का० आ० 108 (अ) केन्द्रीय सरकार, चाय अधिनियम, 1953 (1953 का 29) की धारा 30 की उपधारा ( 3 ) के साथ पठित ... 17 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्ननिखित आदेण करती है, अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इम आदेश का नाम चाय 'निर्यात अनुज्ञापन विनियमन ) आदेश, 1984 है ।
( 2). यह राजपत्त्र में अपने प्रकाशन की तारीख से पन्द्रह दिन के सान के पश्चात् प्रवृत होगा ।
2. परिभाषाएं : इम आदेश में , जब तक कि संदर्भ में अन्यथा तिन हो
(क) "अधिनियम " से चाय अधिनियम , 1953 अभिप्रेत है;
( ख) "प्ररूप " से इस आदेश से अनुलग्न प्ररूप अभिप्रेत है ;
(ग) "हरी चाय " से विनिर्मित चाय की ऐसी किस्में अभिप्रेत हैं, जिन्हें वाणिज्यिक रूप में हरी चाय कहा जाता है ;
( घ ) "तत्काल चाय " से चाय ने जलीय सार के निर्जलीकरण द्वारा व्युत्पन्न जल विलेय चाय चूर्ण अभिप्रेत है;
(ङ) "अनुज्ञप्ति" से इस आदेश के उपबन्धों के अधीन अनुदत्त अनुज्ञप्ति अभिप्रेत है;

(च) "अनुज्ञापन प्राधिकारी " से चाय बोर्ड का अध्यक्ष भिप्रेत है;
(छ ) "पैकेट चाय " से ऐसे यूनिट पैकों या आधानों में पैक की गई चाय अभिप्रेत है जो किसी ब्रांड नाम से फुटकर विक्रय के प्रयोजन के लिए मामूली तौर से रखे जाते हैं और जिन्हें चाय बोर्ड ने अनुमोदित कर दिया है तथा इनके अन्तर्गत ऐसे पैकेज भी हैं जिन्हें " जोटा " पैक कहा जाता है और जिनमें दो पैकेट एक साथ पैक किए जाते हैं और ऐसे एक आधारिक पैक यूनिट में चाय का शुद्ध भार एक किलोग्राम से अधिक नहीं है;
(ज) "चाय थैली" से पैकेट अभिप्रेत हैं जिनमें संमिश्रित चाय या संसाधित चाय , फिल्टर पेपर या नाइलान जालिमों से बनी ऐसी थैलियों में रखी गई है जिनमें प्रत्येक में 20 ग्राम से अधिक चाय नहीं है और जिन्हें सीधे ठंडे या गर्म जल में डुबोकर चाय लिकर का निसबन किया जाता है, ऐसी थैलियों का वाणिज्यिक नाम चाय थैली है; और
(झ) "चाय बोर्ड" से अधिनियम की धारा 4 के अधीन स्थापित चाय बोर्ड अभिप्रेत है ।
3. निर्यात अनुज्ञापन:-किसी चाय का निर्यात तत्र तक नहीं किया जाएगा जब तक कि वह इस आदेश के उपबन्धों के अनुसार जारी की गई किसी अनुज्ञप्ति के अन्तर्गत नहीं है :
परन्तु-
(क) केन्द्रीय सरकार या चाय वोर्ड द्वारा या उसकी ओर से;
( ख) डाक पार्सल के माध्यम से;

