आदेश
का० आ० सं ० 930 ( अ ) चाय अधिनियम, 1953 ( 1953 कार 29 ) की धारा 30 की उप-धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार चाय ( वितरण तथा निर्यात) नियन्क्षण आदेश 1957 में और आगे संशोधन करने के लिए एमद्वारा निम्तोक्त आदेश करती है , अर्थात्ः-
1 ( 1 ) इस आदेश को चाय ( वितरण तथा निर्यात) नियन्त्रण (द्वितीय संशोधन ) आदेश , 1983 कहा जाएगा ।
( 2 ) यह सरकारी राजपक्ष में उपके प्रकाशन का तारोख में प्रवृत होगा ।
2. पाय ( वितरण तथा निर्यात) नियन्त्रण आदेश , 1957 में ,
(1 ) खण्ड 3 के उप खण्ड ( ह ) को हटा दिया जाएगा
(2) खण्ड 11 को उसमें उप-खण्ड ( 1 ) के रूप में पुनः संध्याकित किया जाएगा और पुनः संश्यांकित किये गये रूप में उप खण्ड

( 1 ) के माद, निम्नोंक्त उपखण्ड- उप-खण्ड ( 2 ) तथा ( 3 ) के रूप
में अन्तःस्थापित किया जाएगः अर्थात्:-
" ( 2) कोई भी व्यक्ति तब तक मी ०टी ०सी० चाय निर्यात नहीं करेगा जब तक कि उसे-
( क) चाय की थैलियों के रूप में निर्यात न किया जाय;
(ख) चाय ( वितरण तथा निर्यात ) नियन्त्रण ( द्वितीय संशोधन ) आदेश 1983 के प्रवृत होने से पहले इस अधिनियम की धारा 17 के अन्तर्गत प्राप्त निर्यात लाईसेस के अनुग्ररण में न किया जाए ;
( ग ) चाय ( वितरण तथा निर्यात) नियन्त्रण ( द्वितीय संशोधन) आवेश 1983 के प्रवृत होने से पहले की गई संविदा को अनुसरण में न किया जाय तथा इस प्रयोजनार्थ घाय कलकत्ता, सिलीगुड्डी, गोहाटी, अमृतसर , कोचीन , कुन्नूर अथवा कोयम्बटूर में हुई सार्वजनिक नीलामियों में न खरीदी गई हो;
(日) चाय ( वितरण तथा निर्धात) नियन्त्रण ( द्वितीय संशोधन) आदेश, 1983 के प्रवृत्त होने से पहले ऐसी पैकेट चाय के निर्यात के लिए की गई संविदा के अनुसरण में पैकेट चाय के रूप में निर्यात न किया जाए और जब तक वाय ( वितरण तथा निर्यात) नियन्त्रण (द्वितीय संशोधन ) आवेश , 1983 के प्रवृत होने से तीस दिन के भीतर अथवा उस बढ़ाए गये समय में जो कि लाईसेंस प्राधिकारी द्वारा दिया जाए , पोत लदान न किया जाय , ( 3 ) उप खण्ड ( 2 ) में किस्सी बन के होते THE GAZETTE OF INDIA EXTRAORDINARY

