का. आ. 162 (अ)/ 18चक/ 18 कक्र/ आई. डी. आर. ए / 84:-केन्द्रीय सरकार ने , भारत सरकार के उद्योग मंत्रालय , औद्योगिक विकाम विभाग के आदेश मं . का. आ. G13 (अ)/ 18चक/ 18 कक/आई डी. आर . ए./76 दिनांक 15 सितम्बर , 1976 दुद्वारा इण्डस्ट्रीयल रिकन्सट्रक्शन कारपोरेशन आफ इंडिया लिमिटेड , कलकत्ता (जिसे इसमें इसके पश्चात् प्राधिकृत व्यक्ति कहा गया है) मैसर्स बंगाल पाटरीज लिमिटेड कलकत्ता के स्दामित्व वाले 45 , टंगरा रोड , कलकत्ता और 3 , पगलाडांगा रोड , कलकत्ता स्थित औद्योगिक उपक्रमों के सम्पूर्ण प्रबंध को 15 सितम्बर , 1976 में पांच माल की अवधि के लिए ग्रहण करने के लिए प्राधिकृत किया था ;
और केन्द्रीय सरकार ने भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास विभाग) के आदेश सं . का. आ. 697 (अ) /18चक/ 18 कक/आई . डी. आर . ए ./81 तारीख 14 सितंबर , 1981 दद्वारा प्राधिकृत व्यक्ति को उक्त औद्योगिक उपक्रमों का एक वर्ष की अतिरिक्त अवधि के लिए प्रबंध करते रहने के लिए प्राधिकृत किया था ,

और केन्द्रीय सरकार ने भारत सरकार के उद्योग मंत्रालय (ओष्योगिक विकास विभाग) के आदेश सं . का . आ. 665 (अ)/ 18चक/18कक/आई . डी. बार ए ./82 तारीख 14 सितम्बर , 1982कां. आ . 174 (अ) / 18क्षक/ 18कक/आई. डी. आर. ए./ 83 तारीख 14 मार्च 1983 तथा का. बा. 660 (अ) /18चक/18 कक/ आई . डी. आर . ए-83 दिनांक 14 सितम्बर , 1983 द्वारा प्रथि कृत व्यक्ति को उक्त वो औद्योगिक उपक्रमों का प्रबंध 14 मार्च , 1984 तक की अतिरिक्त अवधि के लिए करते रहने के लिए प्राधिकृत किया था ;
और केन्द्रीय सरकार ने , यह राय होने पर कि सर्व साधारण के हित में यह समीचीन था कि प्राधिकृत व्यक्ति उक्त औद्यो- गिक उपक्रमों का प्रबंध करना जारी रखों , उद्योग (विकास और विनियमन) अधिनियम , 1951 ( 1951 का 65) की धारा 18 -चक की उप- धारा (2) के परन्तुक के अधीन एक आवेदन कलकत्ता उच्च न्यायालय को दिया था जिसमें यह प्रार्थना की गई थी कि ऐसा प्रबंध तारीख 30 जून , 1984 तक की और अवधि के लिए जारी रखा जाए । और उक्त उच्च न्यायालय ने अपने , तारीख 12 मार्च , 1984 के आदेशानुसार प्राधिकृत व्यक्ति को उक्त दो औद्योगिक उपक्रमों का प्रबन्ध तारीख 30 जून , 1984 तक की और अवधि तक जारी रखने के लिए अनुज्ञात कर दिया था ।
अतः केन्द्रीय सरकार उक्त अधिनियम की धारा18- कक के साथ पठित धारा 18 - चक की उप - धारा ( 2) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , प्राधिकृत को निर्देश

बेती है , कि वह तारीख 30 जून , 1984 तक , जिसमें यह तारीख भी सम्मिलित है , की और अधि के लिए उक्त औष्योगिक उप- क्रमों का प्रबन्ध करना आरी रखे ।

Now, therefore , in exercise of the powers con- ferred by the proviso to sub- section (2 ) of section 18FA read with section 18AA of the said Act , the Central Government hereby directs the autho- rised person to continue to manage the said two in- dustrial undertakings for a further period upto and inclusive of the 30th June , 1984 .

