का ० आ० 2100 (अ) :-मध्य प्रदेश के रायसेन जिले में पत्थर खानों मे नियोजित कर्मवारियों को देय मजबूरी की न्यूनतम उजन्ती दरों को निर्धारित करने के कतिपय प्रस्तावों को, न्यूनतम मजदूरी अधिनियम, 1948 ( 1948 का 11 ) की धाग 5 की उप-धारा ( 1 ) के खंड (ख) द्वारा यथा अपेक्षित, भारत के राजपत्र , असाधारण , के भाग II खंड 3, उप-खंड ( ii ) विनाक 31 अक्तूबर , 1983 को भारत सरकार , श्रम और पुनर्वास मंत्रालय ( धम विभाग ) की अधिसूचना सख्या का० आ० 785 ( अ ) दिनांक 31 अक्तूबर , 1983 के अन्तर्गत उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया गया था जिनके उनसे प्रभावित होने की संभावना है, तथा उक्त अधिसूचना के राजपक्ष में प्रकाशन की तारीख से दो मास की अवधि की समाप्ति तक सभी व्यक्तियों से आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्न जनता को 31 अक्तूबर, 1983 को उपलब्ध कराया गया था;
और उक्त प्रस्ताबो के बारे में प्राप्त आक्षेपों तथा सुझावों पर केन्द्रीय सरकार ने विचार किया है;
अतः , अब न्यूनतम मजदूरी अधिनियम , 1948 ( 1948 का 11 ) की धारा 4 की उपधारा ( 1 ) के खंड ( iii ) के साथ पठित धारा 3 की उपधारा ( 1 ) के खंड ( क) और धारा 5 की उपधारा ( 2 ) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार, सलाहकार बोर्ड से विचार-विमर्श के पश्चात्, मध्य प्रवेश के रायसेन जिले में पत्थर खानों में कर्मचारियों को उनके द्वारा किए गए उजरती कार्य के लिए , जो उक्त अनुसूची के स्तम्भ ( 2 ) में अनुरूपी प्रविष्टियों के लिए निर्दिष्ट हैं, न्यूनतम मजदूरी दरें निर्धारित करती है जो इससे उपाबळ अनुसूची के क्रमशः स्तम्भ ( 3 ) और ( 4) में निविष्ट हैं और यह निर्देश है कि यह अधिसूचना सरकारी राजपन्न में प्रकाशन की तारीख को लागू होंगी ।

4. प्रस्तर खंड को तहों में विभाजित करना तथा उन्हें लंबाई- चौड़ाई में काटना ।
स्पष्टीकरण:
1. इस अधिसूचना के अनुसार निर्धारित न्यूनतम उजरती दरें गर्व सम्मि लित दरें हैं, जिनमें आधारी दर, जीवन निर्वाह भत्ता आवश्यक वस्तुओं के रियायती दर पर किए गए प्रदायों का, यदि कोई हों , नकदी मूख्य सम्मिलित है तथा साप्ताहिक विश्राम के लिए वेय मजबूरी भी इसमें सम्मिलित हैं ।
2. मजबूरी की न्यूनतम दरें ठेकेदारों द्वारा नियोजित कर्मचारियों पर भी लागू हैं ।
3. जहां पर संविदा या करार या किसी अन्य आधार पर निर्धारित मजदूरी की प्रचलित वरें इम अधिनियम के अधीन अधिसूचित दरों से उच्चतर हैं यहां ऐसी उच्वतर दरों को सुरक्षित रखा जाएगा तथा उन्हें इस अधिसूचना के प्रयोजनार्थ न्यूनतम दरे समझा जाएगा ।
NOW, THEREFORE , in exercise of the powers conferred by clause ( 3 ) of sub - section ( 1 ) of section 3 read with clause ( iii) of sub- section ( 1) of section 4 and sub - section (2) of section 5 of the Minimum Wagos Act , 1948 (11 of 1948) , the Central Govern- ment , after consulting the Advisory Board, fixes the minimum rates of wages as specified in coluins ( 3 ) and (4) respectively of the Schedule annexed hereto , payable to the employees for piece work done by them in Stone mines in Raisen District of Madhya Pradesh as specified in the corresponding entries in column (2) of the said Schedule and directs that this notification shall come into force on the date of its publication in the official Gazette .
SCHEDULE
4. सभी उजरती वर कर्मचारियों के लिए न्यूनतम प्रत्याभूति मजबूरी , अर्थात् निर्वाह योग्य मजदूरी अनुसूची में कार्य के प्रत्येक वर्ग सामने स्तम्भ 4 में यथा-निर्दिष्ट के अनुसार होगी ।

Explanation:-
1. The minimum piece rates of wages fixed as per this notification are all - inclusive rates including the basic rate , the cost of living allowance and the cash value of concessional supply , if any, of essen- tial commodities and also include the wages payable for the weekly day of rest .
2. The minimum rates of wages are applicable to employees employed by contractors also.
3. Where the prevailing rates of wages based on contract or agreement or otherwise are higher than the notified rates under the Act , the higher rates should be protected and treated as the mini- mum rate of wages for the purpose of this notifi- cation.
4. The minimum guaranteed wage , i.c. the fall -back wage for all piece rated employees shall be as specified under column 4 of the Schedule against each category of work .
5. Men and women employees shall get the same rates of wages for the same work or work of a similar nature .
6. The minimum guaranteed rates of wages for disabled persons and for persons below cighteen years of age shall be 100 % and 80 % respectively of the rates payable to adult workers of the appго- priate category .
