सा० का ० नि० 590 ( अ) नव मंगलौर पत्तन (पेट्रोलियम ) नियम, 1979 का संशोधन करने के लिए कतिपय नियमों का प्रारूप भारतीय पत्तन अधिनियम, 1908 की गग 6 की उपधारा ( 2 ) की अपेक्षानुमार, भारत सरकार के नौवहन और परिवहन मत्रालय ( पत्तन खंड ) की अधिसूचना सं . 11 ( अ) दिनाक 6 जनवरी , 1984 के अधीन , भारत के राजपत्र, असाधारण, भाग 2 खंड 3 उपखंड ( i ) दिनांक 6 जनवरी , 1984 को पृष्ठ 2 ने ऊपर प्रकाशिन किया गया था. जिसमें राजपत्र में उक्त अधिसूचना के प्रकाशन की तारीख से 60 दिन की अवधि की समाप्ति तक उन सभी व्यक्तियों में आक्षेप और मुझाव मांगे गए थे, जिनके उसमे प्रभावित हाचे की संभावना थी। और उक्त 6 जनवरी, 1984 को जनता को उपलब्ध करा दिया गया था , और जनता से कोई आक्षेप या सुझाव प्राप्त नहीं हुए हैं ।
अतः अव केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते
हुए, निम्नलिखित नियम बनाती है, अर्थात्: --
1. ( 1 ) इन नियमों का संक्षिप्न नाम नव मंगलौर पत्तन (पेट्रोलियम) ( संशोधन ) नियम, 1984 है ।
( 2 ) ये राजपत्र में इसके अंतिम प्रकाशन की तारीख क़ो प्रवृत्त होगी ।
2. नव मंगलौर पत्नन (पेट्रोलियम ) नियम1979 में,--
(क) नियम 4 , में-
( 1) उप-नियम ( 2 ) के स्थान पर ' निम्नलिखित उप- नियंम रखे जाएंगे , अर्थात्:--
" 2 कोई तेल टैंकर पेट्रोलियम वर्ग क खाली करने के पश्चात् तेल जैटी से भिन्न किसी घाट पर तब तक लंगर नहीं डालेगा जब तक कि विस्फोट नियंत्रक या उप- नियंत्रक का इस

भाशय का प्रमाणपत्र प्रस्तुत नहीं कर दिया जाता कि उसने सभी टकों, काफर-डामों , पम्प कक्षों , पाइप लाइनों और तेल टैंकर के ऐम श्रन्य भागों की, जिन्हें श्रावश्यक समझा जाए परीक्षा असगोदित वाष्प परीक्षण उपस्कर की सहायता मे कर ली है और टैंकर खतरनाक पेट्रोल वाष्पों से मुक्त है ,"
(ii) उप नियम ( 3 ) में--
( 1) खंड ( 1) में " दोनों प्रमाणपत्रों की प्रतिया" शब्दों के स्थान पर " प्रमाणपत्र की एक प्रति" शब्द रखे जाएंगे ,
( 2 ) खंड ( 2 ) मे " इन दोनों प्रमाणपत्त्रों की मूल प्रतियो" शब्दों के स्थान पर " उक्त प्रमाणपत्र की मूल प्रति" शब्द रखे जाएंगे,
( 3) खंड ( 3 ) में "एक नया गैस मुद्रिक का प्रमाणपत्र शब्दों के स्थान पर " उपनियम ( 2 ) के अधीन एक नया प्रमाणपत्र" शब्द च्खे जाएंगे,
(iii) उप-नियम ( 5 ) के स्थान पर निम्नलिखित उप- नियम रख जाएंगे, श्रर्थात्:---
" ( 5) किसी तेल टैंकर को तेल जेटी को आबंटन या किसी तेल टैंकर के स्थानान्तरण का विनिश्चय उप संरक्षक द्वारा किया जाएगा और उसके इस विनिश्चय के विरुद्ध कोई अपील पसन संरक्षण के पास की आएगी " ।
(iv) उपनियम ( 7) में,--
खंड ( 1 ) , ( 2 ) , ( 3 ) , ( 4) और ( 5) के स्थान पर निम्नलिखित खंड रखे जाएंगे , अर्थात्:--
(1) किसी तेल टैंकर का स्वामी या अभिकर्ता, जो पत्तन की सीमाओं के भीतर जलयान की मरम्मत करना चाहता है , उप- नियम ( 2) के अधीन विस्फोटक नियंत्रक या विस्फोटक उप-नियंत्रक से प्रमाणपत्र प्राप्त करेगा ।
( 2) इस प्रमाणपत्र की मूल प्रति मास्टर या किसी अन्य जिम्मेदार अधिकारी के कब्जे में फलक पर रखी जाएगी और हर समय निरीक्षण के लिए उपलब्ध रहेगी ।
( 3 ) उक्त प्रमाणपत्र ... एक प्रति उप-संरक्षक को भेजी जाएगी जो अपना यह समाधान हो जाने पर कि पांत के फलक पर मरम्मत करना निरापद है, आवश्यक अनुज्ञा दे सकेगा ।
( 4) पूर्वोक्त प्रमाणपत्र की एक प्रति मरम्मत का कार्य प्रारंभ करने से पूर्व पोत मरम्मत कर्ता को भी दी जाएगी ।
( 5) पोत की मरम्मत करने वाली फर्म किमी तेल टैंकर के फलक पर तब तक कोई मरम्मत नहीं करेगी जब तक वे उपरोक्न प्रमाणपत्र की प्रति प्राप्त नहीं कर ले । और एसी मरम्मत करते समय भारत सरकार द्वारा विहित की गई आचार संहिता का पालन करेगी । "
(2) खंड ( 1 ) में, " एक नया गैस मुक्ति का प्रमाणपत्र" शब्दों के स्थान पर " उप-नियम ( 2 ) के अधीन एक नया प्रमाण-पत्न" शब्द रखे जाएगे ।

