सा० का ० नि० 924 ( अ ) फेन्द्रीय सरकार , भारतीय पद्मन अधिनियम, 1908 (1908 का 15) की धारा 34 के साथ पठित धारा 33 की उप- द्वारा ( 1 ) प्रवत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के नौवहन और परिवहन मंत्रालय (पत्तन पक्ष ) की अधिसूचना सा ० का ० नि० 635 ( ङ) तारीख 30 अक्टूबर , 1982 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण के पूर्व किया गया है या करने का लोप किया गया है , यह निदेश देती है कि इग अधिसूचना के राजपत्र में प्रकाशन की नारीख से साठ दिन की समाप्ति के पश्चात् ठीक अगले दिन से मद्राम पत्तन पर आने वाले और इससे उपाबद्ध अनुसूची के स्तम्भ ( 1 ) में वर्णित प्रत्येक जलयान पर और स्तम्भ ( 2 ) की तत्स्थानी प्रविष्टि में विनिर्दिष्ट दरों पर, और स्तम्भ ( 3 ) की तत्तस्थानी प्रविष्टि में विनिदिष्ट अन्तरालों पर पसन फीस उद्ग्रहीत की जाएगी ।

संदेय है परन्तु एक बार किमा गया फीस का संदाम साठ दिन की उक्त अवधि के दौरान पत्तन में केवल तीन बार प्रवेश करने के लिए ( जिसमें बह भ्रवेश भी सम्मिलित है जिस पर संदाय किया गया था) निधि- मान्यहोगा।
2. भारतीय डाक में प्रवेश करने वाले जलयान .
( क) बिदेशी जलयान:

स्पष्टीन ग्ण:-इम अनुसूभी में--
(क) "पोत" मे पूर्णतः बाबुशक्ति ने जालिम जलवान अभिप्रेत है ,
( ख) "स्टीमर " से पोत से भिन्न कोई जलयान अभिप्रेत है,
(ग) "तटवर्ती बोन और तदवर्ती स्टीमर" क्रमशः ऐमा पोत या स्टीमर अभिप्रेत है जो भारत स्थित एक पलन का स्थान ने भारत स्थित फिगी अन्य पत्तन वा स्थान की मात्रिको मा सामान का समुद्र द्वारा वह्न करताहै ,
(घ) "विदेशी पोत" और बिदेशी स्टीमर से क्रमशः ऐसा पोत या ऐसा स्टीमर अभिप्रेत है जो भारत स्थित एक पत्तन या स्थान और किसी अन्य भत्सन श्रा स्थान के बीच मा भारत के बाहर पत्तत या स्थानों के बीच व्यापार में लगा है ।

(PortsWing) NOTIFICATIONS New Delhi , the 28th December , 1983
G.S.R. 924 (E) . In exercise of the powers conferred by sub - section ( 1 ) of Section 33 , read with Section 34 of the Indian Ports Act , 1908 ( 15 of 1908 ) and in supersession of the notification of Government of India in the Ministry of Shipping and Trans- port ( Ports Wing ) No. GSR 635 ( E ) , dated the 30th October , 1982 , except as respects things done or omitted to be done before such supersession , the Central Government hereby directs that with effect from the day following the expiration of sixty days from the date of publication of this notification in the Official Gazette, port dues shall be levied on each of the vessels entering the Port of Madras as described in column ( 1 ) of the ' Schedule' hereto annexed at the rates specified in the corresponding entry in column (2 ) , and at the intervals specified in the corres- ponding entry in column (3 ) , of the said schedule :

Explanation in this Schedule ,
(a) 'Ship' means a vessel propelled solely by wind power ;
(b) ' steamer ' means any vessel other than a ship ;
(c) ' coasting ship' and ' coasting steamer ' mean respectively a ship or steamer which is engaged in the carriage by sea of passengers or goods from any part or place in India to any other port or place in India ;
(d) ' foreign ship ' and ' foreign steanter ' mean respectively a ship on steamer employed in trading between any port or place or between ports or places outside India .

