सा० का ० ति०487 ( श्र): -श्रौषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए कतिपय नियमों का एक प्रारूप, औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 12 और 33की अपेक्षानुमार, भारत सरकार के स्वास्थ्य और परियार कल्याण मंत्रालय की अधिसूचना सं० मा ० का ० नि० 31 ( अ) तारीख 18 जनवरी , 1983 के अधीन , भरत के राजपत्र, असाधारण, म.ग 2 , खंड 3, उपखंड ( i ) त. शेख 18 जनवरो, 1983 के पृष्ठ1-2 पर प्रकाशित किया गया था जिसमें उन व्यक्तियों से प्रारूप अधिसूचना के राजपत्र में प्रकाशन की तारीख में नब्बे दिन की अवधि के अवसान तक आक्षेप और सुझाव मांगे गए थे , जिनके उसने प्रभावित होने की संभावना थो;
भौर उक्त राजपत्न 2 फरवरी , 1983 को जनता को उपलब्ध करा दिया गया था;

हुए है; और उक्त प्रारूप पर कोई आक्षेप या सुझाव प्राप्त नहीं
अतः केन्द्रीय सरकार , औषधि और प्रसाधन सामग्री, अधिनियम , 1940 ( 1940 का 23) को धार 12 और 33 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए हुए , औषधि त नोकी मलाहकार बोर्ड में परामर्श करने के पश्च त् श्रीषधि और प्रसाधन सानग्रो नियन, 1945 का संशोधन करने के लिए निम्नलिखित नियम बनातो है , अर्थात्
( 1 ) इन नियमों का संक्षिप्त नाभ औषधि और प्रसाधन भामग्री ( चतुर्थ संशोधन ) नियम, 1984 है ।
( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगे ।
2. औषधि और प्रसाधन सामग्री नियम , 1945 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 61 के उपनियम ( 2 ) के परन्तुक्र के स्थान पर निम्नलिखित परन्तुक रखा जाएगा, अर्थात्: -
"परंतु यह कि प्ररूप 21 क में कोई अनुज्ञप्ति, अनुसूची "ग" में विनिदिष्ट औषधियों के लिए अनुदरत

नहीं की जाएगी और केवल उन्ही अनुसूची Pi(1) को औषधियों के लिए विधिमान्य होगी जो अनुजप्ति में विनिदिष्ट हैं । "
3. उक्त नियमों के नियम 96 के उपनियम ( 1 ) के खंड ( 8 ) के परंतुक में "परंतु" शब्द के स्थान पर, निम्त लिखित रखा जाएगा , अर्थात् :---
"परंतु यह कि अनुसूचः Pi(1) में सम्मिलित प्रपुंज रूप में ऐसी औषधियों के जो उपयोग के लिए तैयार नही हैं, लेबल पर विनिर्मात द्वार नियत शक्ति के अवसन की तारीख होनी अवश्यक नहीं है:
परंतु यह और कि
4. उक्त नियमों को अनुसूची क में, ---
(1) प्ररूप 19-क्र में--
(क) पैरा 1 के उपगैरः ( ii ) में "अनुसूची ग और pi(1) में विनिदिष्ट औषधियों" शब्दों, अक्षरों , कोठकों अंक के स्थान पर, दोनों स्थनों पर जहां कहीं वे आते हैं, "अनुसूचो pi(1) में विनिदिष्ट औषधियां " शब्द, अक्षर , कोष्ठक और अंक रखे जायेंगे ।
(ख ) पैरा 4 में, "अनुसूवो ग और pi (1) ^ prime prime शब्दों, अक्षरों, कोष्ठकों और अंक के स्थान पर "अनुसूची Gamma (1) ^ prime prime शब्द, अक्षर, कोष्ठक और अक रखे जाएंगे ।
(2) प्ररूप 21क में, "अनुसूची न और mathfrak pi (1) ^ prime prime शब्दों, अक्षरों , कोष्ठक और अंक के स्थान पर जहां कही वे आते हैं, "अनुसूची pi (1) ^ prime prime अक्षर, शब्द, कोष्ठक और अंवा रखे जाएंगे ।
5. उक्त नियमों को अनुसूची ग में, क्र. सं ० 11 और उससे संबंधित प्रविष्टियों के स्थन पर, निम्नलिखित क्रम संख्यांक और प्रविष्टियां रखी जाएंगी, अर्थात् :---
^ 6 11. एंटिबायोटिक्स और उनकी विनिमितियों जो आन्वेतर रूप में दिए जाने व.ले आफार में न हों ।"
6. उक्त नियमों को अनुसूची ग ( 1 ) में, क्रम संख्यांक 9 और उससे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित क्रम संख्यांक और प्रविष्टियां रखा ज. एंगो , अर्थात्:--
" 9 एंटिबायोटिक्स और उनको विनिर्वातियां, जो अन्वेतर रूप में दिए जाने वाले आकार में न हो । "
टिप्पण : 1-5-1979 तक यथा संगांधित औषधि और प्रसाधन सामग्री नियम , 1945 , स्वास्थ्य और परिवार कल्याण मंत्रालय (स्वास्थ्य विभाग) के औषधि और प्रसाधन सामग्री अधिनियम और नियम वाले प्रकाशन में अंविष्ट है । उक्त निथम में, पश्चात्वर्ती संशोधन, भारत के राजपत्र भाग 2, खंड 3(i) में

NOTIFICATION
New Delhi , the 2nd July, 1984
G.S.R. 487 (E ) .-Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 was published , as required by sections 12 and 33 of the Drugs and Cosmetics Act , 1940 (23 of 1940 ) , under the notification of the Govern- ment of India in the Ministry of Health and Family Welfare (Department of Health ) No. G.S.R. 31 ( E ) dated the 18th January, 1983 at poges 1-2 of the Gazette of India, Extraordinary. Part- II, Section 3 , Sub - Section (i ) dated the 18th January, 1983 inviting objections and suggestions from all persons likely to be affected thereby be- fore the expiry of ninety days from the date of publication of the draft notification in the Offi- cial Gazette;
And whereas the said Gazette was made avail. able to the public on the 2nd February, 1983 .
And where no objections , suggestions has been received from the public on the said draft rules ; -
Now, therefore, in exercise of the powers con- ferred by Sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) , the Central 3

letters , brackets and figure "Schedule C( 1 ) " shall be substituted.
Government , after consultation with the Drugs Technical Advisory Board ; hereby makes the following rules further to amend the Drugs and Cosmetics Rules , 1945 , namely :-
5. In Schedule C to the said rules , for serial number 11 and the entries relating thereto , the following serial number and entry shall be sub- stituted , namely : ---
(1) These rules may be called the Drugs and Cosmetics ( Fourth Amendment ) Rules , 1984.
" 11. Antibiotics and preparations thereof in a form to be administered parente- rally."
(2) They shall come into force on the date of their publication in the Official Gazette.
6. In Schedule C( 1 ) of the said rules , for serial number 9 and the entries relating thereto , the following serial number and entry shall be substituted namely :--
2. In rule 61 of the Drugs and Cosmetics Rules , 1945 (thereinafter referred to as the said rules ) in sub- rule (2 ) , for the proviso , the following pro- viso shall be substituted , namely :-
preparations thereof "9. Antibiodes and not in a form to be administered par- enterally." .
"Provided that a licence in Form 21 - A shall not be granted for drugs specified in Schedule C and shall be valid for only such Schedule C ( 1 ) drugs as are speci- fied in the licence . "
3. In rule 96 of the said rules , in sub -rule ( 1 ) , in the proviso to clause (viii ) , for the words "Pro- vided that " the following shall be substituted, namely :-
