अधिसूचना
सा ० का ० नि० 438 (अ) केन्द्रीय सरका भारत का सामुद्रिक क्षेत्र ( विदेश जलयान मत्स्थन विनियामत ) अधिनियम, 1981 ( 1981 का 42 ) की धारा 25 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत का सामु- द्रिक क्षेत्र ( विदेशी जलयान मत्स्यन विनियमन ) नियम, 1982 में निम्नलिखित संशोधन करती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम भारत का सामुद्रिक क्षेत्र ( विदेशी जलयान मत्स्यन विनियमन) द्वितीय संशोधन नियम, 1984 है ।
(2) ये राजपत्त्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. भारत का सामुद्रिक क्षेत्र ( विदेशी जलयान मत्स्यन विनियमन ) नियम, 1982 में,
(i ) नियम 15 के पश्चात् निम्नलिखित नियम रखा जाएगा, अर्थात्:--
" 15क. अभिगृहीत जलयान/ अन्य चीजों के स्वामी या म.स्टर द्वारा आवेदन का प्ररूप ।

धारा 9 की उपधारा ( 4 ) के खंड (क) के प्रथम परन्तुक के अधीन अभिगृहीत किसी विदेशी मत्स्य जलयान या अन्य चीजों का स्वामी या मास्टर इस प्रकार अभिगृहीत जलयान या अन्य चीजों के निर्मोचन के लिए प्ररूप "ट" में आवेदन कर सकेगा । " ;
( ii ) प्ररूप "प्न" के पश्चात् निम्नलिखित प्ररूप जोड़ा जाएगा अर्थात्:--

अधिनियम, 1981 की धारा 9 की उपधारा ( 2 ) के अधीन अभिगुहीत जलयान/ चीजों के, ' जो इसमें इसके पश्चात् और विशिष्ट रूप में वर्णित है, निर्मोचन के लिए आवेदन करता हूं ।
( 1 ) जलयान का वर्णन
(क ) जलयान का नाम
(ख ) जलयान का ध्वज रःज्य और स्वदेश पत्तन
(ग) रजिस्ट्रीकरण का देश और पन्नन
(घ) रजिस्ट्रीकरण संख्यांक
(ङ) जलयान के स्वामी और मास्टर का नाम
(च) स्वामी और मास्टर को राष्ट्रिकता और उनका पता ।
(छ) रजिस्ट्रीकृत लंबाई
(ज) रजिस्ट्रीकृत चौड़ाई
(झ) रजिस्ट्रीक्कृन गहराई ( डैफ़्ट )
(अ) सकल टनभार और शुद्ध टन भार
( ट) मुख्य इंजन की किस्म , विनिर्मित मुख्य इंजन का नाम और स्थान
(ठ) मुख्य इंजन की घोषित अश्व शक्ति
(2) मत्स्यन गियर का वर्णन ।
(3 ) जलयान के फलक पर अन्य उपस्कर स्टोर और स्थोरा का वर्णन।
मैं यथा अपेक्षित रु ० की नकद प्रतिभूति दी गई बैंक प्रत्याभूति की मूल प्रति सं०६० की राणि की द्वारा निक्षिप्त को नकद प्रतिभूति के प्रमाण- बक प्रत्याभूति/ देता हूं तारीख स्वरूप चालान सं ० इसके साथ संलग्न है ।

टिप्पणः- भारत का सामुद्रिक क्षेत्र ( विदेशी जलयान मत्स्यन विनियमन) नियम, 1982 भारत सरकार के कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) की अधिसूचना सं ० सा ० का० ति० 619,
(अ) , तारीख 26 अगस्त, 1982 के अधीन प्रकाशित किए गए थे । तथा तत्पश्चात् दिनांक 5 मई, 1984 की सरकारी अधिसूचना का ० आ० संख्या 361 ( ई ० ) , जो कि भारत के राजपत्र ( असाधारण ) के भाग 2 खंड 3 ( ii ) में प्रकाशित हुई थी, के द्वारा संशोधित किए गए थे ।

S.O. 438 ( E ) . In cxercise of the powers conferred by section 25 of the Maritime Zones of India ( Regula- tion of Fishing by Foreign Vessels ) Act , 1981 (42 of 1981 ) , the Central Government hereby amends the Maritime Zones of India ( Regulation of Fishing by Forcign Vessels ) Rules , 1982 , as follows , namely : -
1. ( 1 ) These Rules may be called the Mariti.ne Zones of India (Regulation of Fishing by Foreign Vessels) Second Amendment Rules , 1984 .
(2) They shall come into force from the date of their publication in the Official Gazette .
2. In the Maritime Zones of India ( Regulation of Fishing by Foreign Vessels ) Rulcs , 1982,
( i) after rules 15, the following rules shall be inserted , namely.-
"15A. Form of applicationby owner or mas- ter of seized vessel other things-The owner or the master of a foreign fishing vessel or other things seized under the first proviso to clause ( a) of sub - sec- tion (4)(4) of section 9 , may make an ap plication in Form K for the release of the vessel or other things so seized."
( ii) after Form J, the following forms shall be added , namely:-
"Form K (See rule 15A) FORM OF APPLICATION BY THE OWNER OR MASTER OF THE VESSEL FOR RELEASING THE VESSEL THINGS SEIZED .

I, as owner master of the vessel , hereby apply for release of the vessel things , more particularly describ- ed hereinafter , seized under sub- section 2 of section 9 of the Maritime Zones of India (Regulation of Fishing by Foreign Vessels ) Act, 1981 .
(1) Description of the Vessel
(a) Name of the Vessel .
(b) Flag state and home port of Vessel .
(c) Country and port of registration.
(d) Registration number .

(2) Description of fishing gear .
(3) Description of other equipments , stores and cargo on board the vessel .

of Fishing by Foreign Vessels) Rulcs , 1982 were published under the Notification of Government of India, Ministry of Agriculture (Department of Agriculture and Cocpcration) No. G.S.R. 619 (E) dated the 26th August , 1982. Subsequently amendment by Government Notification S.O. No. 361( E) dated 5th May , 1984 published in the Gazette of India , Extraordinary Part - II Section 3( ii ) .
