सा०का ० नि ० 83 (अ) केन्द्रीय सरकार , चलचित्र अधिनियम , 1952 ( 1952 का 37) की धारा 8 द्वारा प्रदत शक्तियों का प्रयोग करते हुए , चलचित्त ( प्रमाणन) नियम, 1983* का और संणोधन करने के लिए निम्नलिखित नियम अनाती है, अर्थात्:--
1. ( 1) इन नियमों का संक्षिप्त नाम चलचित्त ( प्रमाणन ) ( संशो- हाम) नियम, 1984 है ।
( 2) ये 1 मार्च, 1984 को प्रवृत्त होंगे ।
2. चलचित्र ( प्रमाणन ) नियम, 1983--
(i ) नियम 2 में.
(क ) खण्ड ( ४ ) में, "परीक्षण अधिकारी से " शब्दों के पश्चान "एक मुभ्य कार्यपालकः अधिकारी या" शब्द अन्नःस्थापित किए जाएंगे;
*भारत के राजपत्र, अभीधारण , भाग 2 , खंड 3 उपखंड ( ⅰ ) तारीख 9-5-83 मे सा ० का ० नि० 381 (अ) के रूप में प्रकाशित ।
(1) 1586 GI/83
(या) खंड ( 9 ) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्:---
(ix) "फिचर फिल्म" से 35 मि०मी० में 2000 मीटर लंबाई से अधिक या अन्य गेजों में समतुल्य लम्बाई की या वीडियो पर काल्पनिक कथा फिल्म अभिप्रेत है; "
(ग) खण्ड ( ii ) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्:--
( 1 ) "लम्बी" फिल्म ऐसी फिल्म है जो 35 मि०मी० में 2000 मीटर लम्बाई में अधिक या अभ्य गैजों में सम- मुल्य लम्बाई की या बोडियो पर है;
( थ) खंड 16 के स्थान पर निम्नलिखित खंड रखा जाएगा , अर्थात्:-
( 1 ) " लघु फिल्म" में ऐसीं फिल्म जो 35 मि ०मी० में 2000 मीटर लम्बाई तक जिसमे 2000 मीटर भी सम्मिलित है या अस्य गेजों में समतुल्य लम्बाई की या वीडियो पर है, अभिप्रेत है" 一;
( 2) नियम 21 के उपनियम ( 1 ) में " प्ररूप 1 या प्ररूप 2" शब्दों और अकों के स्थान पर " यथास्थिति प्ररुप 1 या प्ररूप 1 -क या प्ररूप ii या प्ररूप -संक" रखा जाएगा;

