का० आ०. 305 ( अ) / सं ० ई० (सी) ओ 1977/ए एम० ( 284):--- आायात एवं निर्यात (नियंत्रण ) अधिनियम , 1947 ( 1947 का 18) के भाग, 3 में प्रवत्त अधिकारों का प्रयोग करते हुए केन्द्रीय सरकार निर्यात (मियंक्षण) आदेश , 1977 में संशोधन करने के लिए निम्नलिखित आदेश का निर्माण करती है, अर्थात्ः- एतदद्वारा भ

1. इस आवेश को निर्यात ( नियंत्रण) औथा संशोधन आवेश,1984 की संज्ञा दी जाए ।

2. निर्यात ( नियंत्रण ) आवेश , 1977 में :--

( 1) अनुसूची 1 के भाग " क" में--

(क) क्रम सं० 1 में शब्द " कृषि मंत्रालय " को " पर्यावरण विभाग " शब्दों द्वारा प्रतिस्थापित किया जाएगा ।

(ख) क्रम सं० 4 के सामने आने बाली यर्तमान प्रविष्टि "सभी प्रकार के समुद्रीय शैवाल " को हटा दिया जाएगा ।

(ग) क्रम सं ० 8 ( 12) में आने वाली वर्तमान प्रविष्टि को निम्नलिखित द्वारा प्रतिस्थापित किया आएगा:--

टिप्पणीः-लेकिन उपर्युक्त विनियमों में ढील दे दी गई है और निर्यात की अनुमति फर्मों द्वारा मुख्य वनपाल या मुख्य जंगली जीव अथवा उनके द्वारा प्राधिकृत अधिकारी से यह प्रमाण पत्र प्रस्तुत करने पर स्वीकृत किया जाएगा कि ये माल वृक्षारोपण अथवा नर्मरी मूल के हैं । थो आर्किड्म निर्यात भी जंगली फाऊमा और फ्लोर के अन्तरराष्ट्रीय व्यापार विषयक पर हुए सम्मेलन के अनुसार अनुमेय हैं ।

(घ) क्रम सं० 8 ( 17 ) के बाद निम्नलिखित को जोड़ा जाएगाः-- " ४क-सभी क्रिम्म/श्रेणियों के वनखण्ड के बीज, मूल और प्रजनक बीज " ।

(ड. ) क्रम सं० 15 पर आने वाली बर्तमान प्रविगिट को निम्नलिखित

द्वारा प्रतिस्थापित किया जायगा:- "किसी भी पशु मूल की चर्बी, वसा और या तेल चाहे पिथालाया हुआ, बिना पिधलाया हुआ या अन्यथा रूप से है"

(च) क्रम सं० 27 ( 13 ) पर आने वाली वर्तमान प्रविष्टि को निम्नलिखत द्वारा प्रतिस्थापित किया जाएगा :-

"फारमुनेशन को छोड़कर क्फोरोक्वीन फास्फेट और क्लोरोक्वीन सल्फेट " ।

(छ) क्रम सं० 46 पर आने बाली वर्तमान प्रविष्टि हटा दी जाएगी।

( 3 ) अनुसूची 1 भाग " खू" में-

(क) सम्बन्धित क्रम संख्याओं के सामने आने वाली प्रविष्टियों को निम्नलिखित द्वारा प्रतिस्थापित किया जायगाः

" 2- जीबित मर भैसें और जो प्रजनन और दुग्ध देने के उ‌द्देश्य के लिए न हों ।

3-जीवित भेड़ और बकरी (प्रौढ़)

6 (क)- भैसों का मांस ( नर एवं मादा, दोनों ) जिसमें बिल , जिगर, फेफड़े, विमाग , जिल्वा, गुर्दा और अन्य अंग शामिल हैं।

13-हड्डियां:

