का० आ० 334 ( अ) 18 कक आई० डी० आर ० ए ०84 ; भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग ) के आदेश सं ० का ० आ० 265( अ) 18 कक आई ० डी० आर ० ए०/ 78 तारीख 13 अप्रैल 1978 द्वारा (जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है) मैसर्स स्वदेशी काटन मिल्स कंपनी लिमिटेड कानपुर के संपूर्ण औद्योगिक उपक्रमों अर्थात् ( i) मैसर्स स्वदेशी काटन मिल्स कानपुर ( ii ) मैसर्स स्वदेशी काटन मिल्स पाडिचेरी ( iii ) मैसर्स स्वदेशी काटन मिल्स नैनी ( iv ) मैसर्स स्वदेशी काटन मिल्स मउनाथ भेजन (v) मैसर्स उदयपुर काटन मिल्स उदयपुर और ( vi ) मैसर्स रायबरेली टैक्सटाईल मिल्स रायबरेली का ( जिन्हें इसमें इसके पश्चात उक्त उपक्रम कहा गया है ) प्रबंध उद्योग ( विकास और विनियम )अधिनियम 1951 ( 1951 का 65) की धारा 18 कक की उपधारा ( i ) के खंड (क) के अधीन 13 अप्रैल 1978 से पांच वर्ष की अवधि

के लिए ग्रहण किया गया था और राष्ट्रीय बस्न निगम लिमिटेड को उक्त संपूर्ण औद्योगिक उपक्रमों का प्रबंध ग्रहण करने के लिए प्राधिकृत किया गया था;
और भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग ) के आदेश सं ० का ० आ० 283 (अ) 18कक आई० टी० आर ० ए ०/ 83, तारीख 11 अप्रैल 1983 द्वारा उक्स आदेश की अवधि , 31 जुलाई , 1983 तक जिसमें यह तारीख भी सम्मिलित है बढ़ा दी गई थी;
और भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग ) के आदेश सं० का ० आ० 525 (अ) 18/ कक/आई ० डी० आर० ए०/ 83 , तारीख, 27 जुलाई 1983 द्वारा उक्त आदेश की अवधि 31 जनवरी , 1984 तक, जिसमें यह तारीख भी सम्मिलित है बढ़ा दी गई थी;
और भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास विभाग ) के आदेश सं० का ० आ० 41 ( अ) / 18कक आई ० डी० आर० ए०/ 84, तारीख 30 जनवरी 1984 द्वारा उक्त आदेश की अवधि 30 अप्रैल 1984 तक, जिसमें यह तारीख भी सम्मिलित है बढ़ा दी गई थी;

और केन्द्रीय सरकार की यह राय है कि लोकहित में यह समीचीन है कि उक्त आदेश 31 जुलाई 1984 तक की जिसमें यह तारीख भी सम्मिलित है और अवधि के लिए प्रभावी बना रहे ;
अतः अब केन्द्रीय सरकार उद्योग ( विकास और बिनियमन) अधिनियम 1951 (1951 का 65) की धारा 18 कक की उपधारी ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह निदेश देती है कि उक्त आदेश 31 जुलाई, 1984 तक की जिसमें यह तारीख भी सम्मिलित है और अवधि के लिए प्रभावी बना रहेगा ।