(3) नियम 28 के उपनियम ( 1) में " दिए गए प्रमाणपत पर " शब्दों के पश्चात " अध्यक्ष या" शब्द अन्तःस्थापित किये जाएंगें;
( 4) नियम 29 के उपनियम ( 2 ) में " प्ररुप 4, 5, 6 या
7" शब्द और अंकों के स्थान पर निम्नलिखित शब्द और अंक रखे जाएंगे , अर्थात्:--
"प्ररूप 4, 4 -क , 5 , 5-क, 6, 6 , 7, या 7-क"
(5) नियम 30 के उप नियम ( 1 ) मे निम्नलिखित परन्तुक जोड़ा जाएगा, अर्थात्:-
"परन्तु वीडियो फिल्म की दशा में प्रमाणपत्र की एक प्रति जिसमें क्रम संख्या, प्रवर्ग या अभ्य ब्योरे वशित किए गए हों प्रत्येक बीडियो कैसेट और उसके केण पर चिपकाई जानी चाहिए ।"
( 6) नियम 33 के उपनियम ( 3 ) में " सदस्य " शब्द के स्थान पर "एक सदस्य शब्द रखखे जाएंगे "
(7) नियम 35 में
(क) उप नियम ( 1) में, "प्ररूप 4, 5, 6 या 7" शब्द और अंकों के स्थान पर निम्नलिखित शब्द और अंक रखे जाएंगे , अर्थात्
"प्ररूप 4, 4-क, 5, 5-क , 6, 6-क, 7 या 7-क"
(ख) उप नियम ( 3 ) में "ट्रेलर प्रमाण पत्ता की लम्बाई
यह होगी जो निम्नलिखित सारणी में अधिकथित है:-" शय्वों के स्थान पर निम्नलिखित शब्द रखे जाएंगे , अर्थात्-
"वीडियो फिल्म की दशा में ट्रेलर प्रमाण पत्र पन्द्रह सेकेन्ड से अन्यून की अवधि का होगा और अन्य फिल्मों की दशा में , ट्रेलर प्रमाणपत्र की लम्बाई वह होगी जो निम्नलिखित सारणी में अधिकथित है "
( 8) नियम 36 के उपनियम ( 1 ) में ,
(क) भाग 3 के पश्चात, निम्नलिखित भाग अन्तः स्थापित किया जाएगा , अर्थात् "भाग 3 -फ बीडियो फिल्म"
(i) प्रत्येक 10 मिनट की अवधि या उसके भाग के लिए जहां वीडियो फिल्म 20 मिनट की अवधि से अधिक की नही है, 40 रुपये;
( ii) प्रत्येक 10 मिनट की अवधि या उसके भाग के लिए , जहां वीडियो फिल्म 20 मिनट की अवधि से अधिक की नहीं है , न्यूनतम 600 रु० के अधीन रहते हुए, 200 रुपए;
(ख) भाग 4 में, खण्ड ( 3) के पश्चात निम्नलिखित खंड अन्तः स्थापित किया जायगा, अर्थात्:--
" ( 4) वीडियो फिल्म की दशा से प्रत्येक 10 मिनट की अवधि या उसके भाग के लिए 40 रुपए; "
(ग) भाग 4 के प्रथम परन्तु क में " अनुमार 600 मीटर या 240 मीटर या 120 मीटर से अधिक है" शब्दों के पश्चात, "और वीडियो फिल्म की दिशा में जो 20 मिनट से अधिक की अवधि की है" शब्द और अंक रखे जाएंगे;
( घ) भाग 4 के प्रथम और द्वितीय परन्तुक में " या भाग 3" शब्दों और अंकों के पश्चात " या भाग 3-क" शब्द, अंक और अक्षर अन्त स्थापित किए जाएंगे;

(ङ) भाग 5 में, " माग 1 , 2, 3 " शब्दों और अकों के पश्चात " 3-क" अंक और अक्षर अन्तस्थापित किए जाएंगे;
(घ ) भाग 5 में प्रथम परन्तुक में, " 120 मीटर से अधिक नही है" अंकों और शब्दों के पश्चात " और बीडियो फिल्म की दशा में जहां तक 20 मिनट की अवधि से अधिक नाही है" शब्द और अंक अम्त स्थापिन किए जाऐंगे;
(छ) भाग 5 के प्रथम परन्तुक के अन्त में " या जहां वीडियो फिल्म 20 मिनट की अवधि से अधिक की है" अंक और शब्द अन्तः स्थापित किए जाएंगे;
(ज) भाग 6 में " रील या रीले " शब्दों के पश्चात "या कैसेट या कैसेटों" शब्द अन्त स्थापित किए जाएंगे;
(9) नियम 39 में, "बोर्ड एक रजिस्टर रखेगा" शब्दों के स्थान पर " बोर्ड एक रजिस्टर बनाए रखेगा" शब्द रखे जाएंगे;
(10) दूसरी अनुसूची में ,
(क) प्ररूप 1 के पण्चात निम्नलिखित प्ररूप अन्तःस्थापित किए जाएंगे , अर्थात्:- प्ररूप-1
भारत में निमित्त वीडियो फिल्म के सार्वजनिक प्रदर्शन के लिए प्रमाणम के लिए आवेदन का प्ररुप [नियम 21 का उपनियम ( 1 ) देखिए]

