का बा. 41 (अ)/ 18 कक/ आई डी आर ए/ 84.-भारत सरकार के उद्योग मंत्रालय ( ओद्योगिक विकास विभाग) के आदेश सं. का.ना. 265 (अ) / 18 कक/ आई डी आर ए/ 78 , तारीख 13 अप्रैल , 1978 (जिसे इसमें इसके पश्चात उन्न आदेश कहा गया है) के द्वारा समस्त उपक्रमों अर्थात ( 1) मैसर्स स्वदेशी काटन मिल्प , कानपुर , ( 2) स्वदेशी काटन मिल्म , पांडिचेरी , (3) स्वदेशी काटन मिल्स , नैनी , ( 4) स्वदेशी काटन मिल्स , मऊ- नाथभंजन' , ( 5) मैसर्स उदयपुर काटन मिल्स, उदयपुर और (6) रायबरेली टेक्सटाइल मिल्म , रायबरेली आफ मैसर्स स्वदेशी काटन मिन्स कम्पनी लिमिटेड , कानपुर (जिन्हें इगमें इसके पश्चात उक्न उपक्रम कहा गया है) का प्रबंध , उद्योग (विकार और विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 18 कक की उपधारा ( 1) के खंड (क) के अधीन 13 अप्रैल , 1978 से 5 वर्ष की अवधि के लिए ग्रहण किया गया था और राष्ट्रीय वस्त्र निगम लिमिटेड को संपूर्ण औद्योगिक उपक्रमों का प्रबंध ग्रहण कारने वो लिए प्राधिकृत किया गया था ;
और , भारत सरकार के उद्योग मंत्रालय (औद्योगिक विक्काग विभाग), के आदेश सं . का. बा. 283 (अ) /18 कक/आई डी आर

ए/ 83 , तारीख 11 अप्रैल , 1983 द्वारा उक्त आदेश की अवधि 31 जुलाई , 1983 तक जिसके अंतर्गत यह तारीख भी सम्मिलित है , बड़ा दो गई थी ;
और , भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग) के आदेश सं. का . आ. 525(अ) /18 कक/ आई डी बार ए/ 83तारीख 27 जुलाई , 1983 के द्वारा उक्त आदेश की अवधि 31 जनवरी , 1984 तक जिसके अंतर्गत यह तारीख भी सम्मिलित है , बढ़ा दी गई थी ;
और , केन्द्रीय सरकार की यह रांग है कि लोक हित में यह ममीचीन है कि उक्त आदेश 30 अप्रैल , 1984 तक की और अवधि के लिए जिसके अंतर्गत यह तारीख भी मम्मिलित है , प्रभावी बने रहना चाहिए ;
अतः , अब , केन्द्रीय सरकार , उद्योग ( विकास और विनिय- मन) अधिनियम , 1951 ( 1951 का 65) की धारा 18 कक की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह निदेश देती है कि उक्त आदेश 30 अप्रैल , 1984 तक की और अवधि के लिए जिसके अंतर्गत यह तारीख भी सम्मिलित है , एभावी बना रहेगा ।

New Delhi , the 30th January , 1984
S.O. 41 ( E) 18AA IDRA 84.-Whereas by the Order of Government of India in the Ministry of Industry (Department of Industrial Development ) No. S.Ó. 265 ( E ) | 18AAJDRA 78 dated the 13th April , 1978 ( hereinafter referred to the said Order ) , the management of the whole of the industrial undertakings , namely ( i ) Messrs Swadeshi Cotton Mills , Kanpur , ( ii ) Swadeshi Cotton Mills , Pondi- cherry , ( iii ) Messrs Swadeshi Cotton Mills, Naini . ( iv) Messrs Swadeshi Cotton Milis , Maanath Bhanjan , ( v ) Messrs Udaipur Cotton Mills . Udai- pur and ( vi ) Messrs Rae Bareli Textile Mills , Rac Bareli of Messrs Swadeshi Cotton Mills Company Limited , Kanpur ( hereinafter referred to as the said undertakings ) were taken over under clause ( a) of sub - section ( 1 ) of section 18AA of the Industries ( Development and Regulation ) , Act 1951 ( 65 of 1951 ) , for a period of five years from the 13th April, 1978 and the National Tex- tile Corporation Limited was authorised to take over the management of the whole of the industrial undertakings :
