15 का०ग्रा ० 479 ( थ) / 18षक/ 18कक/ आई ० डी० आर ०ए०/ 84:-- केन्द्रीय सरकार ने, भारत सरकार के उद्योग मंत्रालय, औद्योगिक विकास विभाग के आदेश सं ० का ०आ० 613 (श्र)/ 18चक/ 18 कक/ आई० डी० आर०ए०/ 76, दिनांक सितम्बर, 1976 द्वारा इण्डस्ट्रीयल रिकन्सट्रक्शन कारपोरेशन आफ इंडिया लिमिटेड, कलकत्ता ( जिसे इसमें इसके पश्चात प्राधिकृत व्यक्ति कहा गया है ) मैसर्स बंगाल पाटरीज लिमिटेड कलकत्ता के स्वामित्व वाले 45 , टंगरा रोड, कलकत्ता और 3 , पंगलाडांगा रोड, कलकत्ता स्थित औद्योगिक उपक्रमों के सम्पूर्ण प्रबंध को 15 सितम्बर , 1976 से पांच साल की अवधि के लिए ग्रहण करने के लिए प्रऋधिकृत किया था;
और केन्द्रीय सरकार ने भारत सरकार के उद्योग मंत्रालय (औद्योगिक विकास विभाग ) के श्रादेश सं ० का० ग्रा० 697

14 (अ) / 18चक/ 18कक/ आई ० डी०आर ०ए ०/ 81 , तारीख सितम्बर, 1981 द्वारा प्राधिकृत व्यक्ति को उक्त औद्योगिक उपक्रमों का एक वर्ष की अतिरिक्त अवधि के लिए प्रबंध करते रहने के लिए प्राधिकृत किया था ,
और केन्द्रीय सरकार ने भारत सरकार के उद्योग मंत्रालय ( श्रऔद्योगिक विकास विभाग) के आदेश सं० का ० मा० 665 (अ)/ 18चक/ 18 कक/ आई ०डी० आर०ए०/ 82, तारीख 14 सितम्बर, 1982 का० श्र० 174 ( अ)/ 18चक/ 18 केक/ आई ०डी० आर ० ए ०/ 83 , तारीख 14 मार्च, 1983 , का ० आ ० 660 ( अ) / 18चत्रः/ 18कक/ आई ०डी० आर ० ए ०/ ४ दिनांक 14 सितम्बर, 1983 तथा का ०आ० 162 ( अ) 18चक/ 18 कक/आई ० डी० आर० ए ०/ 8 , दिनांक 14 मार्च, 1984 द्वारा प्राधिकृत व्यक्ति को उक्त दो औद्योगिक उपक्रमों का प्रबंध 30 जून, 1984 तक की अतिरिक्त अधि के लिए करते रहने के लिए प्राधिकृत किया था;
और केन्द्रीय सरकार ने , यह राय होने पर कि सर्व साधारण के हित में यह व समीचीन था कि प्राधिकृत व्यक्ति उक्त औद्योगिक उपक्रमों का प्रबंध करना जारी रखें, उद्योग