(i ) हटा दिया गया है ।

( ii ) कंकाल और/या उनके हिस्से ।

(iii ) पीसी हुई हड्डिया ।

24-मूल और प्रजनक बीजों और तेल बीजों से भिन्न निम्नलिखित बीज:--

( i) वैश्वा किस्म के हरी खाद के बीच ( प्रमाणित किस्म)

( ii) सन हेम्भ के बीज ( प्रमाणित किस्म)

( iii ) मालू बीज और प्याज के बीज

( iv ) खाद्यान्न बीज जिसमें गेहूं और धान के बीज भी शामिल है (प्रमाणित किस्म)

(v) पेड़ोंके बीज, झाडियों के बीज और तखर बोज

(vi ) सजावटी पौधों के बीज ( प्रमाणित किस्म)

( vii) फूलों के बोज ( प्रमाणित किरम ) जंगली फूलों के बीजों सेभिन्न ।

(viii) सब्जियों के बीज ( प्रमाणिय किस्भ)

38-तेलरहित चावल की भूसी ( चावल से घूंसी का सत्त )

(ग) क्रम सं ० 105 के बाद निम्मलिखित प्रविष्टि जोड़ी जाएगीः- " 106- सभी किस्म के समूद्री शैवाल " ।

(3) खुले सामान्य लाइसेंस 2 अनुसूची 3 में क्रम सं० 6 ( 2) के वाद निम्नलिखित को जोड़ा जाएगाः-

"मोर की पूछ के पंख और उनसे तैयार हस्तशिल्प की वस्तुएं " ,

(4) खुले सामान्य लाइन्सेंस 3, अनुसूची 3 में-

(क ) निम्नलिखित क्रमसंख्याओं के सामने आने बाली सम्बन्धित प्रविष्टिया हटा दी जाएगी:-

1-जीवित भैसे ( फेबल निकृष्ट) और नर भैंसें जिनका उपयोग प्रजनन और बोझा ढोने के लिए न हो ।

( ख) निम्नलिखिक्त प्रविष्टियां , नीचे दी गई क्रम संख्याओं के सामने के कालम 2 में दी गई प्रविष्टियों द्वारा प्रतिस्थापित की जाएंगीः-

3- भैंस का मांस ( मर एवं मादा, दोनो ) जिसमें हृद्व्य , जिगर , फेफड़े , विमाग, जिहूवा, गुर्दा और अन्य अंग भी शामिल है ।

31( 9) क्लोरोक्वीन फास्फेट और क्लोरोक्वीन स्ल्फेट फार्मूलेशन

50-नरम्र कपास की रद्दी सख्त कपास की रवी

67-सांप/ रेंगने बाले जन्तुओं की खोल से बुने हुए जूतों को छोड़कर सभी किस्म के भूते ।

(ग) क्रम सं ० 44( 4 ) की वर्तमान प्रविष्टि को क्रम सं ० 44 ( 5) के रूप में पूनः संख्यांकित किया जाएगा ।

( घ) नीचे दी गई संख्याओं के सामने के कालम 4 में आने वाली वर्तमान शर्तों को निम्मलिखित द्वारा प्रतिस्थापित किया जाएगाः-

3 (i ) -जिस राज्य से निर्यात के लिए ममि जारी किया गया है, उम राज्य के पशु चिकित्सा अधिकारी द्वारा इस सम्बन्ध में प्रभाण पक्ष प्रस्तुत करने पर निर्यात की अनुमति दी जाएगी कि माँस केवल निकृष्ट भैंस का ही है न कि दूध देने वाली और प्रजनक भैंस का, बशर्ते कि निर्यात मूल्य 11.15 ६० प्रति किलो ग्राम जहाज पर निःशुल्क मूल्य से कम न हो ।

5--40/ -रु ० ( चालीस रुपए) प्रति सौ नगो की दर से अहाज पर्यन्त निःशुल्क मुल्य के न्यूनतम तक निर्यात मूल्य पर टेबल अण्डों के निर्यात की अनुमति दी जाएगी।