भारत में निर्मित्त बीडियो फिल्म के सार्वजनिक प्रदर्शन के लिए प्रमाणन का आवेदन पत्र ।
(1) (क) वीडियो फिल्म का नाम
(ख) वीडियो फिल्म की भाषा
(ग) चालन समय
(घ) कैसेटो की संख्या
( ङ) वीडियो संपरिवर्तन की कोई भी अन्य विशिष्टिया
( च) वीडियो फिल्म का टाइप अर्थात् क्या वीडियो फिल्म 2-डी, 3ठी सिनेमा स्कोप विस्टाविजन आदि है ।
(छ) फिल्म मूक है या संवाक
(ज) फिल्म का रंग
(झ) निर्माता का नाम और पता
(ट) निवेशक का नाम
2. लिखिए क्या वीडियो फिल्म समाचार दर्शन/ वचित/ वैज्ञानिक/ शैक्षिक/फीचर/ विज्ञापन वीडियो फिल्म है ?
2. ( क) विनिर्दिष्ट कीजिए कि किस प्रमाण पत्र के लिए अनुरोध किया है "अनिर्बंधित" " निर्बन्धित वयस्क" " वयस्क" या " विणिष्ट" ।
3. वीडियो फिल्म की निगेटिव और पाजिटिव प्रिंटों की संख्या अलग अलग लिखें,
( क ) निर्मित्त ( निगेटिव पाजिटिव)
(मा) आवेदक के कब्जे मे ( निगेटिव पाजिटिव)
(ग) कापी जहां वमाई गई प्रयोगशाला का नाम और पता ।

4. ( क) क्या यह वीडियो फिल्म जिसके लिए आवेदन किया गया है सैल्यूलाड पर किसी चलचित्र की प्रतिकृत्ति है अथवा उसकी यथावत प्रति है जिसकी बाबत केन्द्रीय फिल्म प्रमाणन बोर्ड द्वारा पहले ही प्रमाण पक्ष प्रदान किया जा चुका है ?
प्रमाणित फिल्म की विशिष्टियो को बताए ।
(ख) क्या यह वीडियो फिल्म, सेल्यूलायड पर किसी प्रमाणित चलचित्त का उपांतरित पाठ है जिसमें परिवर्धन, लोप/अन्य परिवर्तन है । ( उपांतग्गों के ब्यौरे दिए जाएं )
( ग) क्या किसी मूल वीडियो फिल्म की बाबत आवेदन किया जा रहा है और न कि सेल्यूलायड पर पहले से प्रमाणित चलचित्त फिल्म की प्रति की बाबत ।
(घ) क्या विद्यमान वीडियो फिल्म, किसी अन्य फिल्म का उब किया गया पाठ है या पुनः बनाया गया है ? यदि हा तो उस वीडियो फिल्म को जारी प्रमाणपत्तों की ब्यौरे सहित विशिष्टियों का उल्लेख करें ।
(ङ) क्या कोई सेंसर पूर्व सल्लाह अभिप्राप्त की गई थी और यदि यावे ली गई की गई थी तो उसका ब्यौरा दीजिए ।
( च) क्या विदेश में विदेश की किस सूटिंग के लिए अनुशा ली गई थी, यदि लो गई थी तो उसका ब्यौरा वीजिए ।
(छ) क्या वीडियो फिल्म में , वीडियो फिल्म की भाषा से भिक्ष किसी भाषा में कोई कथोपथन/टीका है ; यदि है तो वह भाषा और वे कसेट विनिविष्ट करें जिसमें वे आते हैं ।
5. क्या इस वीडियो फिल्म को भारत में सार्बजनिक प्रदर्शन के लिए उपयुक्त प्रमाणित करने के लिए पहलो कोई आवेदन किया गया है, यदि किया गया हो तो
(क ) वह कहां और किसे दिया' गया था ?
(ख ) आवेदन का क्या परिणाम रहा है ?
( 1 ) अनिबंधित/ अनिबंधित वयस्क/बयस्क/ विशिष्ट प्रमाणपत्र सं ० शारीख . .. इस शर्त के अधीन रहते हुए विया गया था कि निम्नलिखित भाग काट विए जाएं . से प्रमाणपत्र देने से इन्कार कर दिया गया था ।
6. क्या इस वीडियो फिल्म/ फिल्म का प्रदर्शन किसी समय निलम्बित किया गया था या वीडियो फिल्म/ फिल्म केन्द्रीय या किसी राज्य सरकार द्वारा अप्रमाणित घोषित की गई थी ? विशिष्टियां लिखेंः-