सा०का०नि० 925 ( अ ) केन्द्रीय सरकार, भारतीय पत्तभ अधिनियम, 1908 ( 1908 को 15) की धारा 35 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयाग करते हुए भारत सरकार के नौबहन और परिवहन मंत्नालय की अधिसूचना म० सा० का ० नि ० 636 ( ङ) तारीख्य 30 अक्टूबर, 1982 के साथ प्रकाणित मद्राम बत्तन मार्गदर्शन और अन्य कार्य ( फीस ) आदेश 1975 को उन बातो के सिवाय अधिकान्त करमे हुए जिन्हें ऐसे अधिक्रमण के पूर्ण किया गया है या करने का लाष किया गया है , मद्रास पत्तन में गार्गवर्णन और अन्य कार्य के लिए फीस के उद्ग्रहण को विनि- वमिर करत के जिनिम्नलिखित बीअर्थान्--
आदेश
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इम आदेश का संक्षिप्त नाम मग्राम पत्तन मार्गवर्णन और अन्य कार्य ( फीम आदेश ) 1982है ।
( 2 ) वह तुरन्त प्रबूत होगा ।
2. इस आदेष में, अब तक कि विषय या सवर्भ से अभ्यया अपेक्षित न हो,
(क ) " आनरिक बन्दरगहार में वर्थ" से जवाहर डाक और भारतीय डाक में अर्थों से भिन्न श्रर्व अभिप्रेत है ।
(ख) "विन " व से किसी बर्थ में किसी वर्ष का लगाया जाना पूरा होने के समय से 24 घंटे अभिप्रेत है ।
(ग) "कुल टनभार " से पोन द्वारा जब यह अधिकतम ग्रीष्म भारण रेखा ( समर लोड लाइन ) तक भारित किया गया हो, ले जाए जा रहे THE GAZETTE OF INDIA EXTRAORDINARY

स्पोरा , भडारी ईधन , याजियो और नाविक दल को भार अभिप्रेत है।
(घ ) "पत्तत" से मद्रास पत्तन अभिप्रेत है ।
(ङ) "पोत" से पूर्णत. वायुशक्ति से चालित जलयान अभिप्रेत है ।
(च) "स्टीमर" से पोत भिन्न कोई जलयान अभिप्रेत है ।
( छ) "तटवर्ती पोत" और " तटवर्ती स्टीमर " से क्रमश ऐसा पोत था स्टीमर अभिप्रेत है, जो भारत स्थित एक पत्तन या स्थान से भारत स्थित किसी अन्य पत्तन या स्थान के यात्रियो या सामान का समुद्र द्वारा वहन करता है ।
(ज) "विवेशी पोत" और " विदेशी स्टीमर " से क्रमश ऐसा पोत मा ऐसा स्टीमर अभिप्रेत है, जो भारत स्थित एक पत्तन या स्थान और किसी अन्य पत्तन या स्थान के बीच या भारत के बाहर पत्तन या स्थानो के बीच व्यापार में लगा है ।
(स) "चलत जलयान" से जलयान का कोई ऐसा प्रकार अभिप्रेत है जिसमें पालों द्वारा नौवहन के लिए पर्याप्त पाल क्षेत्र की व्यवस्था है चाहे उसमें नौवन की मांत्रिक युक्तियां लगी हों या नही और इसमें खेने बाली लौका या केती सम्मिलित है किन्तु फ्रीडायास इसके अतर्गत नहीं है ।
3 मार्ग दर्शन , लंगर डालने या लंगर खेलने यावि के लिए फीस
( 1) बवरगाह में और उसके बाह्र जलयानो के मार्ग दर्शन के लिए जिसके अंतर्गत पत्तन मे पाइलटों की सेवाए और नाविक दल महित (लाखों की सेवाए है किन्तु जिसमें जलयानो की लगर डालने या लंगर बोलने की सक्रियाओं में सलग्न टगो की सेवाएं नहीं है, उद्ग्रहणीय फीस नीचे की सारणी में विनिर्दिष्ट वरों पर होगी , अर्थात