(ग ) यात्रियों के वैयक्तिक चीजवस्त के रूप में;
( घ ) किन्हीं गैर वाणिज्यिक प्रयोजनों के लिए,
निर्वात की गई चाय के लिए कोई अनुज्ञप्ति अपेक्षित नहीं है ।
चाय के निर्यात के लिए जिस्ट्रीकरण के लिए, ऐसी 4. निर्यात संविदाओं का रजिस्ट्रीकरण प्रत्येक संविदा अनुज्ञापन प्राधिकारी के समक्ष संविदा पूर्ण होने के विन से ग्यारहवें दिन के पश्चात्, प्रस्तुत की जाएगी, परन्तु निम्नलिखित से संबंधित किसी संविदा का रजिस्ट्रीकरण अपेक्षिन नहीं होगा , अर्थात्
( क ) पैकेट चाय, तत्काल चाय, चाय थैलियों या हरी चाय के निर्यात से; और
( भा) कलकला, सिलीगुड़ी, गौहाटी, अमृतसर , कोचीन, कुनूर या कोयमबतूर में किए गए नीलामों द्वारा क्रय की गई चाय या बिदेश में स.वैजनिक नीलामों के लिए परेषिप्त चाय के निर्यात से ।
5. रजिस्ट्रीकरण के लिए निर्यात संविदाओं का प्रस्तुत किया जागा : ( क ) इस आदेश के अधीन रजिस्ट्रीकरण के लिए अपेक्षित चाय के निर्थात की, प्रत्येक संबिदा प्रस्थ्य 'क' में अनुज्ञापन प्राधिकारी के समक्ष या चाय बोर्ड के किसी ऐसे अधिकारी के समक्ष प्रस्तुत की जाएगी जिमे अनुज्ञापन प्राधिकारी ने इस निमित्त विनिविष्टतः प्राधिकृत किया है;
( ख) ऐसी प्रत्येक संविदा के साथ किसी स्वतन्त्र दलाल द्वारा , जिसका नाम चाय बोर्ड द्वारा रखे गए पैनल में है, बाथ की बाबत मूल्यांकन रिपोर्ट होगी;
(ग) अनुज्ञापन प्राधिकारी या उप पैरा ( क ) के अधीन प्राधिकृत अधिकारी , संविदा की संवीक्षा करने के पश्चात् और मूल्यांकन रिपोर्ट तथा अन्य बातों के साथ-साथ विद्यमान कीमतों और संविदागत कीमत , अभ्तर्वलित माना और गन्तब्य स्थान को ध्यान में रखते हुए , किसी सविदा को रजिस्टर करेगा या रजिस्टर करने से इंकार करेगा;
(घ) किसी संविदा को रजिस्टर करने से इंकार करने के कारणों को सेवाबद्ध किया जाएगा और ऐसे कारण रजिस्ट्रीकरण की प्रार्थना की प्राप्ति की तारीख से पन्द्रह दिन के भीतर , आवेदक को संसूचित किए आऐंगे ;
(क) अनुज्ञापन प्राधिकारी , इस आवेश के अधीन अपने कृत्यों के निर्वहन में सलाह प्राप्त करने के लिए , विशेषश का एक पैनल नियुक्त कर सकता है ।
6. रजिस्ट्रीकरण की विधिमान्यता की अवधि : "पैरा 5 के उप-पैरा (ग ) के अधीन अनुदत र्गजस्ट्रीकरण , ऐसे रजिस्ट्रीकरण के अनुदान की तारीख से नब्बे दिल की अवधि के लिए विधिमान्य होगा, परन्तु रजिस्ट्री- करण की विधिमान्यता की अवधि को 30 दिन तक के लिए विस्तारित किया जा सकता है । यदि अनुज्ञापन प्राधिकारी या पैरा 5 के उप-पैरा ( क ) के अधीन इस निमित्त प्राधिकृत किसी अधिकारी का ऐसा विस्तारण चाहते के लिए कारणों की पर्याप्तता के बारे में समाधान हो जाता है ।
7. निर्यात अनुज्ञप्ति के लिए रजिस्ट्रीकरण की विशिष्टयों का प्रस्तुत किया जाना । इस आवेश के अधीन रजिस्ट्रीकरण के लिए अपेक्षित संविदाओं के अधीन चाय के निर्यात के लिए कोई अनुज्ञप्ति तब तक जारी नही की जाएगी जब तक की अनुज्ञप्ति के लिए आवेदन अनुज्ञापन प्राधिकारी के समक्ष ऐसे रजिस्ट्रीकरण से संबंधित सुमंगत विशिष्टियां, प्रस्तुत नही कर बेता है ।
8. लवाई के लिए अनुज्ञप्ति की विधिमान्यता इस आदेश के अधीन रजिस्ट्रीकृत संविदाओं के लिए जारी की गई कोई अनुशर्शाप्त रजिस्ट्रीकरण या पैरा 6 के अधीन किए गए विस्तारण की अवधि की तारीख से नब्बे दिन के पश्चात् की गई लदान के लिए विधि मान्य नहीं होगी ।

