आई सी एस बाई/ 710/2/ एम(1) कम्पनी सचिव अधिनियम , 1980 (1980 का 56) की धारा 39 की उपधारा ( 3) के साथ पठित 'उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , परिषद् , केन्द्रीय सरकार के अनुमोदन से , कम्पनी सचिव विनियम 1982 में निम्नलिखित संशोधन करती है , अर्थात्:-
1. (क) इन विनियमों का नाम कम्पनी सचिव (संशोधन) विनियम , 1984 है ।
(ख) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगे ।
2. कम्पनी सचिव विनियम , 1982 में (जिन्हें इसमे इसके पश्चात् उक्त विनियम कहा गया है) : -
(1) विनियम 4 के उप-विनियम (1 ) में
(1) खण्ड (च) में, अन्त में " या " शब्द अन्तःस्थापित किया जाएगा ;
(2) ' इस प्रकार संशोधित खण्ड (च) के पश्चात्, निम्न- लिखित को खण्ड (छा) और (ज) के रूप में अंतःस्थापित किया जाएगा , अर्थात-

(1) "(छ) तारीख 31 दिसम्बर , 1972 को या उससे पूर्व इंस्टीट्यूट ऑफ चार्टर्ड सेक्रेट्रीज एण्ड एडमिनिस्ट्रेटर्स , लन्दन में छात्र के रूप में स्वयं को रजिस्ट्रीकृत करा लिया था , और उक्त संस्थान की अन्तिम परीक्षा उत्तीर्ण कर ली थी और उसे अपक्षित व्यावहारिक अनुभव प्राप्त था या उसने संस्थान द्वारा संचालित अन्तिम परीक्षा उत्तीर्ण करने वाले अभ्यर्थियों के लिए यथा नियत विहित व्यावहारिक प्रशिक्षण पूरा कर लिया था ; या
(ज) वह भारत का नागरिक है , जो विदेशी मुद्रा विनियमन अधिनियम , 1973 (1973 का 46) की धारा-2 के खण्ड (त) में यथा परिभाषित "भारत के बाहर रहने वाला व्यक्ति" है और इंस्टीट्यूट मांफ चार्टर्ड मेक्रेटरीज एण्ड एडमिनिस्ट्रेटर्स , लन्दन द्वारा संचालित अर्हक परीक्षा उत्तीर्ण करने के पश्चात , उक्त संस्थान का सदस्य हो गया है और उसने भारत या विदेश में अपेक्षित व्यावहारिक अनुभव प्राप्त कर लिया था या उक्त संस्थान द्वारा संचा- लित अन्तिम परीक्षा उत्तीर्ण करने बाले अभ्यर्थियों के लिए यथा नियत व्यावहारिक प्रशिक्षण पूरा कर लिया था । " [PART III- SEC 4 ] THE GAZETTE OF INDIA : EXTRAORDINARY

