ORDER
New Delhi, the 19th May, 1984
S.O.393(E)|18AA|IDRA|84.—Whereas by the Order of the Government of India in the Ministry of Industry (Department of Industrial Develop- ment) No. S.O. 874(E)|18AA|IDRA|8O, dated the 3rd November, 1980 (hereinafter referred to as the said Order), the management of the industrial undertaking known as Messrs Motipur Sugar Factory Limited, Motipur, District Muzaffarpur n the State of Bihar (hereinafter referred to as the said industrial undertaking), was taken over inder clause (a) of sub-section (i) of section 18AA of the Industries (Development and Re- ulation) Act, 1951 (65 of 1951), for a period of two years upto and inclusive of 2nd November, 1982 and the Bihar State Sugar Corporation limited, Patna was authorised to take over the nanagement of the said industrial undertaking;
And, whereas, the Central Government by an Mrder of the Government of India in the Ministry ii. Industry (Department of Industrial Develop- nent No. 769(E)|18AA|IDRA|82 dated the 30th Dctober, 1982, extended the period by one year upto and inclusive of the 2nd November, 1983;
And whereas the High Court at Calcutta had, ide its order dated the 29th September, 1983, lirected that the Central Government shall not nake any further extension of the take over the management of the said industrial undertaking beyond the 2nd November, 1983, (the date on which the notification extending the period of take over the management of the said industrial under- taking was due to expire), and had further directed that the said industrial undertaking shall continue to be under the management of the Bihar State Sugar Corporation Limited, til] the disposal of the writ petition;
And whereas the said High Court has, vide its order dated the 23rd April, 1984, directed the Central Government to extend, after giving the company and its directors a reasonable opport- unity of showing cause against the proposed order, the period of take over the management of the said industrial undertaking under section 18AA of the Industries (Development and Regulation) Act, 1951 (65 of 1951J, within four weeks from the 23rd April, 1984;
And whereas as directed by the said High Court a notice has been given to the company and its directors intimating the Government's intention to extend the period of take over and giving tho company and its directors an opportunity to show cause as to why an order of extension of the period of take over of the said industrial under- taking should not be made;
And whereas the cause shown by the company
has been considered by the Central Government;
And, whereas, the Central Government is of the opinion that it is expedient in the public inte- rest that the said industrial undertaking should continue under the management of the Bihar State Sugar Corporation Limited, Patna for a fur- ther penod upto and inclusive of the 31st October,
Now, therefore, in exercise of the powers con- ferred by sub-section (2) of section 18AA of the said Act, the Central Government hereby directs that the said order shall continue to have effect for a further period upto and inclusive of 31st Octo- ber, 1984.