( 2 ) "कोल्ड मूय" पर जलयान के मार्ग दर्शन के लिए प्रर्थात् जलयान के इजन की शक्ति विना, जा भागत या पूर्णत चल रहा हो, मार्गदर्शन फीस उपखक ( 1 ) के अधीन सदेय फीस में दुगुनी दरो पर उद्- ग्रहीत की जाएगी ।
( 3 ) किसी तटवर्ती जलयान या विदेशी जलयान की बर्थ से स्थानान्त रिन करने के लिए उसका पुन लगर डालने के लिए या उसको वर्थ में जलयान को घुमाने के लिए फोस, जिसके अनर्गत भारी लिम्बो वाला जलयान भी है, उस वर्थ की बाबत जहां से स्थानान्तरण या घुमाने का कार्य किया जाता हो उपखण्ड ( 1 ) के अधीन एक तरफ मार्गवर्शन ( लगर डालने या खोलने के लिए सदेय प्रभार की भाधी दर पर उग्रहीत की जाएगी ।
परन्तु, यह कि ऊपर विनिर्दिष्ट फीस उस दणा में बुगुनी दर पर उड्ग्रहीत की जाएगी जब जलयान " कोल्ड बेम" पर प्रचालित किया जाता है।
(4) बदरगाह के बाहर किसी जलयान के लगर डालने के लिए फीस जब वह न तो प्रवेश करता है और न बाहर जाता है, आंतरिक बदरगाह की बात्रत उपखंड ( 1 ) के अधीन एक तरफा मार्गदर्श (लंगर डालने या खोलने ) के लिए सवेय प्रभाग की अधीक बर पर उद्ग्रहीत की जाएगी
( 5) 18 00 बजे से 600 बजे के बीच लगर डालते या अगर खोलने , स्थानान्तरित करने के प्रयोजनो के लिए जलयानो के नौवालन के लिग अतिरिक्त प्रभार आतरिक बदरगाह जवाहर डाक या भारती डाक पर विदेशी जलयान के लिए प्रति जी आर टी 10 20 रु ० भौर तटवर्ती अलयान क लिए प्रति जी आर टी 0 15 २० उद्ग्रहीत किया जाएगा । स्पष्टीकरण इस उपखण्ड के प्रयोजनार्थ, पाइलट द्वारा जलयान पर श्रहने के समय को प्रारभ समझा जाएगा ।
( ८) उपल्ब्रड ( 1 ) , उपखंड ( 2 ) , उपखंड ( १ ) और नपखंड ( 5 ) के अधीन उग्रहणीय मार्गदर्शन और अन्य प्रभारो के प्रयोजनार्थ पैट्रोल बर्थ और प्राउटर एभरेज की भातरिक बदरगाह समझा जाएगा ।

( 7) उप पाइलटों की दशा में जिनकी सेवाओं की अध्यपेक्षा की गयी है किन्तु उनका उपयोग नहीं किवा गया है, निम्नलिखित प्रभार उदग्रहीत किए जाएंगे , अर्थात:--

में पाइलट जिसकी सेवाओं की अध्यपेक्षा उपखंड ( 1 ) , उपखंड ( 2 ) , उपखंड ( 3 ) या उपखंड ( 4 ) के अधीन की गयी है किन्तु जिनका उप- योग पाइलट के जलयान पर चढने के पश्चात् नहीं किया गया है ।
टिप्पण:-( 1 ) ऊपर विनिविष्ट दर पर प्रभार जलयान के बारे
की दिशा में मार्गदर्शन के लिए न केवल अध्यपेक्षा के रहकरण के मामले में ही उद्ग्रहीत किए जायेगे बल्कि जलयानो के अर्थ के स्थानान्तरण के लिए जलयान को उसके बर्थ में घुमाने के लिए या भारी लिफ्टों की स्थिति के कारण उसी वर्ष में जलयान के पुनः लंगर डालने के लिए श्रध्यवेक्षा के रद्दकरण के लिए भी उद्ग्रहीत किए जायेगे ।
( 2) ऊपर के प्रभार ऐसे रहकरणों की दशा में जो
(क ) पाइलटों के जलयान पर चढ़ने से अपर्याप्त समय पूर्व ऐसे रकरणों की वशा में जो असाधारण परिस्थितियों के अधीन ऐमे कारणों से हुए हैं जिन्हें जलयान की मूल स्वरूप मामा जा मकता है ।
(3) यदि उपखंड ( 2 ) के अधीन प्रभार के सदाय के विषय मे कोई शका है तो उस मामले को अध्यक्ष को निर्देशित किया जाएगा जो उसके विनिश्णय करेगा ।
4. विशेष प्रभार ( 1 ) उस प्रत्येक घंटे या उसके भाग के लिए जिसके सिए पाइलट की मद्रास पराम से किसी जलयान के फलक पर उसके ऐसे जलयान में बढ़ने के पश्चात् तीस मिनट से अधिक प्रतीक्षा करनी पड़ती है , तटवर्ती जलयान की बाबत 180 ८० और विदेशी जलयान की बाबत 360 ८० फीस उग्रहीत की जाएगी ।
( 2) मद्रास पत्तन की सीमाओं के भीतर 30 मिनट और उससे कन की अवधि के लिए पाल जलयान के कर्षण के लिए प्रभार न्यूनतम 90 रु० के अधीन रहते हुए 180 रु ० प्रतिबंटा होगा । इस अवधि के लिए प्रभार उस दर पर उवग्रहीत किए जाएंगे जो एक घंटे या उसके भाग के लिए नियत है ।
( 3) साल के उद्घारण के लिए या गोताखोरों की सेवायो के उपयोग के लिए फीसें निम्नलिखित रूप में होगी
(क) उद्धारण प्रभार-उदधारण प्रभार नीचे मारणी में विनिदिष्ट वरों पर उग्रहणीय होंगे ।

