सा० का० नि० 419 (श्र ): भारत सरकार और सोवियत समाजवादी गणराज्य संघ ने, स्थोरा के वाहन से व्युत्पन्न आय कर करों की बाबत दोहरे कराधात से बचने के लिए, उक्त सरकारों द्वारा किए गए करार के उपांतरण के लिए , पत्त्र व्यवहार के माध्यम से एक करार किया है, जो इसके उपायंध में उपणित है ,
अतः, अब, केन्द्रीय सरकार, आयकर अधिनियम , 1961 ( 1961 का 43 ) की धारा 90 और कंपनी ( लाभ ) मतिकर अधिनियम, 1964 (1964 का 7) की धारा 24 क द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए , यह निवेश देते है कि उक्त करार के उपबंध भारत संघ में प्रभावी किए जाएंगे ।

व्यापारिक जहाजरानी से संबंधित करार को संशोधित करने के लिए भारत सरकार तथा सोवियत समाजवादी गणतंत्र संघ के बीच करार ।

भारत गणराज्य की सरकार तथा सोवियत समाजयादी गणतंत्र संघ की मरकार के प्रतिनिधि-मंडलों की नई दिल्ली में 4-6 , अप्रैल , 1983 को बैठकें हुई जिनमें उन दो नौका-धाहकों "टाइवर जेम्यूली " तथा "यूलियम फ्यूचिक" के संचालन के बारे में विस्तार से बातचीत की गई थी जिनका मालिक सोवियत संघ है परन्तु इम्टरलाइटर इन्टरनेशनल शिपिंग कपनी, जिसका प्रधान कार्यालय बुडापेस्ट में है , तथा जो सोवियत संघ , चेकोस्लो- बाकिया, बल्गारिया और हंगरी की सरकारों की एक संयुक्त उद्यम कंपनी है, को एक निश्चित समय के लिये किराये पर विये गये है । ये पोत सोवियत संघ का भंडा फहराएंगे । स्वामित्व वाले देशो के बीष अंतर- सरकारी करार के अंतर्गत, इटरलाइटर इन्टरनेशनल शिपिंग कंपनी केवल सोवियत जलयानों का ही प्रयोग कर सकती है ।
मामले की विशेष परिस्थितियों को देखते हुए तथा उद्योग और वाणिज्य में , जिसमें जहाजरानी भी शामिल है , बढ़ते हुए भारत -सोवियत सहयोग को ध्यान में रखते हुए दोनों प्रतिनिधि मंडल इस बात पर सहमत हुए थे कि सोवियत संघ के स्वामित्व वाले ऊपर उल्लिखित नीका-वाहन का संचालन , तथा सोवियत झंडा फहराना, 1976 के भारत-सोवियत जहाजरारी करार के अंतर्गत आता है । इन बातों पर भी सहमति हुई थीकिः-
( 1) इन्टस्लाइटर द्वारा भारत से तथा भारत को ले जाये जाने वाले माल पर, मूल के देश तथा गन्तव्य स्थान के देशों के बीच विद्यमान द्विपक्षीय जहाजरानी करारों , जहां कहीं ऐसे फरार भारत भौर इन्टरलाइटर के संयुक्त माविकों के बीच [PART I- SEC . 3 ( i ) ]

विद्यमान हों, की शर्ते लागू होंगी तथा , इस प्रकार के करारों के नहीं होने की स्थिति में , माल पर कोई विशेष रियायतें नहीं दी जाएगी
( 2) ( क ) संवितरणों और पत्तन प्रभारों का भुगतान उम सीमा तक भारतीय रुपयों में किया जाएगा जिस सीमा तक यह पोत, रुक्मों में भुगतान करने वाले देशों से तथा देशों की माल ले जा रहा ही;
(ख) रुपयों में भुगतान नही करने वाले देशों से तथा वेशों को ले जाये जाने वाले माल के लिए संवितरणों और पत्तन प्रभारों का भुगतान भुक्त विदेशी मुद्रा में किया जाएगा ।
परिस्थितियों के बदल जाने पर , वोनों पक्ष पारस्परिक सहमति से इस करार की समीक्षा कर सकते है ।
कृपया इस बात की पुष्टि करें कि इस संबंध में हमारे बीच जं। कगर हुभा है यह उपर्युक्त में यथोचित रूप से निर्दिष्ट किया गया है ।