(2) उक्त विनियमों की अनुसूची ' ग' में -
Company Secretaries Act , 1980 (56 of 1980) read with sub - section ( 3 ) thereof , the Council , with the approval of the Central Government, makes the following amendments to the Company Secretaries Regulations , 1982 , namely :-
(क) भाग 1 में , ' प्रारम्भिक परीक्षा के लिए पाठ्य- विवरण ' शीर्षक के अधीन , कोष्ठकों के अन्तर्गत आरम्भिक भाग में , " परीक्षा में लेखन-माश्यम केवल अंग्रेजी है" शब्दों के स्थान पर , निम्न- लिखित शब्द रखे जाएंगे , अर्थात्-
1. ( a) These regulations may be called the Com- pany Secretaries (Amendment ) Regulations, 1984.
(b ) They shall come into force on the date of their publication in the Gazette of India.
2. In the Conmpany Secretaries Regulations , 1982 ( hereinafter referred to as the said regula- tions) ;
" परीक्षा में लेखन- माध्यम अंग्रेजी होगा ; परन्त परिषद् , ऐमी शतों के अधीन जैसी वह ठीक समझे और अभ्यर्थियों को पर्याप्त रूप से पूर्व सूचना देने के पश्चात् , किसी विशेष विषय के लिए लेखन - माध्यम के रूप मे हिन्दी के प्रयोग को अनुज्ञात करने के लिए मक्ष्म होगी" ।
(1) In regulation 4 , in sub - regulation ( 1 ) -
( i) in clause ( f ) the word " or " shall be in- serted at the end ;
(रु) भाग 2 में , " इण्टरमीडिएट परीक्षा के लिए पाठ्यक्रम" शीर्षक के अधीन , कोष्ठकों के अन्तर्गत आरम्भिक भाग में , " परीक्षा में लेखन- माध्यम केवल अंग्रेजी है" शब्दों के स्थान पर निम्नलिखित शब्द रखे जाएगे , अर्थात-
( ii) after clause ( f ) as so amended , the fol- lowing clauses shall be inserted as clauses ( g ) and ( h ) namely :-
" परीक्षा में लेखन माध्यम अंग्रेजी होगा ; परंतु परिषद् , ऐसी शतों के अधीन जैसी वह ठीक समझे और अभ्यर्थियों को पर्याप्त रूप से पूर्व सूचना देने के पश्चात , किसी विशेष विषय के लिए लेखन-गाध्यम के रूप में हिन्दी के प्रयोग को अनुज्ञात करने के लिए सक्षम होगी । "
"(g ) had registered himself as a student with the Institute of Chartered Secrc- taries & Administrators , London on or before 31st December , 1972 and had passed the final examination of that Institute and had either possess- ed the required practical experience or andergone the prescribed practical training as stipulated for candidates passing the final examination conduct- ed by the Institute ; or (ग) भाग 3 में , " अंतिम परीक्षा के लिए पाठ्यक्रम" शीर्षक के अधीन , कोष्ठकों के अन्तर्गत आरम्भिक भाग में , " परीक्षा में लेखन-माध्यम केवल अंग्रेजी है" शब्दों के स्थान पर निम्नलिखित शब्द रखे जाएंगे , अर्थात्:-
" परीक्षा में लेखन- माध्यम अंग्रेजी होगा ; परन्तु परिष्द् गेमी शर्तों के अधीन जैसी वह ठीक मझे और अभ्यर्थियों को पर्याप्त ए मे पूर्व सूचना देने के पश्च्चात्, किमी विशेष विषय केलिए लेखन- माध्यम के रूप में हिंदी के प्रयोग को अनुज्ञात करने के लिए सक्षम होगी" ।

(h) is un Indian citizen who is a " person resident outside India " as defined in clause ( p) of section 2 of the Foreign Exchange Regulations Act , 1973 (46 of 1973 ) and has become a mem- her of the Institute of Chartered Sec- retaries and Administrators , London , after passing the qualifying examina tion conducted by that Institute and had either possessed the required prac- tical experience in India or abroad , or undergone the prescribed practical training as stipulated for the candi- dates passing the final examination conducted by the Institute " .
(2) in Schedule C to the said regulations ,- THE INSTITUTE OF COMPANY SECRETARIES OF INDIA
(Constituted under, the Company Secretaries Act, 1980)
the (a) in Part I , under the heading ' Syllabus for Preliminary Examination' , in opening portion within brackets , for the words " The medium of writing the examination is English only " , the following shall be substituted , namely:-

(b) in Part II, under the heading ' Syllabus for Intermediate Examination' , in the opening portion within brackets , for the words "The medium of writing the examination is English only " , the follow- ing shall be substituted , namely :-
"The mediurn of writing the examination will be English ; provided that it shall be competent for the Council to per- mit , subject to such conditions as it may deem fit and after giving sufficient advance information to the candi- dates, the use of Hindi as a medium of writing for any particular subject" .
(c) in Part III , under the heading ' Sylla- bus for Final Examination', in the open- ing portion within brackets , for the words "The medium of writing the examina- tion is English only " , the following shall be substituted , namely :---
"The medium of writing the examination will be English; provided that it shall be competent for the Council to per- mit , subject to such conditions as it may deem fit and after giving suffi- cient advance information to the can- didates , the use of Hindi as a medium of writing for any particular subject" .
