबंटन) आवेश 1968 के अधीन इन राज्यों में उसके लिए आर्राक्षत हैं , एक मान्यता प्राप्त राजनैतिक दल है ;
और , निर्वाचन आयोग ने उक्त आदेश के पैरा 6 के अनुसरण मों, मई , 1982 में हुए केरल की और पश्चिमी बंगाल की विधान सभा के साधारण निर्वाचन में उक्त दल की मतदान में सम्पादित स्थिति का पुनर्विलोकन किया है ;
Now, therefore, in pursuance of clauses (b) and (d) of sub- paragraph ( 1 ) and sub - paragraph (2) of paragraph 17 of the said symbols Order , the Election Commission hereby makes the fol- lowing amendments in its notification No. 56/82 , dated the 8th April , 1982 , published as Ο.Ν. 29 (E) , in the Gazette of India Extraordinary, Part II, Section 3 ( iii) , dated the 12th April , 1982, amended from time to time, namely :- as
और निर्वाचन आयोग का यह समाधान हो गया है कि उक्त पुनर्विलोकन के परिणामस्वरूप रिवोल्यूशनरी सोशलिस्ट पार्टी केरल राज्य में मान्यता को बनाए रहने के लिए हकदार नहीं है ;
(1) In Table 2 of the said notification, against the State of Tripura referred to under column 1, for the existing entry 'Tripura Upajati Juba Samiti Two Leaves' under columns 2 and 3 , the following entries shall be substituted :
"1. Revolutionary Socialist Party and Stoker . Spade
और , निर्वाचन आयोग ने तारीख 13 जुलाई , 1983 को उक्त दल' को यह स्पष्ट करने के लिए एक नोटिस जारी किया है कि क्योंन केरल राज्य में मतदान में उसको कमज़ोर सम्पादित स्थिति के कारण उस राज्य की मान्यता प्राप्त राजनीतिक दलों की सूची से उसका नाम हटा दिया जाना चाहिए ;

और इस बारे में उक्त दल को अनुस्मारक भेजने के बावजूद इस दल ने उक्त नोटिस का उत्तर नहीं दिया है और इस प्रकार पर्याप्त समय बीत चुका है ;
और निर्वाचन आयोग ने उक्त दल की मान्यता को करेल राज्य मे वापस लेने का विनिश्चय किया है ;
अतः अब , निर्वाचन आयोग , उक्त आदेश के पैरा 17 के उप- पैरा (1) के खण्ड (ख) और उप - पैरा (2) तथा पैरा 18 के अनुसरण में भारत के राजपत्र , असाधारण भाग -2 , सण्ड 3 ( 3) , तारीख 12 अप्रैल , 1982 के का. आ. 29 (अ) के रूप में प्रकाशित और समय समय पर यथा संशोधित अपनी अधिसूचना सं . 58/82 , तारीख 8 अप्रैल1982 में निम्नलिखित संशोधन करता है : अर्थात:-
उक्त अधिसूचना से संलग्न सारणी 2 भ , स्तम्भ 1 में वर्णित केरल राज्य के सामनें , स्तम्भ 2 और 3 में क्रमशः उल्लिखित 5 रिवोल्यूशनरी सोशलिस्ट पार्टी " फावड़ा और बेलमा " प्रविष्टि हटा दी जाएगी ।

Ο.Ν. 91 (E ) . Whereas the Revolutionary Socialist Party is a recognised political Party in the States of Kerala and West Bengal with the Symbol ' Spade and Stoker' reserved for it in these States , under the Election Symbols (Reservation and Allotment ) Order , 1983 ;
And whereas , in pursuance of paragraph 6 of the said order, the Election Commission has reviewed the poll per- formance of the said Party in the general election to the Legislative Assembly of Kerala and West Bengal held in May, 1982 ;
And whereas the Election Commission is satisfied that as a result of the said review the Revolutionary Socialist Party is not entitled for continued recognition in the State of Kerala ;
And whereas the Commission has issued a notice to the said Party on 13 July, 1983 to explain as to why its name should not be deleted from the list of recognised political parties in Kerala State on account of its poor poll perfor- nuance in that State ;
And whereas the said Party has not responded to the said notice in spite of a reminder to the Party in this regard and a considerable time has thus elapsed ;
And whereas the Election Commission has decided to de- recognise the said Party from the State of Kerala ;
Now, therefore, in pursuance of clause (b ) of sub -para (1 ) and sub -para (2 ) of paragraph 17 and paragraph 18 of the said order the Election Commission hereby makes the following amendment in its notification No. 56/82 , dated the 8th April , 1982, published as O.N. 29 ( E) , in the Gazette of India Extraordinary Part II , Section 3 ( thi ) , dated the 12th April , 1982, as amended from time to time , namely
In Table 2 appended to the said notification , against the State of Kerala mentioned in column 1, the entry " 5. Revo- lutionary Socialist Party... Spade and stoker " referred to in coluruns 2 and 3 , respectively, shall be deleted .
