सा. का . नि . 602 (भ) केन्द्रीय सरकार , प्रतिलिप्यधिकार (संशोधन) अधिनियम, 1983 ( 1983 का 23 ) की धारा 1 की उप- द्वारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सारीव्र 9 अगस्त 1984 को उस तारीख के रूप में नियत करती है जिनको उक्त अधिनियम प्रवृत्त होगा ।

केन्द्रीय सरकार , प्रतिलिप्यधिकार अधिनियम, 1957 ( 1957 का 14) की धारा 78 द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए , प्रति- लिष्यधिकार नियम, 1958 का संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:--

1. संक्षिप्त माम और प्रारम्भ:

(1) इन नियनों का संक्षिप्त नाम प्रतिनिध्यधिकार( संगोधन) नियम, 1984 है ।

(2 ) ये, प्रतिलिप्यधिकार (संशोधन) अधिनियम, 1983 के प्रवृत होने की तारीख से. प्रवृत होंगे ।

2 प्रतिनिव्यविकार नियम, 1958 ( जिसे इसमें इसके पश्चात् मूल नियम कहा गया है ) , में नियम 11 के पश्वात् निम्नलिखित श्रन्तः स्थापित किया जाएगा, अर्थात्:--

"अध्याय 4 क

अप्रकाशित कृति, कृति के भाषास्तर और पुनरूत्पावन के प्रकाशन के लिए अनिवार्य अनुज्ञप्ति

11 क

प्रनुज्ञप्ति के लिए आवेदन किसी अप्रकाशित कृति को प्रकाशित करने या किसी कृति का किसी भाषा में भाषान्तर करने या किसी प्रकाशित कृति की पुनः उत्पादित करने के लिए धारा 31 क , धारा 32 की उपधारा (क्षक) और धारा 32 क के अधीन अनुज्ञप्ति के लिए तीन प्रतियों में प्ररूप II क के भनुसार दिया जाएगा और उनके साथ दूसरी धनुसूची में विहित की गई फीस होगी ।

ऐसा प्रत्येक आवेदन फेवरु कृति की बावन पौर किसी कृति के केवन एक भाषा में भाषान्तर की बाबत होगा ।

आवेदन की सूचना :

( 1) ऐसे आवेदन की एक प्रनि . , रजिस्ट्रीकृत डाक द्वारा, प्रति- लिप्यधिकार के स्वामी को तामील की जाएगी ओर यत्रि ऐसे प्रतिनिप्य धिकार का स्वामी अज्ञात है या उसकी खोज नहीं हो पा रही है तो आवेदन की एक प्रति उस प्रकाशक के नाम पर जिपका नाथ कृति के कार प्रकाशित है, तामील की जाएगी ।

(2) प्रतिलिप्यधिकार बोर्ड आवेदक को और जहां साध्य हो वहां किसी ऐसे व्यक्ति को जो कृति के प्रतिजिप्यविकार में किसी हित का दावा करता है. सुनवाई का अवसर देना और ग्रावेदन की बावत ऐसा साध्य जैसा वह उचित मसचे ले सकेगा ।

( 3) यदि, प्रतिलिप्यधिकार बोर्ड के समक, पति के उसी भाया में भाषान्तर के लिए या कृति के पुनरुताइन के लिए या हितो बराति कृति के प्रकाशन के लिए एक या अधिक भावेश्न संवित हैं तो ऐने सभो शाबेदनों पर एक साथ विचार किया जाएगा ।

(4) यदि, प्रतिलिप्यधिकार बोर्ड का समाधान हो जाता है कि कृति के किसी भाषा में भाषान्तर के लिए या कृति के पुनरुतादन के लिए यः प्रकाशित कृति के प्रकाशन के लिए आवेदिक अनुज्ञप्ति आवेदक को या यदि एक से अधिक ग्रावेदक हैं तो, आवेदकों में से किमी धावेश्त को , जो प्रतिलिप्यधिकार बोर्ड की राय में जनता के हितों की जलो बांति सेवा करेगा, मंजूर की जा सकती है, तो वह तदनुनार अनुत्रति गंजूर करेगा ।

( 5 ) ऐसी प्रत्येक अनुज्ञप्ति स्वामित्व के संदाय से संबंधित धारा 31क की उपधारा ( 7 ) , बारा 32 की जायर ( 1) के खंत्र ( i ) और धारा 32 क की उपधारा ( 4 ) के खंड ( 1 ) में उग्रधित, शतों के अधीन होगी और उसमें निम्नलिखित विनिर्दिष्ट होगा:--