टिप्पण इन प्रभारों के अंतर्गत माधारण गोताखोरों के प्रभारी का व्यय
भी है किन्तु कोई ऐसे विशेष प्रभार इसके अंतर्गत नहीं है जो कतिपय दशाओं में आवश्यक हो, जैसे कि टगों, बार्जेज या अन्य यानों का प्रयोग जिसके लिए प्रभार यथास्थिति बास्तविक खर्च या पत्तन के लिए उपवणित दरों के माप मान पर लिए जायेगे । जल से क्षतिग्रस्त हो मकने वाले माल की दशा में उपर्युक्त प्रतिशंतता यथास्थिति विषय मूल पर या सीमाशुल्क मूल्यांकन के श्राधार पर बसूल की जाएगी ।
(ख) गोताखोरों के प्रभार-गोताखोरों के प्रभार नीचे मारणी में विनिविष्ट दरों पर उग्रहणीय होगा ।

टिप्पणी- ( 1 ) ऊपर विनिर्दिष्ट उद्घारण प्रभार पत्तन के अंत समुद्र गोताखोरी की सेवाओं के लिए विशेष अध्यपेक्षाओं पर किए गए किसी गोताखोरी के कार्य की सभी दशाओ में गोताखोरों द्वारा तलाशी या परीक्षाओं के परिणामो का विचार किए बिना उग्रहीत किए आयेगे । जहां फलक पर बोए माल को बरामद करने के लिए कोई तलाशी की जाती है और ऐसा माल बरामद हो जाता है तो ऐसे प्रभार उद्ग्रहीत किए जायेमे जो उद्धारण के लिए विहित है ।
( 2) जब गोताखोरों की मौका उसी लांच द्वारा कथित की जानी है को कर्षण प्रभार इसके अतिरिक्त उद्द्मष्ठीत किए जायेंगे ।

of the Government of India in the Ministry of Slupping an Transport No. GSR 636 ( E ) dated 30th October , 1982 , excep as respects things done or omitted to be done before such super- session , the Central Government hereby makes the following order for regulating the levy of fees for pilotage and other services in the Port of Madras , namely : --

1. Short title and commencement : ---( 1 ) This order may be called the Post of Madras Pilotage and Other Services (Fees) Order 1983 .

2. Definitions : In this order, unless the context otherwise requires :

(1) " Berths in the Inner Harbour " means berths other than tha berths in Jawahar Dock and Bharathi Dock;

( i ) Vessels of less than 60,000 dead weight tons .

(g ) "Coasting ship " and " Coasting Steamer " mean res- pectively a ship or steamer which is engaged in the carriage by sea of passengers or goods from any Port or Place in India to any other port or place in India.