And, whereas , by the Order of the Government of India in the Ministry of Industry ( Department of Industrial Development ) No. S. O. 283 ( Ε ) 18AA IDRA 83 , dated the 11th April , 1983 the period of the said Order was extended upto and inclusive of the 31st July, 1983 ;
And , whereas , by the Order of the Government of India in the Ministry of Industry ( Department of Industrial Development ) No. S.O.525 ( E ); 18AA IDRA 83 dated the 27th July, 1983 the period of the said Order was extended upto and inclusive of the 31st January, 1984 ;
And , whereas , the Central Government is of opinion that it is expedient in the puble interest that the said Order shouldshould continue to have effect for a further period upto and inclusive of the 30th April, 1984 ;
Now, therefore , in exercise of the powers con- ferred by sub - section ( 2 ) of section 18AA of the Industries ( Development and Regulation) Act , 1951 ( 65 of 1951 ) , the Central Government here- by directs that the said Order shall continue to have effect for a further period upto and inclusive of the 30th April , 1984 .
के आदेश सं० का० आ0 277 (अ) 218 चस/आई डो आर गे/ 78 , तारीख 28 अप्रैल , 1978 (जिसे इसमें इसके पक्षात् उक्त आदेश कहा गया है) के द्वारा केन्द्रीय सरकार ने उद्योग (विकाम और विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 18 वरू की उपधारा ( 1 ) के खंड (ख) द्वारा , प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा की थी कि उक्छ आदेश के जारी किए जाने की तारीख के ठीक पूर्व प्रक्त सभी संविदाओं , संपत्ति के हस्तान्तरण-पत्रों , करारों , व्यवस्थापनों , पंथाटों , स्थायी आदेशों या अन्य लिखित्तों से प्रोद्भुत या उद्भुत लेने वाली सभी वाद्यताओं और दायित्वों का , (उनसे भिन्न जो बैंकों और वित्तीय संस्थाओं के प्रतिभूत दायित्वों से संबंधित है) जिनकी निम्नलिखित रूप में ज्ञान श्रौद्योगिक उपक्रम ( 1) मैसर्स स्वदेशी काटद मिल्म , कानपुर , ( 2) मैमर्स स्वदेशी काटन मिल्स, पांडिचेरी , ( 3 ) मैमर्म मेंदेशी काटा रिल्स नैनी (4) मैसर्स स्वदेशी काटन निल्म माऊभंजन, ( 5) मैमर्स उदयपुर काटन फिल्म, उदयपुर और ( 6) मंसर्ग गयबरेली टैक्सटाइल मिल्म . रायबरेली आफ मैसर्स ग्वदशी काटन मिल्स कम्पनी लिमिटेड , कानपुर , एक पक्षकार हैं या जो ऐसे औद्योगिक उपक्रम को लागू हों , प्रवर्तन ऐसी तारीख से एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख के पर्व उम्कं अधीर प्रोद्भुत या उद्भत होने वाली सभी बाध्यताएं और दायित्व उक्त अवधि के लिए निलम्बित रहेंगे ;
और भारत मरकार ने अपनी यह राय होने पर कि लोकहित में यह आवश्यक है कि उक्त आदेश पूर्वोक्त एक वर्ष की अर्वाध की समाप्ति के पश्चात प्रभावी बना रहना चाहिए , भारत सरकार कं उद्योग मंत्रालय (औद्योगिक विकास विभाग) के आदेश संख्या का. आ. 209( अ)/18 चख/ आई डी आर ए/ 79 , नारीख 16 अप्रैल , 1979 , का. आ. 262 (अ) /18 चखा/ आई डी आर ए 80 , तारीख17 अप्रैल , 1980 , का० आ० 305 (अ) /18 चख ! आई डी आर ए/ 81 , तारीख 20 अप्रैल , 1981 , का . आ. 272 (अ) /18 चल/आई डी आर ए/ 82 , तारीख 20 अप्रैल , 1982 , का. आ. 284(अ) /18 चरू/ आई डी आर ए/ 83 , तारीख 11 अप्रैल , 1983 और का.आ. 526(अ)/18 चरख/आई डी आर ए/83 , तारीख 27 जुलाई , 1983 द्वारा ममय समय पर 31 जनवरी , 1984 तक की और अवधि तक जिसके अन्तर्गत यह तारीख भी सम्मिलित है , ऐसे बनाए रखने के लिए घोषणा की थी ;
अनः , केन्द्रीय सरकार का अमाधान हो गया है कि उक्त आदेश की अवधि 30 अप्रैल , 1984 की और अवधि तक जिसमें यह तारीख भी सम्मिलित है , बढ़ायी जानी चाहिए ;