(क) वह अवधि जिसके भीतर ऐत्ती कृति प्रकाशित की जाएगी;

(ख) वह दर जिस पर जनता को विक्रय को गई ऐतो कृतित्रों की प्रतियों की वाबत स्वामित्व का संदाय कृति प्रतिलिप्यधिकार के स्वाभी को किया जाएगा ।

(ग) कृति के भाषांतर की दशा में, वह भाया जिनमें भाषास्तर उत्पादित और प्रक्राणित किया जाएगा ग्रौर

( घ) वह व्यक्ति या थे व्यक्ति जिन्हें ऐसे स्वामिन्त्र संदेय हैं ।

( 6) ऐसी प्रत्येक अनुज्ञप्ति की मंजूरी को, यथासम्भव पोत्र, राजपत्र में अधिसूचित किया जाएगा और अनुज्ञप्ति की एक एक प्रति संबंधित अन्य पक्षकारों को भेजी जाएगी ।

स्वामित्व अवधारित करने की रीति प्रतिलिप्यधिकार बोर्ड , धारा 31क की उपधारा ( 7) , धारा 32 की उपधारा ( 4 ) के खंड ( 1) और धारा 32 क की उपधारा ( 4) के खंड ( 1 ) के यत्रीन प्रतिलिप्यधिकार के स्वामी को संदेय स्वामित्व निम्नलिखित पर विचार करने केके पश्चात् अवधारित करेगा:

(क) ऐमी कृति की एक प्रति की प्रस्तावित फुटकर कीमत.

(ख ) ऐसी कृतियों के संबंध में स्वामित्वों के त्रिद्यमान म्तर; और

( ग) ऐसे अन्य विषय जिन्हें प्रतिलिप्यधिकार बोर्ड द्वारा सुतंगन सपन जाता है ।

अनुज्ञप्ति की अवधि का विस्तारः प्रतिलिप्यधिकार वोर्ड जहां साध्य हो वहां अनुज्ञप्तिधारी के आवेदन पर, और प्रतिलिप्यधिकार के स्वामी को सूचना के पश्चात् यदि उसका यह समाधान हो जाता है कि अनुज्ञप्तिधारी

अनुज्ञप्ति में विनिविष्टवतोपरभर को उदित और प्रकाशित करने या कृषि को फिरते विकृति को प्रकाशित करने चंपनियों में अनवर्य या हो ऐशी अधि को बढ़ा गहेना ।

अनुजधि का रकारन प्रतितिष्वत्रिकार बोर्ड , अनुतप्तित्रारो को. गुनवाई का प्रासर देने के पश्वात्, अनि को निम्नलिखित में से किसो थावार पर रद्द कर सकेगा, वीज

(क) . यह कि अनुजिनेनिदिट पथय के भीतर या अनुबन्धियारी के आम पर पड़ा पर ऐसी कृति को उत्पादितो प्रकाशित गरी में अतफत हो गया है ।

(ख) यह कि अनुवन्ति कस्ट द्वारा या हियो के बारे में दुर्व्यपदेशन द्वारा प्राप्त की गई थी ।

( ग ) यह कि धनुजव्तिश्रायेनेतिबिंब नाशतों का उल्लंघन किया है ।

भनुज्ञप्ति के पर्यवसान की सूवनाः धारा 32 ज की उपधारा ( 1 ) या उपधारा ( 2 ) के परन्तु के अधीन श्रनुज्ञप्ति के पर्यवसान की नना प्रतिलिप्पत्रिकार के स्थानी द्वारा, इन दिनों को पहली अनुवी के प्रका ख में, अनुज्ञप्तिधारण करने वाले व्यक्ति को तामील की आएगी ।

3. मूत नियय में. पहनी अनुजी नें--

(1) प्ररून पात्रातर को जनन्ति के लिए आवेदन, के पश्चात् निर्मातदिन अंतःस्थान त्याजाना, -

2. मैं, अनुज्ञप्ति की, यदि मुझे मंजूर कर दी जाती है, निबंधनों और शर्तों का सर्वधा गलन करने का वचनबंध करता हूं ।