का. आ. 163 (अ.)/ 18चख/उ . वि. वि. अ./84- केन्द्रीय सरकार ने उद्योग (विकास और विनियमन) अधिनियम , 1951 (1951 का 65) की धारा 18 वख की उपधारा ( 1) के खण्ड (क) और (ख) दुवद्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के उद्द्योग मंत्रालय (औद्योगिक विकास विभाग) के आदेश सं . का . आ. 39 (अ)/ 18चल/उ . वि . वि. आ./77, तारीख 22 जनवरी , 1977 द्वारा ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है) यह घोषणा की थी कि:-
S.O. 162 (E) 18FA 18AA IDRA 84.--Whereas by the order of the Government of India in the Ministry of Industry ( Department of Industrial Development ) No. S.O. 613 ( E) 18FA 18AA IDRA 76 , dated the 15th September, 1976 the Certral Government had authorised the Industrial Reconstruction Corporation of India Limited, Cal- cutta ( hereinafter referred to as the authorised person) to take over the management of the whole of the two industrial undertakings at 45 , Tangra Road, Calcutta, and at 3 , Pagladanga Road, Cal- cutta , owned by Messrs Bengal Potteries Limited, Calcutta, for a period of five years from the 15th September , 1976;
(क) औध्योगिक विवाद आर्धािनयम , 1947 (1947 का 14) इस अनुकूलों सहित की उक्त अधिनियम की धारा 9 - क , 5 - क , 5 ( ख) और धारा 33 - ग का लोप किया जाएगा , मैसर्स बंगाल पोटरीज लिमि टेड कलकत्ता के स्वामित्वाधीन दो औद्योगिक उप- क्रमों जो कि 45 , टंगरा रोड , कलकत्ता और 3 , पगलाडांगा रोड , कलकत्ता में स्थित हैं , को लागू होगा, और
And, whereas , by the order of Government of India in the Ministry of Industry (Department of Industrial Development No. S.O. 697 (E ) 18FA 18AA IDRA 81 , dated the 14th September. 1981 the Central Government authorised the authorised person to continue to manage the said two indust- rial undertakings for a further period of one year ;
(ख) राजपत्र में उक्त आदेश के प्रकाशन की तारीख से ठीक पूर्व प्रवृत्त ऐसी सभी संविदाओं संपत्ति के हस्तांतरण-पत्रों, करारों व्यवस्थापनों , पंचाटों , स्थायी आवेशों या अन्य लिखतों का प्रवर्तन ( उनसे भिन्न जिनका संबंध बैंकों और वित्तीय संस्थाओं के प्रतिभूत दायित्वों से है) जिनके उक्त औद्योगिक उपक्रम पक्षकार हैं या ऐसे औद्योगिक उपक्रमों की स्वामी कम्पनी पक्षकार है , या जो व्यथास्थिति , उन औद्योगिक उपक्रमों का कम्पनी को लागू होते हों , और उक्त तारीख के पूर्व उनके अधीन प्रोद्भुत या उद्भुत सभी या कोई अधिकार विशेषाधिकार बाध्यताएं और दायित्व निलंबित रहेगा , And, whereas , by the order of Government of India in the Ministry of Industry ( Department of Industrial Development ) Nos . S.O. 665 (E) 18FA 18AA IDRA 82 dated 14-9-1982, S.O. 174 ( E ) | 18FA 18AA IDRA 83 dated the 14-3-1983 and S.O. 660 (E ) 18FA 18AA IDRA 83 dated 14th September, 1983 , the Central Government autho rised the authorised person to continue to manage the said two industrial undertakings for a further period upto 14th March . 1984 .
और उक्त आदेश की अधि समय - समय पर और 14 मार्च , 1984 तक के लिए जिसमें यह लारीरू भी सम्मिलितहै , वढ़ा दी गई थी,
और केन्द्रीय सरकार का समाधान हो गया है कि उक्त आदेश की अवधि 30 जून , 1984 तक के लिए जिममें यह तारीख भी सम्मिलित है , ग्ढा दी जानी चाहिए ,
And, whereas , the Central Government being of opinion that it was expedient in the interests of the general public that the authorised person should continue to manage the said Industrial Undertak- ings , made an application under the proviso to sub - section ( 2 ) of section 18FA of the Industries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) , to the Calcutta High Court praying for the continuance of such management for a further period upto and inclusive of 30th June , 1984 ;
अतः अब , केन्द्रीय सरकार , उद्योग (विकास और विनिय- गन) अधिनियम 1951 (1951 का 65) की धारा 18 - जय की उप- धारा ( 2) के साथ पठित उण्धारा ( 1) के खण्ड (क) और (ख) दुवारा प्रदत्त शक्तियों को प्रयोग करते हुए , उक्त अवधि 30 जून , 1984 तक के लिए जिएम वह तारीख भी सम्मिलित है , बठासी है ।
[फा. सं. 2 (19)/75-सी. यू. एस. ] And, whereas , the said High Court by its Order dated the 12th March , 1984 permitted the autho- rised person to continue to manage the said two industrial undertakings for a further period upto and inclusive of 30th June, 1984 ;

[भाय II-खंड 3 ( ii )]
S.O. 163 (E) 18FB IDRA 84.----Whereas by the order of the Government of India in the Ministry ofIndustry (Department of Industrial Develop- ment) No. S.O. 39 (E) 18FB IDRA 77 , dated the 22nd January , 1977 (hereinafter referred to as the said order ) , the Central Government in exercise of the powers conferred by clauses ( a) & (b ) of sub section ( 1) of section 18FB of the Industries (De- velopment & Regulation ) Act, 1951 ( 65 of 1951 ) declared that :-
(a) the Industrial Disputes Act, 1947 ( 14) of 1947) , shall apply to the two industrial undertakings at 45 Tangra Road, Cal- cutta and 3 Pagladanga Road, Calcutta owned by Ms. Bengal Potteries Limited, Calcutta with the adaptation that section 9A, Chapters , VA and VB and section 33C of the said Act shall be omitted, and
(b) the operation of all contracts , assurances of property, agreements , settlements , awards , standing orders or other instru- ments in force immediately before the date of publication of the said Order in the Official Gazette (other than those re- lating to secured liabilities to banks and financial institutions) , to which the said industrial undertakings are parties , the company owing such industrial under- takings , is a party or which may be ap- plicable to the industrial undertakings of the company , as the case maybe and all or any of the rights , privileges obligations and liabilities accruing arising thereunder before the said date , shall remain suspended; ог ог
And, whereas , the duration of the said Order was extended from time to time and inclusive of the 14th March , 1984 ;
And, whereas , the Central Government is satis- fied that the duration of the said order should be extended for a further period upto and inclusive of the 30th June , 1984;
Now, therefore , in exercise of the powers con- ferred by clause ( a) and ( b) of sub- Section ( 1 ) , read with sub- section ( 2 ) of Section 18FB of the Indust- ries (Development and Regulation ) Act, 1951 ( 65 of 1951 ) , the Central Government hereby extends the duration of the said Order upto and inclusive of the 30th June , 1984 .