ORDER
New Delhi , the 30th April, 1984
S.O. 334( E) 18AA IDRA 84. Whereas by the Order of Government of India in the Ministry of Industry (Depart- ment of Indusrial Development ) No. S.O. 265 (E) 18AA IDRA 78 , dated the 13th April , 1978 (hereinafter referred to as the said Order ) , the management of the whole of the industrial undertakings , namely ( i ) Messrs Swadeshi Cotton Mills , Kanpur , ( ii ) Messrs Swadeshi Cotton Fills , Pondich- erry, ( iii ) Messrs Swadeshi Cotton Mills , Naini , ( iv ) Messrs Swadeshi Cotton Mills , Maunath Bhanjan, (v) Messrs Udai- purCotton Mills , Udaipur and ( vi ) Messrs Rae Bareli Textile Mills, Rae Bareli of Messrs Swadeshi Cotton Mills Company Limited, Kanpur (hereinafter referred to as the said under- takings) were taken over under clause (a) of sub- section ( 1) of section 18AA of the Industrial (Development and Regu- lation) , Act , 1951 ( 65 of 1951 ) , for a period of five years from the 13th April, 1978 and the National Textile Corpo- ration Limited was authorised to take over the management of the whole of the said industrial undertakings :
And, whereas , by the Order of the Government of India in the Ministry of Industry (Department of Industrial Deve- lopment No. S.O. 283 (E ) / 18AA/ IDRA/ 83 , dated the 11th IDRA 83 , dated the 11th April, 1983 the period of the said Order was extended upto and inclusive of the 31st July, 1983;
And, whereas , by the Order of the Government of India in the Ministry of Industry ( Department of Industrial Deve- lopment) No. S.O. 525 (E) 18AA IIDRA 83 , dated the 27th July, 1983 the period of the said Order was extended upto and inclusive of the 31st January , 1984.
And, whereas , by the Order of the Government of India In the Ministry of Industry ( Department of Industrial Deve- lopment ) No. Σ.Ο. 41 ( E) 18ΑΑ IDRA 84, dated the 30th January , 1984 , the period of the sald Order was upto and inclusive of the 30th April , 1984; extended
And, whereas, the Central Government is of opinion that It is expedient in the public Interest that the said Order should continue to have effect for a further period upto and inclusive of the 31st July, 1984
Now, therefore , in exercise of the powers conferred by sub- section (2) .of section 18AA of the Industries (Development and Regulation) Act, 1951 ( 65 of 1951) , the Central Govern- ment hereby directs that the said Order shall continue to have

effect for a further period upto and inclusive of the 31st July, 1984.

का० आ ० 335 ( अ)/ 18 चख/ आई ० डी० आर० ए०/ 84:- केन्द्रीय सरकार ने भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास विभाग) के आदेश सं ० का ० आ० 277 (अ)/ 78 चख / आई० डी० आर० ए ०/ 78 तारीख 28 अप्रैल 1978 द्वारा ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) उद्योग विकास और विनियमन अधि- नियम 1951 ( 1951 का 65 ) की धारा 18 चख की -उपधारा ( i ) के खंड (ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा की थी कि उक्त आदेश के जारी किए जाने . की तारीख से ठीक पूर्व प्रवृत्त सभी संविदाओं संपत्ति. के हस्तान्तरण पत्नों, करारों, परिनिर्धारणों, पंचाटों, स्थायी आदेशों या अन्य लिखितों से प्रोदभूत या उदभूत होने वाली सभी वाचताओं और दायित्वों का उनसे भिन्न जो बैंकों और वित्तीय संस्थाओं के प्रतिभूत दायित्वों से संबंधित है जिनका मैसर्स स्वदेशी काटन मिल्स कम्पनी लिमिटेड कानपुर के ( i ) मैसर्स स्वदेशी काटन मिल्स कानपुर ( ii ) मैसर्स स्वदेशी काटन मिल्स पाडिचेरी ( iii ) मैसर्स स्वदेशी काटन मिल्स नैनी ( iv ) मैसर्स स्वदेशी काटन मिल्स मऊनाथ भंजन (v) मैसर्स उदयपुर काटन मिल्स उदयपुर और ( vi ) मैसर्स रायबरेली टैक्सटाईल मिल्स रायबरेली नामक औद्योगिक उपक्रम एक पक्षकार है या जो ऐसे औद्योगिक उपक्रमों को लागू हैं , प्रवर्तन ऐसी तारीख से एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख से पूर्व उसके अधीन प्रोदभूत या उदभूत होने वाली सभी बाध्यताएं और दायित्व उक्त अवधि के लिए निलम्बित रहेंगे ;
और भारत सरकार ने अपनी यह राय होने पर कि जनसाधारण के हित में यह आवश्यक है कि उक्त आदेश पूर्वोक्त एक वर्ष की अवधि की समाप्ति के पश्चात प्रभावी. बना रहे 30 अप्रैल 1984 तक की उसमें यह तारीख भी सम्मिलित है और अवधि के लिए ऐसे बने रहने की समय-समय पर घोषणा की थी देखिए भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास विभाग ) के आदेश सं ० का ० आ० 209( अ)/18 चख / आई० डी० आर ० ए०/79 तारीख 16 अप्रैल 1979 का ० आ० 262 ( अ)/ 18 नख / आई ० डी० आर० ए ०/ ४० तारीख 17 अप्रैल 1980 का० आ० 305 (अ)/ 18 चख आई ० डी० आर० ए०/ 81 तारीख 20 अप्रैल 1981 का ० ० 272 ( अ) / 18 चख आई० डी० आर ० ए०/ 82 तारीख 20 अप्रैल 1982 का आ० 284 (अ) / 18 चख / आई ० डी० आर ० ए० / 83 तारीख 11 अप्रैल. 1983 फा ० आ० 506 ( अ )/ 18 चख/ आई ० डी० आर ० ए ०/ 83 तारीख 27 जुलाई 1983 और का ० आ० 42 ( अ)./18 चख आई० डी० आर ० ए०/ 84 तारीख 30 जनवरी 1984
और केन्द्रीय सरकार का यह समाधान हो गया है कि उक्त आदेश की अवधि 31 जुलाई 1984 तक की जिसमें 3

