सा.का. नि. 912 (अ) केन्द्रीय सरकार , सीमाशुल्क अधि- नियम , 1962 (1962 का 52) की धारा 25 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के भूतपूर्व राजस्व और बैंकिंग विभाग (राजस्व पक्ष) की अधि- सूचना सं . 125 - सीमाशुल्क , तारीख 1 जुलाई , 1977 को अधि- क्रांत करते हुए , अपना यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है , इससे उपाबद्ध अनुसूची में विनि- दिष्ट व्यक्तियों के किसी वर्ग के व्यक्ति द्वारा किसी विदेशी सरकार से प्राप्त और उक्त व्यक्ति द्वारा उगके यात्री गाभाग के भाग के रूप में भारत में आयातित उपहार की वस्तुओं को तथा किसी शासकीय प्रयोजन के लिए भारत की यात्रा करने वाले विदेशी उच्चपदस्थ व्यक्ति द्वारा उसके यात्री सामान के भाग के रूप में भारत में आयातित और पूर्वोक्त अनुसूची में विनि- र्दिष्ट व्यक्तियों के किसी वर्ग के व्यक्ति को उपहार के रूप में दी जाने वाली उपहार की वस्तुओं को ,
(क) सीमाशुल्क टैरिफ अधिनियम , 1975 (1975 का 51 ) की पहली अनुसूची के अधीन उन पर उद्ग्रह- णीय ममस्त सीमाशुल्क से; और
(ख) उक्त सीमाशुल्क अधिनियम की धारा 3 के अधीन उन पर उग्रहणीय समस्त अतिरिक्त शुल्क से ,
इस शर्त के अधीन रहते हुए , छूट वेती है कि
(1) यथास्थिति , संबंधित व्यक्ति या विदेशी उच्चपदस्थ व्यक्ति द्वारा सीमाशुल्क अधिनियम , 1962 (1962 का 52) की धारा 77 के उपबन्धों के अनुसार घोषणा की जाती है ; और
(2) (क) उक्त अनुसूची में विनिर्दिष्ट व्यक्तियों के किसी दर्ग के व्यक्ति द्वारा किसी विदेशी सरकार से प्राप्त और उक्त व्यक्ति द्वारा उसके यात्री सामान के स्टैंप में भारत में आयातित उपहार की वस्तुओं की दशा में , उदन व्यक्ति , उपहार की ऐसी बस्तुओं की निकासी के समय , मीमाशुल्क सहायक कलक्टर के समक्ष यह घोषणा

करता है कि वह उक्त अनुसूची में विनिविष्ट व्यक्तियों के किसी वर्ग का व्यक्ति है और
(ख) किसी शासकीय प्रयोजन के लिए भारत की यात्रा करने वाले विदेशी उच्चपदस्थ व्यक्ति द्वारा उसके यात्री सामान के भाग के रूप में भारत में आयातित उमहार की वस्तुओं की दशा में और उभ दशा में जिसमें उपहार की वस्तुओं को उक्त अन्- सूची में विनिर्दिष्ट व्यक्तियों के किमी वर्ग के व्यक्तियों को उपहार में दिया जाना है , ऐसा विदेशी उच्चपदस्थ व्यक्ति , उपहार की ऐसी वस्तुओं की निकासी के समय , सीमाशुल्क सहायक कलक्टर के समक्ष यह घोषणा करता है कि उपहार की ऐसी वस्तुओं को उक्त अनुसूची में विनिर्दिष्ट व्यक्तियों के किसी वर्ग के व्यक्तियों को उपहार में दिया जाना है ।
अनुसूची
1. संघ या राज्य या संघ राज्यक्षेत्र के मंत्री ।
2. किसी लोक सेवा में कोई पद या संघ या किसी राज्य के कार्यकलापों से संबंधित पद धारण करने वाले व्यक्ति , किन्त जो किसी विधि द्वारा या उसके अधीन स्थापित किसी निगम में या सरकार के स्वामित्वाधीन या नियंत्रणाधीन किसी निगम में नियुक्त व्यक्ति नहीं हैं ।

New Delhi , the 23rd December , 1983
NO . 326 83 - CUSTOMS
G.S.R. 912 ( E ) . In exercise of the powers con- ferred by sub -section ( 1 ) of section 25 of the Customs Act, 1962 ( 52 of 1962 ) , and in super- session of the notification of the Government of India in the late Department of Revenue and Bank- ing ( Revenue Wing ) No. 125 - Customs , dated the 1st July, 1977 , the Central Government , being satisfied that it is necessary in the public interest so to do , hereby exempts articles of gift received from any foreign Government by a person belong- ing to any class of persons specified in the Schedule annexed hereto and imported by the said person into India as part of his baggage , and articles of gift imported into India by a foreign dignitary. visiting India for any official purpose , as part of his baggage and to be gifted to persons belonging to any class of persons specified in the aforesaid Schedule,from-
(a) the whole of the duty of customs leviable thereon under the First Schedule to the Customs Tariff Act, 1975 ( 51 of 1975 ) ; and
(b) the whole of the additional duty leviable thereon under section 3 of the said Cus- toms Tariff Act . subject to the conditions that-
(i) a declaration is made by the concern- ed person or foreign dignitary , as the case may be , in accordance with the provisions of section 77 of the Cus- toms Act, 1962 ( 52 of 1962 ) ; and
( ii) ( a) in the case of articles of gift received from any foreign Government by a person belonging to any class of persons specified in the said Sche- dule and imported by the said person into India as part of his baggage, the said person, at the time of clearance of such articles of gift makes a decla- ration to the Assistant Collector of Customs that he is a person belonging to any class of persons specified in the said Schedule ; and
(b) in the case of articles of gift imported into India by a foreign dignitary , visiting India for any official purpose , as part of his baggage and such arti- cles of gift are to be gifted to persons belonging to any class of persons specified in the said Schedule , such foreign dignitary, at the time of clearance of such articles of gift , makes a declaration to the Assistant Collector of Customs that such articles of gift are to be gifted to persons belonging to any class of persons specified in the said Schedule .
SCHEDULE
1. Ministers of the Union or of a State or of a Union territory.
2. Persons holding any appointment in any public service or post in connection with the affairs of the Union or of any State, but not being persons appointed in any corporation established by or under any law or any corporation owned or con- trolled by Government .

उक्त अधिसूचना की अनुसूची में क्रम सं . 241 और उससे संबंधित प्रविष्टि के पश्चात निम्नलिखित क्रम सं. और घिष्टि अंतःस्थापित की जाएगी , अर्थात :-

In exercise of the powers conferred-by sub -section ( 1 ) of section 25 of the Customs Act, 1962 ( 52 of 1962 ) , read with sub- section ( 4 ) of section 45 of the Finance Act, 1983 ( 11 of 1983 ) , the Central Government , being satisfied that it is necessary in the public interest so to do, hereby makes the following further amend- ment in the notification of the Government of India in the Ministry of Finance ( Department of Revenue) No. 126/ 83 - Customs , dated the 13th May . 1983. namely : -
In the Schedule to the said notification , after Sl . No. 241 and the entry relating thereto , the following Sl . No. and entry shall be inserted, namely :--
"242. No. 327 83 Customs, dated the 23-12-1983 " .