20और 21 क से ड-निर्यात की अनुमति निर्यातक द्वारा इस सबन्ध में घोषणा प्रस्तुत करने पर दी जाएगी कि निर्यात किए जाने वाले बीज मःतो जंगली बीज है और न ही मूल तथा उपजाऊ बीज हैं ।

21च-निर्यात की अनुमति इस सम्बन्ध में राज्य प्रमागन अभिकरण/ मागवानो विभाग से यह घोषणा-पन प्रस्तुत करने पर दी जाएगी कि निर्यात किए जाने वाले बीज प्रमाणित किस्म के हैं, न कि मूल और प्रजनक बोज है ।

21.छ.1- नर्सरी मूल के सब्जियों के बीज की अनुमति स्वयं निर्यातक द्वारा इस बारे में ऐसा प्रमाण पत्न प्रस्तुत करने पर दी जाएगी कि बीअ नर्सरी मूल के हैं और निर्यात आदेश के मद्दे जगाए गए हैं और ये मूल भौर प्रजनक बीज नहीं है ।

2- अन्य किस्मों के मामले में ( का) राष्ट्रीय बीज निगम सहित और (ख) राष्ट्रीय बीज निगम सहित मान्यता प्राप्त राज्य प्रमाणन अभि- करण से यह प्रमाणपत्त्र प्रस्तुत करने पर अनुमति दी जाएगी कि बीज. मूल और प्रजनक बीज नहीं है ।

25क्र-निर्यात की अनुमति भारतीय सोयाबीन संसाधन संघ, बम्बई के पास संविदा पंजीकृत करवाने पर की जाएगी ।

2.5 ग- निर्यात की अनुमति भारतीय विलायक निष्त्रर्षक संघ, बम्बई के पास संबिदाओं के पंजीकृत के भद्दे दी जाएगी ।

38 ( 2)-इमारती लकड़ी की अधिप्राप्ति के सम्बन्ध में निर्यात की अनुमति केवल मुख्य वन संरक्षक, आन्ध्र प्रदेश या मुख्य वन संरक्षक, तमिलनाड जैसा भी मामला हो, जारी किए गए मूल प्रमाण-पत्र प्रस्तुत करने पर दी जाएगी ।

39-लाल चन्दन की लकड़ी को छोड़ कर सभी गन्तब्य स्थानों को सभी प्रकार को संसाधित इमारती लकड़ी के निर्यात की अनुमति है । इमारतो लकड़ी की अधिप्राप्ति के सम्बन्ध में , लाल खन्दन की लकड़ी से बनी संभाषित इमारती लकड़ो की अनुमति केवल मुख्य वन संरक्षक, आन्ध्र प्रदेश या मुख्य बन गंरक्षक तमिलनाडु जैसा भी मामला हो, द्वारा आरी किए गए मूल प्रमाणपत्र प्रस्तुत करने पर ही थी जाएगीः-

(ङ) क्रम स० 55 और 56 के मामने आने बाली शर्त सं० ( 3) के अन्तिम वाक्य को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः-

'भारत मदों' के सम्बन्ध में विकास आयुक्त ( हस्तशिल्प ) के कार्यालय द्वारा जारी किया गया उचित प्रमाण-पत्त अपेक्षित होगा।"

(घ) क्रम सं ० 57, 59 और 61 के सामने की शर्त सं ० ( 2 ) के अन्तिम वाक्य को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा ।

57--" भारतीय मदों" के सम्बन्ध में विकास ( हस्तशिल्प ) के कार्यालय द्वारा जारी किया गया उचित प्रमाण पत्र अपेक्षित होगा ।

59-" भारतीय मदो" के अन्तर्गत वस्त्र उत्पादों के मामले में वस्त्र आयुक्त ( हस्तशिल्प) के फर्यालय से एक प्रमाण पत्र आवश्यक होगा।