9. कुछ परिस्थितियों में निर्यात अनुज्ञप्ति अनुवत्त करने से इंकार करना : अनुज्ञापन प्राधिकारी या पैरा 3 के उपपैरा ( क) के मधोन इस निमित्त विनिदिष्टतः प्राधिकृत अधिकारी, अनुज्ञप्ति जारी कर सकता है या आवेदक को सुनवाई का अवसर प्रदान करने के पश्चात् अनुज्ञप्ति जारी करने में इंकार कर सकता है किन्तु यह तब जब वे इस विध्कर्ष पर पहुंचे कि निर्यात संविदा के रजिस्ट्रीकरण के समय कोई तात्विक विशिष्टि के ब.रे में दुर्व्यपदेशस किया गया है ।
10. अपील ऐस कोई व्यक्ति, जो पैरा 5 के अधीन निर्यात संविदा रजिस्टर करने से इंकार करने वाले या पैरा 9 के अधीन अनुज्ञप्ति जारी किए जाने से प्रकार करने वाले आदेश से व्यथित है, ऐसे इंकार किए जाने के आदेश के तोम दिन की अवधि के अन्दर , केन्द्रीय सरकार को अपील कर सकेगा और केन्द्रीय सरकार तदुपरि मामले का विनिश्चय करेगी।
11. अनुशप्ति की शतें ( 1 ) प्रत्येक अनुज्ञप्ति के बारे में यह समझा जाएगा कि वह अनुज्ञप्तिधारी को व्यक्तिगत रूप से दी गई है और किसी भी अनुज्ञप्ति का विक्रय या उसका अन्यथा अन्तरण नहीं किया जाएभा ।
( 2) जहां कोई अनुज्ञप्तिधारी अपने कारबार को किसी अन्य व्यक्ति को विक्रय करता है या अन्यथा उनका अन्नग्ण करता है, वहां क्रेता या अन्तरिती इम आदेश के उपबंधों के अनुसार एक नई अनुज्ञप्ति अभिप्राप्त करेगा ।
( 3) यदि कोई अनुशणिधारी इस अनुज्ञप्ति के अन्तर्गत आने बाले कारबार की बावत कोई भागीदारी करता है , तो वह ऐसी भागीदारी करने के तीस दिन के अन्दर उस तथ्य की रिपोर्ट अनुज्ञापन प्राधिकारी को करेगा और अनुज्ञप्ति में समुचित संशोधन करवायेगा ।
(4) यदि अनुज्ञप्ति धारण करने वालो भागीदारी का विघटन हो जाता है तो ऐसा प्रत्येक व्यक्ति जो ऐसे विघटन के ठीक पूर्व भागीदार था, उसके तीम दिन के अन्दर विषटन की रिपोर्ट अनुज्ञापन प्राधिकारी को करेगा ।
12. आदेशों और निवेशों की ताभील पैरा 5 के उपपैरा ( क ) के अधीन इम मिमित्त बिनिदिष्ट रूप से प्राधिकृत अनुज्ञापन प्राधिकारी या अधिकारी द्वारा किया गया कोई निदेश या जारी किया गया कोई आदेश ,
(क) साधारण प्रकृति के व । व्यक्तियों के किसी वर्ग को प्रभाषित करने वाले किसी आदेश की दशा में, राजपत्र में अधिसूचित किया जाएगा, और
( ख) किसी विनिर्दिष्ट व्यक्ति को निर्देशित किसी आवेश को दसा में ऐसे व्यक्ति पर निम्नलिखित गति में तामील किया जाएगा-
(i ) उस व्यक्ति को परिवस्त करके या श्रेकर, या
(ii) यदि वह इस प्रकार परिषत्त नहीं किया जा सकता या नहीं दिया जा सकता, तो उसे उन परिसरों के, जिनमें पह व्यक्ति निवास करता है, कारबार करता है, या व्यक्तिगत रूप से अभिलाभ के लिए काम करता है , बाहरी वरवाजे या किसी अन्य सजदृश्य स्थान पर चिपका कर और उसकी एक लिखित रिपोर्ट तैयार की जाएग और उस परिक्षेत्र में निवास करने वाले दो व्यक्तियों द्वारा साक्षित को जाएगो ।

3. निर्यात सविदा उसको प्रति महित मूल रूप में संलग्न की जाती है । कृपया मूल प्रति को रजिस्ट्रीकरण के पश्चात् लौटा दिया जाए ।
4. मैंने/हमने जाय (निर्यात विनियम अनुज्ञापन) आदेश , 1984 को सावधानीपूर्वक पढ़कर समन लिया है और मैं हम उक्न आदेश के उपबंधों का पालन करने के लिए सहमत हैं ।

MINISTRY OF COMMERCE (Department of Commerce ) ORDER New Delhi , the 22nd February , 1984
S.O. 108 ( E ) . In exercise of the powers con- ferred by section 17 read with sub- section ( 3 ) of section 30 of the Tea Act, 1953 ( 29 of 1953 ) , the Central Government hereby makes the following order namly :-
1. Short Title and commencement.- ( 1 ) This order may be called the Tea ( Regulation of Export Licensing ) Order, 1984.
(2) It shall come into force on the expiry of 15 days from the date of its publication in the Official Gazette .
2. Definitions . In this order unless the context otherwise requires :-
(a) Act' means the Tea Act, 1953 ;
(b ) 'Form' means the form appended to this order ;
(c) ' green tea' means the variety of manu- factured tea commercially known as green tea ;
(d) " instant tea" means a water - soluble tea powder derived by dehydration of aqueouseous extract of tea ;
( e) ' licence' means a licence granted under the provisions of this Order ;
( f) 'Licensing Authority' means , the Chair- man of the Tea Board ;
(g) ' packet tea' means tea packed in unit packs or containers of a type as are ordinarily put up for the purpose of retail sale under a brand name and have been approved by the Tea Board and includes packages known as " Jota" of two packs packed together in which the net weight of tea contained in the basic pack unit does not exceed one kilogram ;
(h) ' tea bags' means packets containing blended or processed tea in bags made of filter paper or nylon net containing not more than 20 gms . of tea per bag for brewing of tea liquor by direct im- mersion of such bags in hot or cold water, and commercially known as tea bags ; and
( i) 'Tea Board' means the Tea Board esta- blished under section 4 of the Act .
3. Export Licensing .- No tea shall be exported unless covered by a licence issued in accordance with the provisions of this order ;
Provided that no licence shall be required for tea exported :
( a ) by or on behalf of the Central Govern- ment or the Tea Board ;
(b) by means of a postal parcel ;
( c) as personal effects of passengers ;
(d) for any non- commercial purposes .
4. Registration of Export Contracts . Every contract for export of tea shall be submitted for registration to the Licensing Authority not later than the eleventh day of its conclusion , provided that no contract in respect of the following shall require registration :-
(a) for export of packet tea . instant tea , tea bags and green tea ; and , 4