(ii ) Vessels of 60,000 dead weight tons and above
(i) ' sailing vessel' means any description of vessel provided with sufficient sail area for navigation under sails alone whether or not fitted with mechanical means or propulsion and includes er rowing boat or canoe , but does not include a pleasure craft .
3. Fees for Pilotage , Mooring or Unmooring etc .:
(2) For piloting a vessel on " Cold Move ", namely , without the power of the engine of the vessel partly or fully in any opera- tion, pilotage fee shall be levied at double the rates payable under sub - clause ( 1 ) .
(1) The fees leviable for piloting vessels in and out of the harbour which includes services of the Port's Pilots and the services of the launches with the crew but exclud ; the services of tugs engaged in mooring or unmooring operations of vessels , shall be at the rates specified in the Table below , namely :

(3) For shifting a coasting vessel oa foreign vessel from one berth and mooring it or tor turning a vessel arqund in its berth including vessels with heavy lifts , a fee at half the rates payable for one-way pilotage (mooring and unmooring) under sub -clause ( 1 ) in respect of the berth from where shifting or turning is made shall be lovied .

(4) For mooring a vessel outside the harbour when it does not enter or leave it , a fee at half the rates pavable for one way pilotage (mooring or unmooring ) under sub - clause ( 1 ) in respect of inner harbour shall be levied.

(5) For navigation of vessels for purposes of mooring or unmooring , shifting or turning between 18.00 hours and 06.00 hours , additional charges at the rates of Rs . 0.20 per GRT for foreign vessel and Rs . 0.15 per GRT for coasting vessel shall be levied at Inner Harbour , Jawahar Dock and Bharathi Dock .

(6) For purposes of pilotage fees and other charges leviable under sub -clause ( 1), sub- clause ( 2) , sub -clause ( 3 ) and sub- clause (5) the old ' Petrol Berth ' and the ' Outer Anchorage' shall be deemed as ' Inner Harbour ' .
(7) In the case of pilots whose services have been requisitioned but not utilised the following charges shall be levied namely :

540 Pilots whose services have been re- quisitioned under sub - clause ( 1 ) , Sub clause (2) , sub clause (3) or sub-clause (4) but not utilised after the Pilot has boarded a vessel .
Note : (1) The charges at the rates specified above shall be levied not only in cases of cancellations of requisitions for otward pilotage of vessels but also for the cancellations of requisitions for shifting of barths of vessels and re -mooring or for turning avessel around in her berth or for re - mooring a vessel in the same berth due to position of heavy lifts .
(2) The above charges are not leviable in cases of ( a) cancella- tions received sufficiently in time before the pilots board the vessels and ( b ) cancellations caused under exceptional circums- tances for reasons that could not be attributed to the vessel's fault.
(3) If any doubt arises about the payment of charges under sub - clause ( 2 ) the matter shall be referred to the Chairman , who shall decide , the same .
4. Special Charges ( 1 ) A fec of Rs . 180/- in respect of a coasting vessel and Rs . 360/ - in respect of a foreign vessol shall be levied for each hour or part of an hour that a pilot is kept waiting on board any vessel at the Port of Madras beyond thirty minutes after boarding such vessel .
(2) The charge for towage of a sailing vessel within the limits of the Port of Madras shall be Rs . 180/ - per hour subject to a minimum of Rs . 90/- for a duration of 30 minutes and less . Charges for a period in excess of this duration shall be levied at the rate fixed for one hour or part thereof.
(3) Fees for salvage of goods or for use of services of Divers shall be as follows namely :-

Note: These charges include the cost of ordinary diver's charges but are exclusive of any special charges which may be necessary in certain cases , such as the use of tugs , barges or other crafts and cranes which will be charged at actual cost or at the rates set fo th in the Port's Scale of Rates , as the case may be . In case of goods liable to damage by water , the above percentage shall be recovered on the sale value or Customs valuation as the case may be .
(b) Diver's Charges : Diver's charges shall be leviable at the rates specified in the Table below:

Note : ( 1 ) The Diver's charges specified above shall be levied in all cases of living work carried out on special requisitions for the services of the Port Sub-marine Diver irrespective of the results of search or examinations by the Divers . Where a search is undertaken for recovery of goods lost over board and such goods are recovered , charges as for salvage shall be levied.
(2) When the diving beat is towed by a launch , the towage charges shall be levied cxtra .
