का० आ० 386 ( अ) / 18 क/ आई की आर ए/ 84.- भारत सरकार के उद्योग मंशालय (औद्योगिक विकास विभाग ) के आदेश सं ० का० आ० 325 (अ) तारीख 18 मई, 1978 द्वारा ( जिसे इसमें इसके पश्चात उक्त आवेश कहा गया है ) बंगाल इम्यूनिटी कम्पनी लिमिटेड कलकत्ता नामक औद्योगिक उपक्रम का प्रबन्ध, उद्योग विकाम और विनियमन ( अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 क के अधीन उक्त आदेश में प्रबन्ध बोर्ड के रूप में निविष्ट व्यक्ति निकाय द्वारा 17 मई, 1980 तक की जिसमें यह तारीख भी सम्मिलित है, वो वर्ष की अवधि के लिए ग्रहण किया गया था;
और भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास विभाग ) के भावेश सं० का० भ० 324 (अ ) तारीख 17 सई, 1990 ; फा० आ० 327 (अ) , तारीख 17 मई, 1982; सं ० का० आ० 812 (अ) , तारीख 17 नवम्बर, 1982, सं ० फा० आ० 360 ( अ) तारीख 17 मई, 1983 और सं० का० आ० 818 ( अ) तारीखा 17 नवम्बर, 1983 द्वारा उक्त आदेश की अवधि को 17 मई, 1984 तक की, जिसमें यह तारीख भी सम्मिलित है, और अवधि के लिए समय-समय पर बढ़ाया गया था;
और , केन्द्रीय सरकार की यह राय है कि लोकाहेन में यह समीचीन है कि जगत औद्योगिक उपक्रम का प्रबन्ध, उक्त प्रबन्ध- बोर्ड के अधीन छह मास की और अबधि के लिए बना रहे;
अतः , अब केन्द्रीय सरकार, उद्योग ( विकास और विनियमन) अधि- नियम, 1951 ( 1951 का 65 ) की धारा 18क की उपधारा ( 2) द्वारा प्रदत शक्तियों का प्रयोग करते हुए , यह निदेश देती है कि उक्त आदेश 17 नवम्बर , 1984 तक की, जिसमें यह तारीख भी सम्मिलित है, और अवधि के लिए प्रभावी बना रहेगा ।

S.O. 386 ( E ) 18A/ IDRA 84-Whereas by the Order of the Government of India in the Ministry of Industry ( Department of Industrial Development ) No. S.O. 325 ( E) , dated the 18th May, 1978 (hereinafter referred to as the said Order) , the management of the industrial undertaking known as the Bengal Immunity Company Limited, Calcutta , was taken over by a body of persons referred to in the said Order as the Board of Management under section 18A of the Indus- tries (Development and Regulation) Act , 1951 ( 65 of 1951 ) . for a period of two years upto and inclusive of the 17th May, 1980 .
And, whereas , by the Orders of the Government of India in the Ministry of Industry (Department of Industrial Deve- lopment ) Nos . S.O. 324 (E ) dated 17th May, 1980, S.O. 327 ( E) , dated 17th May, 1982, S.O. 312 (E ) , dated 17th November, 1982, S.O. 360 (E) , dated 17th May, 1983 and

8.O. 818 (E) , dated 17th November, 1983 , the duration of the said Order was extanded from time to time for a fur- ther period upto and inclusive of 17th May, 1984 ;
And, whereas , the Central Government is of the opinion that it is expedient in the public interest that the manage- ment of the said industrial undertaking by the said Board of Management should continue for a further period of six months;
Now, therefore, in exercise of the powers conferred by the proviso to sub- section ( 2 ) of section 18A of the Industries (Development and Regulation ) Act, 1951 (65 of 1951) , the Central Government herreby directs that the said Order shall continue to have effect for a further period upto and inclusive of the 17th November, 1984.