यह तारीख भी सम्मिलित . है और अवधि के लिए बड़ा वी जाए;
अतः अब केन्द्रीय सरकार उद्योग विकास और विनियमन अधिनियम 1951 ( 1951 का 65) की घारा 18 चख की उपधारा ( 2 ) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त आदेश की अवधि 31 जुलाई 1984 तक की जिसमें यह तारीख भी सम्मिलित है और अवधि के लिए बढ़ाती है ।

ORDER
S.O. 335/ 18FB IDRA 84.-Whereas by the Order of the Government of India in the Ministry of Industry (Depart- ment of Industrial Development ) No. S.O. 277 (E) / 18FB ID- RA 78 , dated the 20th April , 1978 (hereinafter referred to as the said Order ) , the Central Government in exercise of the powers conferred by clause (b ) of sub- section ( 1 ) of section 18FB of the Industries (Development and Regulation ) Act , 1951 (65 of 1951) , declared that the operation of all obliga- tions and liabilities accruing or arising out of all contracts , assurances of property, agreements , settlements , awards , standing orders or other instruments in force , immediately before the date of issue of the said Order (other than those relating to secured liabilities to banks and financial instituti- ons) to which the industrial undertakings known as : ( i ) Messrs Swadeshi Cotton Mills , Kanpur 5 ( il ) Messrs Swadeshi Cotton Mills, Pondicherry , ( iii ) Messrs Swadeshi Cotton Mills , Naini , ( iv) Messrs Swadeshi Cotton Mills , Maunath Bhanjan, (v) Messrs Udaipur Cotton Mills , Uaipur and (vi ) Mesars Rae Bareli Textile Mills , Rae Bareli, of Messrs Swadeshi Cotton Mills Company Limited, Kanpur, are parties or which may be applicable to such industrial undertakings shall re- main suspended for a period of one year from such date and that all the obligations and liabilities accruing or arising there- under before the said date shall remain suspended for the said period;
And, whereas, the Central Government being of opinion that it is necessary in the interest of the general public that the said Order should continue to have effect after the expiry of the period of one year aforesaid had declared from time to time, for such continuance for a further period upto and inclusive of the 30th April, 1984 , vide Orders of the Govern- ment of India in the Ministry of Industry (Department of Industrial Development ) Nos . S.O. 209 ( E) [ 18FB IDRA 79 , dated the 16th April , 1979 , S.O. 262 ( E) 18FB IDRA 80 , dated the 17th April, 1980 , S.O. 305 ( E ) | 18FB IDRA/ 81 , dated the 20th April , 1981 , S.O. 272 ( E ) 18FB IDRA / 82 , dated the 20th April , 1982 , S.O. 284 (E) 18FB IDRA/ 83 , dated the 11th April, 1983 S.O , 526 (E) / 18FB / IDRA / 83 , dated the 27th July, 1983; and S.O. 42 (E ) / 18FB / IDRA/84 dated the 30th January, 1984;
And, whereas , the Central Government is satisfied that the duration of the said Order should be extended for a further period upto and inclusive of the 31st July, 1984 ;
Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) read with sub- section (2 ) , of section 18FB of the Industries (Development and Regulation ) Act, 1951 (65 of 1951) , the Central Government hereby extends the duration of the said Order for a further period upto and inclusive of the 31st July, 1984 .
