EXPORT TRADE CONTROL
Public Notice No. 9-ETC(PN)|84
Subject:—Import and Export Policy for the pe-
riod April 1984-March 1985 (Volume II)
File No. 19(9) 184-EII.—Attention is invited to Ex- ports (Control) Amendment Order No.F(C), 1977|AM (284) dated the 12th April, 1984, on the above sub- ject.
2. The policy to be followed for export of diffe-
rent items during the period April 1984 to March 1985 is indicated against each item in Sections I and
II enclosed with this Public Notice.
3. This conies into force with immediate effect.
4. Pre-ban (including pre-control) dommitments in respect of items whose export was allowed either on de-oontrolled basis or under OGL-3, shall be consi- dered by the concerned Port Licensing Authorities in terms of provisions of the Hand Book of Import Export Procedures, 1984-85.
5. In respect of items allowed for export "On Merits" no person should enter into commitments before obtaining the necessary permission for export. Applications in respect of such items should be sub- mitted to the office of the Chief Controller of Iniporti & Exports, New Delhi.
81SECTION—I EXPORT CONTROL
1. Object.—The primary object of the Government Is to promote exports to the maximum extent, but in such a manner that the economy of the country is aot affected by unregulated exports of items essentially needed within the country. Export control is, therefore, exercised in respect of a limited number of items whose supply position demands that their exports should be regulated in the larger interest of the country
2, Scope.—Export control is exeicJued in accordance with the provisions of the Exports (Control) Order, 1977 issued by the Central Government in exercise of the powers conferred by Section 3 of the Imports and Exports (Control) Act, 1947. This Act U repro- duced in the current Hand BooV of Import-Export Procedure*.
3. Only Hems included in Schedule, I to the Exports (Control) Order, 1977 are under control. No such item can be exported unless it is covered by n valid licence issued by a licensing authority competent to grant an export licence for that item. Goods which are not included in this schedule can be shipped with- out any export licence unless their export is controlled under any other law for (he time being in force. For instance, export of antiques is regulated under the Antiquities and Art Treasures Act, 1972, whereas the export of Coffee and Tea is regulated by the Coffee Board, Bangalore, and the Tea Board, Calcutta, under the provision of the Indian Coffee Act, 1942 and the Tea Act, 1953 respectively. Likewise export of ^oroe other commodities is either prohibited or regulated under different enactments. A list of some mch enactments is given in Appendix II.
4, Notwithstanding the general rule that an item falling within the scope of the Exports (Control) Order cannot be exported unleRS covered^ by a valid licence issued by a licensing authority competent to grant licence for that item, the Order provides certain exceptions and concessions in terms of which exports can be made, in certain circumstances and lo a limited extent without a licence. The details of these excep- tions and concessions are given In the Current Hand Book of Import-Export Procedures.
5. Exports can be made to any destination in the world. No discrimination is mode, between one country and another, in the matter of issue of lirpn^p*; This means that foreign buyers are free irrespective of the country to which they belong, to procure their requirements of controller! commodities from persons holding export licences or eligible to receive licences. To this general rule, the only exceptions are the Union of South Africa and South-West Africa, because of • complete ban on trade with these countries [No export is, therefore, permitted to these countries, Border trade (i.e. frontier trade) between India and Tibet region of China shall not, however be allowed], 62GI/84-11
6. In the case of exports to Pakistan, all items require an export licence, unless they are covered by OGL-2 or OGL-4. Whether or not an Hem can be exported lo Pakistan depends on the export policy for that item for all other countries as given in Section II. Thus, whereas the policy for export to Pakistan is jxicUy the same as for all other countries, foi statistical purposes, it has been provided that an export licence shall be necessary for exporting gooda to Pakistan. Export licences to Pakistan are Issued on runu'shing the following :—
CO Evidence of irrevocable Letters of Credit having been opened with the State Bank of India in convertible currency or Asian Monetary Unit under the Asian Clearing Union Arrangement or on any Indhn Bank designated under Asian Cleaiintf Union Arrangements, and
(ii) Import Licerfce/permission from the Pakis- tan authorities allowing import Into Pakistan of the goods sought to be exported.
In the case of commodities like Tea, Coffee etc., per- mission to export to Pakistan will be issued by the respective Commodity Boards.
CATEGORIES OF EXPORTERS
7. For the purpose of export licensing, there are two categories of exporters, namely, established ex- porters and new-comen.
Established exporters are those who have mado exports of a particular commodity in the prescribed base period. Export quotas are granted to them in proporation to their exports in such base period.
Exporters who have no exports in the prescribed base period of the particular commodity concerned, are treated ai new-comers, provided such exporter has the requisite experience and is able to satisfy tbo lioi-f'sinff authorities on that account.
Details are given in the Current Hand Book of
fmport-Export Procednrei.
