सा०का ००८० 415 ( अ): औषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए नियमों का निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार, औषधि तकनीकी सलाहकार बोर्ड से पटामर्श करने के पश्चात , औषधि और प्रसाधन सामग्री अधिभियम, 1940 ( 1940 का 23 ) की धार। 12 और 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बनान। चाहती है, उक्त धारा को अपेक्षानुसार ऐसे सभी व्यक्तियों का जानकारी के लिए प्रकाशित किया जाता है , जिनके उससे प्रभावित होने की संभावना है । इसके द्वारा यह सूचना है। जाती है कि उक्त प्रारूप पर, उस राजपत्त की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध कराए जाने की तारीख से नब्बे दिनों को अवधि को समाप्ति के पश्चात विचार किया जायगा ।

ऐसे आक्षेपों या सुझावों पर जो पूर्वोक्त अवधि को समाप्ति से पहले उक्त प्रारूप की बाबत किमी व्यक्ति से प्राप्त होंगे , केन्द्रीय सरकार विजार करेति ।

प्रारूप नियम

1. इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री (सशोधन ) नियम , 1984 है ।

2. औषधि और प्रसाधन सामग्री नियम, 1945 में.--

(क) भाग 5 के शीर्षक के स्थान पर निम्नमिता जायभा अर्थात्

"सरकारी विश्लेषक, निराशरु, अनुज्ञापन प्राधिकारी मौर नियंत्रक प्राधिकारी"

(ख) नियम 49 के पश्चात निम्तलिखित अंतःस्थापित किया जायना, अर्थात्:--

"49फ अनुज्ञापन प्राधिकारी को अईहराएँ:

अधिनियम के अधान राज्य सरकार द्वारा नियुक्त तुज्ञापन प्राधिकारी ऐसा व्यक्ति होगा जो विधि द्वारा भारत में, स्थापित किसो विश्वत्रिश्यालय से भेत्रज विज्ञान में या ओषधि निर्माण रमायन में स्नातक है और जिसके पास औषधि के विनिर्माग या जाँच करने में या अधिनियम के उपबंधों का प्रभुत करन में पांव वर्ष का अनुभव है:

परन्तु यह कि शैक्षिक अर्हता का बाबत अपेक्षा, अधिनियम के अधीन नियुक्त ऐसे निरोक्षकों को लागू नहीं होगी जो औषधि और प्रसाधन सामग्री (संशोधन) नियम, 1984 की प्रारम्भ को तारीख को इस भव पर " ;

(ग) नियम 50 के उपनियम ( 3 ) के पश्चात निम्नलिखित अंतः स्थापित किया जायगा , अर्थात्: -

" ( 4 ) नियंत्रण प्राधिकारों को अर्हताएं :

अधिभियम के अधीन राज्य सरकार द्वारा निरुक्त नियंत्रण जाहिरा ऐसा व्यक्ति होगा जो विधि द्वार। भारत में स्थान से नेषज विज्ञान या औषधि निर्माण रमावन में स्नातक है और जिसके क्र्स औषधि के विनिर्माण या जांच करने में या अधिनियम के उपबंधा को प्रवृत्त करने में पांच वर्ष का अनुभव है

परन्तु यह कि प्रशैक्षिक अर्हता का बाबन ओआ, अधिनियम के अधान नियुक्त ऐसे निरीक्षका का लागू नही गया जो ओषधि जो नाधन सामग्री ( संशोधन ) नियम, 1994 को प्रारभ को नागेन्द्र का रुन पत्र पर ";

टिप्पण:1-5-1979 तक यया गोत्रिन चौवधि पोर भान नामग्री नियम, 1945 , स्वास्थ्य और परिवार ०१ विभाग ) के पन प्रकाशन अंनविनने औवि और प्रसाधन सामग्री अधिनियम और नियम (पो ००जी ०ए ० एन०- 61) है । तत्पश्चात उक्त निगना कसाना , खड 3 ( i ) में प्रकाशित निम्नलिखित वितुबनानों द्वारा मगोधन किया गया है:-

MINISTRY OF HEALTH AND FAMILY WELFARE NOTIFICATION

New Delhi , the 29th May , 1984

G.S.R. 415 (E) :-The following draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945, which the Central Government proposes to make, after consultation with the Drugs Technical Advisory Board, in exercise of the powers conferred by sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940 ) , is hereby published as re- quired by the said sections for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules will be taken . into consideration after the expiry of a period of ninety days from the date on which the copies of the Official Gazette in which this notification is pub- lished are made available to the public.

Any objections or suggestions which may be re- cerved from any person with respect to the said draft rules before the expiry of the aforesaid period will be taken into consideration by the Central Govern- ment

DRAFT RULES

1. These rules may be called the Drugs and Cos- metics (Amendment ) Rules, 1984 .

2. In the Drugs and Cosmetics Rules , 1945 ,-

(a) in part V, for the heading , the following shall be substituted , namely: --

" Government Analysts , Inspectors , I icensing Inspectors , Authorities and Controlling Authori- ties";

(b) after rule 49 , the following rule shall be inserted namely: --

"49 -A Qualifications of a licensing authori- ty.

A licensing authority appointed by a State Gov- ernment under the Act shall be a person who is a graduate in Pharmacy or Pharmaceutical Chemistr / from the University established in India by law and has at least five years' experience in the manufac- ture or testing of drugs or enforcement of the pro- visions of the Act:

Provided that the requirement as to the academic qualification shall not apply to Inspectors appointed under this Act and who are in position on the date of commencement of the Drugs and Cosmetics (Amendment ) Rules , 1984" ;

"(4) The controlling authority appointed by a State Government shall be a person who is a gra- duate in Pharmacy ог Pharmaceutical Chemistry from an University established in India by law and has at least five years' experience in the manufac- ture or testing of Drugs or inforcement of the provisions of the Act :

NOTE: The Drugs and Cosmetics Rules , 1945 , as amended upto 1-5-1979, is contained in the publication of the Ministry of Health and Family Welfare ( Department of Health) containing the Drugs and Cosme- tics Acts and the Rules (PDGHS - 61 ) . Subsequently the said rules have been amended by the following notifications 3