मैं यह भी घोषणा करता हूं कि मुझे प्रश्नगत वीडियो फिल्म के अधिकार प्राप्त हैं और फीचर फिल्म में ट्रेलरों , विज्ञापनों , वृतचित्त्रों आषि के रूप में अतिरिक्त सामग्री का उपयोग करने का अधिकार है ।

(क) वीडियो फिल्म का नाम .
(ख) वीडियो फिल्म की भाषा .
( ग) वीडियो फिल्म जालन समय . मीटर . सी सी पी और/ या आयात अनुज्ञप्ति में यथा दशित वीडियो फिल्म के चलते रहने का समय .
क्या आवेदक द्वारा स्वैच्छिक रूप से कोई फोट छांट की गई है और यदि की गई है तो उसका ब्यौरा वीजए ।
(घ) केसेटों की संख्या ,
(ङ) वीडियो संपरिवर्तन की अन्य कोई विशिष्टियां
(च) फिल्म का टाइप अर्थात् क्या वह 2 ही 3 डी, मिनेमास्कोप विस्टाविजन आदि ।
(छ) क्या फिल्म मूक है या संबाकू ?
(ज) फिल्म का रग
7. क्या वीडियो फिल्म में कोई कथोपकथन गीत , कविता, भाषण या टीका अंग्रेजी या किसी भारतीय 'माषा से भिन्न किसी भाषा में है, यदि है तो यह विनिविष्ट करें कि किसा कैसेट या कैसेटों में ऐसा कथोप- कथन , गीत, कविता, भाषण या टीका आती है और उसमें किस भाषा का या किन भाषाओं का प्रयोग किया गया है ।
४. नियम 36 में विहित फीस करे बाबत आवेदन के साथ फीस की राशि देखिए:

2. लिखिए क्या वीडियो फिल्म समाचार दर्शन/ वृत्तचित्त/वैज्ञानिक शैक्षिक/ फीवर/ विज्ञापन वीडियो फिल्म है ।
3. वीडियो फिल्म की निगेटिव और पाजिटिव प्रिंटों की संख्या अलग-अलग लिखिए:

4. (का) क्या वह वीडियो फिल्म, जिसके लिए आवेदन किया गया है, सेल्यूलायड पर किसी चलचित्र की प्रतिकृति चित्त/ यथावत चित्त है जिसकी बाबत केन्द्रीय फिल्म प्रमाणन बोर्ड द्वारा पहले ही प्रमाणपत्तन मन्जूर किया जा चुका है ? प्रमाणित फिल्म की विशिष्टियों का कथन भी करें ।
( वा) क्या यह वीडियो फिल्म, सेल्यूलायड पर किसी प्रमाणित चलचित परिवर्तन है का उपांतरण है जिसमें परिवर्धन, लोप/ अन्य (उपान्तरणों के म्योरे विए जाए )
(ग) क्या किसी मूल वीडियो फिल्म की बाबत आवेदन किया जा रहा है मौर म कि सेल्यूलायड पर किसी पहसे से प्रमाणित चलचित्र की कोई प्रति ।
(च) यह फिल्म किन किन अन्य भाषा/ भाषाओं में यदि कोई हो/हों निमित्त या डब की गई हैं ?
जहां प्रत्येक भाषा में शीर्षक एक ही नहीं है ; बहां प्रत्येक पाठ का, शीर्षक जिससे उसको निर्मित्त या उब किया गया, कथन करें ।
5. क्या इस वीडियो फिल्म/फिल्म को प्रमाणित ( इसके वर्तमान या किसी अन्य शीर्षक के अधीन)
(क) भारत में,
(ख) संयुक्त राष्ट्र अमेरिका में,
(ग) यूनाइटेड किंगडम में,
( घ) किसी अन्य देश में,
करने के लिए पहले कोई आवेदन किया गया है ? यदि किया गया था तो,
(i) वह कहां और किसको किया गया था ?
( ii) आवेवन किया गया है ? यवि किया गया था तो,

