मा का नि. 428 (अ) केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क और नमक अधिनियम , 1944 ( 1944 का 1) की धारा 37 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय उत्पाव- शूल्क नित्यमा, 1944 का और संशोधन करने के लिए निम्न - लिखित नियम बनाती है , अर्थात्:-
1. ( 1) इन नियमों का संक्षिप्त नाम केन्द्रीय उत्पाद शुल्क ( संशोधन) पाचवां निख्म, 1984 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय उत्पाद शुल्क नियम , 1944 के नियम 64 में , परन्तुक के पश्चात निम्नलिखित परन्तुक अन्तःस्थापित किया जाएगा , अर्थात्:-
"परन्तु यह और कि अहां केन्द्रीय सरकार का यह समाधान हो जाता है कि इस तथ्य के कारण कि आवश्यक केन्द्रीय उत्पाद शुल्क स्टाम्प उपलब्ध नहीं है या किसी अन्य सुसंगत कारण से , ऐसा करना आवश्यक या समीचीन है वहां वह:-
(1) किसी विनिर्माता या विनिर्माताओं के बगों , या
(2) किसी क्षेत्र या किन्हीं क्षेत्रों में विनिमित वियासलाइपों , या
(3) दियासलाइयों के किन्हीं प्रवगों ;
की बाबत नियम 52 के अनुसार ऐसे बक्से या पुस्तिका पर केन्द्रीय उत्पाद शुल्क स्टाम्प लगाए बिना , दियासलाइयों पर शुल्क का संदाय , साधारण या विशेग आदेश द्वारा , अनुज्ञात कर सकेगी । '

NOTIFICATION
No. 138 / 84- CENTRAL EXCISES
G.S.R. 428 ( E) . In exercise of the powers conferred by section 37 of the Central Excises and Salt Act , 1944 ( 1 of 1944 ) , the Central Government hereby makes the following rules further to amend the Central Excise Rules , 1944 , namely :-
1. ( 1 ) These rules may be called the Central Excise ( 5th Amendment) Rules , 1984 .
(2) They shall come into force on the date of their publica- tion in the Official Gazette .

2. In the Central Excise Rules , 1944 , in rule 64 , after the proviso , the following proviso shall be inserted , namely :-
" Provided further that where the Central Government is satisfied that by reason of the fact that the necessary Central Excise stamps are not available or for any other relevant reason it is necessary or expedient so to do , it may , by general or special order , allow the duty on matches to be paid , without affixing Central Excise stamps to such box or booklet , in accordance with rule 52 in respect of-
(i) Any manufacturer or classes of manufacturers , or
( ii ) matches manufactured in any area or areas , or
(iii) any categories of matches. " .