हुए भी, केन्द्रीय सरकार लाईसेंस प्राधिकारी की सिफारिश पर असाधारण मामलों में और कारणों को लिखित में रिकार्ड करके मी० टी० सी० जाय के निर्यात की अनुमति दे सकती है ।"
स्पष्टीकरण
(1) इम खण्ड में
(क) 'सो० टी० सी० चाय' का अभिप्राय मी० टी० सी० चाय के प में वाणिज्यिक गप्प में जानी जाने वाली चाय है;
( ख) 'चाय की थैलियों से अभिप्राय उन पैकेटों से है जिनमें फिल्टर पेपर अथवा नायलन की बनी थैलियों में ग्लैंड की हुई अथवा संसाधित चाय हो तथा जिनमें गरम अथवा ठण्डे पानी में ऐसी थैलियों को सीधे हुमा कर चाय पेय तैयार करने के लिए प्रति थैली 20 ग्राम से अधिक चाय न हो तथा जिन्हें वाणि- ज्यिक रूप में आय की थैलियां कहा जाता हो ।
(ग) 'पैकेट चाय ' से अभिप्राय उस चाय से है जो यूनिट पैको अथवा ऐसे डिश्वों में पैक की गई हो जो कि सामान्यत: ब्रांड नाम के अन्तर्गत फुटकर बिक्री के प्रयोजनार्थ पेश की ज.ती है और जिन्हें बोर्ड द्वारा अनुश्रोवित कर दिया गया हो एवं इसमें व पैकेज गमिल है जिन्हें एक साथ पैक किये गए वो पैकों का " जोटा" कहा जाता है और जिसमें मूल पैक में चाय का निबल भार एक किलोग्राम से अधिक न हो ।
( 2) विवाव के मामलों में कि कोई विशेष चाय सी० टी० सी ० चाय या चाय की थैली अथवा पैकेट चाय है या नहीं, विवाद का लाईसेंस प्राधिकारी द्वारा नियुक्त किये गये तीन विशेषज्ञों के पैनल को सौंपा जाएगा , जिनका निर्णय उस सम्बन्ध में अन्तिम होगा और पार्टियों के लिए बाध्यकारी होगा ।

ORDER
S.O. 930 (E) . In exercise of the powers con- ferred by sub- section (3) of section 30 of the Tea Act, 1953 (29 of 1953 ) the Central Government hereby makes the following order further to amend the Tea (Distribution and Export) Control Order, 1957, namely :-
1. ( 1 ) This order may be called the Tea (Dist- ribution and Export) Control (Second Amend- ment) Order , 1983 .
(2) It shall come into force on the date of its publication in the Official Gazette .
2. In the Tea (Distribution and Export) Cont- rol Order , 1957 ,
(i) sub -clause (e) of clause 3 shallbe omitted;

(ii) clause 11 shall be renumbered as sub- clause ( 1 ) thereof and after sub- clause (1) as so renumbered , the following sub- clause shall be inserted as sub- clause (2) and (3 ) namely :--
"(2) No person shall export CTC teas un- less it is
(a) exported in the form of tea bags ;
(b) in pursuance of an export licence ob- tained under section 17 of the Act before the coming into force of the Tea (Distribution and Export ) Cont- rol (Second Amendment) Order, 1983;
(c) in pursuance of a contract entered into before the coming into force of the Tea (Distribution and Export) Control (Second Amendment) Order, 1983 and the teas for this purpose have been,. purchased at pubic auctions held in Calcutta , Siliguri , Gauhati , Amritsar, Cochin, Conoor batore ; or Coim-
(d) exported in the form of packet tea in pursuance of a contract for export of such packet tea entered into before the coming into force of the Tea (Distribution and Export) Control (Second Amendment) Order , 1983 and the shipment is made within thirty days from the coming into force of the Tea (Distribution and Export) Control (Second Amendment) Order , 1983 or such extended time as may be granted by the licensing authority.
(3) Notwithstanding anything contained in sub - clause (2) , the Central Govern- ment may, on the recommendation of the licensing authority, allow in ceptional cases and for reasons to be re- ported in writing , the export of C.T.C. teas." ex-
Explanation :
(1) In this clause,--
(a) CTC tea means known as CTC tea ; the commercially
(b) ' tea bags' means packets containing blended or processed tea in bags made of filter paper or nylon net containing not more than 20 gms . of tea per bag for brewing of tea liquor by direct im- mersion of such bags in hot or cold water, and commercially known as tea bags.

(c) 'packet tea' means tea packet in unit packs or containers of a type as are ordinarily put up for the purpose of retail sale under a brand name and nave been approved by the Board and includes packages known as " Jota " of two packs packed together in which the net weight of tea contained in the basic pack unit does not exceed one kilogram.

(2) In cases of dispute as to whether or not a particular tea to CTC tea or is a tea bag or packet tea, the dispute shall be referred to a panel of three experts appointed by the licensing autho- rity whose decision thereon shall be final and binding on the parties .