7. क्या बीडियो फिल्म में कोई कथोपकथन, गीत, कविता , भाषण या टीका अंग्रेजी से या किसी भारतीय भाषा से भित्र भाषा में है ? यदि है तो यह विनिर्दिष्ट कीजिए कि केसिट या केसिटों में ऐसे कथोपकथन, गीत, कविता, भाषण या टीका आती है, और उसमें किस भाषा या किन किन भाषाओं का प्रयोग किया गया है ।

11. क्या बीडियो फिल्म/फिल्म वक्षिणी अफ्रीका या रोडेशियायी रराष्ट्रिकों द्वार। या उनके सहयोग से पूर्णतः या भागतः दक्षिणी अफ्रीका , वक्षिण पश्चिमी अफ्रीका या रोडेशिया में निर्मित्त की गई है या फिल्म दक्षिणी अफ्रीका, यः रोडेशियाई राष्ट्रिकों के पूर्णतः या भावतः स्वामित्वा- धीन है ? यदि कोई है तो ब्यौरे दोजिए ।
12. मैं घोषणा करता हूं कि वीडियो फिल्म बोर्ड द्वारः परीक्षण के लिए तैयार है और यह कि ऊपर अभिलिखित कथन हर विशिष्ट में सही है । मैं यह भो घोषणा करता हूं कि मुझे प्रश्नगत फिल्म के वीडियो अधिकार प्राप्त है । मैं आगे घोषणा करता हूँ कि वीडियो फिल्म, ट्रेलरों , विज्ञापनों , वृत्त चित्रों आदि के रूप में फीचर फिल्म की अतिरिक्त सामग्री का उपयोग का मेरा अधिकार है ।

(घ) प्ररूप 4 , 5 , 6 और 7 में क्रमः संख्या 2 के अन्त में निम्नलिखित शब्द अंतः स्थापित किए जाएंगे, अर्थात्:-- "तथापि यह प्रमाणपत्र वीडियो फिल्मों के लिए मान्य नहीं है"
(ङ) प्ररूप 4 के पश्चात निम्नलिखित प्ररूप अन्त स्थापित किया जाएगा, अर्थात्:

भाग 2
उस कांट छांट और उपांतरों की विशिष्टियां जिनके अध न रहते हुए प्रमाण दिया गया है ।
1. यह प्रमाणपत्र चलचित्र अधिनियम, 1952 के अधीन विरचित चलचित्र ( प्रमाणन ) नियम, 1983 के नियम 35 के अनुसार दिया गया है ।
2. यह प्रमाणपत्र केवल मॉडियो फिल्म का बाबत हैं। मान्य है ।

NOTIFICATION
New Delhi , the 28th February , 1984
G.S.R. 83 (E) . In exercise of the powers con- ferred by section 8 of the Cinematograph Act, 1952 (37 of 1952) , the Central Government hereby makes the following rules further to amend the Cinema- tograph ( Certification) Rules , 1983 , namely :-
1. ( 1 ) These rules may be called the Cinemato- graph (Certification) (Amendment) Rules , 1984.
( 2) They shall come into force on 1st day of March, 1984.
2. In the Cinematograph (Certification) Rules , 1983 ,-
(1) in rule 2 ,-
(a) in clause ( viii) , after the word " means" . the words " a chief executive officer or " shall be inserted;
(b) for clause (ix) , the following clause shall be substituted , namely :-
"(ix) " feature film " means fictionalised story film exceeding 2000 metres in length in 35 mm or corresponding length in other gauges or on video ; "
(c) for clause ( xi) , the following clause shall be substituted . namely-
" (xi ) " long" film is a film with a length exceeding 2000 metres in 35 mnt or corresponding length in other gauges or on video;"
(d) for clause ( xvi ) , the following clause shall be substituted, namely
"(xvi) " short film" means a film with a length upto and including 2000 metres in length in 35 mm or corresponding length in other gauges or on video ; "
(2) in rule 21 , in sub - rule (1 ) , for the words and figures " Form I or Form, II " , the words and figures "Form I or Form I-A or Form II or Form II -A as the case may be" shall be substituted;

