का. आ. 728 (अ) / 18 कक/ आई डी आर ए/ 83 .-भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग) के आदेश नं . का. आ. 267 (अ) / 18 कक/ आई डी आर ए/ 78 , तारीख 13 अप्रैल , 1978 द्वारा (जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है) , मैसर्स श्री दुर्गा काटन स्पिनिंग एण्ड वीविंग मिल्स लिमिटेड , कोन्नगर , जिला हुगली , पश्चिमी बंगाल नामक संपूर्ण औद्योगिक उपक्रम का प्रबंध , उद्योग (विकास और विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 18कक की उपधारा ( 1 ) के खंड (ख) के अधीन 12 अप्रैल , 1983 तक की , जिसमें यह तारीख भी सम्मिलित है , पांच वर्ष की अवधि के लिए ग्रहण किया गया था और भारतीय औद्योगिक एन- निर्माण निगम लिमिटेड , कलकत्ता को उक्त औद्योगिक उपक्रम का प्रबंध ग्रहण करने के लिए प्राधिकृत किया गया था ;
और , भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग) के आदेश सं. का. आ . 291 (अ) / 18 कक/आईडीआरए/ 83, तारीख 12 अप्रैल , 1983 द्वारा उक्त आदेश की अवधि को , 12 अक्तूबर , 1983 तक की, जिसमें यह तारीख भी सम्मिलित है , छह मास की और अवधि के लिए बढ़ाया गया था ;
और , केन्द्रीय सरकार की यह राय है कि लोकहित में यह समीचीन है कि उक्त औद्योगिक उपक्रम का प्रबन्ध , भारतीय औद्योगिक पुननिर्मार्माण निगम लिमिटेड , कलकत्ता के अधीन 12 अक्तूबर , 1984 तक की , जिसमें वह तारीख भी सम्मिलित है, एक वर्ष की और अवधि के लिए बना रहे ;
अतः , अब , केन्द्रीय सरकार , उद्योग (विकास और विनियमन ) अधिनियम , 1951 (1951का 65 ) की धारा 18कक की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह निदेश देती है कि उक्त आदेश 12 अक्तूबर , 1984 तक की, जिसमें यह तारीख भी सम्मिलित है , और अवधि के लिए प्रभावी बना रहेगा ।

ORDERS New Delhi , the 11th October, 1983
S.O. 728 (E) 18AA IDRA 83.-Whereas by the Order of the Government of India in the Ministry of Industry (Department of Industrial Develop- ment) No. S.O. 267267 (E) 18AA IDRA 78 , dated the 13th April , 1978 (hereinafter referred to as the said order ) , the management of the whole of the Industrial Undertaking known as Messrs Sri Durga Cotton Spinning and Weaving Mills Limi- ted, Konnagar, District Hooghly , West Bengal , was taken over under clause (b) of sub - section ( 1) of section 18AA of the Industries (Development and Regulation ) Act , 1951 (65 of 1951 ) , for a period of five years upto and inclusive of the 12th April ,, 1983 , and the Industrial Reconstruction Corpo- ration of India Limited, Calcutta , was authorised to take over the management of the said industrial undertaking;
And , whereas , by the order of the Government of India in the Ministry of Industry (Department of Industrial Development ) No. S.O. 291 (E) 18AA IDRA 83 , dated the 12th April , 1983 , the period of the said order was extended for a further period of six months upto and inclusive of the 12th October, 1983 ;
And, whereas , the Central Government is of opinion that it is expedient in the public interest that the said industrial undertaking should continue under the management of the Industrial Recons- truction Corporation of India Limited, Calcutta, for a further period of one year upto and inclusive of the 12th October , 1984;
Now, therefore, in exercise of the powers con- ferred by sub- section (2) of section 18AA of the Industries ( Development and Regulation) Act, 1951 ( 65 of 1951) , the Central Government here- by directs that the said order shall continue to have effect for a further period upto and inclusive of the 12th October, 1984 .

का. आ. 729 (अ)/ 18 चख/ आई डी आर ए/83 :-केन्द्रीय मरकार ने , भारत सरकार के उद्योग मंत्रालय ( औद्योगिक ठिकास विभाग) के. आदेश मं. का. आ. 506(अ) 18 च स्खा/आई डी आर ए/78, वारीस्ल18 अगस्त , 1978 द्वारा (जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है) उद्योग (विकास और विनियम । ) अधिनियम , 1951 (1951का 65) की धारा 18 छ व की उपधारा ( 1 ) के खंड (स्व) व्यारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह घोषणा की थी कि उक्त आदेश के जारी किए जाने की तारीख से ठीक पहले प्रवत्त ऐसी सभी संविदाओं . संर्पास्त के हस्तांतरण पत्रों , करारों , परिनिर्धारणों , पंचाटों , स्थायी आदेशों या अन्य लिखतों का ( उनसे भिन्न जो बैंकों और

