G.S.R. 488(E).—Whereas a dralt of the Preven- tion of Food Adulteration (Amendment) Rules, 1982 was published as required by stab-section (i) of section 23 of the Prevention of Food Adulteration Act, 1954(37 of 1954) with the notification of the Government of India in the Ministry of Health and Family Welfare (Department of Health) No. G.S.R. 699. dated the 5th August, 1982 at pages 1994 to 1995 of the Gazette of India Part II, Section 3, sub- section (i), dated the 21st August, 1982 for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of ninety days from the date of publication of the said notification in the Official Gazette;

And whereas it is1 considered desirable to republish the said draft rules with some modification for informa- tion of all persons likely to be affected thereby;

Now, therefore, the following draft of the rules further to amend the Prevention of Food Adulteration Rules, 1955 which the Central Government proposes to make, after consultation with the Central Commit- tee for Food Standards, in exercise of the powers con- ferred by sub-section (1) of section 23 of the said Act is hereby republished as required by the said sub-sec- tion for information of all persons likely to be affec- ted thereby, and notice is hereby given that the said draft rules will be taken into consideration after the -expiry of a period of ninety days from the date on which copies of the Gazette of India in which this notification is published are made available to the public.

Any objection or suggestion which may be received from any person with respect to the said daft rules before the expiry of the period so specified will be considered by the Central Government.

DRAFT RULES

1. (1) These rules may be calPed the Prevention

of Food Adulteration (Amendment) Rules, 1984.

(2) They shall come into the force on the date of their final publication in the Official Gazette, except rule 3 which shall come into force immediately after one year from the date of such publication.

2. Tn the Prevention of Food Adulteration Rules

(b) in item 32, the words "Dried Milk", the words "Milk Power, skimmed milk powder, partly skimmed mific powder, malted milk food and such other powders containing milk as major ingredient" shall be substituted.

3. In rule 49 of the said rules, after sub-rule (15), the following sub-rule shall be inserted, namely:— "(16) Tv'ilk powder and condensed milk shall1 not be sold except 'under Indian Standard Institution Certifi- cation mark".

4. In Appendix B of the said ruies,—

(i) ior item A.I 1.01.01, the following item shall be substituted, namely:—

"A 11.01.01 - Milk is the normal mammary : ecre- tio ;. s;er;"e

(ii) in item A 1 i .01.02 —

(b) Use "Explanation" occu.ring at the end shall

be omitted;

(viii) in item A.ll.02.07.01, the following shall

be added at the end, namely:—

"either singly or in combination. It may contain Calcium Chloride (anhydrous) not exceeding 0.02 per cent by weight";

(ix) in item A. 11.02.08, the following \hall be

added at the end, namely:—

"In case of ice-cream, where the chocolate portion forms a separate layer, only the ice cream portion shall conform to the standaids of ice-cream";

(x) in item A.J1.02.J6, for the words and figures "fat co :lent of the product shall be between 1-6 and 24.0 per cent", the words and figures "fa; content of the product shall be more than 1.5 and les-= than 26.0 per cent" shall be substituted;

(xii in item A.' 1.02.17.-

milk rolids" shall be inserted;

(ili) in item A. 11.01.03, in the last sentence, for the word "container", the words "'sealed container" shall be substituted;

(iv) in item A 1 1.01.06,—

(a) for the words "standardised to t fat percent- age", the words "standardised to fat and solids-not- fat percentage" shall be substituted:

(b) for the words "abstraction and|or addition of milk fat. o by the addition of skimmed milk or by addition of recombinrd or reconstituted skimmed milk", the words "adjusiment of milk solids" shall be substituted;

(.v) in ifem A.il.01.08. for the words "with non- fat milk solids or milk powder, :md water, or by partial abstraction|addi!ion of fat from*to milk", the words "that has been standardised to fat and solids- not-fat in the table below item A.I 1.01 of milk solids'" shall be substituted;

(vi) in item A.11.01.09, for the words "with non- fat-milk sol'ds and water, or by partial abstraction! addition of fat f.omjto milk", the words "that has been s'andardised to fat and sol ids-not-fat percentage given in the table below item A. 11.01.11. by adust- ment of milk solids" shall be substituted;

(vii) in item A.I 1.02.04 and A.I 1.02.05, the

following chal1 be added at the end, namely: —

"Milk solids may also be used in preparation of this

rtroduct".