3 मैं, यह सत्यापित करता हूं कि इस प्ररूपं में दी गई विशिष्टियां मेरे सर्वोत्तम आन , विश्वास छौर जानकारी के अनुसार यही हैं और उसमें कुछ भी छुपाया नहीं गया है ।

**( यदि कृति किजी पत्रिका या मैगजीन रूप में या अन्यथा प्रकाजित हुई है जो पत्रिका. या मैगजीन का नाम जारी किए जाने की जिन्द संयांक और रोज मोर पुन्ड लिखिए।

5. यदि यादेइन भागन्दर की अनुवन्ति के लिए किया गया है तो निम्न- लिखित का कथन वारें

(क) वह शापा जिसमें कृति का भायान्तर किया जाना प्रश्नाति? है

(ख) भागासर की का पूरा नाम महुँताएं और पत'.

(ग) भाषान्सर को प्रस्तुत ओर प्रकाशित करने वाने आवेदक क अर्हताएं

6. उस कारण को उपशित करें जिसके जिराजनितिन है ।

7. आवेदित अनुज्ञप्ति के अधीन प्रदाशित की जाने वाली प्रस्तावि कृति की प्रतियों की मंशा

9. कृति की एक प्रति की प्रभावित कुडकर की बत

10. स्नामित्व की यह दर, जिनको को संदत करने के लिए मुन्तिरु देह प्रतिजिष्य विकार के स्वामी समजना है .

11. स्वामित्व के संदाय के लिए आवेदक के साधन

12. क्या विनिश्ष्टि फोस मंदत्त कर दी गई है यदि कर दी गई है तो संदाय की विशिष्टियां ( पोस्टल डेरा / खजाना चालान मंख्या लिखिए )

13. ( क) अनुशप्नि को जारी करने के लिए सक्षम व्यक्ति का पूरा नात्र, पता और राष्ट्रीयना

(ख) क्या आवेदक अपनी ओर से सधरना के जान् व्याथी को ढूंढने में अपन रहा या ।

* (ग) बया यावेदरु ने सामान्दर प्रस्तुत और प्रहाजित करने या भापान्नर प्रकाशित वा कृषि को पुनस्तादित करने या यत्र- काशित कृति को प्रकाशित करने के लिए अनुरोध किया था और उक्त व्यक्ति द्वारा प्राधिकार नामंजूर कर दिया गया था ।

( ध ) यत्रि आवेदक स्वामी को ढूंढने में असमर्थ रहा था तो क्या उक्ने अनुरोध की एक प्रति राजिस्ट्रीकृत वायुयान डाक द्वारा उग प्रकाशक को जिसका नाम कृति पर है भेजी थी । यदि भेजी थी तो प्रति के भेजने की तारीख

14. वया कृति के रवनिता ने कृति को विवरण प्रतियों से प्रतियां ले ली है ।

15. भाषान्तर के लिए श्रावेदन की दशा में निम्नलिखिन अतिरिक्त नूाना दे :

(क) वथा इगो भावा में भावान्नर पहले भी प्रकाशित किया गया है ।

( ख) क्भा पूर्वतय भाषान्तर तपाप्त हो गया है ।

(ग) पूर्वनन आवान्तरकर्ता का पूरा नाम, पत्ता ओर राष्ट्रीयता जौर यदि उक्त आयान्तरकर्ता मृतक है तो उसकी मृत्यु की लरीड ..

(घ ) पूर्वतन भाषान्नर का नाम

( ङ) पूर्वतय भावान्तर के प्रकाशक का पूरा नाथ , पना और राष्ट्रीयता

(च) प्रकाशन का वने

( छ) पूर्वनम भावान्तर को एक प्रति को कोना ...

(ज) यदि दुर्वनन भानान्तर धारा 45 के अधीन रजिस्ट्रीकृत है तो उसका रजिस्ट्रेशन संख्या

(i) पड़ने की भापान्तर की बावन प्रतिजिव्याधिकार के स्वामी को सदन स्वामिन्य की दर बोर राशि यदि ज्ञात हो

16(क) कथा ऊरर 5 में जर आवानों के अलावा और किसी भाया भावानर में किया गया है

(ख) भाषान्तरकर्ता का पूरा नाम, पता और राष्ट्रीयता ओर र्याद उत्त आवान्तरकता मृत है तो उसके मृत होने की तारीख