वित्तीय संस्थाओं के प्रतिभूत दायित्वों से संबंधित हैं) , जिनका मैसर्स श्री दुर्गा काटन स्पिनिंग एण्ड वीविंग मिल्स लिमिटेड , कोन्नगर , जिला हुगली , पश्चिमी बंगाल नामक उक्त औद्योगिक उपक्रम एक पक्षकार है या जो उक्त औद्योगिक उपक्रम या कम्पनी को लागू हैं , प्रवर्तन एक वर्ष की अवधि के लिए विलम्वित रहेगा और उक्त तारीख से पहले उसके अधीन प्रोद्भुत या उद्भूत सभी अधिकार , विशेषाधिकार , बाध्यताए और दायित्व उक्त अवधि के लिए निलम्बित रहेंगे ;
और , केन्द्रीय सरकार ने , अपनी यह राय होने पर कि जन- साधारण के हित में यह आवश्यक है कि उक्त आदेश का प्रभाव पूर्वोक्त एक वर्ष की अवधि की समाप्ति के पश्चात् जारी रहे , 12 अक्तूबर , 1983 तक की , जिसमें यह तारीख भी मम्मिलित है , और अवधि के लिए ऐसे जारी रहने के लिए , समय-समय पर , घोषणा जारी की थी [वेखिए भारत सरकार के उद्योग मंत्रालय के अद्योगिक विकास के आदेश सं . का . आ. 455(अ)/ 18 चख/ आई डी आर ए/ 78 , तारीख 9 अगस्त , 1979 , का . आ . 628 (अ) /18चस/ आई डी आर ए/ 80 , का. आ. 651 (अ)/18 चख/आई डी आर ए/81 तारीख 14 अगस्त , 1981 , का. आ. 600 (अ) /18 चस/ आई डी आर ए/ 82 , तारीख 17 अगस्त, 1982 और का . आ. 292/18 चल/ आई डी आर ए/ 83 , तारीख12 अप्रैल , 1983 ] ;
और , केन्द्रीय सरकार का यह समाधान हो गया है कि उक्त आदेश की अवधि को ,12 अक्तूबर ,1984 तक की और अवधि के लिए बढ़ा दिया जाए ;
अतः अब , केन्द्रीय सरकार , उद्योग (विकास और विनिय- मन) अधिनियम , 1951 ( 1951 का 65) की धारा 18 चख की उप- धारा (2) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त आदेश की अवधि को , 12 अक्तूबर , 1984तक की , जिसमें यह तारीख भी सम्मिलित है , और अवधि के लिए बढ़ाती है ।

S.O. 729 (E) 18FB IDRA/ 83.-Whereas by the order of the Government of India in the Ministry of Industry (Department of Industrial Develop- ment) No. S.O. 506 (E) 18FB IDRA 78 , dated the 18th August , 1978 (hereinafter referred to as the said Order ) , the Central Government in exer- cise of the powers conferred by clause (b) of sub- section ( 1 ) of section 18FB of the Industries (Development and Regulation) Act 1951 (65 of 1951) , declared that the operation of all contracts , assurances of property , agreements , settlements, awards , standing orders or other instruments in force immediately before the date of issue of the said order (other than those relating to secured liabi- lities to banks and financial institutions) to which the said industrial undertakings , known as Messrs Sri Durga Cotton Spinning and Weaving Mills Limited, Konnagar, District Hooghly , West Bengal is a party or which may be applicable to the said industrial undertaking or company shall remain suspended for a period of one year and all rights , privileges , obligations and liabilities , accruing or arising thereunder before the said date shall remain suspended for the said period;

And, whereas , the Central Government being of opinion that it is necessary in the interest of the general public that the said Order should continue to have effect after the expiry of the period of one year aforesaid, had declared from time to time, for such continuance , for a further period upto and inclusive of the 12th October, 1983 (vide Orders of the Government of India in the Minis- try of Industry. Department of Industrial Deve- lopment Nos . S.O. 455 (E) 18FB IDRA 79 , dated the 9th August, 1979, S.O. 628 (E) 18FB IDRA 80, dated the 18th August , 1980 , S.O. 651 (E) 18FB IDRA 81 , dated the 14th August, 1981, S.O. 600 (E) 18FB IDRA/ 82 , dated the 17th August , 1982 and S.O. 292/ 18FB IDRA 83. dated the 12th April, 1983 ;
And, whereas , the Central Government is satis- fied that the duration of the said Order should be extended for a further period upto the 12th Octo- ber, 1984;
Now , therefore , in exercise of the powers con- ferred by sub- section ( 1) read with sub- section (2) of section 18FB of the Industries (Development and Regulation) Act, 1951 (65 of 1951 ) , the Cen- tral Government hereby extends the duration of the said Order for a further period upto and inclu- sive of the 12th October , 1984 .
