अधिसूचना
सा०का ०नि० 246 ( अ) -यन वायुयान नियम, 1937 में और संशोधन करने के लिए कुछ प्रारूप नियमों को जिन्हें केन्द्रीय सरकार का वायुयान अधिनियम, 1934 ( 1934 का 22) की धारा 5 के अन्तर्गत बनाने का प्रस्ताव है, ऐसे सभी व्यक्तियों से जिनके उनसे प्रभावित होने की संभावना है , उस तारीख से तीन महीने की अवधि समाप्त हाने से पहले पहले, जिस तारीख को उस राजपत्त्र की प्रतियां, जिनमे उक्त अधिसूचना प्रकाशिन की गयी थी, जनना को उपलब्ध कराई गई थी, आपत्तियां एवं सुझाव मांगने के लिए भारत सरकार पर्यटन और नागर विमानन मंत्रालय की अधिसूचना सं.० मा०का ० नि० 379, दिनांक 26-4-1983 के साथ भारत के राजपत्त्र के भाग II, खंड 3 , उपखंड ( i ) , दिनांक 14 मई. 1983 के पृष्ठ 1138 से 1140 पर प्रकाशित किया गया था ;
और यतः उक्त राजपत्न जनता को 14 मई , 1983 को उपलब्ध करा दिया गया था ;

और यन जनता से प्राप्त आपत्तियो अथवा मुझावों पर विचार कर लिया गया है ,
अतः ग्रब , उक्त अधिनियम की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करने हुए , केन्द्रीय सरकार एतद्वारा वायुयान नियम, 1937 में और श्रागे मशोधन करने के लिए निम्नलिखित नियम बनाती है अर्थात्: --
( 1) ये नियम वाय्यान ( द्वितीय संशोधन) नियम, 1984 कहलाएंगे ।
(2) ये 1 अप्रैल , 1984 को प्रवृत्त होग ।
2. वायुयान नियम, 1937 की अनुसूची--V खंड ग में उप-पैरा ( i) व ( ii ) के स्थान पर निम्नलिखित प्रतिस्थापित किय जाएगे अर्थात् .--
बम्बई , कनकत्ता, मद्रास और दिल्ली त्रिमान क्षत्रों पर अवतरण रुग्ने वाली अनर्गष्ट्रीय उडाने ।
प्रत्येक अवतरण के लिए प्रभार विमान का कुल भार
30 रुपए
75 रुपए 2,000 कि०ग्रा ० से अनधिक 2,000 कि०ग्रा ० से अधिकः परन्तु 5,000 कि० ग्रा ० से अनधिक
5,000 कि०ग्रा० से अधिक परन्तु 10,000 कि०ग्रा ० में अनधिक

G.S.R. 246 (E) . Whereas certain draft rules further to amend the Aircraft Rules, 1937 , which the Central Government proposes to make under Section 5 of the Aircraft Act, 1934 (22 of 1934) were published at pages 1138 to 1140 of the Gazette of India Part IJ , Section 3 , Sub- section ( i ) , dated the 14th May 1983 with the noti- fication of the Government of India , Ministry of Tourism and Civil Aviation No. GSR 379 dated the 26-4-1983 , inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of three months from the date on which the copies of the Official Gazette in which the said notification was published were made available to the public ;

परन्तु 60,000 किलोग्राम से अधिक भार वाले वायु- यान को, यदि वह भारतीय उड़ान सूचना क्षेत्र (श्रेत्रों ) के ऊपर से 500 किलोमीटर या कम दूरी पर उड़ान करता है, दिक्चालन सुविधाएं प्रदान करने के लिए प्रत्येक अवतरण के लिए 2,100 रुपये की दर से प्रभार देना होगा ।

And whereas the objections or suggestions receiv- ed from the public have been considered;
Now, therefore , in exercise of the powers con- ferred by Section 5 of the said Act , the Central Government hereby makes the following rules fùr- ther to amend the Aircraft Rules , 1937, namely : ----
1. ( 1 ) These rules may be called the Aircraft (Second Amendment ) Rules , 1984 .

(2) They shall come into force on 1st April , 1984 .
2. In the Aircraft Rules , 1937 in Schedule V, Section C for sub - paragraphs (i) and (ii), the fol- lowing shall be substituted, namely :--
(i) International flights landing at Bombay , Calcutta, Madras and Delhi Airports .

Rs 75 Over 2,000 Kgs . but not exceeding 5,000 Kgs .
Rs . 285 Over 5,000 Kgs . but not exceeding 10,000 Kgs .

Rs . 938 Over 15,000 Kgs . but not exceeding 30,000 Kgs .
Rs . 1688 Over 30,000 Kgs . but not exceeding 60,000 Kgs .

Provided that an aircraft exceeding a total weight of, 60,000 Kgs . shall pay charges for providing route navigation facilities at the rate of Rs . 2,100 for each landing of the distance flown over Indian Flight Information region(s) is 500 Kms . or less .

Note : Principal sub -rule (4) under Rule 82 of Aircraft Rules 1937 introducing route navigation facilities charges was inserted vide G.S.R. 1233 dated 18th September , 1972 published in Gazette of India 1972 Part II Section 3 , Sub- section ( i) dated 30th September , 1972 .
Subsequently amended by :---
( i) Notification No. GSR 48 ( E) dated the 29th January 1977 published in the Gazette of India (Extraordinary ) Part II . Section 3 , Sub- section (j ) dated the 29th January, 1977 .