[PART II- SEC . 3 (1) ]
(3) in sub - rule ( 1) of rule 28 , after the word " after" , the words " the Chairman or " shall be in- serted;
(4) in sub - rule (2) of rule 29 , for the word and figures " Form IV, V, VI or VII " the following word and figures shall be substituted , namely----
"Form IV , IV - A , V, V- A, VI , VI-A, VII or VII -A " .
(5) in rule 30 , to sub - rule ( 1 ) , the following pro- viso shall be added, namelv
"Provided that in the case of video film , a copy of the certificate showing the serial number, the category and other details should be pasted on every video cassette as well as on its case . "
(6) in sub - rule (3 ) of rule 33 , for the words " the member " the words " one member " shall be subs- tuted;
(7) in rule 35-
(a) in sub - rule ( 1 ) , for the word and figures "Forms IV, V, VI or VII" the following word and figures shall be substituted, namely:--
" Forms IV , IV-A , V, V-A , VI, VI-A , VII or VII - Α" .
(b) in sub - rule (3) , for the words " The length of the trailer certificate will be as laid down in the following table : " the fol- lowing words shall be substituted , name- ly :---
"In the case of a video film , the trailer cer- tificate shall be for a duration of not less than fifteen seconds and in the case of other films , the length of the trailer certificate will be as laid down in the following table :"
(8) in sub - rute ( 1 ) of rule 36, ---
(a) after Part III, the following Part shall be inserted, namely :---
"Part III- A video films .
(i) Rs . 40 for every 10 minutes of dura- tion or part thereof where the video film does not exceed 20 minutes of duration;
(ii) Rs . 200 for every 10 minutes of duration or part thereof where the video film exceeds 20 minutes of duration subject to a minium Rs . 600" ; of 7

(b) in Part IV, after clause (iii) , the following clause shall be inserted , namely :-
"( iv) Rs . 40 for every 10 minutes of duration or part thereof in the case of video films";
(c) in the first proviso to Part IV, after the figures and words " 8 millimetres super - 8 " , the words and figure " and in the case of a video film with a duration of more than 20 minutes " shall be inserted;
(d) in the first and second provisos to Part IV , after the words and figure " or Part III" , the words figure and letter " or Part III-A " shall be inserted;
(e) in Part V. after the words and figures " in Parts I, II , III " , the figure and letter " III-A" shall be inserted;
(f) in the first proviso to Part V, after the figures & words " 8 millimetre super - 8 " and before the words " an.l at the rate of" , the words and figure " and where it does not exceed 20 minutes of duration in the case of video films " shall be in- serted;
(g) at the end of the first proviso to Part V, the words and figure " or where the video film ex- ceeds 20 minutes of duration " shall be inserted;
(h) in Part VI after the words " reel or reels" , the words " or cassette or cassettes " shall be in- serted;
(9) in rule 39 , after the words " The Board shall" the word " maintain " shall be inserted;
(10) in the Second Schedule,
(a) after Form I, the following forın shall he inserted , namely :-

(b) Whether the video film is a modified ver- sion of a certified cinematograph film on celluloid containing additions , dele- tions other alterations ( details of modi- fications may be provided).
(c) Whether the application being made is in respect of an original video film and not a copy of an already certified cine- matograph film on celluloid .
(d) Whether the present video film is a dub- bed version or re- inake of any other video film ? If so , state the particulars alongwith full details of certificates issued to that video film.
(e) Whether any pre -censorship advice was obtained and if so the details thereof .
(f) Whether permission for any shooting abroad was obtained and , if so, the de- tails thereof .
(g) Whether the video film contains any dia- logue commentary in any language other than the language of the video film and, if so, specify the language and the cas- sette in which they occur.