84 dated the 14th March, 1984 , the Central Gov- ernment authorised the authorised person to con- tinue to manage the said two industrial undertak- ings for a further period upto 30th June , 1984 ;
(विकारा और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18-चरु को उप-धारा ( 2 ) के परन्तुक के अधीन एक आवेदन कलकत्ता उच्च न्यायालय को दिया था जिसमें यह प्रार्थना की गई थी कि ऐसा प्रबंध तारीख 31 दिसम्बर , 1984 तरह को और अवधि के लिए जारी रखा जए ।
And, whereas , the Central Government being of opinion that it was expedient in the interests of the general public that the authorised person should continue to manage the said Industrial Undertak- ings , made an application under the proviso to sub - section ( 2 ) of section 18FA of the Industries (Development and Regulation) Act , 1951 (65 of 1951 ) , to the Calcutta High Court praying for the continuance of such management for a further period upto and inclusive of 31st December, 1984 ;
और उक्त उच्च न्यायालय ने अपने , तारीख 28 जून, 1984 के श्रादेशानुसार प्राधिकृत व्यक्ति को उक्त दो श्रौद्यो गिक उपक्रमों का प्रबंध तारीख 31 दिसम्बर , 1984 तक जिसमें यह तारीख भी सम्मिलित है की और अवधि तक जारी रखने के लिए अनुज्ञात कर दिया थः ।
And , whereas , the said High Court by its Order dated the 28th June , 1984 permitted the authorised person to continue to manage the said two indus- trial undertakings for a further period upto and inclusive of 31st December, 1984 ;
श्रतः केन्द्रीय सरकार उक्त अधिनियम को धारा 18कक के साथ पठित धारा 18चक की उपधारा ( 2 ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, प्राधिकृत को निर्देश देती है, कि वह 31 दिसम्बर , 1984 तक, जिसमें यह तारीख भी सम्मिलित है , की और अवधि के लिए उक्त औद्यागिक उपक्रमों का प्रबंध करना जारी रखें ।

Now , therefore , in exercise of the powers con- ferred by the proviso to sub-section (2) of section 18FA read with section 18AA of the said Act , the Central Government hereby directs the authorised persons to continue to manage the said two indus- trial undertakings for a further period upto and inclusive of the 31st December , 1984 .

ORDER
का०आ० 480 ( भ) / 18चख/ आई ०डी० आर ० ए ०/ 84:-- केन्द्रीय सरकार ने उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65) की धारा 18 चख की उपधारा ( 1 ) के खण्ड ( क) और ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार के उद्योग मंत्रालय ( श्रौद्योगिक विकाम विभाग ) के आदेण सं ० का ० श्रा० 39 (श्र)/ 18चम्य/ उ ० वि० वि ० आ ०/ 77 , तारीख जनवरी, 1977 द्वारा ( जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है ) यह घोषणा की थी कि:-- 22 S.O. 479 ( E) 18FA 18AA IDRA 84.-Whereas by the order of the Government of India in the Ministry of Industry (Department of Industrial Development) No. S. O. 613 (E ) [ 18FA 18AA IDRA 76, dated the 15th September , 1976 the Central Government had authorised the Industrial Reconstruction Corporation of India Limited , Cal- cutta (hereinafter referred to as the authorised person) to take over the management of the whole of the two industrial undertakings at 45 , Tangra Road, Calcutta, and at 3, Pagladanga Road, Cal- cutta, owned by Messrs Bengal Potteries Limited, Calcutta, for a period of five years from the 15th September , 1976;
( क ) श्रौद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14) इस अनुकूलों सहित' को उक्त अधिनियम की धारा 9- क , 5-क्र, 5 (ख ) और धारा 33 -ग का लोप किया जाएगा, मैसर्स वंगाल पाटरीज लिमिटेड कलकत्ता के स्वामित्वाधीन दो औद्योगिक उपक्रमों जो कि 45 , टंगरा रोड कलकत्ता, और 3, पगलाडांगा रोड , कलकत्ता में स्थित है, को लागू होगा, और
And, whereas , by the order of Government of India in the Ministry of Industry ( Department of Industrial Development) No. S.O. 697 (E) ( 18ГА 18AA IDRA 81 , dated the 14th September, 1981 the Central Government authorised the authorised person to continue to manage the said two indus- trial undertakings for a further period of one year ;
And, whereas , by the order of Government of India in the Ministry of Industry (Department of Industrial Development ) Nos . S.O. 665 ( E) 18ΓΛ 18AA IDRA 82 dated 14-9-1982, S.O. 174 (E) 18FA/ 18AA IDRA 83 dated the 14-3-1983 , S.O. 660(E) 18FA 18AA IDRA 83 dated 14th Sep- tember , 1983 and S.O. 162 ( E ) ( 18FA 18AA IDRA
(ख ) राजपत्र में उक्त आदेश के प्रकाशन की तारीख से ठीक पूर्व प्रवृत्त ऐसी-ऐसी संविदानों संपत्ति के हस्तांतरण-पत्रों, करारों, व्यवस्थापनों, पंचाटों, स्थायी आदेशों या अन्य लिखतों का प्रवर्तन ( उनसे भिन्न जिनका संबंध बैंकों और वित्तीय संस्थानों के प्रतिभूत दायित्वों से है ) जिनके उक्त श्रौद्योगिक 3