61--" भारतीय मदों" के सम्बन्ध में विकास आयुक्त ( हस्तशिल्प ) के कार्यालय द्वारा जारी किया गया उचित प्रमाण पत्र अपेक्षित होगा।

(छ) निम्नलिखित मवों को उनकी सम्बन्धित क्रम संख्याओं के सामने भीचे दिए गए के अनुसार जोड़ा जाएगाः- 2 3 4 1

.27 ( क) निम्नलिखित के प्रस्तुत करने पर निर्यात की अनुमति दीजाएगी:-

( 1 ) निर्यात मूल्य संवीक्षा पर्ची , और 21क. भाग क की क्रम सं०. 14 ब में उल्लिखित को छोड़कर मीलेक, सीडलाख , बटनलाख, गार्नेट लाख और लाख की अन्य सभी किस्में,

(2) शैलेक निर्यात संवर्धन परिषद, कलकत्ता द्वारा जारी किए गए क्वालिटी प्रमाण-पक्ष

( ) ( 1 ) अप्रैल , 1984 मार्च , 1985 के दौरान लदान किए गए शैलेक के मूल्य के 10 प्रतिशत की सीमा तक शैलेक के निर्यातकों को सीडलाख के निर्यात की अनुमति दी जाएगी ।

(21) ऊपर (क ) में निर्धारित शर्त के अधीन भी सीडलाख के निर्यात की अनुमति दी जाएगी । ' 4

25 साल मंगों, महुआ और काकूम ख.41 ( 5 ) भारतीय का सत्ल

विलायक निष्कर्षक संघ, बम्बई के पास संविदाएं पंजीकृत करवाने पर निर्यात की अनुमति दी जाएगी ।

25 च. सूर्यमुखी बीज और तौरिया ख.41 बीज सत्त

( 6 ) भारतीय विलायक निषकर्षक संघ , बम्बई के पास संविवाएं पंजीकृत करवाने पर निर्यात की अनुमति वी जाएगी ।

37क. कम बजट की फीचर फिल्में ख .55 (20 लाख रू० की लागत पर बनाई गई) ,

सूचना एवं प्रसारण मंत्रालय से इस आशय का प्रमाण- पत्न प्रस्तुत करने पर कि फिल्म 20 लाख रूपये की लागत पर बनाई गई कम बजट की फीवर फिल्म है, निर्यात की अनुमति दी जाएगी ।

44 ( 4) 30 प्रतिशत य। अधिक खा. 64 ( 3 ) निर्यात की अनुमति संशिलष्ट रेणे संशिलिष्ट विरंजित धागा वाला

19 रूपये प्रति कि.ग्रा . जहाज पर्यन्त निःशुल्क के न्यूनतम निर्यात मूल्य के आधार पर दी जाएगी । निर्यातक किए गए निर्यातों के सम्बन्ध में सूचना पोतलवान की तिथि से सात दिनों के भीतर सम्बन्ध परिषद को भेजेगा ।"

(5) खुले सामान्य लाइसेंस 4, अनुसूची 3 , में: -

(क) क्रम से ० , 3 की वर्तमान प्रविष्टि हटा दी जाएगी ।

(ख) क्रम से०. 17 (i ) के कालम. 2 की वर्तमान प्रविष्टि निम्न- लिखित द्वारा प्रतिस्थापित को जाएगीः--

" 20 लाख रूपये की लागत पर बनाई गई कम बजट की फोचर फिल्मों को छोड़कर भारतीय फीचर फिल्मों के वीडियो राइट्स सहित अभिदणित सिनेमाटोग्राफिरु फिल्में ( फीचर फिल्में) "

(ग) क्रम सं ० . 12 के सामने के फालम 4, में सरणीबद्ध अभिकरण का नाम निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा:- " भारतीय अध्त्रक व्यापार निगम लिमिटेड"

E(C)1977 /AM( 284) : -In exe4cise of the powers conferred by Section 3 of the Imports and Exports (Control ) Act, 1947 , (18 of 1947) ,the Central Government hereby makes the following Order further to amend the Export (Control) Order, 1977, namely :-

[PART II- SEC . 3 ( ii ) ;

1. This Order may be called the Exports (Control) Fourth Amendment Order, 1984 .

2. In the Exports ( Control ) Order , 1977--

(1) In Part 'A' Schedule I-

(a) In S. No. 1 the words " Ministry of Agriculture" shall be substituted by the words " Department of Environment" .