मुझे 12 अप्रैल, 1983 का आपका पक्ष मिला जो इस प्रकार है: "भारत गणराज्य की सरकार तथा सोवियत समाजवादी गणतंत्र संघ की सरकार के प्रतिनिधि मंडलों की नई दिल्ली में 4-6 अप्रैल , 1983 को बैठक हुए जिनमें उन वो मौका- वाहकों "टाइवर जेम्यूली" तथा "यूलियम फ्यूचिक " के संचालन के बारे में विस्तार से बातचीत की गई थी जिनका मालिक सोवियत संघ है परन्तु इण्टरलाइटर इन्टरनेशनल शिपिंग कंपनी, जिसका प्रधाम कार्यालय बुडापेस्ट में है , तथा जो सोवियत सध, चेकोस्लोवाकिया, बल्गारिया भौर हंगरी की सरकारों की एक सयुक्त उद्यम कंपनी है , को एक निश्चित समय के लिये किराये पर विये गये हैं । ये पोत सोवियत संघ का झंडा फहराएंगे । स्वामित्व वाले देशो के बीच अतर-सरकारी करार के अंतर्गत , इन्टरलाइटर इन्टरनेशनल शिपिंग कंपनी केवल सोवियन जलयानो का ही प्रयोग कर सकती है ।
मामले की विशेष परिस्थितियों को देते हुए तथा उधोग और वाणिज्य में, जिसमें जहाजरानी भी शामिल है, बढ़ते हुए भारत-सोवियत सहयोग को ध्यान में रखते हुए , दोनों प्रतिनिधि मंडल इस बात पर सहसत हुए थे कि सोवियत संघ के स्वामित्व वाले ऊपर उल्लिखित नौका -वाहकों का संचालन, तथा सोवियत झंडा फहराना , 1976 के भारत-सोवियत जहाजरानी करार के अंतर्गत माता है । इन बातों पर भी आगे सहमति हुई थी कि:
( 1 ) इन्टरलाइटर द्वारा भारत से तथा भारत को ले जाये जाने वाले माल पर, मूल के वेश तथा गन्तव्य स्थान के देशों के बीच विद्यमान द्विपक्षीय- जहाजरानी करारों , जहां कहीं ऐसे करार भारत भौर हन्टरलाइटर के मयुक्त मालिलों के बीच विद्यमान हों, की शर्तें लागू होंगी तथा, इस प्रकार के करारों के नहीं होने की स्थिति में , माल पर कोई विशेष रयायत नहीं की जाएंगी
(2) (क ) संषितरणो भौर पत्त प्रभारों का भुगतान उस सीमा तक भारतीय रुपयों में किया जाएगा जिस सीमा तक वह पोत, रुपयों में भुगतान करने वाले देशों से तथा वेशों देशों को माल ले जा रहा हो;
(ख) रुपयों में भुगतान नहीं करने वाले देशों से तथा देशों को ले जाये जाने वाले माल के लिए संवितरणों भौर पत्तन प्रभारों का भुगतान मुक्त विदेशी मुद्रा में किया जाएगा ।।
मरिस्थितियों के बदल जाने पर , बोनों पक्ष पारस्परिक सहमति से इस करार की समीक्षा कर सकते हैं ।
कृपया इस बात की पुष्टि करें कि इस संबंध में हमारे बीच नो करार हुआा है वह उपर्युक्त में यथोचित रूप से निविष्ट किया गथा है ।

