अधिसूचना
मा०का ०नि० 583 ( श्र ) केन्द्रीय सरकार, कंपनी अधिनियम , 1956 ( 1956 का 1) की धारा 10 ङ की उपधारा ( 4ख ) के माथ पठिन धारा 642 द्वारा प्रदत गक्तियों का प्रयोग करते हुए, कम्पनी विधि बोर्ड (बैंच ) नियम, 1975 का ( जिये इसमें इसके पश्चात् "उक्त नियम कहा गया है ) और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1) इन नियमों का संक्षिप्त नाम कंपनी विधि बोर्ड ( बैंच) संशोधन नियम, 1984 है ।
*टिप्पण : कंपनी विधि बोर्ड ( बैंच ) नियम, 1975 भाग्न के राजपत्र (अमाधारण) , भाग 2, खंड 3 , उपखंड ( i ) में अधिसूचना सं ० गा०का०नि ० 58.3 ( प्र) तारीख 10-12-75 के द्वारा प्रकाशिन किए गए ।
बाद में उनका निम्ननिखिप्त अधिसूचना २० द्वारा संशोधन किया गया:

( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. उक्त नियमों के नियम 3 में, खंष्ट ( अ) के पश्चात् निम्नलिखित खंड अन्नःस्थापित किया जाएगा, अर्थात्: --
"( का क) " एकाधिकार अधिनियम" से एकाधिकार तथा अवरोधक व्यापारिक व्यवहार अधिनियम , 1969 ( 1969 का 54) श्रभिप्रेत है ; "
3. उक्त नियमों के नियम । मे "धारा 2 के खंड ( 13फ ) के स्पष्टीकरण " शब्दों, कोष्ठकों और श्री श्रीर अक्षरों के स्थान पर "एका धिकार अधिनियम की धारा 26" शश्व, अंक और अक्षर रखे जाएंगे ।
4. उनन नियमों के नियम 11 मे
( 1) उपनियम ( 2) की मारणी में, क्रम मलयाक । गे संबंधित प्रविष्टियों के स्थान पर,--
(क) स्तम्भ 1 में, " धारा के खंड ( 18 क ) के स्पष्टीकरण" शब्दों, काष्ठका, अकों ओर अक्षर के स्थान पर " एकाधिकार अधिनियम की धारा 2 रु" शब्द, अंक प्रोर अक्षर रखे जायेगे ,
या (ख) स्तम्भ में " उग प्रश्न का अवधारण कि ट्रां या दा से अधिक व्यष्टि श्रादि किसी गमृद के भीतर गठन करते हैं उसके अंतर्गत प्रात " शब्दों के स्थान पर " एकाधिकार पधिनियम की धारा 25 के उपबंधों के अनुमरण में, समूह , अंतर्सम्बद्ध या उन्नः प्रवन्ध के किसी प्रश्न का अवधारण" शब्द रखे जायेगे ।

( 2) उप नियम ( 3) के स्थान पर निम्नलिखित रखा जाएगा,
अर्थात्:-
" ( 3 ) फीस का संवाय-इस नियम के अधीन संवेय फीस 104--अन्य साधारण प्राधिक सेवाएं केन्द्रीय सरकार और कंपनी विधि बोर्ड द्वारा कंपनी अधिनियम , 1956 के अधीन उसे किए गए आवेदनों/ जियों पर वसूल की गई फीस , लेखा शीर्ष के अंतर्गत अभा करने के लिए भारत के लोक खाते में पंजाब नेशनल बैंक की निम्नलिखित शास्त्राओं में संदल की जाएंगी ।

(3) उप नियम ( 3 ) के पश्चात निम्नलिखित अंतःस्थापित किया जाएगा, अथर्थात्
"( 4) इस नियम के अधीन संदेय फीस भी वेतन और लेखा अधि- कारी , कंपनी कार्य विभाग , नई दिल्ली के पक्ष में लिखे गए बैंक ड्राफ्ट द्वारा संदल की जा सकेगी । "
5. उक्त नियमों के नियम 17 के उपनियम ( 1 ) में " अधिनियम" शम्य के स्थान पर " प्रधिनियम या एकाधिकार अधिनियम" शब्द रखे जायेंगे ।

MINISTRY OF LAW , JUSTICE AND COMPANY AFFAIRS (Department of Company Affairs) New Delhi , the 1st August , 1984 NOTIFICATION
G.S.R. 583 ( E) : In exercise of the powers conferred by section 642 , read with sub - section (4B) of section 10E , of the Companies Act , 1956 ( 1 of 1956) , the Central Government hereby makes the following rules further to amend the " Com- pany Law Bard ( Bench) Rules , 1975 , ( hereinafter called " the said rules ") , namely :-
1. ( 1 ) These rules may be called the Company Law Board (Bench) Amendment Rules , 1984 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In rule 2 of the said rules , after clause ( j ) , the following clause shall be inserted , namely :-
"(ja) " The Monopolies Act " means the Mono- polies and Restrictive Trade Practices Act , 1969 ( 54 of 1969);"
3. In rule 4 of the said rules , for the words , brackets figures and letter , " Explanation to clause ( 15A ) of Section 2 " , the words , figure and letter , " Section 2A of the Monopolies Act " shall be substituted.
4. In rule 11 of the said rules ,-
(1) in the Table to sub - rule ( 2 ) , for the entries relating to Serial Number 1 ,-
(a) For the words , brackets , figures and letter , " Explanı - tion to Clause ( 181 ) of Section 2 " in column 1 , the words , figure and letter , " Section 2A of the Micno- polies Act" shall be substituted;
(b) For the words ,, "Determination of the question whether two or more individuals , etc. , constitute or fall within a group " in column 2, the words " Determination of any question of group , inter - connection or same manage- ment in accordance with the provisions of Section 2A of the Monopolies Act " shall be substituted .
(2) For sub - rule (3) , the following shall be substituted namely:
"(3) Payment of fees . Fees payable under this rule shall be paid into the Public Account of India at the following branches of the Punjab National Bank for credit under the Head of Account - 104 Other General Economic Services Fees realised by the Central Government and Company Law Board on applications/ petitions made to it under the Companies Act , 1956, namely :-

(5) In sub rule u) to cule 17 of the said rules for the word "Act" , the words " Act or the Monopolies Act " shall be substituted .