उपक्रम पक्षकार हैं, या ऐसे श्रौद्योगिक उपक्रमों की स्वामी रुम्पनी पक्षकार है, या जो यथा- स्थिति उन औद्योगिक उपक्रमों या कम्पनी को लागू होते हों, और उबन तारीख के पूर्व उनके अधीन प्रादमन या उदभूत सभी या कोई अधिकार विजेषाधिकार बाध्यताएं और दायित्व निलंबित रहेगा ,
और उक्त आदेश की अवधि सायन्सच पर और 30 जून, 1984 तक के लिए जिसमें यह तारीख भी सम्मिलित है, बहा दी गई थी,
और केन्द्रीय सरकार का समाधान हो गया है कि उक्त आदेण की अवधि 31 दिसम्बर , 1984 तक के लिए जिसमें यह तारीख भी सम्मिलित है, बढ़ा दी जानी चाहिए ,
अतः अब, केन्द्रीय सरकार , उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18-चश्व की उपधारा ( 2 ) के माथ पठिन उपधारा (1 ) के खण्ड ( क) भीर (ख ) द्वारा प्रदत्त शक्तियों का प्रयाग करते हुए, उक्त अवधि 31 दिसम्बर , 1984 तक के लिए जिसमें वह तारोख भः सम्मिलित है, बढ़ाती है ।

ORDER
by S.O. 480(E ) 18FB IDRA 84.-Whereas the order of the Government of India in the Ministry of Industry ( Department of Industrial Development ) Nơ. S.O. 39 ( E ) | 18FB | IDRA 77 , dated the 22nd January , 1977 ( hereinafter re- ferred to as the said order ) , the Central Govern- ment in exercise of the powers conferred by clauses ( a) & (b ) of sub - section ( 1 ) of section 18FB of the Industries ( Development & Regulation ) Act , 1951 ( 65 of 1951 ) , declared that :-
( a) the Industrial Disputes Act, 1947 ( 14 of 1947 ) , shall apply to the two indus- trial undertakings at 45 Tangra Road , Calcutta and 3 Pagladanga Road, Cal- cutta owned by Ms. Bengal Potteries Limited, Calcutta with the adaptation that section 9A , Chapters , VA and VB and section 33C of the said Act shall be omitted, and
are (b ) the operation of all contracts , assurance of property, agreements , settlements , awards, standing orders or other instru- ments in force immediately before the date of publication of the said order in the Official Gazette ( other than those relating to secured liabilities to banks and financial institutions ) , to which the said industrial undertakings parties , or the company owing such in- dustrial undertakings , is a party which may be applicable to the indus- trial undertakings of the company , as the case may be and all or any of the rights , privileges , obligations and liabi- lities accruing or arising thereunder be- fore the said date , shall remain suspend- ed: or
And, whereas , the duration of the said Order was extended from time to time upto and inclu- sive of the 30th June , 1984;
And, whereas , the Central Government is satis- fied that the duration of the said order should be extended for a further period upto and inclusive of the 31st December, 1984 ;
Now, therefore , in exercise of the powers con- ferred by clause ( a) and ( b ) of sub-section ( 1 ) , read with sub -section ( 2 ) of Section 18FB of the Industries ( Development and Regulation) Act, 1951 ( 65 of 1951 ) , the Central Government hereby extends the duration of the said Order upto and inclusive of the 31st December , 1984.