(b) for export of tea purchased wholly through auctions held at Calcutta, Siliguri , Gauhati , Amritsar , Cochin , Coonoor or Coimbatore or tea consigned for public auctions abroad.
5. Submission of Export Contracts for Registra- tion.-( a) Every contract for export of tea required to be registered under this order shall be submitted in Form ' A' to the Licensing Authority or to any officer of the Tea Board specifically authorised in this behalf by the Licensing Authority.
(b) Every such contract shall be accompanied by a valuation report regarding the tea by an in- dependent broker borne on the panel to be main- tained by the Tea Board .
(c) The Licensing Authority or the officer authorised under sub - paragraph ( a) shall , after scrutinising the contract and having regard to the valuation report and among other factors . the prevailing prices and the contract price , quantity involved and destination , register or refuse to register a contract .
(d) Refusal to register a contract shall be for reasons to be recorded in writing and communicated to the applicant within a period of 15 days from the date of receipt of the request for registration.
( e) The Licensing Authority may appoint a penal of exports for advising him in the discharge of his functions under this Order .
6. Period of Validity of Registration. A regis- tration granted under Sub -paragraph ( c) of para- graph 5 shall be valid for a period of 90 days from the date of grant of registration provided that the validity of a registration may be extended byby a further period of 30 days if Licensing Authority or the Officer authorised under Sub - paragraph ( a ) of paragraph 5 is satisfied about the sufficiency of the reasons for seeking such extension .
7. Submission of Particulars of Registration for Export Licence. No licence for export of tea against contracts required to be registered under this order shall be issued unless the applicant for a licence submits to the Licensing Authority the relevant particulars relating to its registration.
8. Validity ofLicence for Shipment . No licence issued against contracts registered under this order shall be valid for shipments made after 90 days from the date of registration or the extended period given under paragraph 6 .
9. Refusal to grant Export Licence in Certain Circumstances . The Licensing Authority or the Officer specifically authorised in this behalf under Sub - paragraph ( a) of paragraph 5 may, issue a licence or, after giving an applicant an opportunity of being heard , refuse to issue a licence if they

come to the conclusion that there has been any misrepresentation as to any material particular at the time of registration of the export contract .
10. Appeal. Any person aggrieved by an order of refusal to register an export contract under para- graph 5 or refusal to the issue of a licence under paragraph 9 may, within a period of 30 days of such order or refusal , appeal to the Central Govern- ment and the Central Government shall, thereupon, decide the matter .
11. Conditions of Licence. ( 1 ) Every licence shall be deemed to have been granted personally to the licensee and no licence shall be sold or other- wise transferred .
(2) Where a licensee sells or otherwise transfers his business to another person , the purchaser or transferee , as the case may be , shall obtain a fres licence in accordance with the provisions of this order .
(3) If a licensee caters into a partnership in regard to the business covered by his licence , he shall report the fact to the Licensing Authority within thirty days of entering into such partnership and shall get the licence suitably amended .
(4) If a partnership holding a licence is dis- solved , every person who was a partner immediately before such dissolution shall send a report of the dissolution to the Licensing Authority within thirty days thereof.
12. Service of Orders and Directions .-Any order or direction made or issued by the Licensing Authority or the officer specifically authorised in this behalf under sub - paragraph ( a ) of paragraph 5 shall,
(a) in the case of an order of a general nature or affecting a class of persons , be notified in the Official Gazette and ,
(b) in the case of an order directed to a specified individual, be served on such individual-
(i) by delivering or tendering it to that individual , or ,
(ii) if it cannot be so delivered or tendered, by affixing it on the outer door or some other conspicuous partpart of the premises in which that individual lives or carries on business , or personally works for gain and a written report thereof shall be prepared and witnessed by two persons living in the neighbourhood.