(ख) नियम 5 में--
( 1) उपनियम ( 61 ) में " जिम्मेदार प्राधिकारी " शब्दों के स्थान पर " प्रमाणिन नौवहन अधिकारी" शव्द
( 2) उप नियम ( 8 ) में ग्खड ( 1 ) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्: --
"( 1 ) यदि पेट्रोलियम का उतारना या लादना प्रारंभ कर दिया जाता है तो ऐसे उतारने या लादने का कार्य तेल जेटी, लंगर और जंडी पर के अन्य उपस्करों ( जिसके अन्तर्गत टैंकर और तेल जेटी में फलक पर कार्यरत कामिक भी आने -हैं) , की मुरआ को ध्यान में रखकर अत्यधिक पूर्वावधानी के साथ किया जाएगा" ।

New Delhi , the 6th August , 1984 .
G.S.R. 590(E) . Whereas the draft of certain rules to amend the port of New Managalore ( Petro- Itum) Rules , 1979 was published as required by sub- section ( 2 ) of section 6 of the Indian Ports Act , 1908 , at pages 2to 3 of the Gazette of India. Extra- ordinary , Part II section 3 sub- section ( i ) dated the 6th January, 1984 under the notification of the Government of India in the Ministry of Shipping and Transport ( Ports Wing ) No. G.S.R. 11 ( E ) dated the 6th January , 1984 , inviting objections and suggestions from all persons likely to be affected thereby till the expiry of a period of 60 days from the date of publication of the notification in the Official Gazette.
And whereas the said Gazette was made available to the public on 6th January , 1984 ;
And whereas no objection or suggestion was received from the public;
Now, therefore in exercise of the powers conferred by sub- section ( 1 ) of section 6 of the said Act , the Central Government hereby makes the following rules , namely: -
1. ( 1 ) These rules may be called the Port of New Mangalore ( Petroleum) ( Amendment ) Rules , 1984 .
( 2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Port of New Managlore ( Petroleum) Rules , 1979.

(a) in rule 4 ,-
(i) for sub - rule ( 2 ) , the following sub - rule shall be substituted , namely :-
(ii) The original of this certil be kept in board in posses: Master or other respons and shall be available for at all times .
(iii) A copy of the said certi be sent to the Deputy ( who , on being satisfied. safe to carry out repair the ship , may grant the permission .
(iv) A copy of the aforesaid shall also be handed ( ship repairer prior to mencement of the repai " ( 2 ) No oil tanker shall berth at any of the wharves other than the oil jetty after having discharged petroleum Class A until a certificate is produced from the Controller of Explosives or the Deputy Controller of Explosives to the effect that he has examined all the tanks , coffer -dams , pumprooms , pipelines and such other parts of the oil tanker as deemed necessary with the aid of an ap- proved vapour testing equipment and the while tanker is free from dangerous petrol vapours . " ;
( ii) in sub -rule ( 3 ) , ( 1) in clause ( i ) , for the words " Copies of both the Certificate " , the words "A copy of the Certificate" shall be substituted;
(v) Ship repairing firms shal out any repairs on bo tanker until they hav the copy of the above and when undertaking : shall comply with the c duct as prescribed by t ment of India .
(2) in clause ( ii ) , for the words " Originals of both these Certificates " , the words "Original ofo the said certicertificate" shall be substituted;
(2) in clause ( vi ) , for the wor gas- free certificate" , the wo certificate under sub - rule ( 2 substituted;
(3 ) in clause ( iii ) , for the words " a fresh gas- free certificate " , the words " a fresh certi- ficate under sub- rule ( 2) " shall be sub- stituted;
(b) in rule 5,-
( iii) for sub- rule ( 5 ) , the following sub- rule shall be substituted , namely :-
(i) in sub - rule ( 6 ) , for the Wo ponsible officer " , the words navigating officer" shall be "(5) Allotment of the oil jetty to , or shift- ing of, any oil tanker shall be decided by the Deputy Conservator and an appeal against the decision shall lie to the Conservator of the Port . "
(ii) in sub rule ( 8 ) , for clause lowing clause shall be namely :-
( iv) in sub - rule ( 7 ) ,
for clauses ( i ) , ( ii ) , ( iii ) , ( iv) & ( v) , the following clauses shall be substituted , namely :-
" (i) When discharging or load leum has been commence charging or loading shall ed with utmost caution mind the saftey of the ta jety, moorings and other the jetty including the personnel working on boa and the oil jetty."
[No. PW ( i) The owner or agent of any oil tanker who desires to carry out repairs to the vessel within the port limits shall obtain a certificate under sub- rule ( 2 ) from the Controller of Ex- plosives or Deputy Controller of Explosives.