(b) The existing entry " Seaweeds , all types " appearing against S. No. 4 shall be deleted .

NOTE :-The above regulations are however rolaxed and export permitted by firms on obtaining certi- ficates from the Chief Conservator of Forests or Chief Wild Life Warden or the Officer authorised by them, that the material is of plantation or nursery origin . However , export of orchids is in addition regulated as per the provisions of the Convention on International Trade in Endangered Species of Wild Fauna and Flora .

(d) The following item shall be added after S. No. 8 ( xvii ):...

"8A-Forestry seeds , Foundation and breeder seeds , all varieties /categories" .

"Tallow, fat and/or oils rendered , unrendered or otherwise , of any animal origin" .

(f) The existing entry appearing against S. No. 27( 13 ) shall be substituted by the following:-

(g) The existing entry appearing against S. No. 46 shall be deleted.

5-Export of Table Eggs allowed subject to minimum export price of Rs . 40/ - (Forty) per hundred num- ber f.o.b.

21A to E -Export allowed subject to production of a decla- ration by the exporter that the seeds to be exported are not Wild Seeds and also that the seeds are not Foundation and Breeder Seeds .

21 F.-Export allowed subject to production of a certi- ficate from State Certification Agency/Depart- ment of Horticulture that the seeds are of certified variety and not Foundation and Breeder Seeds .

21G 1.-Vegetable seeds of nursery origin against a certi- cate by the exporter himself to the effect that the seeds are of nursery origin and have been grown against export order and that the seeds are not Foundation and Breeder Seeds.

2.-Other varieties Against (a) Quality Control Certificate , and (b ) Certificate that the seeds are Foundation and Breeder Seeds from recognised State Certification Agency including National Seeds Corporation .

25A -Export allowed against registration of contracts with the Soyabean Processors Association of India , Indore.

25C -Export allowed against registration of contracts with the Solvent Extractors Association of India, Bombay.

38 ( ii )-Export will be allowed only on production of Certificate of Origin issuedby the Chief Conser- vator of Forests , Andhra Pradesh or the Chief Conservator of Forests , Tamil Nadu , as the case may be, as regards procurement of timber .

39-Export of Processed Timber all species , except Red Sanders Wood will be allowed to all permissible destinations . Processed timber made out of Red Sanders Wood will be allowed on production of

Certificate of Origin issued by the Chief Conser- vator of Forests, Andhra Pradesh or the Chiof Conservator of Forest , Tamil Nadu, as the case maybe, as regards procurement of the timber.

(e) The last sentence of condition No. ( iii ) appearing against S. Nos . 55 and 56 shall be substituted by the the following :-

"In respect of " India Items " appropriate certi- ficate issued by the Office of the Development Commis- sioner (Handicarfts ) willbe required" .

(f) The last sentence of condition No. ( ii) appearing against S. Nos . 57 , 59 and 61 shallbe substituted as indicated below :-

57-In respect of " India Items " appropriate Certificate issued by the Office of the Development Commis- sioner ( Handicrafts) will be required .

59-In the case of textile product falling under " India Items" a Certificate by the Office of the Develop- ment Commissioner ( Handicrafts ) will be required.

61-In respect of " India Items " appropriate Certificate

issued by the Office of the Development Com-

missioner (Handicrafts ) will be required .

(g) The following items shall be added at their respective S. Nos . as indicated below :-