क ० भा० 387 ( अ) / 18 च-ज/आई. डी. आर ए/ 83. केळीय सरकार में भारत सरकार के उद्योग मन्त्रालय ( औद्योगिक विकास विभाग ) के मादेश सं ० का० मा० 354( अ) , तारीख 25 मई , 1978 द्वारा ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) ( उद्योग विकास और विनियमन) अधिनियम, 1951 (1951 का 65) की धारा 18 - चख की उपधारा ( 1) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए. घोषणा की थी कि 25 मई, 1978 से ठीक पहले प्रवृत्त ऐसी सभी संविदाओं सम्पत्ति के हस्तान्तरण पत्रों, करारों, परिनिर्धारणों, पंचाटों, स्थायी आदेशों या अन्य लिखतों का, जिनका बंगाल इम्यूनिटी कम्पनी लिमिटेड, कलकत्ता नामक औद्योगिक उपक्रम या ऐसे उपक्रम का स्वामित्व रखने वाली कम्पनी पक्ष- कार है या जो उक्त औद्योगिक उपक्रम या कम्पनी को लागू है, प्रवर्तन 18 मई, 1979 तक निलंबित रहेगा और उक्त तारीख से पहले उसके अधीन प्रोद्भूत या उद्भूत सभी अधिकार, विशेषाधिकार, बाध्यताएं और वामित्व उक्त अवधि के लिए निलम्बित रहेंगे;
और , भारत सरकार के उद्योग मंत्रालय ( औद्योगिक विकास विभाग) कै आवेश से ० का ० आ० 166 (अ) तारीख 29 मार्च , 1979, सं० का० आ० 325 ( अ) तारीख 17 मई, 1980, सं ० का० था० 371 (अ) तारीख 16 मई, 1981; सं ० का० आ० 328(अ) तारीख 17 मई, 1982; सं ० का ० आ० 813 ( म) तारीख 17 नवम्बर , 1982 सं ० का० आ० 361 ( अ ) , तारीख 17 मई, 1983 और सं० का० आ० 819 (अ) तारीख 17 नवम्बर, 1983 द्वारा उक्त आवेश की अवधि को 17 मई, 1984 तक की जिसमें यह तारीख भी सम्मिलित है, और अवधि के लिए समय -समय पर बढ़ाया गया था;
और केन्द्रीय सरकार का यह समाधान हो गय है कि उक्त आदेश की अवधि को छह मास की और अवधि के लिए बढ़ा दिया जाए;
अतः अब, केन्द्रीय सरकार, उद्योग ( विकास और बिनियमन) अधि- मियम, 1951 ( 1951 का 65) की धारा 18-षब की उपधारा ( 2) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त आदेश की अवधि को, 17 नवम्बर , 1984 तक की, जिसमें यह वारीच भी सम्मिलित है, और भवधि के लिए बढ़ाती है ।

SO . 387 (E) /18 - EB/DRR/84.---Whereas by the Order of the Government of India in the Ministry of Industry (Department of Industrial Development ) No. S.O. 354 (Ε) , dated the 25th May, 1978 (hereinafter referred to as the said Order) the Central Government , in exercise of the powers conferred by sub -section ( I ) of section 18FB of the Industries ( Development and Regulation) Act, 1951 ( 65 of 1951) , declared that the operaion of all contracts , assurances of property, agreements, settlements , awards , standing orders or other instruments in force immediately before the 25th May, 1978 to which the industrial undertaking known as

the Bengal Immunity Company Limited , Calcutta or the company owing such undertaking is a party or which may be applicable to the said industrial undertaking or company shall remain suspended upto the 18th May , 1979 and that all rights, privileges , obligations and liablities accruing or arising thereunder before the said date shall remain suspended for the said period;
And, whereas, by the Order of the Government of fidia in the Ministry of Industry (Department of Industrial Deve- lopment) Nos . S.O. 166 (E) , dated 29th March, 1979 S. O. 325 (E) , dated 17th May , 1980 , S.O. 371 ( E) , dated 16th May, 1981 , S.O. 328 ( E) , dated 17th May, 1982 . S.O. 813 (E) , dated 17th November, 1982 , S.O. 361 (E) , dated 17th May, 1983 and S.O. 819 (E) , dated 17th Novem- ber, 1983, the duration of the said Order was extended from time to time for a further period upto and inclusive of the 17th May, 1984;
And, whereas, the Central Government is satisfied that the duration of the said Order should be extended for a further period of six months .
Now, therefore, in exercise of the powers conferred by sub- section (1 ) read with sub- section ( 2 ) of section 18FB of the Industries (Development and Regulation ) Act, 1951 (65 of 1951 ) , the Central Government hereby exterids the duration of the said Orders for a further period upto and inclusive of the 17th November, 1984 .

फा० भ० 388 ( अ) केन्द्रीय सरकार, उद्योग ( विक'स और विनियमन ) अधिनियम, 1951 ( 1951 का 65) की धारा 18 क द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए भारत सरकार के उद्योग मंजालम (मौद्योगिक विकास विभाग) के आदेश सं० का० आ० 325 (अ) तारीख 18 मई, 1978 का निम्मलिखित और संशोधन करती है , अर्थात्:--
उक्त आदेश में , क्रम सं ० 4 और उससे संबंधित प्रविष्टि के स्थान पर निम्नलिखित क्रम संख्या और प्रविष्टि रखी जाएगी , अर्थात्:-
" 4. विंग कमांडर, डी. पी. कपूर, सेवा नियंत्रक, रसायन और उर्वरक मंत्रालय, नई दिल्ली ।"

In exercise of the powers conferred by section 184 of the Industries ( Development and Regulation ) Act, 1951 (65 of 1951) , the Central Government bereby makes the following further amendment to the Order of the Government of India in the Ministry of Industry (Depart- ment of Industrial Development ) No. S.O. 325 (E ) , dated the 18th May , 1979 namely :-- 3