( ii) प्ररूप IV में पैग 4 के पश्चात् प्रतिलिप्याधिकार रजिस्ट्री- करण आवेदन पत्र के स्थान पर निम्नलिखित अन्तःस्थापित किया जाएगा; प्रर्थात्:-

" फ में यह सत्यापित करता हूं कि इस प्ररूप में दी गई विशिष्टियां और आगे की विशिष्टियों का विवरण मेरी सर्वोत्तम जानकारी विश्वास और सूचना के भनुसार सत्य है और इसमें कोई भी बात छिपाई नहीं गई है"

( iii ) प्ररूप IV में पैरा 13 के पश्चात् विशिष्टियों का विवरण शीर्षक के नीचे प्रतिलिप्याधिकार के रजिस्ट्रीकरण के लिए प्रावेश्त के स्थान पर निम्मलिखित अन्तःस्थापित की जाएगी प्रर्यात्:--

" 13 क -यवि कृति "कलात्मक कृति " है तो क्या इसे व्यापार चिह्न कार्यालय में व्यापार और पण्य बस्तु चिह्न अधिनियम , 1958 की धारा 4 के अधीन रजिस्ट्रीकृत किया गया है । यदि नहीं तो क्या इस कृति के रजिस्ट्रीकरण के लिए व्यापार विक्त कार्यालय में कोई आवेदन दिया गया है ( कृपया इसका व्यापार चिह्न कार्यालय से प्रमाणपक्ष संलग्न करें) "

(iv) प्ररूप V में पैरा 4 के पश्चात् प्रतिलिप्याधिकार रजिस्टर में प्रविष्टि के परिवर्तन के लिए आवेदन के स्थान पर निम्नलिखित अन्तः- स्थापित किया जाएगा भर्थात्:--

" 4क मैं सत्यापित करता हूं कि इम प्ररूप में दी गई विशि- ष्टियां और विशिष्टियों का विवरण मेरी सर्वोतम जानकारी विश्वास और सूचना के अनुसार सत्य है और इसमें कोई बात छिपाई नही गई है ।"

4. मूल नियम में दूसरी अनुसूची के स्थान पर निम्नलिखित रखा जाएगा अर्थात् :-~

संगीतमय के पुर्नप्रकाशन

100 रुपए प्रति कृति 1. साहित्यक नाटकीय या कला- त्मक कृति के लिए अनुज्ञप्ति (धारा 31 , 31 क श्रीर 32क )

500 रु० प्रति कृति 2. चलचित्र फिल्म के पुर्नप्रकाशन के लिए अनुज्ञप्ति (धारा 31)

200 रुपए प्रति कृति 3. रिकार्ड के पुर्नप्रकाशन के लिए अनुज्ञप्ति (धारा 31)

25 रुपए प्रति कृति 4. किसी भारतीय कृति को जनता में दिखाया या प्रसारण द्वारा जनता में कृति का संचार करने के लिए अनुज्ञप्ति

100 रुपये प्रति कृति 5. किसी भी भाषा में किसी साहित्यक या नाट्य कृति के भाषान्तर और प्रकाशन के लिए श्रावेवन [धारा 32 और 32( 1 क) ]

6. निम्न की बाबत प्रतिलिप्याधिकार के रजिस्ट्रीकरण के लिए

10 रुपए प्रति कृति (क ) साहित्यक नाट्य संगीतमय भौर कलात्मक कृति

50 रुपए प्रति कृ লি (ख) परन्तु किसी साहित्यक या कला त्मक कृति जिसे माल के रूप में इस्तेमाल किया गया है या जो इस्तेमाल करने के लायक है की बाबत ( धारा 45 )

7. प्रतिलिप्याधिकार रजिस्टर में प्रविष्टि किए गए प्रतिलिप्या- धिकार विशिष्टियों में निम्न- लिखित की बाबत परिवर्तन के लिए आवेदन पत्र:

5 रुपये प्रति कृ শি (क) माहित्यक नाट्य संगीतमय या कलात्मक कृति

25 रुपए प्रप्ति कृति (ख) परन्तु किमी साहित्यक या कलात्मक कृर्ति जिमे साल के रूप में इस्तेमाल किया गया है या जो इस्तेमाल करने लायक है (धारा 45)

200 रुपए प्रति कृति 8. चल वित्त्र फिल्म में प्रतिलिप्या- धिकार के रजिस्ट्रीकरण के लिए आवेदन ( धारा 45)