अत. अब , केन्द्रीय सरकार उद्योग (विकास और विनियमन) अधिनयम , 1951 ( 1951 का 65) की धारा 18 जल की उपधारा (2) के साथ पठित उप - धारा ( 1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त आदेश की अवधि 30 अप्रैल , 1984 की ओर अवधि तक जिसके अन्तर्गत यह तारीख भी सम्मिलित है , बढ़ाती है ।

ment No. S.O. 277 ( E ) | 18FB IDRA 78 , dated the 20th April, 1978 ( hereinafter referred to as the said Order) , the Central Government in exercise of the powers conferred by clause ( b ) of sub- section (1) of section 18FB of the Industries ( Develop- ment and Regulation ) Act , 1951 ( 65 of 1951 ) , declared that the operation of all obligations and liabilities accruing or arising out of all contracts , assurances of property, agreements , settlements , awards , standing orders or other instruments in force, immediately before the date of issue of the said Order ( other than those relating to secured liabilities to banks and financial institutions ) to which the industrial undertakings known as : ( i) Messrs Swadeshi Cotton Mills , Kanpur , ( ii ) Messrs Swadeshi Cotton Mills , Pondicherry , ( iii ) Messrs Swadeshi Cotton Mills , Nairi , ( iv ) Messrs Swa- deshi Cotton Mills , Maunath Bhanjan , ( v ) Messrs Udaipur Cotton Mills . Udaipur and ( vi ) Messrs Rae Bareli Textile Milis , Rae Bareli , of Messrs Swadeshi Cotton Mills Company Limited , Kanpur , are parties or which may be applicable to such industrial undertakings shall remain suspended for a period of one year from such date and that all the obligations and liabilities accruing or arising there- under before the said date shall remain suspended for the said period ;
And Whereas the Central Government being of opinion that it is necessary in the interest of the general public that the said Order should continue to have effect after the expiry of the period of one year aforesaid, had declared from time to time . for such continuance for a further period upto and inclusive of the 31st January, 1984 vide Orders of the Government of India in the Ministry ofIn- dustry ( Department of Industrial Development ) Nos . S.O. 209 ( E) 18FB IDRA 79 , dated the 16th April , 1979 , S. O. 262 ( E ) 18FB IDRA 80 , dated the 17th April, 1980 , S.O. 35 ( E ) 18FB IDRA 81 , dated the 20th Apru , 1981. S.O. 272 ( E ) | 18FB IDRA 82, dated the 20th April. 1982, S.O. 284 ( E) 18FB IDRA 83 , dated the 11th April , 1983 , and S.O. 526 ( E ) [ 18FBJDRA 83 , dated the 27th July, 1983 ;
And, whereas , the Central Government is satis- fied that the duration of the said Order should be extended for a further period upto and inclusive of the 30th April, 1984 ;
Now, therefore , in exercise of the powers confer- red by sub - section ( 1 ) read with sub- section ( 2 ) , of section 18FB of the Industries ( Develpoment and Regulation) Act, 1951 (65 of 1951) , the Central Government hereby extends the duration of the said Order for a further period upto and inclusive of the 30th April , 1984 .