मुझे वो रूसी "नौका वाहको" "टाइबर जेम्यूली" तथा " यूलियस क्यूजिक" के संचालन के संबंध में हुई आपसी भर्चा का तथा भारतीय और सोवियत प्रतिनिधि मंडलों के बीच आज भयर्थात् 12 अप्रैल , 1983 को हुए पत्र के आदान- प्रदान का हवाला देने का गौरव प्राप्त हुपा है । दो प्रतिनिधि मंडलों के मध्य इस बात पर भी सहमति हो गई है कि ऊपर उल्लिखित जलयान केवल बम्बई पत्तन पर ही भायेंने तथा एक कैलेंडर वर्ष में 14 बार तक आ सकेंगे । इसके अतिरिक्स , यदि परि स्थितियां बदल जायें तो दोनों पक्ष पारस्परिक सहमति से इस व्यवस्था की समीक्षा कर सकते हैं ।
कृपया इस बात की पुष्टि करें कि इस संबंध में हमारे बीच जो समझौता हुआा है उसे उपर्युक्त में यथोचित रूप से निर्दिष्ट किया गया है ।

मुझे आपका 12 अप्रैल , 1983 का पत्तत्र प्राप्त हुश्रा जो इस प्रकार है--"मुझे दो म्प्सी "नौका-जाका" "टाइवर जेम्यूली" तथा " यूलियस फ्यूचिक" के संचालन के संबंध में हुई झापमी चर्चा का तथा भारतीय और सोवियत प्रतिनिधि मंडलो के बीच आज अर्थात 12 अप्रैल, 1983 को हुए पत्त्र के आवान-प्रदान का हवाला देने का गौरव प्राप्त हुआ है । वा प्रतिनिधि मंडलों के मध्य इस बात पर भी सहमति हो गई है कि ऊपर उल्लिखित जलयान केवल बंबई पत्तन पर ही भागे तथा एक फैलेण्डर बर्ष में 14 बार तक आ सकेंगे । इसके अतिरिक्त , यदि परिस्थितियो बदल जाये तो दोनो पक्ष पारम्परिक सहमति से इस व्यवस्था की समीक्षा कर सकते हैं । कृपया इस बात की पुष्टि करें कि इस संबंध में हमारे बीच जो समझौता हुआा है उसे उपर्युक्त में यथोचित रूप से निर्दिष्ट किया गया है ।

"The delegation of the Government of the Union Republic of India and the Government of the Union of Soviet Socialist Republics met at New Delhi on April 4-6-1983 and had detailed discussions about the operation of two lighter- carriers "Tibor Szemuely" and "Yulius Fuchik " owned by the Soviet Union but on time- charter to the Inter- lighter International Shipping Compony with head- quarters at Budapest which is a joint venture company of the Governments of Soviet Union, Czechoslovakia, Bulgaria and Hungary. The ships fly the flag of the Soviet Union . Under the inter- governmental agreement between the owner coun- tries , the Interlighter International Shipping Company can use only the Soviet vessels .

In view of the special circumstances of the case and taking note of the growing Indo- Soviet cooperation in industry and commerce including shipping, the two delegations agreed that the operation of the above named lighter- carriers owned by the Soviet Union and flying the Soviet flag is covered by the Indo- Soviet Shipping Agree- ment of 1976. It was further agreed:
MINISTRY OF FINANCE (Department of Revenue) (Foreign Tax Division) NOTIFICATION New Delhi , the 31st May, 1984 INCOME -TAX
(1) the cargoes handled by the " Interlighter " from and to India will be subject to the existing bilateral shipping agreements between the countries of origin and destination wherever they exist between India and the co- owners of the " Inter- lighter " and, in the absence of such agreements , the cargoes will not attract any special concessions;
(2) ( a) disbursements and port dues shall be paid in Indian rupees to the extent the ship is carrying cargo from and to rupee payment countries;
G.S.R. 419 (E) .-- Whereas the Government of India and the Union of Soviet Socialist Republics have concluded an agreement through exchange of letters as set out in the Annexure hereto , for the modification of the Agreement entered into by the said Government, for the avoidance of double taxation in respect of taxes on income derived from the carriage of cargo ;
(b) disbursements and port dues shall be paid in free foreign exchange for cargoes carried from and to the non-rupee payment countries .
Now, therefore , in exercise of the powers con- ferred by section 90 of the Income- tax Act, 1961 (43 of 1961 ) and section 24A of the Companies (Profits) Surtax Act, 1964 (7 of 1964 ) , the Central

Further, in case thethe circumstances change , the parties may by mutual consent review this arrangement .