100 रुनाए

9. चल चित्र की बाबत प्रति- लिप्याधिकार रजिस्टर में प्रति- लिप्याधिकार विशिष्टियों की प्रविष्टि में परिवर्तन के लिए प्राषेवन (धारा 45)

50 रुपए

10. किसी अभिलेख में प्रतिलिप्या- धिकार के रजिस्ट्रीकरण के लिए धावेषन 5

12. प्रतिनिध्याधिकार रजिस्टर से उद्धरण मैना ( धाग 47 ) 5 रुपए प्रति कृनि प्रति घंटा

Application for licence : An application for a licence under section 31A, sub - section ( IA ) of section 32 and section 32A to publish any unpublished work or to translate any work in any language or to reproduce any published work shall be made in triplicate in accordance with Form IIA and shall be accompanied by the fee prescribed in the Second Schedule .

Every such application shall be in respect of one work only and in respect of translation of a work into one language only .

( 1 ) A copy of such application shall be served by registered mail on the owner of copyright and if the owner of such copyright is not known or is not traceable , a copy of the application shall be served on the publisher whose name appears on the work .

( 2) The Copyright Board shall give an opportu- nity to the applicant and also, wherever practicable , to any person claiming any interest in the copyright of the work , to be heard and may take such evidence in respect of the application as it thinks fit .

(3) If more than one application for translation of the work in the same language or for reproduction of the work or for publication of any unpublished work is pending before the Copyright Board, all such application shall be considered together .

(4) If the Copyright Board is satisfied that the licence for a translation of the work in the language or for reproduction of the work or for publication of unpublished work , applied for may be granted to the applicant , or if there are more applicants than one , to such one of the applicants , as in the opinion of the Copyright Board , would best serve the interests of the general public , it shall grant a licence accordingly.

In exercise of the powers conferred by Sestion 78 of the Copyright Act , 1957 ( 14 of 1957) , the Central Government hereby makes the following rules to amend the Copyright Rules , 1958 , namely :--

1. Short title and commencement :-

(5) Every such licence shall be subject to the conditions provided in sub - section ( 7 ) of section 31A , clause ( i ) of sub-section ( 4 ) of section 32 and clause ( i ) of sub- section ( 4) of section 32A relating to payment of royal- ties and shall specify :-

(1) These rules maybe called the Copyright (Amendment) Rules , 1984 .

(a) the period within which such work shall be published;

(2) They shall come into force on the date on which the Copyright (Amendment ) Act , 1983 shall come into force .

(b) the rate at which royalties in respect of the copies of such work sold to the public 6

shall be paid to the owner of the copyright in the work;

( c) in a case of translation of the work , re language in which the translation shall be produced and published ; and

(d) the person or persons to whom such royalties shall be payable .

(6 ) The grant of every such licence shall , as soon as possible , be notified in the Official Gazette and a copy of the licence shall be sent to the other partics concerned .

Manner of determining royalties : 'The Copyright Board shall determine the royalties payable to the owner of the copyright under sub - section ( 7 ) of section 31A, clause ( i ) of sub -sectica (4 ) of section 32 and clause ( i ) of sub - section 4 of section 32A after taking into consideration :

(a) the proposed retail price of a copy of such work;

(b) the prevailing standards of royalties in regard to such works ; and

Extension of the period of licence : The Copyright Board may , on the application of the licensee and after notice to the owner of the copyright , wherever practi- cable , if it is satisfied that the licensee was for sufficient reasons unable to produce and publish the translation or reproduce the work or publish the unpublished work within the period specified in the licence , extend such period.

Cancellation of licence : The Copyright Board may, after giving the licensee an opportunity of being heard, cancel the licence on any of the following grouds , namely :

(a) that the licensee has failed to produce and publish such work within the time specified in the licence or within the time extended on the application of the licensee ;

(b) that the licence was obtained by fraud or misrepresentation as to any essential fact ;

Notice for termination of licence : Notice for termi- nation of licence under proviso to sub - section ( 1 ) or sub - section ( 2) of section 32B shall be served on the person holding the licence by the owner of copyright in Form IIB of the First Schedule to these rules .

3. In the principal rules , in the First Schedule : ( i ) after Form II-Application for a licence for transla- tion, the following shall be ingerted , namely : ----

" Form IlA-Application for a licence for publi- cation translation reproduction. [See rule 11A]
