season is over and has, therefore, recommended the extension of the date for the completion of election in 5-Kokrajhar (ST), 6-Barpeta, 10- Nowgong, 14-Dibrugarh and 14-Lakhimpur par- liamentary constituencies of Assam upto 31st December, 1984;

And, whereas the Commission is satisfied that

such extension is necessary.

Now, therefore, in exercise of the powers con- ferred by article 324 of the Constitution, sections 153 and 30 of the Representation of the People Act, 1951, read with section 21 of the General Clauses Act, 1897, and all other powers enabling it in this behalf, the Election Commission hereby makes the following amendments in its Notifica- t i on No. 464|AS-HP]83(J) dated 12th January, 1983, as subsequently amended by three Notifi- cations No. 464|AS-HPj83 dated 27th February, 1983, 28th June, 1983 and 28th December, 1983 :—

NOTIFICATION

New Delhi, the 30th June, 1984

O.N. 38(E).—Whereas the Election Commis- sion by its Notification No. 464]AS-HP|83 dated the 28 th December, 1983, published in the-Gazette of India, Extraordinary, Part II. Section 3(iii) of that date, extended the date for completion of poll in 5-Kokrajhar (ST), 6Barpeta, 9-Tezpur, 10-Nowgong, U-Dibrugarh and 14-Lakhimpur parliamentary constituencies of Assam from 28th February, 1983, as originally fixed, to 30th June, 1984;

And, whereas, on account of the death of a contesting candidate from 9-Tezpur parliament- ary constituency, the poll from that constituency has been countermanded by the Returning Officer under section 52 of the Representation of the People Act, 1951;

And, whereas, the Chief Electoral Officer of Assam has reported that the State is in the grip of flood during this time of the year and it will not be possible to hold the elections till the flood (A) In the last para of the Commission's Notification No. A 64-AS-HP 183(1) dated 12 January, 1983, as amended by subsequent Notifications No. 464-AS- HP|83 dated 27-2-83, 28-6-83 "and 28-12-83, for the date "30th June, 1984 (Saturday)" the date "31st De- cember, 1984- (Monday)" shall be sub- stituted ;-

(B) In clause (e)(ii), as inserted in Com- mission's Notification No. 464;AS-HP| 83(2) dated the 12th January, 1983, by Commission's Notification No. 4641 AS-HP|83 dated the 27th February, 1983, and subsequently amene'ed by Commission's Notifications No. 464-AS- HP|83 dated 28th June, 1983 and 28th December, 1983, for the date "the 30th June, 1984 (Saturday)" the date "the 31st December, 1984 (Monday)" shall be substituted.
